PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES Monica Gery, Public Information Officer for Animal Care and Control introduced Sinatra, a 7-year-old senior dog that has been in the shelter since May. He enjoys evening walks and snacks at home. He is a little shy at first and if someone has the patience to win him over, they have a friend for life. Ms. Gery said he has been vaccinated, microchipped, neutered, licensed and is ready to go. She said today through Sunday October 10th, all adoptions are sponsored by Bissel Pet Foundation to help reduce the population in the shelters. For more information, please visit Pets.Maricopa.gov. PRESENTATIONS - PRESENTACIÓNES 5. DOMESTIC VIOLENCE AWARENESS PROCLAMATION Proclaim October 2021 as Domestic Violence Awareness Month (C-06-22-929-X-00) Juanita Garza, Clerk of the Board, read the proclamation. A copy of the proclamation is on file with the Clerk of the Board's Office and retained in accordance with LAPR retention guidelines. Supervisor Gallardo talked about the importance of community awareness around domestic violence. His Chief of Staff, Cris Arzaga, has served on the Arizona Domestic Violence Coalition Board for many years, and currently is president. Supervisor Formal Meeting Minutes 10/06/2021 Page 3 of 57 Gallardo said he likes this time of year when the downtown buildings are illuminated in purple to help bring awareness to domestic violence. The pandemic and the associated stress have escalated the incidences of domestic violence and Supervisor Gallardo wants to remind the citizens to please speak up. He said awareness is key and to let people know that help is available. Supervisor Hickman talked about the impact that domestic violence has on law enforcement and the courts. He said the role in assisting the victims can result in harm to law enforcement also. He said the community is touched by the issue of domestic violence and encouraged those who are victims to reach out and get help before the situation deteriorates. Supervisor Gallardo thanked the Communications team for all their work in the campaign Color the County, which has been done for the past five years. He reminded the public of the “Wear Purple Day”, October 21, 2021, for city, county, state, and some businesses in recognition of domestic violence awareness. The following Planning Engineering conditions shall apply: 1. Septic facilities not shown. When submitting the plans for a building permit include the septic facilities on the plans. Maintain a minimum 25 ft. separation between septic facilities and the underground retention. 2. E. Mesquite Street is along a midsection alignment requiring preservation of 40 feet half width future right-of-way per Maricopa County Zoning Ordinance Section 1105 per email by MCDOT Planning, Lynndsay O’Neill (lynndsay.oneill@maricopa.gov). 3. E. Mesquite Street north half is within jurisdiction of the City of Mesa. The applicant will be responsible for coordinating with the City to review any traffic impact, right-of-way dedication, permitting or roadway improvement requirements. 4. The site is accessed through a series of public and private easements that comprise 202nd Place. 202nd Place has not been accepted by the County; and is therefore not maintained by the County. 5. The subject site is not located within the County’s Urbanized Area and thus will not require a Storm Water Pollution Prevention Permit (SWPPP) from the County. This does NOT preclude the requirement to obtain a Construction General Permit (CGP) Notice of Intent to Discharge (NOI) from the State (ADEQ), as may be required. 6. Retention basin(s) underground storage must drain within 36 hours. 7. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. d. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. He said he is frustrated that the cities, towns, and individuals have known about this for years and are now coming forward. He said it amounts to infighting within the industry and the real question is what is the best policy for Maricopa County. Supervisor Gallardo said he will be ready to support this item on November 17, 2021. Supervisor Hickman concurred with Supervisor Gallardo and added it is important to be judicious before approving this item. EROP CASE ES-2021-002/MCEHC CHAPTERS I, VIII, X AND XIII CONVENING HEARING Pursuant to A.R.S. § 11-251.05 and A.R.S. § 36-184(B)(5), convene a public hearing for October 6, 2021 to solicit comments and consider the adoption of EROP Case ES-2021- 002/MCEHC Chapters I, VIII, X and XIII. Upon Board approval, this item will become effective. Proposed MCEHC revisions include: clarification that an approved inspection to operate and payment is required before a permit is considered valid, removing hearings before the Environmental Health Officer (where not required by statute or another regulation) and adding a third party hearing officer, updating references for plumbing codes and statutes, deleting a mechanical code reference that has been repealed, updating frozen dessert pasteurization requirements, and allowing for the operation of a shared facility without the need for a second permit. In addition, the proposal includes requirements for the manufacture of frozen desserts in retail food establishments and an option for school and public accommodation new owner transition. This MCEHC revision proposal is following Maricopa County’s EROP policy. In addition, this proposal does not contain fee revisions. EROP CASE ES-2021-001/2017 FOOD CODE INCORPORATION BY REFERENCE CONVENING HEARING Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), convene a public hearing for October 6, 2021 to solicit comments and consider the adoption of EROP Case ES-2021- 001/2017 Food Code Incorporation by Reference. Upon Board approval, this item will become effective. Proposed revisions incorporate the 2017 FDA Food Code and annexes by reference and eliminate references to earlier versions, while removing MCEHC language in conflict with the 2017 FDA Food Code. The new 2017 FDA Food Code and annexes contain the latest food safety practices. In addition, this proposal provides a consistent, statewide regulatory framework that will reduce stakeholder confusion between agencies because both Maricopa County and the State will have adopted the FDA 2017 Food Code and annexes. The Governors Regulatory Review Council approved the 2017 FDA Food Code and annexes, which the State adopted in June 2020. This MCEHC revision proposal is following Maricopa County’s EROP policy. In addition, this proposal does not contain fee revisions. School Superintendent - Superintendente de Escuelas 16. APPLY AND ACCEPT THE SCHOOL’S INFORMATION TECHNOLOGY PROGRAMS GRANT FROM STATE FARM® Approve the application for and acceptance of $38,466 for the School’s Information Technology Program Grant from State Farm®. The term of this grant is July 1, 2021 through December 31, 2024. The grant will create a centralized makerspace to train Maricopa County Formal Meeting Minutes 10/06/2021 Page 11 of 57 educators on how to use various tools in standards-based instruction. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant award is One-time, and a cash or in-kind match is not applicable. MCSS’s indirect rate for FY 2022 is 18.3 percent. The indirect cost rate allowed by this grant source is 0.0 percent. Total indirect costs on this award are $7,039.28 which are unallowable. No budget adjustment is required and ongoing cash contributions not applicable. There are no costs that will need to be absorbed by the department’s operating budget. The Maricopa County Department of Finance has calculated the Department of Emergency Management's composite indirect cost rate at 10% or $7200. The Department will not be recovering indirect costs off of this grant. The amount of unrecoverable indirect cost is $7200. Emergency Management will absorb these indirect costs within their general budget. The grant award is non-recurring, the department has to apply every year however, we have received the grant for the past four years. The department does not have an in-kind match requirement for this grant. The grant award is not a mandated function but it is a department strategic goal to have all county departments with a viable Continuity of Operations Plan (COOP). The grant is awarded through the Arizona State Homeland Security Department- State Homeland Security Grant Program (SHSGP), which is a competitive grant program. Maricopa County jurisdictions compete for projects based off the State grant initiatives. Maricopa County has spear headed the grant for the Emergency Operations Plans (EOP)/COOP software project for all county departments and jurisdictions within Maricopa County. Each year Maricopa County applies for the recurring cost of the software maintenance and training funds. Maricopa County does not have to fund any additional costs for the program. The grant is intended to renew the MaricopaRegionPrepares.com subscription. Supervisor Hickman asked Lee Ann Bohn, Assistant County Manager to come forward to clarify. Ms. Bohn said Judge Snow for the Melendres case ordered a management consultant to oversee compliance for the Sheriff’s Office. Historically this expense is the obligation of Maricopa County under Judge Snow’s orders to pay for the services of the management consultant. Supervisor Hickman said he wanted to make sure this process was understood and thanked Ms. Bohn for clarifying this ongoing court ordered obligation. 37. Supervisors'/County Manager's summary of current events - Resumen de temas de actualidad de los Supervisores/Administrador del Condado Supervisor Hickman asked Chairman Sellers to lead the public comment section. Supervisor Chucri talked about Best in Class and the two agenda items, #26 and #27, regarding the American Rescue Plan Act as good examples of Maricopa County being Best in Class. Maricopa County has been working with the local municipalities and non- profits, helping to get assistance to the businesses of Maricopa County. The County has received great comments from the non-profits and Supervisor Chucri said it is important to take notice when the County is getting it right. Supervisor Gates said he is honored to have the opportunity to speak tomorrow, October 7, 2021, alongside Chairman Sellers to the House Oversight Committee in Washington DC. He said they have been asked to talk about the elections that Maricopa County conducted, and he said he is proud to shine a light on the great job Maricopa County Elections has done. Supervisor Hickman said he went to the County Supervisors Association (CSA) meeting last month and saw Supervisor Gallardo in his role as CSA President. He thanked Supervisor Gallardo for leading by example and for the great job he has done over this past year during the pandemic. Supervisor Hickman said it was great to see the other Counties represented at the meeting and talk with CSA members. He said good luck to Chairman Sellers and Supervisor Gates as they were performing a vital role in Washington D.C. on behalf of Maricopa County. Supervisor Gallardo also said good luck to Chairman Sellers and Supervisor Gates in Washington D.C.as they deliver the Best-in-Class message from Maricopa County. Supervisor Gallardo spoke about an interview he did with Joe Dana, a news reporter from 12 News, regarding Hispanic Heritage Month. The interview profiled Daniel Ruiz, Chief of Staff to Governor Ducey. Mr. Ruiz grew up in Maryvale, graduated high school, worked for Maricopa County Recorders office and is now in the Governor’s Office. The article told the story of his rise through the system. Supervisor Gallardo said it was great to contribute in the sharing of his story. Supervisor Chucri added good luck to Chairman Sellers and Supervisor Gates in their speaking engagement in Washington. Chairman Sellers talked about the Intel Corporation groundbreaking that he had the honor of attending. He also mentioned the Greater Phoenix Economic Council meeting and was motivated by all the economic development and growth in the County that attracts jobs and talent to Maricopa County. He said thank you to Supervisor Gallardo for his leadership in CSA. Chairman Sellers closed by saying he was offended that there have been postings that suggest Chairman Sellers and Supervisor Gates are in Washington D.C. for some partisan reason and nothing could be further from the truth.
