PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
Dr. Robyn Jaynes, Director of Animal Care and Control introduced Cynthia Ann, a
three-year-old mixed breed dog. Dr. Jaynes said Cynthia Ann has a lot of energy,
enjoys going out for walks, has mastered basic training skills, and has a great
personality. The cost for adopting is currently $25 and includes vaccinations,
spay/neuter surgery, microchipping and County license. For more information on
adoptable pets, visit the webpage at Pets.Maricopa.gov.
Chairman Sellers asked the Clerk if there were any announcements or corrections to
the agenda. The Clerk said there was one change. On item #86, she said on the
attachment for approvals, it was necessary to remove parcel #200-13-096.

RECOGNITION OF LESLEY KRATZ, ASSISTANT CHIEF DEPUTY, ASSESSOR'S
OFFICE
Recognition of Lesley Kratz, Assistant Chief Deputy, for 31 years of dedicated service as
contractor and employee to Maricopa County. (C-06-22-765-X-00)
Chairman Sellers introduced Lesley Kratz, former Assistant Chief Deputy, Assessor’s
Office. Ms. Kratz retired August 2, 2021 after 31 years of service to Maricopa County.
She served in several roles including five years as a contractor, and 26 years as an
employee. He said she began in Internet Technology helping to create the first website
for the County Assessor. Ms. Kratz has served as the Assistant Chief Deputy since
2018 and Chairman Sellers said Assessor Cook would miss her knowledge and
expertise. He thanked her for 31 years of service.
Assessor Cook came forward and spoke. He summarized the many changes that have
happened over the years Ms. Kratz has been with Maricopa County. Ms. Kratz worked
under six Assessors. He said the number of parcels in Maricopa County has gone from

800,000 in the early 1990’s to approximately 1.8 million in 2021. In the early years she
was instrumental in the development of the first webpage for the Assessor’s office and
has witnessed many transitions in the business of the Assessor’s office. Assessor Cook
said she is a prime example of hard work, treating people right and climbing the career
ladder in the Assessor’s Office. He said she is a wealth of information and he thanked
Ms. Kratz for her exceptional customer service and dedication to Maricopa County.
Assessor Cook thanked her husband for allowing her to contribute to the County for so
many years. Assessor Cook spoke about the function of the Assessor’s office and he
explained that the assessment of property in Maricopa County and the property taxes
that are collected help to provide the services that benefit the entire County. He
suggested the citizens should be proud knowing that they contribute to the wellbeing of
Maricopa County.
Ms. Kratz came forward and thanked the Board and their Chiefs for all the support they
have given through the years. The Board gathered for a picture and Assessor Cook
presented her with a plaque of recognition.
Supervisor Gallardo thanked Ms. Kratz for all her support of District 5. He said as the
County has grown over the years, she was the Board’s point of contact in the
Assessor’s Office and she has been a wealth of information for staff and constituents.
Supervisor Chucri called Ms. Kratz a consummate professional saying she worked
under many Assessors, knew her job and did it well.
Supervisor Gates echoed the previous comments. He said she was very helpful to
District 3 as the County has managed growth and the splitting of many parcels. Through
the tough times, Supervisor Gates said she was the rock in the Assessor’s Office.
6.
PROCLAMATION REGARDING CHILD SUPPORT AWARENESS
Proclaim the month of August as Child Support Awareness Month. (C-06-22-755-X-00)
Juanita Garza, Clerk of the Board, read the proclamation. A copy of the proclamation
is on file with the Clerk of the Board's Office and retained in accordance with LAPR
retention guidelines.

Commission Recommendation: On 7/8/21, the Commission voted 7-0 to recommend
approval of Z2021035 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall be in substantial conformance with the Narrative Report
consisting of 6 pages, dated May 7, 2021, and stamped received May 19, 2021, except as
modified by the following conditions.
b. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to number of proposed building lots/units,
drainage design, access and roadway alignments. These items will be addressed as
development plans progress and are submitted to the County for further review and/or
entitlement.
2. A traffic impact study must be submitted with future entitlement (preliminary plat or POD)
application(s).
3. R/W dedication along the development site’s Baseline Road frontage may be required as
part of any future entitlement application(s). Coordinate dedication with the City of Phoenix.
4. Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa County

County; MCDOT Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.
c. Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to issuance
of a building permit, written confirmation will be required from the emergency fire protection
jurisdiction having authority that the facility has been designed in accordance with their
regulations and requirements, and that emergency fire protection service will be provided to
the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction
review and approval will be required.
d. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
e. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
f. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert

to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any

value of the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change had never

development and engineering design shall be in conformance with Section 1205 of the

f. The following Environmental Services (MCESD) condition shall apply:
1. Obtain new Notice of Intent to Discharge (NOID) from MCESD program. Water service
information to be provided.
g. Prior to approval of the initial final plat or precise plan of development approval, the
applicant shall provide the Maricopa County Planning and Development Department with an
executed pre-annexation service agreement with the City of Glendale that identifies the
details for the provision of water and sewer service. In lieu of a pre-annexation service
agreement, the developer must provide a ‘will serve’ letter from the certificated water and
sewer provider(s). Otherwise, documentation to be provided from the City of Glendale stating
that this type of agreement would no longer be required.
h. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.

i. Development of the site shall be in compliance with all applicable Maricopa County Air
Quality rules and regulations.
j. Prior to zoning clearance or Final Plat approval, developer(s) and/or builder(s) shall
establish emergency fire protection services, covering all real property contained within the
project area during course of construction and shall obtain a ‘will serve’ letter substantiating
coverage from the applicable fire service provider.
k. All habitable buildings constructed within this subdivision shall be constructed to attain a
noise reduction level as per ARS § 28-8482(B).
l. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
m. Noncompliance with the conditions of approval will be treated as a violation in accordance
with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of
approval may be grounds for the Planning and Zoning Commission to take action in
accordance with Chapter 3 (Conditional Zoning).
n. Non-compliance with the regulations administered by the Maricopa County Environmental
Services Department, Maricopa County Department of Transportation, Drainage Review
Division, Planning and Development Department, or the Flood Control District of Maricopa
County may be grounds for initiating a revocation of this Zone Change as set forth in the
Maricopa County Zoning Ordinance.
o. The granting of this Zone Change has been at the request of the applicant, with the
consent of the landowner. The granting of this approval allows the property owner to enjoy
uses in excess of those permitted by the land use existing on the date of the application,
subject to conditions. In the event of the failure to comply with any condition of approval, the
property shall change to the land use designation that existed on the date of the application.
It is, therefore, stipulated and agreed that revocation due to the failure to comply with any
conditions does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in the value of the property
from the value it held on the date of application due to such revocation. The Zone Change
enhances the value of the property above its value as of the date the Zone Change is granted
and changing to the prior land use designation results in the same value of the property as
if the Zone Change had never been granted.
p. The following Luke Air Force Base condition shall apply:
Thomas E Russell Revocable Trust and successive owners shall notify future
owners/tenants that they are located near a military airport with the following language:
“You are locating in a residential dwelling inside the State Statute defined “territory in the
vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly
as low as 1,500 feet above the ground. You will be subject to direct overflights and noise by
Luke Air Force Base jet aircraft in the vicinity.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.
Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours and
during most weekends.

Agua Fria River to Deer Valley Road which extends through the site.
4. The only access that will be allowed for the Williams Drive/Deer Valley Road
alignment will be at one location along Parcel G as a right-in right-out. A second access point
for Parcel G will be needed along the 117th Avenue alignment.
5. Future right-of-way dedications, offsite improvements, and any additional right-of-way
needed shall be addressed by future entitlement (preliminary plat or POD) application(s) and
submittal of a traffic impact study (TIS)”.
6. R/W dedication (130 feet)) along the development site’s portion of Pinnacle Peak Road
will be required as part of any future entitlement application(s), unless otherwise determined
by MCDOT Planning.

best practices at the time of application for construction.
g. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
h. Development of the site shall be in compliance with all applicable Maricopa County Air
Quality rules and regulations.
i. Prior to zoning clearance or Final Plat approval, developer(s) and/or builder(s) shall
establish emergency fire protection services, covering all real property contained within the
project area during course of construction and shall obtain a ‘will serve’ letter substantiating
coverage from the applicable fire service provider.
j. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
k. Noncompliance with the conditions of approval will be treated as a violation in accordance
with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of
approval may be grounds for the Planning and Zoning Commission to take action in
accordance with Chapter 3 (Conditional Zoning).
l. Non-compliance with the regulations administered by the Maricopa County Environmental
Services Department, Maricopa County Department of Transportation, Drainage Review
Division, Planning and Development Department, or the Flood Control District of Maricopa
County may be grounds for initiating a revocation of this Zone Change as set forth in the
Maricopa County Zoning Ordinance.
m. The granting of this Zone Change has been at the request of the applicant, with the
consent of the landowner. The granting of this approval allows the property owner to enjoy
uses in excess of those permitted by the land use existing on the date of the application,
subject to conditions. In the event of the failure to comply with any condition of approval, the
property shall change to the land use designation that existed on the date of the application.
It is, therefore, stipulated and agreed that revocation due to the failure to comply with any
conditions does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in the value of the property
from the value it held on the date of application due to such revocation. The Zone Change
enhances the value of the property above its value as of the date the Zone Change is granted
and changing to the prior land use designation results in the same value of the property as

Mr. Ellsworth reviewed agenda item #12. This special use permit includes a request for
modification to the setbacks for the cell towers and the size of the arrays. He stated
there was significant opposition from the neighbors and the applicant is requesting a
continuance to have further discussions with the neighbors.
Chairman Sellers asked the Clerk if there were any registered speakers or comments
received on this item. The Clerk said 33 comments were received in opposition; Five
registered speakers who want to speak in opposition and three registered speakers
who want to speak in favor.
The Clerk called on the speakers in opposition:
Renee Hunter, resident, spoke in opposition saying the cell signal in the area is fine.
She said an 80-foot tower in the neighborhood would be an eye sore, it would decrease
home values and it is not clear on the long-term health risks of having a 5G tower in the

backyard. Ms. Hunter said the posting for the hearing was not placed where the
neighbors would see it and it was through word of mouth that the neighbors have
learned about the project.
Lincoln Hunter, resident, spoke in opposition and said the proposed tower would be
located right outside their front window. He stated there are plenty of other locations for
a tower that is not right in front of a house. Mr. Hunter said the cell signal is fine with
plenty of other towers in the area.
Frederick Kreutzberger, resident, spoke in opposition saying the proposed location is
directly across the street his home. He stated his wife has a health condition and he is
concerned about the effects the tower may have on her health. He stated an 80-foot
tower in this area is ridiculous.
Amanda Rakofsky, resident, spoke in opposition saying her home is two parcels to the
east of the tower site and that is too close. She said the posting for the hearing was not
easily seen. She talked about the negative impact on property values, the dark sky and
quiet that is valued by the neighborhood, and the health implications for humans and
livestock are not clear. Ms. Rakofsky is a renter, and she said the property owner does
not live in the area so he would not feel the impact.
Alan Muller, resident, stated he is a community leader and a past president of New
River Desert Hills Community Association. He said a community petition was circulated
for denial and he sent a letter to the neighbors in the surrounding community. Mr. Muller
also served on the Planning and Zoning Commission and assisted in the updating of
ordinances related to the Wireless Communication Facilities (WCF). He cited numerous
aspects of the proposed WCF that did not comply with ordinances that were established
to protect the residents from adverse visual impact. Mr. Muller said this proposed WCF
violates Maricopa County ordinances that are in place and T-Mobile is attempting to
erect a WCF without regard to the zoning ordinances or community. He stated there
are other towers in the area to provide cellular signal. Mr. Muller requested the Board
deny case #Z2021044.
Keith Paffrath, resident, spoke in opposition. Mr. Paffrath works with the Daisy Mountain
Fire Department (DMFD). He said DMFD was approached by T-Mobile to piggy-back
their equipment onto a tower on DMFD property. T-Mobile had the option to do that and
has declined because they did not want to comport with the requirements of the Fire
Station to meet the construction requirements. He said T-Mobile can put their
equipment on an existing pole, but T-Mobile has declined due to cost and their interest
in leasing the pole space to other carriers in order to make money. Mr. Paffrath said
there has been limited notice of the meetings and many residents did not know it was
happening. He asked the Board to deny this proposal saying the community does not
want this tower rising out of the desert floor.
Supervisor Gates said he understands the interest of the residents to oppose this
project. He said up to this point there has been little outreach on the part of the applicant
and Supervisor Gates would like to make sure they can address the concerns of the
community.

Kyle Moyer, a government affairs representative, has been hired by the applicant who
is committed to working with the neighbors and community residents to find an equitable
resolution to this case.

there needed to be additional conversation with the community.

VICTIM COMPENSATION FUNDING FROM THE ARIZONA CRIMINAL JUSTICE
COMMISSION
Approve acceptance of $1,609,500 in grant funds from the Arizona Criminal Justice
Commission. These funds come from the FY 2021-2022 Arizona Crime Victim
Compensation program administered by the Arizona Criminal Justice Commission. Of these
monies, $557,625 are State funds, and $1,051,875 are Federal funds under CFDA 16.576.
The Arizona Criminal Justice Commission Grant Number VC-22-056 commences July 1,
2021 and will terminate on June 30, 2022. Authorize the Chairman to sign all applicable
documents. These monies are to be used for the benefit of victims of crime through the
Maricopa County Victim Compensation Program and cannot be used for indirect costs
(Agreement, Page 7, Paragraph 35). The Maricopa County Attorney's Office's composite
indirect cost rate for FY22 is 20.3%, or $326,728.50. The recoverable indirect cost of
administering this grant is $0; the non-recoverable indirect cost is $326,728.50. Non-
recoverable indirect costs will be covered by the departmental general fund budget. There is
no requirement of match funds. This grant is competitive and does not require on-going cash
contributions after the grant period end date. Grant revenues are not “local revenues” for the
purpose of the constitutional expenditure limitation, and therefore expenditure of the funds
is not prohibited by budget law. This funding directly supports the overall mandated function

FY22 VERTICAL PROSECUTION OF AUTO THEFT OFFENDERS GRANT FROM
ARIZONA AUTO THEFT AUTHORITY
Approve receipt of grant funds from the Arizona Automobile Theft Authority in the amount of
$235,751.00 and authorize the Chairman to sign all applicable documents. These grant
funds are intended to be used exclusively for reimbursement of expenditures related to the
prosecution of Arizona Vehicle Theft Task Force auto theft cases. This grant agreement
commences retroactively on July 1, 2021 and will terminate on June 30, 2022. In accordance
with paragraph 1, page 2, of the agreement, the grant allows a 0% rate for indirect costs, or
$0 that may be incurred by the County Attorney’s Office of Maricopa County for the
administration of this grant. The Maricopa County Attorney's Office's composite indirect cost
rate for FY22 is 20.3%, or $ $47,857.45. The recoverable indirect cost of administering this
grant is $0; the non-recoverable indirect cost is $47,857.45 which will be covered by the

This funding directly supports the mandated function of prosecution of criminal cases.

agreement is in the amount of $235,751.00. These grant funds are intended to be used
exclusively for salary expenditures of two prosecutors and two paralegal who will give priority

Upon receipt of funds and pursuant to ARS §42-17106(B), approve revenue and expenditure
appropriation adjustments to the Constables (D250) General Fund (100) Non-Recurring
(NRNP) associated with the grant in the amount of $27,121 for FY 2022. Grant revenues are
not local revenues for the purpose of the constitutional expenditure limitation, and therefore,
expenditure of the funds is not prohibited by the budget law. This budget adjustment does

Approve Amendment No. 1 to the Agreement between Diocesan Council for the Society of
Saint Vincent de Paul (Contractor) and Maricopa County (County), administered by its
Human Services Department. The purpose of the Agreement is for the Contractor to provide
weather relief accommodations for individuals experiencing homelessness at the St. Vincent
de Paul Watkins Hall of Banners, 420 West Watkins Road, Phoenix, Arizona 85003 location.
The purpose of the Amendment is to address the following items:
A. Increase contract amount by $343,682 from $387,782 to $731,464 in order to add
unanticipated budget line items for security, additional staffing, cots and shade/misters.

RESCIND ACTION AND APPROVE REVISED IGA WITH MARICOPA COUNTY
COMMUNITY COLLEGE DISTRICT
Rescind the action taken by the Board of Supervisors on June 23, 2021 to approve a financial
Intergovernmental Agreement (Agreement) between the Maricopa County Community
College District on behalf of Rio Salado College collectively referred to as (“Contractor”) and
Maricopa County administered by its Human Services Department, (“County”).
Request approval to substitute the revised IGA which addresses the following changes
requested by Rio Salado College:
• Revise Paragraph 15.0 GENERAL INDEMNIFICATION:
• Revise Paragraph 17.0 INSURANCE:
o Remove items 17.1 through 17.21
o Add paragraph:
Each party acknowledge and agree that each are self-insured, or otherwise possess
necessary and proper insurance policies that maintain appropriate/standard levels of
coverage for General Liability and Worker’s Compensation.
The purpose of the Agreement is for the Contractor to provide training to childcare providers
who require educational qualifications as a part of their contract with the Maricopa County
for the Head Start Zero-Five Program. The goal of the activities is to improve the quality of
childcare by providing training to childcare providers. Contractor shall work to determine if
individual staff members meet the Infant/Toddler (I/T) Child Development Associate
education requirements as determined by the Council for Professional Recognition.
The County shall reimburse the Contractor for training an amount not to exceed $30,000 per
fiscal year. The term of Agreement shall be retroactive to July 1, 2021 through June 30,
2023. This Agreement may be extended by a written amendment approved and signed by
both Parties.
The Maricopa County Head Start program is administered by the Human Services
Department Early Education Division. This Agreement is funded by grants from U.S.
Department of Health and Human Services (DHHS)/Administration for Children and Families
(ACF), Office of Head Start (OHS) (C-22-20-003-G/09HP000200). There is no long-term
commitment on the part of the County to continue this Agreement beyond the term of the
Agreement. The Agreement is subject to the availability of funds.
This Agreement does not impact the County General Funds.

Coalition to End Sexual and Domestic Violence, a Community-Based Non-profit
Organization (“Contractor”) and Maricopa County (the “County”) administered by its Human
Services Department.

The purpose of the Agreement is to administer a grant assistance program that will support
Maricopa County sexual and domestic violence survivors (survivors) and address service
gaps that have increased as a result of the COVID-19 Pandemic. The Contractor shall
receive and review applications, administer grants to qualified agencies, and distribute up to
$14,280,000 on behalf of the County to partner agencies serving Maricopa County residents.
The funding shall be distributed in the following Project Expenditure categories:
• Grants to member agencies shall total no greater than $4,760,000 to address funding gaps
caused by the COVID-19 Pandemic that impacted the agency’s ability to provide domestic
violence services.
• Grants to qualified agencies shall total no greater than $9,520,000 will be provided to
administer legal and counseling services, community-based services, and financial
assistance for survivors
Funding of this Agreement is through the American Rescue Plan Act, Coronavirus State and
Local Fiscal Recovery Funds under the CFDA number of 21.027. The Agreement amount
shall not-to-exceed $15,000,000.
Agreement term is retroactive to July 1, 2021 and will expire June 30, 2024.

in Paragraph 7.0:
7.1 Administrative Change Orders – The Chairman of the Board of Supervisors is authorized
upon the recommendation of the Human Services Department Director and Legal Counsel

Administrative Change Orders. Administrative Change Orders shall be approved and fully
executed by the Chairman of the Board of Supervisors and the Contractor’s authorized
Representative. Administrative Change Orders may address any of the following areas:
7.1.1 Modifications to the project timeline if the last day of the project timeline is within the
Agreement term;
7.1.2 Modifications to Budget line items if the Agreement Amount remains unchanged;
7.1.3 Modifications required by federal, state, or County regulations, ordinances, or policies;
and
7.1.4 Modifications to Administrative requirements such as changes in reporting periods,
frequency of reports, or report formats required by Department of Treasury or local

NETWORK
Approve a Competition Impracticable Agreement (“Agreement”) between Arizona Food Bank
Network., a Community-Based Non-profit Organization (“Contractor”) and Maricopa County
(the “County”) administered by its Human Services Department.
The purpose of the Agreement is for Contractor to provide grants to food banks and local
partner agencies for food bank operations and food distribution services. AFBN has the
expertise to determine which food bank agencies are qualified to receive funds that are
critical to support increased demand, increased staffing needs, delivery, increased
refrigeration and cooling capacity, mobile and drive-thru distributions, and increased storage
capacity as a result of COVID-19 pandemic and its economic impacts.
Funding of this Agreement is through the American Rescue Plan Act, Coronavirus State and
Local Fiscal Recovery Funds under the CFDA number of 21.027. The Agreement amount

Approve a financial Intergovernmental Agreement between the City of Mesa (“Subrecipient”)
and Maricopa County, administered by its Human Services Department. Through this

City of Mesa and its unincorporated areas, impacted by the COVID-19 pandemic. The

Approve a Notice of Award (NOA) 1 CPIMP211277-01-00 from DHHS, CDC, for the
‘Collaborative Approach to Improve Health Literacy for Vulnerable Populations: A cross
collaborative approach
between healthcare, CBOs, refugee resettlement orgs, and public health departments. This
is a COVID-19 Response award.
The NOA is in the amount of $4,000,000 for the 2-year project period July 1, 2021 through
June 30, 2023. This action awards funding from the Coronavirus Response and Relief
Supplemental Appropriations Act, 2021 (P.L. 116-260).
This Grant deviates from County Policy A2505 and does not allow for full indirect cost
reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the
NOA. MCDPH indirect rate for FY22 is 17.97%. The full indirect costs are for the 2-year term
are estimated at $653,454 of which $363,636 is recoverable and $289,818 is unrecoverable.
Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool.
Departmental indirect rates are re-established at the beginning of each fiscal year and the
future indirect rates will be collected at the corresponding rates.
This is a new award and it is uncertain whether it will reoccur after the initial 2-year period.
The grant does not require an in-kind match and ongoing cash contributions are not required.
This is not a mandated service but provides a benefit to the citizens by improving the

ongoing development of the State and County Health Preparedness Infrastructure through
the CDC Public Health Preparedness Cooperative Agreement with the ADHS.

Tobacco Use is the number one preventable cause of death and disease in Arizona. In
1993, there were over 70,000 middle and high school youth using tobacco. Cigarette
smoking during pregnancy accounts for 20 – 30% of low birth weight babies, up to 14% of
pre-term deliveries, and about 10% of all infant deaths.
In 1995, as a result of the Tobacco Tax Initiative, the Arizona Legislatures authorized the
Arizona Department of Health Services (ADHS) to develop and fund tobacco prevention and
cessation programs. The Maricopa County Department of Public Health (MCDPH) is funded
by ADHS to identify effective strategies and implement school-based tobacco use prevention

RENEWAL TO LETTER OF AGREEMENT WITH VITALYST HEALTH FOUNDATION
Approve a Letter of Agreement between Vitalyst Health Foundation (Vitalyst) and Maricopa
County by and through its Department of Public Health (MCDPH), to provide additional
funding for ‘Community Health Re-Imagined’. This grant is funded form the Vitalyst Health
Heart & Lung Medical Assistance Grant. The increased funding is in the amount of $70,000
for the budget term July 1, 2021 through June 30, 2022, the final year of the Agreement.
This award is reoccurring and has been awarded to the department for a number of years.
There is no cash or in-kind match required and indirect cost is fully recoverable. Ongoing
cash contributions are not required. This is not a mandated function but benefits our citizens
with the provision of a program to prevent and decrease the incidence of hypertension and
cardiovascular disease. The grant award was competitively bid.
MCDPH’s indirect rate for FY 22 is 17.97%. The full indirect costs are estimated at $10,663,
all of which is recoverable. Departmental indirect rates are reestablished at the beginning of
each fiscal year and the future indirect rates will be collected at the corresponding rates.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This
Amendment does not alter the budget constraining expenditures of local revenues duly
adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted
as necessary to accommodate this grant through a future reconciliation.) (C-86-16-048-3-

EMERGENCIES
Authorize the Chairman of the Board of Supervisors to execute contracts, in a form to be
approved by the County Attorney’s Office, with any or all of the Contractors that have

submitted responses to PH RFP 210251, Regional Distribution Sites in Support of
Emergencies, a Request for Proposal issued by Public Health related to the provision of
warehousing and transportation logistical services, including receipt, sorting, staging,
inventory, temporary storage, and distribution functions of supplies and equipment
(purchased or donated) in case of natural, public health, or human-made emergencies and
disasters. The Contracts will be for an initial term of 3 years with the first three contracts
beginning on the 9th day of September 2021 and ending the 8th day of September 2024,
with an option to renew up to a maximum of three (3) additional years, (or at the County’s
sole discretion, extend the contract on a month-to-month bases for a maximum of six (6)
months after expiration). Any additional contracts that are awarded from re-solicitation efforts
shall have a delayed beginning date but shall have the same expiration date and renewal
options as the initial three respondents listed below. The anticipated total amount to be spent
on all awarded contracts if activated would be $3,000,000 over the initial term.
The first three (3) contracts were awarded based on a determination by the Public Health
Selection Committee as qualified to provide the specified services. The successful
respondents are:

It is anticipated that these agreements will be funded from American Rescue Plan Act

CONTRACTS FOR TESTING AND TRAINING RELATED TO COVID-19
Authorize the Chairman of the Board of Supervisors to execute amendment 2 to the total
authorized not to exceed amount of all awarded contracts combined under MA #200232.
Currently the maximum not to exceed amount is $10,000,000 as approved 6/10/2020 under
C-86-20-059-3-00 and Amendment 1 approved on 2/10/2021 under C-86-20-059-3-01.
These contracts were solicited under PH RFP 200232, Testing and Training Services
Related to COVID-19.
Anticipated expenditures under this Contract with all awardees are expected to increase by
a not to exceed amount of $10,000,000, with a confirmed amount of $6,000,000 of
Epidemiology & Lab Capacity (ELC2) funds for the Department of Public Health and
$3,500,000 of American Rescue Plan Act (ARPA) funds for Correctional Health Services.
The cumulative total is not to exceed $20,000,000 during the initial three-year term ending
June 28, 2023. These Contracts have the option to extend for up to two (2) one (1) year
periods.

the Tokyo Olympics in floor exercise. He said there is so much pressure and stress and
the accomplishment is something to be proud of.
Chairman Sellers also wished Supervisor Gates a happy birthday. He said he was
honored to represent Maricopa County at the Arizona Commerce Authority meeting for
an announcement about a Lithium Battery Plant that is being built in District 4. He said
having a manufacturing facility in our “backyard” is great for the economy with the
increasing focus on electric cars and electronic devices. He said there is a lot going on
in the Maricopa County and he looks forward to planning for the growth in the County.

IGA FOR PHASE II-A OF THE GRANITE REEF WATERSHED DRAINAGE
IMPROVEMENTS
Approve Intergovernmental Agreement (IGA) FCD 2020A029 for the Design, Rights-of-Way
Acquisition & Utility Relocations for the Phase II-A of the Granite Reef Watershed Drainage
Improvements (PROJECT) between the City of Scottsdale (CITY) and the Flood Control
District of Maricopa County (DISTRICT). This Agreement shall become effective as of the
date it has been executed by all PROJECT PARTNERS and shall expire ten years from that
date, or upon Project completion, whichever occurs first.
The PROJECT consists of the design of a large diameter storm drain that will convey runoff
from Granite Reef Wash, just north of Thomas Road south along the Pima Road corridor to
McKellips Rd, and ultimately out to the Salt River. Once constructed, this PROJECT will
help reduce the flood hazard in the area by capturing and conveying runoff from the 100-
year event. This is a joint project with the CITY and the estimated total PROJECT cost is
$4,100,000. The cost will be shared 50/50 with the CITY making the DISTRICT’s estimated
share of the PROJECT cost $2,050,000. The CITY will take the lead for the PROJECT.

Award Contract FCD 2021C009 On-Call Services to Wood, Patel & Associates (Consultant)
to provide professional engineering services for the design of a channel system and
associated structures for the Paradise Ridge Drainage Improvements (PROJECT). The
contract will be effective for 730 calendar days from the date of execution or the expenditure
of $2,000,000, whichever comes first. The Flood Control District of Maricopa Country
(District) and Consultant will mutually agree to a detailed scope of work for each work
assignment. This is a qualifications-based selection in accordance with the Maricopa County

The Paradise Ridge Channel (extending from the southwest corner of Pinnacle Peak Road
& Scottsdale Road, south approximately 2.5 miles to State Route 101) was identified in the
Pinnacle Peak West Area Drainage Master Study as being a necessary component to control
the alluvial fan flooding in the area. This PROJECT will reduce the flood hazard in the area
and complete the final step of a comprehensive solution to this drainage corridor.

short bed (6.5) and lift gate that has an estimated cost of $38,000 for the purpose of
facilitating Library District staff in their efforts to provide adequate and timely services to our
multiple locations and community partners. Funding for these vehicles is included in the FY
2022, Library District (650), 244 special district fund budget. Annual operating and
maintenance costs are estimated at $11,000 (for the four vehicles) to be paid out of the
