INVOCATION - INVOCACIÓN
Chairman Sellers opened the meeting and said Supervisor Gallardo would introduce
his guest who would offer the invocation and lead the pledge.
Supervisor Gallardo introduced Cyndi Tercero-Sandoval, Student Support Services
Manager for the Phoenix Union High School District. Supervisor Gallardo said Ms.
Tercero-Sandoval was instrumental in putting together a small shop at Carl Hayden
High School where students could go and get necessities to help them be prepared for
their school day. He said during the pandemic, she assisted with the necessary
technology, lunches, and general welfare of the students. Ms.Tercero-Sandoval has
been an advocate for students and Supervisor Gallardo thanked her for the service she
provides.
Ms. Tercero-Sandoval offered the invocation.

Ms. Tercerp-Sandoval led the Pledge of Allegiance to the flag.

9:30 AM on Wednesday, September 1, 2021, in the Supervisors' Auditorium, 205 W. Jefferson
Phoenix, AZ 85003, with the following members present: Jack Sellers, Chairman, District 1; Bill
Gates, Vice Chairman, District 3 (remote); Steve Chucri, Supervisor, District 2; Clint Hickman,
Supervisor, District 4 (remote); Steve Gallardo, Supervisor, District 5. Also present: Juanita

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
Monica Gery, Public Information Officer with Animal Care and Control (ACC),
introduced Julip, Stella and Studly. Ms. Gery said all three of these dogs have lost a leg
and are fondly referred to as “tripods”. She said two of the dogs had to undergo surgery
at ACC due to injuries sustained by cars. Julip loves being with humans, rolling in the
grass and will probably do well with other dogs and kids. Stella is a seven-year-old and
is still spunky and active and needs to be an only pet. Studly has been a shelter favorite
having been returned to the shelter three times over the last few years. He is very active
and loves going on hikes. Ms. Gery said there is an adoption special for the month of
September, featured by NBC and Telemundo called Clear the Shelter. All adoptions
are $25 and include the spay/neuter procedure, microchipping, full vaccination, and
Maricopa County license fee. Information on these and other adoptable pets can be
seen at Pets.Maricopa.gov.
Chairman Sellers asked the Clerk if there were any announcements or corrections to
the agenda. The Clerk said on item #10(d), Special Event Liquor License Application
for Every Kid Counts, the applicant has requested the application be withdrawn.

PROCLAMATION - SUICIDE PREVENTION AWARENESS
Approve the 2021 Suicide Prevention Awareness Proclamation. (C-06-22-833-X-00)
Chairman Sellers asked Juanita Garza, Clerk of the Board, to read the proclamation. A
copy of the proclamation is on file with the Clerk of the Board's Office and retained in
accordance with LAPR retention guidelines.
Supervisor Gallardo spoke on the importance of mental health awareness in our
community. He said with the many challenges people have faced in the last year, it is
important to take care of those who need help and continue to provide services in our
communities. He said the County needs to continue to support and partner with the
agencies who can assist those in need.
Chairman Sellers echoed Supervisor Gallardo’s comments and to continue helping with
awareness and prevention.

RESOLUTION OF SUPPORT FOR A DAY TO RECOGNIZE SECOND RESPONDERS
Adopt a Resolution of the Maricopa County Board of Supervisors regarding the support for
September 1, 2021, as a day to recognize second responders. (C-06-22-841-X-00)
Chairman Sellers asked Lee Ann Bohn, Assistant County Manager to come forward.
She said the following:
“Good morning Chairman and members of the Board. Thank you for this opportunity.
Our first responders receive a great deal of attention on the news and headlines every
day and rightfully so. They are the courageous men and women who, quite literally, put
their lives on the line to keep our communities safe and respond to emergencies. We
are grateful for their service. Less is heard about our second responders, those workers
involved in responding to individuals or communities needs following a traumatic event.
She recently read that a first responder saves a life, but a second responder helps a
person put their life back together. Second responders arrive when the danger is
eliminated, the initial trauma is concluded, and the physical threat is gone. She thinks
this must have been written before March of 2020. Second responders have a hard job
on any day but how hard must it be when the same threat appears every day for 84
weeks and counting. The term “second responder” has taken on a whole new meaning
during COVID. They are not responding to an isolated event; their focus is not on a
single individual or segment of our community. They have shown up every day for
nearly a year and a half to help those whose lives have been forever changed by this
global pandemic. They try to prevent others from experiencing the same loss. Since
March of 2020 our Human Services team and their partners have provided over $50
million of rent and utility assistance to families facing evictions or shut offs. They have
implemented new strategies to address the needs of our homeless population and they
worked with seniors and adults with disabilities to ensure they received the services
they needed to stay safe. They work with families to ensure their young children had
virtual learning opportunities, and they have now safely reopened our Head Start
classrooms and they kept our workforce centers open and discovered new ways to
provide services to job seekers. Our public health team has investigated over 600,000
COVID cases. They have conducted hundreds of webinars for healthcare workers,

schools, and municipalities. They have organized hundreds of testing events and
vaccine events to help prevent future cases and hospitalizations, they have answered
thousands of calls and emails from our residents, and they have mobilized thousands
of volunteers who have contributed over 100,000 hours of their personal time. Our team
at the Medical Examiner's office responded to a 26% increase in reported deaths in
calendar year 2020 and our Emergency Management team has provided millions of
units of personal protective gear throughout our community. Thank you to all of our
second responders for the work you do every day, serving the residents of Maricopa
County. We are fortunate for your expertise, experience, dedication, and compassion.
Thank you.”
Chairman Sellers thanked Ms. Bohn for the recognition of all the second responders
who have helped us get through this pandemic.
Supervisor Gallardo said Ms. Bohn summarized the subject well. He echoed Chairman
Seller’s comments and appreciated all the efforts of second responders, many of whom
do it year-round.

Request: Zone Change from Rural-43 to R-5 RUPD
Site Location: Approx. 1,280’ south of the SEC of Northern Ave. and El Mirage Rd., in the
Glendale area
Commission Recommendation: On 8/5/21, the Commission voted 6-0 to recommend
approval of Z2021062 subject to conditions ‘a’ – ‘k’:
a. Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “Marbella Ranch East”, consisting of 1 full-size sheet, dated and stamped received
July 6, 2021, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Project Narrative for Rezone of Marbella Ranch East”, consisting of 7 pages, dated
and stamped received July 6, 2021, except as modified by the following conditions.
c. The following R-5 RUPD standards shall apply:
1. Front yard: 15 ft.

d. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to drainage design, access and roadway
alignments. These items will be addressed as development plans progress and are
submitted to the County for further review and/or entitlement.
2. A traffic impact study must be submitted with any future entitlement application (i.e.
preliminary plat or plan of development).
3. Dedication of right-of-way for El Mirage Road may be required as part of future entitlement
application(s).
4. The site contains regulated floodplains. Encroachment into FEMA Zone AE and FW
floodplains/floodways is extremely restrictive. The applicant must address requirements
required to develop the site as the project progresses through future entitlement(s).
5. The applicant must address how improvements, residences and other improvements
necessary for development of the site will be protected from scour along the Agua Fria River
(34,500 cfs) as development plans progress and are submitted to the County for further
review and/or entitlement.
6. Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa County
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa
County; MCDOT Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.
e. The following Maricopa County Environmental Services Department (MCESD) condition
shall apply:
1. It should be noted that this document does not approve the referenced project. Comments
are provided only as advisory to Maricopa County Planning and Development Department
to assist staff to prepare a staff report. Other Maricopa County agencies may have additional
requirements. Final review and approval will be made through Planning and Development
Department procedures. Applicant may need to submit separate applications to the Maricopa
County Environmental Services Department for approval of proposed facilities regulated by
the Department. Review of any such application will be based on regulations in force at the
time of application.
f. All buildings subject to noise attenuation as per ARS § 28-8482(B).
g. The master developer shall notify future homeowners that they are located within the state-
defined “territory in the vicinity of a military airport” with the following language:
“You are buying a home or property in the ‘vicinity of a military airport’ as described by State
of Arizona statute ARS §28-8481. Your house should include sound attenuation measures
as directed by State law. You will be subject to direct over flights and noise by Luke Air Force
Base jet aircraft in the vicinity.

Luke Air Force Base executes over 200,000 flight operations per year, at an average of
approximately 170 overflights per day. Although Luke's primary flight paths are located within
20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to
and from the Barry M. Goldwater Gunnery Range and other flight training areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours and
during most weekends.
Such notification shall be recorded on all Final Plats, be permanently posted on not less than
a 3 foot by 5 foot sign in front of all home sales offices, be permanently posted on the front
door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included
in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and
conveyance documents.
h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
i. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
j. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation of the Zone Change. The Zone Change enhances the
value of the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change had never
been granted.
k. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and
ARS § 11-814 for five (5) years, within which time the subject site shall obtain an approved
plan of development or final subdivision plat, and an issued infrastructure permit for initial
development. If this term is not met the Planning and Development Department may present
the R-5 RUPD zoning for Z2021062 to the Board of Supervisors (Board), upon
recommendation by the Planning and Zoning Commission (Commission), for consideration
of amendments or revocation of zoning due to undeveloped parcels. (C-44-22-332-X-00)

483rd Ave. alignment on the west, and approx. 2,855’ NE of the intersection of 459th Ave.
alignment and Salome Hwy. on the east
Commission Recommendation: On 8/5/21, the Commission voted 7-0 to recommend
approval of Z2019121 subject to conditions ‘a’ – ‘i’:
a. The initial Plan of Development shall be developed in substantial conformance with the
Site Plan entitled “RE Papago Solar Photovoltaic Power and Energy Storage Project”
consisting of 32 full-size sheets, dated June 15, 2021, and stamped received July 7, 2021,
except that a revised site plan shall be submitted within 30 days of Board approval that
reflects compliance with condition ‘d.4.” as it pertains to maximum lot coverage.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Zone Change Narrative”, consisting of 22 pages, dated July 6, 2021, and stamped
received July 6, 2021 except as modified by the following conditions except that a revised
narrative shall be submitted within 30 days of Board approval that reflects compliance with
condition ‘d.4.” as it pertains to maximum lot coverage.
c. The following Planning Engineering conditions shall apply:
1. Drainage Waiver case DRB2021005 must be approved prior to issuance of building
permits.
2. Detailed Grading and Drainage Plans showing the new site improvements must be
submitted for the acquisition of building permits. On-site (solar field & substation) areas must
be designed in such a manner so that flows are directed to retention basin(s). Basin
overflows must be directed to well-defined drainage corridors, to the maximum extent
possible.
3. Owner or owner’s agent shall be responsible for identifying and procuring any
permit(s) for disturbance of, or work within delineated jurisdictional (Section 404) washes.
4. Sizing of the basin spillways must be determined based on the peak unattenuated flow
rate, based on the proposed site condition, using either the Rational Method or DDMSW.
Where the retention areas will be comingled with offsite flows, the offsite flows must be
included in the discharge rate.
5. As part of the final design, channelized flow may be required to be dissipated (spread) at
their outflow locations to match existing downstream conditions.
6. Drainage review of planning and/or zoning cases is for conceptual design only and does
not represent final design approval nor shall it entitle applicants to future designs that are not
in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the
Maricopa County Drainage Policies and Standards. All development and engineering design
shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and
current engineering policies, standards and best practices at the time of application for
construction.
7. Any disturbance to Special Flood Hazard Areas (floodplains) will require that a Floodplain
Use Permit be issued concurrent with the associated building permit.
8. Pads for inverters, other electrical equipment, and any buildings within a Floodplain must
be elevated to the regulatory flood elevation or otherwise designed to meet the requirements
of the Floodplain Use Regulations. All development and engineering design shall be in

conformance with the most current version of the Floodplain Use Regulations for Maricopa
County.
9. Project improvements (i.e. electric lines) within and immediately adjacent to District owned
properties require a Right-of-Way Permit from the Flood Control District.
10. Future right-of-way needs, dedication, preservation, and offsite improvements, shall be
addressed during site plan and/or building permit review, with the submittal of a traffic impact
study, prior to any approvals.
11. Driveway accesses to paved MCDOT right-of-ways must be paved for the full width of
the right-of-way.
d. The following IND-2 IUPD Zoning District standards shall apply:
1. Maximum Electric Transmission Line Height – 140’
2. Minimum Side Yard – 0’
3. Minimum Rear Yard – 0’
4. Maximum Lot Coverage – 60%
5. Parking Spaces Required – None required with a Maricopa County Air Quality Department
approved dust control plan. High curb and/or bumper guards not required.
6. Landscaping – No landscaping areas required
7. Sight Visibility Triangles – No sight visibility triangles are required at project site
entry/access points and road intersection, section line, mid-section line or alignment corners
8. Article 902.91 – All utility uses shall be permitted to be conducted outdoors
9. Site Enclosure and Screening – 6’ chain-link fencing with 1’ of barbed wire permitted
e. The Owner or Developer shall address and respond to all recommendations of the Arizona
Game and Fish Department (AZGFD) included in the letter dated May 26, 2021 at the time
of construction permitting. The response shall be sent to AZGFD for review and
consideration. The Zoning Inspector and/or their designee shall review the applicant’s
response, and any subsequent comments received from AZGFD, to determine whether the
response issued by the Owner or Developer addresses AZGFD comments in good faith.
Should the Zoning Inspector and/or their designee decide that the Owner or Developer has
not substantially addressed AZGFD comments in good faith, the Owner or Developer shall
be required to propose and implement alternatives to the recommendations made by
AZGFD.
f. The IND-2 IUPD shall limit the use of the site exclusively to a solar electric generating
facility including ancillary offices and ancillary uses. All other site uses shall require a Zone
Change Major Amendment.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
h. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.

AQ-2017-008-RULE 336 (SURFACE COATING OPERATIONS)
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to
solicit comments on the proposed revision of Maricopa County Air Pollution Control
Regulation III - Rule 336 (Surface Coating Operations) and the associated proposed revision
to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is
requested to adopt the proposed revisions to the rule and to approve submission of the
revised rule as a revision to the Arizona SIP.
Rule 336 establishes limits for the emission of Volatile Organic Compounds (VOCs) from
surface coating operations. Rule 336 applies to VOC-containing coatings as well as related
activities, such as coating preparation/mixing, coating application, and the cleanup of coating
application equipment.
The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 336 to
address rule deficiencies identified by the U.S. Environmental Protection Agency (EPA) to
secure full approval of Rule 336 as a revision to the Arizona SIP. The MCAQD is also
proposing revisions to address rule recommendations provided by the EPA, incorporate
revisions recommended by stakeholders, and make other revisions to improve and clarify
the rule.
Permit fees are not changing due to this action. (C-85-22-060-X-01)
Chairman Sellers said the Board received speaker slips from out-of-state industry
representatives in opposition to item #13. They are requesting to be exempt from Rule
336 and the Environmental Protection Agency (EPA) has denied the request because
it has taken the EPA five years to sign off on the rule. He said at this point in the process,
any change would lead to an EPA rejection of the rule.
Chairman Sellers asked the Clerk if there were any registered speakers or comments
for item #13. The Clerk said there were three speakers in opposition, and they wish to
speak:
Rita Loof, Director of Environmental Affairs for RadTech International. RadTech is a
trade association representing over 800 members in the UV/EB LED industry with
business in Maricopa County. Ms. Loof said she could not support Rule 336 in its
current form. She stated companies that have gone above and beyond regulatory

requirements should be recognized rather than being subjected to overly prescriptive
regulations. Ms. Loof listed a variety of technical characteristics of the product. She
spoke about a proposal that she would like to have considered being written into Rule
336: 1) Adding a definition for Energy Curable Materials. 2) Providing a permitting
extension. 3) Adding a method to test the VOC. 4) Providing relief from transfer
efficiency mandates.
Howard Ragin, Partner in UV Specialties, LLC, which is a boutique UV coatings
manufacturer, and he has been a member of the industry organization RadTech for 35
years. His company has several clients in Maricopa County and would like the Board
to include UV/EB and LED curing technology as proposed by RadTech. He said that
many everyday products use this technology in production. The technology is also
called “energy curing” and he said it is virtually emission free and would like this
technology included in Rule 336. He asked that the rule not be adopted in its current
form.
Douglas DeLong, DDU Enterprises, Inc., has been in the industry since 1987. He stated
he has clients in Maricopa County and all over Arizona and this technology is being
used because it is clean.
Chairman Sellers reiterated that this topic has been going on for five years and he
stressed the importance of continuing to move forward to avoid further delays. If
changes need to be addressed in the future, staff will advise the Board accordingly.
Supervisor Hickman acknowledged the need for regulations and the steps the County
goes through to make these determinations. He asked if Phil McNeely, Director of Air
Quality, was in attendance and able to come forward for some questions. Mr. McNeely
came forward and Supervisor Hickman asked if there is a stakeholder process and if
he heard comments like the Board was hearing today.
Mr. McNeely stated the Rule 336 package was a result of EPA requiring the County to
do an Ozone Moderate Plan for 2008. The Rule 336 was brought before the Board and
approved in November 2016. Since then, there have been negotiations and the EPA
has been adding categories and stakeholder meetings. The questions raised by the
callers have not been raised until a Board of Health meeting on April 26, 2021 when
the Board of Health approved moving forward with the Rule 336 process and it was
sent to the Board of Supervisors for approval in June 2021. It was pulled off the agenda
so there could be stakeholder meetings that included RadTech and Ms. Loof. Mr.
McNeely offered to address Ms. Loof’s comments. He started by stating the EPA gave
conditional approval in January 2021 after four years of negotiations. The conditional
approval said the County must revise the rule as agreed upon or it will be denied. If
there were to be a denial, then the sanction clock starts which could include
Transportation funding. When the County talked to RadTech in April 2021, that situation
was explained, and he said it is unclear as to what RadTech’s issue was. Mr. McNeely
went on to say that within the Rule 336 there is flexibility and there are exemptions
written into the rule that would allow the RadTech product without having to name the
product. Mr. McNeely named the exemptions that would include RadTech’s stated
concerns and ultimately compliance for Maricopa County. If Maricopa County
attempted to write in additional exemptions, the EPA would deny.
Supervisor Hickman thanked Chairman Sellers for the opportunity to ask the questions
and thanked Mr. McNeely for the clarification. Chairman Sellers echoed the
appreciation for clarification.

DELEGATION OF AUTHORITY REQUEST TO IMPLEMENT THE FEDERAL PLAN
REQUIREMENTS FOR EXISTING MUNICIPAL SOLID WASTE (MSW) LANDFILLS
Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-474(4), to
solicit comments on the approval of the Maricopa County Air Quality Department’s (MCAQD)
request for delegation of authority from the U.S. Environmental Protection Agency (EPA) to
implement the Federal Plan Requirements for Existing MSW Landfills at 40 CFR Part 62,
Subpart OOO. Following the public hearing, the Board is requested to approve the request
for delegation of authority and to approve submission of the delegation request to the EPA.
On August 29, 2016, the EPA promulgated emission guidelines for existing MSW landfills
which set forth specific mechanisms and requirements for controlling emissions of non-
methane organic compounds. The emission guidelines are codified at Title 40 of the Code
of Federal Regulations, Part 60, Subpart Cf and require States to submit a plan, also known
as a 111(d) plan, to the EPA to implement the provisions Subpart Cf. The MCAQD submitted
a 111(d) Plan to the EPA in 2018, however, it was not approvable as submitted because it
did not contain a locally enforceable rule which incorporated the emission guidelines in
Subpart Cf. As a result, the MCAQD withdrew the 111(d) Plan in 2019. Currently, the
MCAQD is working to revise Rule 321 (Municipal Solid Waste Landfills) to incorporate the
emission guidelines, but these revisions have not yet been adopted. Once revisions to Rule
321 are adopted, the MCAQD will submit another 111(d) Plan to the EPA for approval.
In August 2019, the EPA released the proposed Federal Plan requirements for existing MSW
Landfills. The Federal Plan was finalized on May 21, 2021, became effective on June 21,
2021, and requires all existing MSW landfills in states without approved 111(d) Plans to
comply with the Federal Plan requirements until a local 111(d) plan is approved by the EPA.
The EPA encourages states that do not have approved 111(d) plans to request delegation
of authority of the Federal Plan so that they can have primary responsibility for implementing
the 2016 emission guidelines. This delegation of authority request must be approved by the
Board of Supervisors before the MCAQD can request delegation of authority from the EPA
to implement the Federal Plan. The Federal Plan and corresponding delegation of authority
will no longer apply upon the effective date of the approved 111(d) plan for Maricopa County.

FY22 VICTIMS’ RIGHTS GRANT FUNDING FROM ARIZONA ATTORNEY GENERAL
Approve receipt of FY 2021-2022 grant funds from the State of Arizona, Office of the Attorney
General, in the amount of $283,320. These grant funds will support mandated functions by
covering direct costs of implementing victims’ rights laws pursuant to Arizona Revised
Statues Title 13, Chapter 40 and Title 8, Chapter 3, Article 7, that impact prosecutorial
agencies as an entity type. This agreement commenced, retroactively, July 1, 2021 and
terminates on June 30, 2022. In accordance with Victims’ Rights Program Guidelines,
Section IV, page 5, the grant allows a 0% rate for indirect costs, or $0 that may be incurred
by the County Attorney’s Office of Maricopa County for the administration of this grant. The
Maricopa County Attorney’s Office FY2022 composite indirect cost rate is 20.3%, or $57,514.

The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect
cost is $57,514. Non-recoverable indirect costs will be covered by the department's general
fund budget. This grant is non-competitive and does not require a match. The grant award
does not require on-going cash contributions after the grant period end date. Authorize the
Chairman of the Board of Supervisors, or designee, to sign all documents related to this
award. Grant revenues are not "local revenues" for the purpose of the constitutional
expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget
law.
This award agreement is in the amount of $283,320. This award will ensure that victims of
crime are notified of the progress of criminal proceedings. This grant will expire at the end of
the agreement. There is no long-term expectation of continued funding for this grant;

General’s office for victim services since FY96/97, the most recent award was for FY 20/21

Superintendent's Office. The term of the grant is amended to six years beginning October 1,
2016, through September 30, 2022.

Approve the Agreement and acceptance of $152,722.00 in advance and reoccurring grant
funding from the Arizona Attorney General’s Office, Victims’ Rights Program (VRP). The
Award Agreement is – A.G. # 2022-046. The term of this funding is July 1, 2021 through
June 30, 2022. The Sheriff’s Office indirect cost rate for FY22 is 14.74%. Unrecoverable
indirect costs associated with this Agreement are estimated to be $22,511.22 and will be
absorbed by the Detention Fund. There is no requirement of match funds. This grant is
competitive and does not require on-going cash contributions after the grant period end date.

The Sheriff’s Office is mandated by Arizona Revised Statues Title 13, Chapter 40 (Crime
Victim’s Rights) and Title 8, Chapter 3 (Victim Rights for Juvenile Offenses) requires victim
notification upon a suspect’s arrest, next court appearance, release from custody, post-
conviction/post adjudication release etc. This funding directly supports the overall mandated
function of providing victim notification services. It covers approximately one-third of the
position costs and operating expense for five Justice System Clerks, one Justice System
Clerk Senior, and one Justice System Clerk Supervisor. The Sheriff’s Office funds the

FUNDING FROM ARIZONA GAME AND FISH COMMISSION FOR LAW
ENFORCEMENT BOATING SAFETY FUND FY22
Approve acceptance of up to $430,000 in continued funding from the Arizona Game and
Fish Commission for Law Enforcement Boating Safety. The term of this funding is estimated
to be July 1, 2021 through June 30, 2022. This funding will be used to pay for personnel
costs, purchase equipment, maintenance/repair and/or replacement of watercraft patrol
boat(s) to continue effectively patrolling the waterways, a mandated public safety function in
Maricopa County.
This funding award formulaic and non-competitive. It is recurring and has been awarded to
the Sheriff’s Office for many years. These funds are the result of A.R.S. § 5-383 and indirect
cost recovery is not allowed. The Sheriff’s indirect cost rate for FY22 is 14.74%. There will
be capital equipment purchases valued at $200,000 that are excluded in the indirect cost
calculation. The indirect cost basis is $230,000 and the unrecoverable indirect cost amount
of $33,902 will be absorbed by the General Fund. There is no match requirement and there
are no future or ongoing contributions required after the grant period ends; however, there
is an expectation to continue patrolling Maricopa County waterways if the funding from the
State was to end.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditures of these revenues are not prohibited by the budget

FUNDING FROM THE ARIZONA GAME AND FISH COMMISSION – FOR LAW
ENFORCEMENT BOATING SAFETY FUND FY21
Accept up to $25,953.83 in additional funding from the State of Arizona Game and Fish
Commission for Boating Law Enforcement and Safety. Also approve an increase of $55,500
in revenue to this fund resulting from proceeds of the sale of boating equipment by
Equipment Services that was originally purchased through this fund. This funding will be
used to pay for personnel costs, equipment, maintenance/repair and/or replacement of
watercraft patrol boat(s) to continue effectively patrolling the waterways in Maricopa County.
The BOS approved an action on October 7, 2020 accepting $405,000 in funding for this
program for FY 2021. Approval of this item increases the funding amount to $485,953.83.
The Sheriff’s indirect cost rate for FY22 is 14.74%. These funds are the result of A.R.S. § 5-

383 and indirect cost recovery is not allowed. The unrecoverable indirect cost applicable to
the funding increase total of $81,453.83 is $12,006.29. This funding is re-occurring, non-

mandate which encompasses patrolling waterways in Maricopa County.

RESCIND AND REPLACE MOU WITH U.S. IMMIGRATION AND CUSTOMS
ENFORCEMENT (ICE) HOMELAND SECURITY INVESTIGATIONS (HSI)
Rescind and replace MOU to include statutory authorization reference on item #2 of the
MOU. On June 9, 2021 the BOS approved a non-financial MOU between U.S. Immigration
and Customs Enforcement (ICE) Homeland Security Investigations (HSI) and Maricopa
County Sheriff’s Office [ICE Form 73-002 (5/14)]. The County’s statutory authorization
reference (item #2) was missing from the initial document. The attached replacement

MOU WITH FRANKLIN POLICE AND FIRE HIGH SCHOOL
Approve a non-financial Memorandum of Understanding (MOU) between Maricopa County
on Behalf of the Maricopa County Sheriff’s Office and Franklin Police and Fire High School,
Phoenix Union High School District for Maricopa County Youth Cadet Post. The initial term
of this MOU is four years commencing retroactive to March 1, 2021 and ending March 31,
2025 and is effective upon signatures of all parties. Following the initial term, this MOU may
be extended for up to three, one-year terms. This agreement can be canceled by either party
within 30-days written notice to terminate to the other party. The purpose of this MOU is to
establish a long-lasting partnership between the Maricopa County Sheriff’s Office Cadet

the Town of Queen Creek (Licensor) for non-exclusive use of two (2) parking spaces on
Town property at 22358 South Ellsworth Road, Queen Creek, AZ, for the purpose of parking
County owned vehicles overnight and County employee personal vehicles during work
hours. The current Agreement expires on September 30, 2021. This amendment will extend
the term two (2) years, commencing on October 1, 2021 through September 30, 2023 at no

Approve an inmate work contract between the Arizona Department of Corrections,
Rehabilitation & Reentry (“ACDRR”), for and of behalf of its Arizona State Prison Complex –
Perryville (ASPC-Perryville) and Maricopa County Animal Care and Control. The inmate
work crews provided will support kennel sanitation and normal property maintenance at the
East and West Shelters. Inmates working under this contract will not be considered County
employees and ACDRR will provide security supervision of the inmates. The term of this
agreement shall begin when all signatures are affixed and executed by the parties and shall
continue for a period of five (5) years thereafter, unless terminated, canceled, or extended

THE NINA MASON PULLIAM CHARITABLE TRUST GRANT AGREEMENT AND
BUDGET ADJUSTMENT
Approve the application and acceptance of grant funds from The Nina Mason Pulliam Trust
Grant Agreement (the “Agreement”) in the amount not-to-exceed $40,000 for the purpose of
offering ten (10) Pet Help mobile clinics that will conduct spay/neuter surgeries and wellness
vaccination events at no-cost to the community. The grant award begins on August 11, 2021
and ends on August 10, 2022. Authorize the Chairman to sign the Agreement and authorize
the Animal Care and Control appointed authority and/or designee to sign other grant-related
documents, such as reporting requirements, etc., as applicable to administer the grant.
In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure
authority in the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-
Recurring Non-Project (NRNP) appropriation group by $40,000.
The grant allows a 0% rate or $0 for indirect costs. The Maricopa County Department of
Finance has calculated the Fiscal Year 2022 indirect cost rate at 14.30% or $5,720. The
recoverable cost rates for administering this grant is $0 and the Animal Care and Control will
absorb the non-recoverable indirect cost of $5,720 into the department’s operating budget.
This grant is non-recurring, and a cash or in-kind contribution is not applicable. There are no

IGA RENEWAL WITH CITY OF PHOENIX
Approve and execute Amendment 2, the Intergovernmental Agreement between City of
Phoenix and Maricopa County. Amendment 2 modifies a prior approved agenda item
submitted as C-88-20-006-3-01 that was approved during the February 10th, 2021 Board
Meeting. The purpose of this Agreement is to set forth the parties’ respective rights and
obligations with respect to Phoenix’s acceptance of Maricopa County’s Recyclables, as
amended by Amendment 1 (C-88-20-006-3-01)(Agreement). Rate changes as provided by
the City of Phoenix will occur with this Amendment 2 but cost to the County is not projected
to increase. This Agreement is extended from February 19, 2021 through February 18th,
2022. There will be three more options to extend. All other terms and conditions of the
Agreement are not changed in this amendment; they remain the same in full force and effect.

EXCEPTION TO THE MARICOPA COUNTY TELEWORKING (HR2409) POLICY
Retroactive to August 18, 2021, approve an exception to the Maricopa County Teleworking
Policy (HR2409) to allow employees whose dependent children test positive or are under a
quarantine order for COVID to telework, if authorized by their Appointing Authority, and watch
their dependent children at the same time. This exception would remain in effect until
December 31, 2021, or rescinded by the Board, whichever comes first.
This policy exception applies to all employees of Maricopa County appointed departments
as well as the Flood Control District of Maricopa County and the Maricopa County Library
District (Special Districts). The Board of Supervisors is authorized to jointly adopt policies
applying to the Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00,

COVID 19 VACCINE INCENTIVE
Approve a COVID 19 vaccine incentive of $100 and one day of Recognition Leave for
employees who are fully vaccinated by 10/31/21. All part-time, full-time, classified,
unclassified, contract, head start contract, and temporary employees are eligible. Employees
must submit proof of being fully vaccinated to Human Resources by close of business Friday,
11/10/21.
It is anticipated that the $100 incentive will appear on eligible employees' 11/24/21
paychecks.
Recognition Leave given under this incentive will not count towards a department’s 10% cap
granted under the Employee Leave Policy (HR2415). This Recognition Leave must be used
by 12/31/2022.
This incentive applies to the County’s elected offices, appointed departments, and the Flood
Control District of Maricopa County and the Maricopa County Library District (Special
Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the
Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, approved on

Chairman Sellers said it is imperative that we do everything we can to get people
vaccinated. He said there are many departments who have direct contact with the
public. Supervisor Sellers stated there has been a lot of discussion on this subject and
short of having a mandate (which we do not want to do), we came up with an incentive
plan.
Supervisor Chucri stated he will vote “no” on this item. He clarified that vaccination is a
personal choice and he appreciates all the efforts of the County departments who have
been working to keep people safe.
Supervisor Gallardo said he respected Supervisor Chucri’s position. He said it is the
County’s mission to create a safe work environment for our employees and the public.
Supervisor Gallardo said similar conversations are happening in the school districts
with discussions on incentives for teachers and students. He said it is important to
continue to educate and promote the importance of the vaccine.

Supervisor Gates said he echoes Supervisor Gallardo’s comments and said incentives
are an opportunity for those who choose vaccination and not punitive for those who
choose not to. He thanked Chairman Sellers for his leadership on this item.
Supervisor Hickman said as a business owner (Hickman Farms), the company made
the decision to offer an incentive to their workers to keep the business running.
Supervisor Hickman said many of his employees decided on the vaccine despite the
incentive and when there was a federal mandate to keep all food supply businesses
open during the pandemic, vaccinations helped keep the employees safe and the
business running. Supervisor Hickman said that since Supervisor Chucri was opposed
to the idea of an incentive, if the item were to be continued there could be more
discussion on ways to vaccinate Maricopa County employees.
Supervisor Chucri said his decision on this matter is personal and philosophical and
appreciated Supervisor Hickman’s interest in a unified vote, but his position will not
change with more discussion.
Chairman Sellers said he believes this is the appropriate action to take at this time. He
mentioned many large companies are incentivizing to get people vaccinated and we
cannot afford to wait any longer. Chairman Sellers said this is a small but important
step in letting employees know how important this is.
Supervisor Hickman asked County Manager, Joy Rich, if Human Resources has done
research as to what other companies are doing and how much thought went into this
decision. Ms. Rich said Human Resources surveyed both public and private sector
companies and there have been a variety of ways to manage this. She said the County
prides itself in embracing the business mindset and this is a business decision. With
the information that is available regarding unvaccinated people and hospitalization, the
potential is great to disrupt business if people get sick. Supervisor Hickman asked if
Ms. Rich knew how many workdays were lost due to COVID.
Jan Plank, Director of Human Resources, was on the phone and said she does not
know off the top and did say that Maricopa County Benefits Trust has incurred $4.1
million in benefits related costs due to COVID for the workforce and dependents.
Ms. Rich added that there has been $2.7 million in Workers Compensation claims
related to COVID.
Supervisor Gallardo said it is the Board’s responsibility to help keep the employees and
the public safe.

Saint Vincent de Paul (Contractor) and Maricopa County (County), administered by its
Human Services Department. The purpose of the Agreement is for the Contractor to provide
weather relief accommodations for individuals experiencing homelessness at the St. Vincent
de Paul Watkins Hall of Banners, 420 West Watkins Road, Phoenix, Arizona 85003 location.

A. Extend the Agreement termination date from September 30, 2021, through June 30, 2022
in order to provide navigation services to people experiencing homelessness who have
utilized the heat relief shelter.
B. The County shall provide an increase in funding amount by $77,039 for the Contractor to
add additional staff to provide navigation services. The Agreement amount shall increase
from $731,464 to $808,503.
C. Funding for Amendment No. 2 is provided by Maricopa County General Funds.
The Agreement is amended to incorporate the changes contained in this Amendment No. 2.
All other terms and conditions of the Agreement and Amendment No. 1 shall remain
unchanged and in full force and effect as executed by the Parties.

FOR COMMUNITY ACTION SERVICES PROGRAM
Approve revenue Amendment No. 4 to the Intergovernmental Agreement (Agreement)
between Arizona Department of Economic Security (DES) and Maricopa County,
administered by its Human Services Department (County). The purpose of Amendment No.4
is for DES to provide the County with carryover allocations from State Fiscal Year 2021 for
the Case Management COVID 19 and the Community Services COVID 19 Supplemental
Funding Budgets. The funding amount shall be increased by $1,419,613.
The Amendment addresses the following:
• Pursuant to the Terms and Conditions, Section 28.0 Levels of Service, this Amendment is
to revise the Case Management Service Budgets and the Community Services Service
budgets for the period of July 1, 2021 through June 30, 2022.
• The revised funding allocations are as follows:
o The Case Management reimbursement ceiling for the period of July 1, 2021 through June
30, 2020 is revised from $5,138,670 to $5,542,885, an increase of $404,215.
o The Community Services service reimbursement ceiling for the period of July 1, 2021
through June 30, 2022 is revised from $898,744 to $1,914,142, an increase of $1,015,398.

LEASE AGREEMENT WITH SHADOW RIDGE ESTATES, LLC
Approve and execute Lease Agreement (“Agreement”) L-7513 with Shadow Ridge Estates
(Mesa), LP, California limited partnership, ("Lessor" or “Landlord”) and Maricopa County
(“Lessee” or “Tenant”). The Lease is for the Maricopa County Human Services Department’s
use of 41,917 rentable square feet (RSF) of office and storage space at 1001 W. Southern
Avenue, Mesa (“Premises”); and authorize the Assistant County Manager and/or the County
Real Estate Director to administer the Agreement.
The purpose of this Agreement is for two Human Services Department programs
(Arizona@Work Maricopa County and the Early Education Division-Head Start
administration) to be co-located in the same site.
The Lessor shall deliver to County the Premises as a turn-key space on or before March 1,
2022. This Agreement shall commence after the County has:
(1) accepted the condition of the Premises as suitable for the Permitted Use;
(2) obtained all required approvals to open to the public (“Commencement Date”).
The initial term of the Agreement is for 124 months (March 1, 2022 through June 30, 2032).
The County will have two (2) five-year options to renew provided that County gives the Lessor
a one hundred eighty-day (180) notice to renew and the first right to purchase the building
should it become for sale. County, at County’s expense, shall have the right to fabricate and
install panels on the monument sign, exterior signage on the top of the building and eyebrow
signage on the first-floor level. The County will utilize two hundred forty-six parking spaces
at no charge of which forty-one (41) will be reserved covered spaces at no charge to the
County. In addition, the existing furniture can be used at no charge should County determine
they want it. Such furniture can be purchased by County via a separate bill of sale in the
amount of $10.00.
Although County shall have access/usage of the Premises from 7am to 7pm Monday –
Friday and 8am to 12pm Saturday; from time to time, Human Services may need to utilize
the building after hours for Program related activities and Lessor agrees to allow such use
upon receipt of the request form. If after hours HVAC is necessary, the parties agree that the
rate for such usage shall be at $7 per hour per HVAC unit used, payable within thirty (30)
days of receipt of invoice from Lessor. An annual estimate for this type of usage is one
thousand ($1,000.00) dollars per year.
The Commencement Date shall be memorialized by the Parties via execution of a
Commencement Date Confirmation Form. This Agreement shall be effective upon full
execution and delivery by the Parties (“Effective Date”). Upon notification from Lessor which
shall be no less than thirty (30) days prior to the commencement date as hereinafter defined,
Lessee and its employees, agents, contractors, subcontractors, engineers, consultants,

suppliers and other representatives, and their respective employees, shall be permitted to
enter and occupy the Premises, free of charge, for the purposes of inspecting same, and to
install Lessee’s furniture, fixtures and equipment (including, but not limited to telephone,
communications and computer equipment, wiring and cabling, and badge readers) (the
“Early Occupancy Period”); provided, however, that Lessee shall not interfere with Lessor’s
performance of any remaining work in the Premises during such Early Occupancy Period.
All of Lessee’s covenants and obligations under this Agreement other than the payment of
Rent (defined in § 3.1) shall apply during the Early Occupancy Period.
Rent for the Premises shall be at an annual full-service gross rate of $974,570.25 plus 2.7%
rental tax for the term of the Agreement.

ACCEPTANCE OF GRANT FUNDS FROM U.S. DEPARTMENT OF HEALTH AND
HUMAN SERVICES FOR HEAD START AND EARLY HEAD START PROGRAMS
Approve the receipt of new one-time grant funds from the U.S. Department of Health and
Human Services (DHHS)/Administration for Children and Families (ACF), Office of Head
Start (OHS), Grant No. 09CH012079-01-00 in the amount not-to-exceed $17,806,826 for the
delivery of Head Start and Early Head Start program services.
The new grant term (Project Period) is July 1, 2021 through June 30, 2026. Funding amounts
are $11,776,329 for Head Start and $6,030,497 for the Early Head Start program services.
The funding availability period is July 1, 2021 through June 30, 2022 (Budget Period).
The grant requires a non-federal share (NFS) match of the total approved project costs. The
total required NFS for FY2022 is $4,398,817 for the budget period of July 1, 2021 thru June
30, 2022. NFS is generated through in-kind donations of goods and services as well as
parent volunteering.
The total Federal and Non-Federal amount for the Project Period is $22,205,643.

COMPETITION IMPRACTICABLE AGREEMENT WITH AREA AGENCY ON AGING,
REGION ONE, INCORPORATED
Approve a Competition Impracticable Agreement (“Agreement”) between Area Agency on
Aging, Region One, Incorporated, a non-profit corporation (“Contractor”) and Maricopa
County (the “County”) administered by its Human Services Department.
The purpose of the Agreement is for Contractor to administer a grant assistance program
that will support the increase in demand for services for Maricopa County seniors and adults
with disabilities as a result of the COVID-19 Pandemic. Funding of this Agreement is through
the American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds under
the CFDA number of 21.027. The Agreement amount shall not-to-exceed $10,600,000.

The Contractor shall provide oversight of the following service activities:
• Biohazard cleaning services, for Senior and Adult Services Division clients up to $540,000;
• Hire an analyst to research and analyze factors affecting the recruitment and retention of
Direct Care Workers in Maricopa County up to $200,000;
• Administer grants to qualified agencies, and distribute up to $8,800,000 on behalf of the
County to partner agencies serving Maricopa County residents:
o Grants to Senior Centers located in Maricopa County up to $2,700,000;
o Support the recruitment and retention efforts by Home Care Agencies for Direct Care
Workers in Maricopa County up to $3,400,000 with a maximum of $1,700,000 annually;
o Grants to Adult Day Health Care Centers up to $2,700,000.
The Contractor shall receive a maximum of $1,060,000 for administration of these services.
Agreement term is September 1, 2021 and will expire June 30, 2024.
Also request authorization for the Chairman to sign Administrative Change Orders as
outlined in Paragraph 7.0:
7.1 Administrative Change Orders – The Chairman of the Board of Supervisors is authorized
upon the recommendation of the Human Services Department Director and Legal Counsel
to make changes within the general scope of the Agreement on behalf of the County through
Administrative Change Orders. Administrative Change Orders shall be approved and fully
executed by the Chairman of the Board of Supervisors and the Contractor’s authorized
Representative. Administrative Change Orders may address any of the following areas:
7.1.1 Modifications to the project timeline if the last day of the project timeline is within the
Agreement term;
7.1.2 Modifications to Budget line items if the Agreement Amount remains unchanged;
7.1.3 Modifications required by federal, state, or County regulations, ordinances, or policies;
and
7.1.4 Modifications to Administrative requirements such as changes in reporting periods,
frequency of reports, or report formats required by Department of Treasury or local
regulations, policies or requirements.
7.2 It is the responsibility of the Contractor to ensure the latest documents are consulted and
followed.

Approve an Amendment to Intergovernmental Agreement (IGA) Contract No. CTR040486
between Arizona Department of Health Services (ADHS) and Maricopa County by and
through its Department of Public Health to provide continued funding for the Sexually
Transmitted Diseases (STD) Services Program. The amendment is in the additional amount
of $67,616 for the period January 1, 2021 through December 31, 2021, for the budget period
total of $649,943. The term of the Contract is January 1, 2019 through December 31, 2023.
The STD grant award is reoccurring and non-competitive and has been awarded to the
Department for several years. There is no cash or in-kind match required and indirect cost
is fully recoverable. Should this grant be discontinued, ongoing cash contributions may be
required as this is a mandated function. At this time, there are no costs to be absorbed by
the department’s operating budget.
The Department of Public Health indirect rate for FY22 is 17.97%. Indirect costs are
estimated at $10,300 and are fully recoverable.
Grant revenues are not local revenues for the purpose of the constitutional expenditure

Approve a retroactive amendment No. 1 for Intergovernmental Agreement (IGA), Contract
No. ADHS18-175355, Prop 201 Smoke Free Arizona between Arizona Department of Health
Services (ADHS) and Maricopa County through its Department of Public Health (MCDPH),
Office of Worksite Health Innovation to provide continued funding for PROP 201 Education
and Compliance Activities Program. The price sheet is effective July 1, 2021 through June
30, 2022 in the total not-to-exceed amount of $816,413. The term of the agreement is from
July 1, 2017 through June 30, 2022. It is mutually agreed that the IGA referenced is amended
as follows:

shall not have any legal obligation to pay for services in excess of the amount indicated on

Order, and/or b) an additional Purchase Order is issued for purchase of services under this
contract.
The Department of Public Health’s indirect rate for FY 22 is 17.97%. Indirect costs are fully
recoverable in the amount of $124,362. Departmental indirect rates are reestablished at the
beginning of each fiscal year and the future indirect rates will be collected at the
corresponding rates.
This grant award is reoccurring and has been awarded to the department in previous years.
There is no cash or in-kind match requirement and indirect costs are fully recoverable.
Ongoing cash contributions are not required. The grant award is not a mandated function
but provides a benefit to the citizens by delivering community-based tobacco cessation and
prevention programs. The Programs provide an education component and responds to
written, on-line, and telephone complaints or other means of communication directly received
from the public as provided in the County delegation authority. The grant award is not
competitively bid, and the department’s operating budget is not required to absorb any costs.

FOR MASS IMMUNIZATION SERVICES AND ADMINISTRATION
Approve an amendment to the IGA between Maricopa County, through its Department of
Public Health (MCDPH) and City of Peoria and its Fire and Medical Department, for the
continued provision and administration of seasonal flu vaccine (as well as COVID-19 and
other types of vaccines, as needed) to those 6 months of age and older. Funding is in the
amount of $50,000 for the project period beginning July 1, 2021 and ending March 31, 2022.
The cumulative total for project period beginning October 12, 2020 and ending March 31,
2022, is $100,000.

COMPREHENSIVE COMMUNITY HEALTH NURSING SERVICES
Approve Amendment 5 to Contract between Southwest Human Development (SWHD) and
Maricopa County through its Department of Public Health, Office of Family Health, for
comprehensive community health nursing services to eligible women and their families
through the Nurse Family Partnership Program (NFP).
The not-to-exceed (NTE) amount is $249,615.50 for the 6-month budget period of October
1, 2021 through March 31, 2022.
This Contract is funded through an ADHS IGA grant, Nurse Family Partnership for Maternal,
Infant and Early Childhood Home Visiting (MIECHV) (ADHS17-155910)) and does not affect
the County general fund. This subcontractor is subject to the Maricopa County Procurement
Code pursuant to Section MC1-102C, as they are a prior designated subcontractor.
MCDPH and SWHD will continue to implement the Nurse Family Partnership (NFP) model
in the South Phoenix Region to provide comprehensive community health nursing services
to eligible women and their families. The program is called South Phoenix Nurse Family
Partnership (SPNFP). MCDPH and SWHD are partnering in this endeavor as each
organization has unique assets that will strengthen the implementation and success of this
program. SWHD has been a provider of services for over 20 years in the South Phoenix
area addressing the area’s multiple needs. SWHD provides Arizona Early Intervention
Services and has been providing Healthy Families (HF) services in Maricopa County for 18

consists of 50 gift cards in the amount of $10 each for a total value of $500.

This is first-time donation from Circle K to the Ryan White Program and future donations are
anticipated. Cash and/or in-kind match is not applicable, nor will ongoing cash contributions
be required should they cease to be provided. Though not mandated, these gift card
donations are a benefit to the Ending the HIV Epidemic initiative under Ryan White Part A.
The gift cards will be given to community members who participate in community feedback
sessions which identify strengths and gaps in the work to end the HIV Epidemic in Maricopa
County. The donation was not given in a competitive manner. Program costs associated with
the donations are absorbed by the program’s grant budget. Any additional administration
costs could be absorbed by the department’s operating budget.
MCDPH’s indirect rate for FY22 is 17.97%. There is no indirect on an in-kind donation,
therefore indirect expense estimated at $89.85 is not recoverable.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This

APPLY AND ACCEPT GRANT FUNDS FROM HEALTH SERVICE AND RESOURCES
ADMINISTRATION FOR LIFE SAVING MEDICAL AND SUPPORT SERVICES
Approve the application and acceptance of grant funds from Health Services and Resources
Administration (HRSA) in the not-to-exceed amount of $10,239,470. In addition, $409,939
will be carried over from the previous grant year for a total of $10,649,409. The grant will
provide continued lifesaving medical and support services to people living with HIV/AIDS.
Authorize the Board Chairman to sign all documents related to these grant funds, as
applicable. The non-competing continuation award period begins on March 1, 2022 and ends
on February 28, 2023.
The grant award is reoccurring and has been awarded to the department for many years.
This is a non-competing continuation opportunity and there is no cash or in-kind match
required. This is not a mandated service but provides a benefit to our citizens with the
provision of health related and support services for up to 4500 People Living with HIV/AIDS.
Should the grant cease, on-going contributions should not be required.
The grant allows for the full indirect rate of 17.97%. Sub-recipient awards will total
approximately $9,113,488 and are not subject to indirect. Indirect cost is estimated to be
$233,962, all of which is recoverable. All program costs are allocated to the grant so there
will be no additional burden on the department’s operating budget.

6, 2021 to solicit comments and consider the adoption of EROP Case ES-2021-002/MCEHC
Chapters I, VIII, X and XIII. Upon Board approval, this item will become effective.
Proposed MCEHC revisions include: clarification that an approved inspection to operate and
payment is required before a permit is considered valid, removing hearings before the
Environmental Health Officer (where not required by statute or another regulation) and
adding a third party hearing officer, updating references for plumbing codes and statutes,
deleting a mechanical code reference that has been repealed, updating frozen dessert

EROP CASE ES-2021-001/2017 FOOD CODE INCORPORATION BY REFERENCE
Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), set a public hearing for October
6, 2021 to solicit comments and consider the adoption of EROP Case ES-2021-001/2017
Food Code Incorporation by Reference. Upon Board approval, this item will become
effective.
Proposed revisions incorporate the 2017 FDA Food Code and annexes by reference and
eliminate references to earlier versions, while removing MCEHC language in conflict with the
2017 FDA Food Code. The new 2017 FDA Food Code and annexes contain the latest food
safety practices. In addition, this proposal provides a consistent, statewide regulatory
framework that will reduce stakeholder confusion between agencies because both Maricopa
County and the State will have adopted the FDA 2017 Food Code and annexes. The
Governors Regulatory Review Council approved the 2017 FDA Food Code and annexes,
which the State adopted in June 2020.

Chairman Sellers asked the Clerk if there was anything to report regarding public

Supervisors'/County Manager's summary of current events - Resumen de temas de

Supervisor Chucri thanked Flood Control for all they do during rainy weather and
commented on how nice the rain has been and how green things have become.
Supervisor Gates echoed Supervisor Chucri’s comments. He said he had the
opportunity to go on a few tours of mental health facilities. The first tour was the Phoenix
Medical Psychiatric Hospital focusing on treating individuals with significant psychiatric,
medical, and neurological disorders and do not have any place to turn to for help. The
second tour was the House of Refuge in Sunnyslope, a faith-based housing program
that serves homeless, unemployed, and recently sober individuals in need. which has
grown a lot and continues to help those in need.
Supervisor Hickman talked about a National Geographic documentary on 9/11 and his
resulting reflections on the 20-year anniversary of 911. He talked about the men and
women who have served our country and the many stories that have been told.
Supervisor Hickman said he remembers how that event brought our County together
as Americans and said we need to decide if we are still Americans. It is time to come
together again but not in war. He said it is important to have civil conversations and be
prepared for the many threats that face us beyond our borders.

Supervisor Gallardo offered a salute to the labor force including our Flood Control
District, second responders, and our County employees. He wished everyone a Happy
Labor Day.
Chairman Sellers spoke about how proud he feels to be part of the County team. The
Board and the County have faced many obstacles and responded to each situation in
a business-like manner. He thanked the Public Health Department for their presentation
which informed the public with up-to-date information. He also thanked the media for
their contributions in getting information out to the public.

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF WATER RESOURCES FOR
PRE-APPLICATION REVIEW SERVICES AND ASSOCIATED ACTIVITIES
Approve Intergovernmental Agreement (IGA) Amendment No. 4 FCD 2010A006 for Arizona
Department of Water Resources (Department) Pre-Application Review Services and
Associated Activities between the Flood Control District of Maricopa County (District) and
the Department.
Amendment No. 4 modifies the terms of the original IGA FCD 2010A006 and previous
Amendments 1, 2 and 3. The District agrees to pay $100.00 per staff-hour based on actual
staff-hours worked (invoiced quarterly) not to exceed $300,000.00 per District fiscal year
(July 1st through June 30th) for costs incurred by the Department in providing the detailed
pre-application reviews by qualified Department staff under each year of this agreement from
October 1, 2021 through June 30, 2023.
Pre-application reviews by the Department result in earlier identification and resolution of
design issues for all District dam projects which require a permit from the Department.
Identification of the Department’s design concerns and issues early in the design process
reduces costly redesign during the later stages of the design process. This Agenda Item

AMENDMENT TO RESOLUTIONS FOR ACQUISITION OF LAND RIGHTS FOR
IMPROVED ACCESS TO EXISTING STRUCTURES AND PROJECT AREA
PROPERTIES
Adopt Resolution FCD 2009R002B, an amendment to previous resolutions numbered FCD
2009R002 and 2009R002A, for the acquisition of land rights and for the construction of road
improvements to provide improved legal access to existing structures and project area
properties for the Flood Control District of Maricopa County (District). This amendment
includes all structures and areas operated and maintained by the District rather than limit the
authorization to a specific list of structures.
The District operates and maintains flood control structures and properties within and without
Maricopa County that protect the residents of Maricopa County from flooding. Several of
these structures lack adequate access for operation and maintenance. In some cases, this
lack of legal access has been exacerbated by new and on-going development. The Board
previously authorized the District to acquire rights-of-way for additional access for specific
structures under resolutions FCD 2009R002 dated March 18, 2009 (C-69-09-052-6-00) and
FCD 2009R002A (C-69-09-052-6-01) dated February 10, 2010. District staff have identified
several more structures and properties operated and maintained by the District that require
additional access.
The acquisition of additional rights-of-way and construction of road improvements for
operations and maintenance access will require expenditure of both District operating funds
and capital improvement program funds. This amendment expands the previous
authorizations to acquire additional access to include the ACDC and Cave Creek Arm,
Apache Jct. FRS and Floodway, Buckeye FRS #1 #2 #3, Bulldog Floodway, Dreamy Draw
Dam, Harquahala Dam FRS, East Valley Drains, Hermosa Vista-Hawes Rd., Loop 303
Outfall Drainage System, IBW Outlet Channel, New River Channelization, Old Cross Cut
Canal, Perryville Bank Stabilization, Reems Rd Channel, Rittenhouse Rd Drain and Basin,
Salt River Channel, Scatter Wash, Sonoqui Wash, Signal Butte Floodway, Skunk Creek,
Sossaman Rd Drain, Vineyard FRS, and Tres Rios Levee; all District maintained properties
and structures and adds authority for the expenditure of operating funds in addition to
previously authorized capital improvement program funds.
Individual land acquisitions will be subject to the ratification and approval of this Board.

STUDY/PLAN UPDATE
Award Contract FCD 2021C018 On-Call Services for the Fountain Hills Area Drainage
Master Study and Plan, (ADMS/P), Update to Black & Veatch Corp., to provide professional
engineering services. The contract will be effective for 730 calendar days from the date of
execution or the expenditure of $750,000.00, whichever comes first. The Flood Control
District of Maricopa Country (District) and Black & Veatch, will mutually agree to a detailed
scope of work for each work assignment. This is a qualifications-based selection in

The Fountain Hills ADMS/P Update will update and refine the findings of the original Fountain
Hills ADMP completed in 1997 (FCD contract 94-16). The purpose of the Fountain Hills
ADMS/P Update is to identify flooding problems due to recent land use changes within the
watershed using updated 2-foot contour mapping.
