Supervisor Hickman introduced Col. Trena Savageau who offered the invocation for
today’s meeting. He noted Col. Savageau’s accomplishments in her community, and in
her professional and personal life.

Monica Gery, Communications Officer, Animal Care and Control, introduced Rocky, a
Shepherd mix who is approximately four years old and weighs approximately 50
pounds. She provided a brief description of Rocky’s attributes and noted he would do
best in an active home to match his energy level. For information on adopting Rocky
and other pets, please contact Animal Care and Control at 602-506-7387 or at
pets.maricopa.gov.
Chairman asked the Clerk if there were any announcements or corrections to the
agenda. The Clerk noted item 26 had a correction to the attachment correcting the
effective date to reflect 3/31/2021. Also, item 9 was pulled from the Planning and Zoning
consent agenda and moved to the regular agenda.

Commission Recommendation: On 2/11/21, the Commission voted 9-0 to recommend
approval of Z2019132 subject to conditions ‘a’ – ‘i’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled
“Twin Knolls Vistas”, consisting of 1 full-size sheet, stamped received February 2, 2021,
except as modified by the following conditions.

owner/applicant must submit evidence of approval/acceptance of the emergency services

Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards, and best practices at the time of application for construction.
9.
Detailed Grading and Drainage Plans showing the new site improvements must be
submitted for approval and acquisition of building permits.
d.
The following Maricopa County Environmental Services Department (MCESD)

A Drinking Water New Source Approval Application (NSA) and Notice of Intent to
Discharge (NOID) for water and sewer are required prior to any construction permits

County takes action to rescind approval due to noncompliance with conditions.
h. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any

that there would be no diminution in value of the property from the value it held on the date

i. The zone change with CUPD overlay is applied to restrict the use of the site. Until such
time as the site is served by sewer, uses on the site shall only be those acceptable to the
Maricopa County Environmental Services Department (MCESD) that can be accommodated
by septic systems. A public water system and public sewer system shall be required prior to

stamped received December 17, 2020, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Bailey Wedding Venue”, consisting of 30 pages, dated November 6, 2020, and
stamped received November 6, 2020, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Retention basins within the parking lot must go according to the Maricopa County
Drainage Policies and Standards Manual Standard 6.10.7. The requirements for the
retention in the parking lot are:
a.
Maximum depth is 1-ft
b.
Parking lot retention areas shall not be adjacent to buildings and not be sited in travel
lanes.
c.
No more than 25% of the parking lot area may be used for stormwater storage.
d.
The minimum longitudinal slope permitted within parking lot storage facilities is 0.005
ft/ft, unless concrete valley gutters are provided.
2.
At the time of the Building permit, the Engineered Grading and Drainage Plans will
need to address the Erosion Setback/Protection. Identify the limits of 100-year inundation
(floodplain limits). The erosion setback is measured from that limit or top of bank, whichever

3.
At the time of the Building permit, the calculations to show the pedestrian bridge can
cross the Paddelford Wash without inundating the buildings in the area.
4.
At the time of the Building permit, the maximum retention basin side slope is 4:1.
5.
Drainage review of planning and/or zoning cases is for conceptual design only and
does not represent final design approval nor shall it entitle applicants to future designs that
are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the
Maricopa County Drainage Policies and Standards.
6.
All development and engineering design shall be in conformance with Section 1205
of the Maricopa County Zoning Ordinance and current engineering policies, standards, and
best practices at the time of application for construction.
7.
The applicant should be aware that there is a FEMA Zone AE Floodplain on the
property. The wash is Paddelford Wash Split 5 from the Paddelford Wash Flood Delineation
Study (Contract #99-12). For more information regarding the floodplain in the area, contact
Jennifer Lynch of the District at (602) 506-3320. Identify the limits of the floodplain on the
G&D's. The applicant should be aware that a Flood Control Permit will be required at the
time of the Building Permit.
8.
The Proposed Event Barn has part of the structure in the floodplain. The structure
must go according to the Floodplain Regulations of Maricopa County. See link:

At the time of the Building Permit a Flood Control Permit will be processed with the Building
Permit. The building will need to go according to the Floodplain Regulations. Prior to
finalizing the Building Permit Inspections, an Elevation Certificate in the FEMA format will
need to be submitted, reviewed, and approved.
d. The following Maricopa County Environmental Services Department (MCESD) condition
shall apply:
1.
Public water system and new NOID must be obtained prior to any construction
permit approval if applicable.
e.
Prior to approval of any building permit associated with the proposed wedding
venue, a new “will serve” letter will be obtained to substantiate the availability of fire and
emergency services.
f.
This special use permit shall expire on March 10, 2041, or upon termination of the
use for a period of 180 or more days, whichever occurs first. All site improvements associated
with the special use permit shall be removed within 180 days of such expiration or termination
of use.
g.
Prior to occupying the existing residence or any portion thereof for any use
associated with the Special Use Permit, the applicant shall obtain a Building Permit to retrofit
the existing residence to meet current commercial building code requirements as applicable
and shall obtain a Certificate of Occupancy for the retrofitted building prior to occupancy.
h.
Noncompliance with any Maricopa County Regulation shall be grounds for initiating
a revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
i. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, and at the time of
expiration of the Special Use Permit, the Special Use Permit shall be revoked. It is, therefore,
stipulated and agreed that either revocation due to the failure to comply with any conditions,
or the expiration of the Special Use Permit, does not reduce any rights that existed on the
date of application to use, divide, sell or possess the property and that there would be no
diminution in value of the property from the value it held on the date of application due to
such revocation or expiration of the Special Use Permit. The Special Use Permit enhances

The fence relocation shown on the Site Plan for the Special Use Permit, located in
the north/northeast corner of the site to enclose the retail spaces, will require a Building
Permit.

are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the

d. The following Maricopa County Department of Transportation (MCDOT) conditions shall

Dobbins Road and the west side of 47th Avenue are Maricopa County Department
of Transportation (MCDOT) operated and maintained roads. Any construction (driveway,
utilities, etc.) within the Right-of-Way will require a MCDOT Right-of-Way Permit.
2.
Traffic Control is the responsibility of owner/applicant.
3.
No road closures/obstructions shall be permitted; and no signs or any other event
related objects shall be placed with the public right-of-way unless a Special Events Permit is
procured from the MCDOT Permitting Branch.

4.
Any off-site, on street parking shall comply with applicable parking regulations
enforced at the time of event.
e.
This Special Use Permit shall expire on March 10, 2031, or upon termination of the
use for a period of 120 or more days, whichever occurs first. All site improvements associated
with the special use permit shall be removed within 120 days of such expiration or termination
of use.
f.
The following SUP standards shall apply:
1.
Existing fencing to be allowed within Site Visibility Triangles (SVT’s) along Dobbin’s
Rd. driveway. If any future structures (including signage) or landscaping are proposed, it
cannot exceed 2’ height within said SVT’s.
2.
0’ setback for existing structures from eastern (street side) property line.
3.
Signage: shall be non-illuminated and ground mounted. Maximum sign area of 24
sq. ft. with maximum 12’ in height, post shall be no taller than 8’. Sign material shall include
two of the following, as approved by Planning and Development Department – corrugated
metal, rusticated metal, wrought iron, barnwood or reclaimed wood, or shiplap siding.
g. This Special Use Permit approval does not grant any entitlement or permits to buildings,
fencing, or structures that may encroach onto adjacent properties, easements, or rights-of-
way. Structures that have been erected or improved without permits must obtain the
necessary approvals through the Maricopa County Planning and Development Department.
h.

This item was removed from the consent agenda to be heard as a regular agenda item.
Jennifer Pokorski, Planning and Development Director, and Darren Gerard, Deputy
Director of Planning and Development approached. Ms. Pokorski provided a review of
this item and noted there were over 380 documents of support and five letters of
opposition from two individuals primarily related to parking and traffic. She noted
parking spaces are provided and all parking regulations will be followed. The Planning
Commission and staff recommended approval.

The Clerk noted the comments received in favor of this and read the following names
into the record as speaking only if necessary: Eric Amadio and Amy Trusler. She noted
the following individuals who submitted forms to speak on the item.
Fern Ward, resident, thanked the Board for the opportunity to speak. She has been a
resident for 40 years and thanked the Amadios for their time and commitment to the
community. After COVID-19 became an issue, food booths and plant pantries were
onsite for people to take what they needed. They occasionally would deliver fruits and
vegetables when needed and are the epitome of good neighbors. Ms. Ward wants the
Board to take this into consideration as most of the community is in full support.
Cheryl Coppinger, Rebecca Perrera, and Melissa Wooden were not connected to the
webinar, but had registered to speak in support of the item.
Supervisor Gallardo commented that the Amadios had visited his office and they had
gone over the plans for this project at least two years ago. He noted they are a pillar in
the Laveen community and are known for home baked pies. This is one of the farmer’s
markets that brings the community together. He thanked everyone for moving this item
forward.

MARIJUANA

Request: A text amendment to the Maricopa County Zoning Ordinance (MCZO) to
incorporate definitions, use regulations and development standards related to the adult use
of recreational marijuana.
Commission Recommendation: On 2/25/2021, Commission voted 8-0 to recommend
approval of TA2020002.
Request to adopt as an emergency measure with 24-hour vesting and effect. (C-44-21-204-
X-00)
Jennifer Pokorski reviewed the item and stated this was a text amendment to include
definitions, use regulations, and development of standards related to the adult use of
recreational marijuana. This text amendment is in response to Proposition 207 that was
passed by voters on November 3, 2020 which legalized adult use and sale of
recreational marijuana. The Arizona Department of Health Services (ADHS) approved
licenses for the sale of recreational marijuana on January 22, 2021. She stated time is
of the essence to update this ordinance to comply with the new law. This text
amendment is being adopted as an emergency measure and will be effective within 24
hours of the vote for approval. The primary changes are adding a definition of a
marijuana establishment and a marijuana testing facility consistent with Proposition
207. Recreational marijuana will eventually be treated the same as medical marijuana.

This means that retail sales are allowed in commercial and industrial zoning districts.
In commercial two and three, you can have ancillary cultivation and infusion for
wholesale used at on-site dispensaries. She noted that Proposition 207 has language
that prohibits treating recreational marijuana differently from medical marijuana. The
County Attorney’s Office was consulted about the language.
Ms. Pokorski noted a correction to be read into record in Section 804.2(45)(d) changes
to “and/or” at the end.
Supervisor Gates asked for clarification if the limitations on medical marijuana that was
put in place are the same for recreational marijuana. She confirmed this was correct.

This is the time for a public hearing on the applications for liquor licenses. At this hearing,
the Board of Supervisors will determine the recommendation to the State Liquor Board as to
whether the State Liquor Board should grant or deny license.

Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the
Governor’s Office of Highway Safety, Proposition 207 Funding (50PROP207) GOHS
Contract Number 2021-207-006 in the amount of $371,179.30 for the award period beginning
January 1, 2021 and terminating on December 31, 2021. This Agreement may be terminated
by any of the parties by written notice to the other parties thirty (30) days prior to termination.
This is the first year for this funding award and there is no match requirement. The Sheriff’s
Office indirect cost rate for FY21 is 14.6%, applicable to the award amount of $371,179.30
less capital expenses of $274,434 for an indirect cost base of $96,745.30 and indirect costs
of $14,124.81. These unrecoverable indirect costs will be paid for by the General Fund.

FOR BIOWATCH PROGRAM
Approve an Extended Budget Period and Award Agreement between the United States
Department of Homeland Security (DHS) and Maricopa County through the Air Quality
Department, in the not-to-exceed amount of $677,877. This Agreement is funded by a grant

from the DHS (Award Number 06OHBIO00003-15-02) with the purpose of continuing funding
for the fifteenth year of the BioWatch program. This award ID# 06OHBIO00003-15-02
increases the federal funding by $146,843.
The BioWatch program includes an ambient air monitoring network to sample air pollution in
a variety of settings, assess health and welfare effects, assist in determining sources of air
pollution; and to carry out the provisions of the US EPA, the Federal Clean Air Act and
Amendments, Arizona Revised Statutes, and County Air Pollution Control Regulations that
are intended to correct, remove, minimize, or prevent air pollution within Maricopa County.
The Agreement is effective from July 1, 2006 until April 30, 2025, while the budget is
retroactively now a twelve-month grant, effective from May 1, 2020 until April 30, 2021.
Project budgets were originally approved as a ten-month budget, this grant will be funded on
a twelve-month grant cycle.
The FY2020 Air Quality composite indirect rate of 23.40% applied to the direct charges of
$85,962 and FY2021 rate of 21.11% applied to the direct charges of $419,288. The
recoverable indirect cost of administering this grant is $108,627; the non-recoverable indirect
cost is $0. The award includes equipment expenses of $32,000 which are excluded from the
indirect cost recovery.
The grant award is reoccurring and has been awarded to the department in previous years.
The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash
contributions not applicable. The grant award is not mandated, and the activities are 100%
financially supported by the grant from Department of Homeland Security (DHS). The Air
Quality Department works with DHS to protect the citizens of Maricopa County by operating
a network of biological samplers. The grant award is non-competitively bid. There are no
costs that will need to be absorbed by the departments operating budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. A

Chairman of the Board of Supervisors for the 2021 MCEOP. The Letter of Promulgation is
signed by the jurisdiction’s senior elected or appointed official(s). The Approval and
Implementation Letter is a signed statement formally recognizing and adopting the plan as
the jurisdiction’s all-hazards Emergency Operations Plan (EOP). The implementation letter
introduces the plan, outlines its applicability, and indicates that it supersedes all previous
plans. It includes a delegation of authority for specific modifications that can be made to the

JUSTICE COURTS
Approve a Competition Impracticable contract, 210050-CI, with Cives Steel Company
(Cives) in the NTE amount of $1,300,000. Cives was a subcontractor to Johnson Carlier for
the South East Justice Center Project for the purchase, fabrication, and installation of steel
and other ancillary metal products. The contract with Johnson Carlier has been terminated
for convenience. Cives has purchased the steel and begun the fabrication of the final steel
products for this project. This contract will permit Cives to continue the fabrication of the steel
for the SE Justice Center Project and minimize any delay in completion. Cives has agreed
to perform these services for the County at the same price and similar terms of their
subcontract with Johnson Carlier. The County is beginning the procurement process to select
a new primary contractor to complete the project. When the new primary contractor is
selected, they will assume the remaining obligations under this contract with Cives as part

COMMUNITY
Pursuant to the Board’s Resolution, regarding Processing of Tribal Gaming Fund
Applications, dated May 31, 2016 (“Gaming Resolution”), Maricopa County is the
administrative pass-through for tribal gaming applications (“Applications”) received pursuant
to the State of Arizona Department of Gaming Compact (“Compact”). The Applications seek
funds for government services that benefit the general public, including public safety,
mitigation of the impacts of gaming, or promotion of commerce and economic development.
Pursuant to the Board’s Gaming Resolution, Maricopa County defers substantive review of
the Applications to the Tribal authorities and place these matters on the consent agenda.
Pursuant to the Compact, Sections 12 (b) and (d), the Tribe shall perform the substantive
review of applications and ensure 12% of its contributions under the Compact go to services
that benefit the general public. Accordingly, authorize Maricopa County to accept and pass-

FY 2021 PERFORMANCE-BASED RETENTION PAY PLAN
Approve the FY 2021 Maricopa County Performance-Based Retention Pay Plan that uses
allocated funding for a one-time lump sum retention payment. The purpose of this
discretionary plan is to recognize employees who have contributed to the County’s COVID-
19 response, 2020 election efforts, and overall operation of the County to serve its residents
during the pandemic. It is designed to address retention and recruitment issues that were
created when no salary increases were approved for FY20/21 and will incentivize employees
so that they are engaged and continue to provide quality services to Maricopa County

been employees across the County who have stayed through the pandemic and

• Pursuant to the Terms and Conditions, Section 28.0 Levels of Service, the purpose of this
Amendment is to revise the Case Management Service Budgets and the Community
Services Service Budget for the period of July 1, 2020 through June 30, 2021.

In accordance with the CSBG and LIHEAP Alerts issued November 9, 2020, the
revised funding allocations are as follows:
o The Case Management reimbursement ceiling for the period of July 1, 2020 through June

o The Community Services service reimbursement ceiling for the period of July 1, 2020

Funds will be utilized to provide assistance to eligible low-income residents in Maricopa

Amendment No. 2, the IGA funding allocation shall be increased to $9,694,029.38.

Public Health (MCDPH) and Arizona Fire & Medical Authority for the continued provision and
administration of needed vaccines to those 6 months of age and older. Funding is in the
amount of $50,000 for the project period beginning April 1, 2021 and ending March 31, 2022,
with an option to extend. The cumulative total is $100,000 for the IGA term beginning October
1, 2020 through March 31, 2022. AZ Fire & Medical Authority serves the communities of
Coldwater Ranch, Corte Bella, Cross River, Dos Rios, Pinnacle Peak County Island, Rancho
Cabrillo, Rancho Silverado, Rio Sierra, Sun City West, Sun Lakes, Sundero, Tonopah,

The purpose of this Intergovernmental Agreement is to identify and define both Parties'
respective roles in the execution of the responsibilities of specific maintenance tasks in areas
that cross jurisdictional boundaries.
The Agreement provides the opportunity to focus on specific maintenance tasks or
emergency highway projects and the availability of the most economical resources by
extending beyond jurisdictional or geographical boundaries. The Agreement's application will
benefit areas in the County and the City where the other Party could complete specific types
of routine maintenance or emergency highway project activities based on scheduled work
within the area. Individual tasks performed by either Party will be executed upon completing
a Letter of Agreement (LOA) approved and signed by the County Department of
Transportation Director and the City Manager, or their designees.
If the value of goods or services exchanged by the Parties is not of equal value, the total
aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If
no services are exchanged, there is no financial impact. An accounting mechanism will be
utilized to track each LOA, as applicable, to identify specific tasks and services and ensure
the exchange of these services is of similar value.

2020. Funding opportunities for the County have recently changed and prompted this new
IGA.
To advance construction to FY23, the District will provide $2,000,000 to the County up front
upon completion of the County’s sealed design plans. The amount to be reimbursed by the
County to the District is estimated to be $1,000,000, or half the project costs, by no later than
the end of FY2026.
The purpose of this IGA is to identify and define the responsibilities of the County and District
with respect to the joint Project design, construction and permitting activities involving 18
locations designated in the IGA’s Exhibit “A.” The County will address clear zone protection
areas, including replacing vehicular guardrails with extended safety rails, and extending
existing drainage culverts where improvements may be needed. The District has various
drainage channel sites with distressed channel linings. Some of these locations need new
access ramps to the channel bottoms, to better facilitate maintenance and inspection
activities by the District and the County. The new ramps are expected to include new access
gates, which will also provide increased access control.
The estimated cost to complete construction of the Project activities reflected in Exhibit “A”
is $2,000,000 and shared equally between the parties. Funds are budgeted in FY2023
Transportation Department (640) Transportation Capital Project Fund (234) Transportation
System Management Project, sub-project TT0615.
The IGA shall become effective the date it is approved by both the County Board of
Supervisors and the District’s Board of Directors and remain in full force and effect until all
stipulations are met. However, the IGA can be amended by the Parties at any time.

said the people being appointed to these precincts are unknown and unfamiliar. He

Chairman Sellers noted Reid Spalding, Deputy County Manager, was representing Joy
Rich, County Manager, today and he had nothing to report.
Supervisor Hickman said he was invited by the mayor of the City of Peoria to join her
on a television program. She was happy to have him come out and said, "You guys are
not getting enough credit for what you have done through this pandemic, specifically

with the Public Health Department response and how well they are working with the
cities.” She thanked the Public Health Department and Maricopa County for being
exceedingly gracious leaders in the community when it comes to the public health
response. Supervisor Hickman said he attended a Homeowners’ Association (HOA)
meeting through zoom and noted there were issues that needed discussion. The HOA
also thanked Maricopa County for the work done in this unincorporated area. Their
thanks extended to the Sheriff’s Office, MCDOT, the Flood Control District, and other
County staff. He said they expressed their appreciation that the government spoke with
them. He noted people are keeping an eye on Maricopa County and are saying the
County is doing very well. He commented on the Public Health Department performing
a vital task and doing it very well.
Supervisor Gates noted a year has passed under the COVID-19 pandemic and he
wanted to recognize everyone’s effort. The Elections Department has done amazing
work over the past year and he appreciated this effort. He recently met with Ann
O’Brien, City of Phoenix Councilwoman for District 1 and who also serves on the Board
of the Deer Valley School District. She raved about the partnership between the Public
Health Department and the school district. He recognized the longtime service of
Thelda Williams, City of Phoenix Councilwoman. He said she will soon be leaving, and
he thanked her for her service.
Supervisor Chucri stated he had nothing to report.
Supervisor Gallardo also recognized Thelda Williams as a dear friend and great partner
to work with. He congratulated Debra Stark for her reelection to the City of Phoenix City
Council representing District 3 and Yassamin Ansari, City of Phoenix Councilwoman,
District 7. He said he is looking forward to getting to know Councilwoman Ansari better.
He said he knows there has been discussion concerning refugees that are now settling
in Maricopa County. He said more and more refugees are seeking asylum and the
Board needs to consider on how to deal with the refugees. They need to be tested for
COVID-19 to make sure COVID is not being spread if they move on to a different
destination. He commented on his issues with social media concerning the 2020
election and on the false statements concerning the Board of Supervisors from the
people of Maricopa County and State legislators. The Board must work with the Senate
and comply with the subpoena.
Chairman Sellers commented on the mask requirement and the discussion held
recently concerning this requirement. The Public Health Department and everyone else
are feeling pandemic fatigue. He said it is important to let all residents know health and
safety is critical and important and the Board’s highest priority. He noted there is a light
at the end of the tunnel. He said the Public Health Department updated the Board with
current data and noted what major things are being studied that will help the County go
forward in its battle to end the spread of COVID-19. He noted everyone is ready to get
past this pandemic and spend time with family and friends. The Board stays in constant
contact with the Public Health Department to stay on top of the most recent data being
provided and it needs to let science tell them when it is best to move forward. He stated
we cannot lose focus on what is critical and ensure people’s health is not jeopardized.

AMENDMENT TO IGA WITH CITY OF PEORIA FOR THE PEORIA NORTHERN
COMMUNITY PARK (PALOMA COMMUNITY PARK) PROJECT
Approve Intergovernmental Agreement (IGA) Amendment No. 1 FCD 2016A001A for
Funding of the Peoria Northern Community Park Project (now known as Paloma Community
Park) Section 408 Permit at New River Dam between the City of Peoria (City) and the Flood
Control District of Maricopa County (District).
Amendment No. 1 extends the effective period of the original IGA FCD 2016A001 (C-69-16-
030-3-00) which details the necessary coordination and responsibilities of each party for
obtaining a U.S. Army Corps of Engineers (USACE) Section 408 permit. All costs shall be
borne by the City. There is no cost to the District.
In 2020, the City completed construction of Phase 1 of Paloma Community Park located
within the limits of the New River Dam Project flood impoundment area. The park provides
recreational and multi-use facilities and activities, The City is now initiating planning and
design for Phase 2 of Paloma Community Park (the PROJECT). The USACE has
determined that a Section 408 permit is required for the PROJECT. The District is the single
local sponsor with the USACE for New River Dam. In accordance with the USACE rules and
regulations, the USACE only issues Section 408 permits to local sponsors for USACE
projects. Therefore, the local sponsor, the District, in partnership with the City, intends to
apply for and obtain a Section 408 Permit for the PROJECT.
This Agenda Item impacts Supervisorial District 4. (C-69-16-030-3-01)

Adopt IGA FCD 2021A005 for the Sun City West Area Channel Crossings Project
(PROJECT), between the Flood Control District of Maricopa County (DISTRICT) and the
Maricopa County Department of Transportation (COUNTY), regarding cost-sharing, design,
construction, and permitting of the PROJECT.

Also approve rescinding the original Intergovernmental Agreement, County C-64-20-167-M-
00 and C-69-20-026-3-00/FCD IGA 2019A011, previously approved on May 6, 2020.
Funding opportunities for the County have recently changed and prompted this new IGA.
The DISTRICT owns and maintains drainage channels throughout the Sun City West Area
(SCW), while the COUNTY owns and maintains the road-crossing culverts that inter-connect
the subject channels.
The County will address clear zone protection areas, including replacing vehicular guardrails
with extended safety rails, and extending existing drainage culverts where improvements
may be needed. The District has various drainage channel sites with distressed channel
linings. Some of these locations need new access ramps to the channel bottoms, to better
facilitate maintenance and inspection activities by the District and the County. The new
ramps are expected to include new access gates, which will also provide increased access
control.
The estimated cost to complete construction of the Project activities reflected in Exhibit “A”
is $2,000,000 and shared equally between the parties. To advance construction to FY23, the
District will provide $2,000,000 to the County up front upon completion of the County’s sealed
design plans. The amount to be reimbursed by the County to the District is estimated to be
$1,000,000, or half the project costs, by no later than the end of FY2026. (C-69-21-072-X-

AMENDMENT TO IGA G-30225 WITH THE GILA BEND UNIFIED SCHOOL DISTRICT
NO. 24
Approve and execute this First Amendment to Intergovernmental Agreement G-30225
(“Agreement”) between the Gila Bend Unified School District No. 24 (“School District”) and
the Maricopa County Library District (“Library District”) for the use of real property owned by
the School District located at 308 N. Martin Ave., Gila Bend, Arizona 85337.
The Library District and the School District executed the Agreement on June 24, 2020 (C-
65-20-011-M-00) to establish the terms and conditions under which the parties would
relocate the Gila Bend Branch Library to the new school campus. During construction of the
new building, it was determined that additional improvements would be necessary to create
a safe, secure, and functionally efficient joint-use public/school library. The purpose of the
amendment is to update the cost the Library District will reimburse the School District or its
Contractor for the improvements to an amount not to exceed one hundred fifty-seven
thousand and five hundred dollars ($157,500.00), replace Exhibit C and update the Library
District’s notice address. At completion of the project, and upon the Library District’s move
into the new building, IGA G-30149 (C-65-07-025-2-00) will be terminated and this
Agreement, as amended, will supersede. This action takes place in Supervisory District 5
District 1. (C-65-20-011-M-01)
Motion to approve by Director Steve Gallardo, seconded by Director Clint Hickman
Director Gallardo commented on his conversation with the school district in Gila Bend.
He noted that in past years the school district has not been able to pass a school bond
election and have had to deal with older facilities. He said a school bond was passed
and they were able to build an energy efficient and modern school district. There are
now larger facilities and larger classrooms along with a much larger library. The school
district and the Library District have been great partners. He had a conversation
concerning the mitigation of COVID issues. The school district and library are in a good
location for the area and it is safe for students. He is looking forward to when schools
can reopen.
Director Hickman noted the agenda item stated this item was in District 1 and suggested
this be investigated.

RECEIVE QUARTERLY REPORT FROM AZPB LIMITED PARTNERSHIP
Pursuant to paragraph 13 of the Binding MOU between the Maricopa County Stadium District
and AZPB Limited Partnership, receive the quarterly report from AZPB Limited Partnership
regarding disbursements from the Chase Field Reserve Account covering the period of
October 1, 2020 to December 31, 2020.
This item was heard in Executive Session on February 24, 2020 2021. (C-06-21-511-X-00)
The Clerk noted the correction that the Executive Session date should read 2021
instead of 2020. This correction was to the executive session date.
