Chairman Sellers opened the meeting and asked the Clerk to call the roll.
Supervisor Hickman introduced R.J. Cardin, Director of Parks and Recreation
Department, who offered the invocation.
2.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
RJ Cardin led the assemblage of the Pledge of Allegiance to the flag.
Following the pledge, Supervisor Hickman thanked Mr. Cardin for his contributions to
the Parks and Recreation Department for the past 14 years, helping to manage the
120,000 acres of County parks including the Maricopa Trail linking all the County parks.
The invocation reflected the love he has for the natural world. Supervisor Hickman said
this year marks the eighth year that the County recognizes “Take a Hike Day” and
encourages all to get out and enjoy the outdoors.
Mr. Cardin spoke briefly and said National Take a Hike Day originated by the American
Hiking Society in 1976. In honor of Take a Hike Day, Maricopa County is waiving the
park fee for today to encourage people to get out and enjoy the beauty of the natural
world. He added that the Maricopa Trail and the County parks trails combined covers
over 600 miles of hiking trails.
Chairman Sellers echoed Supervisor Hickman’s comments and thanked Mr. Cardin for
all the work he has done.

Monica Gery introduced Bruno, a two-year-old friendly, active dog, that knows basic
commands and said he would be a great hiking partner. Ms. Gery said Bruno was found
wearing a t shirt that said “my name is Bruno, and I broke my fence…” the telephone
number that followed was worn off. After an exhaustive search, he was put up for
adoption. His adoption fee is $25, that includes his surgery, being microchipped,
vaccinated, and a dog license. Ms. Gery said that November is Adopt a Senior Month
and all the pets six years and older have their adoption fees sponsored by the Bissell
Pet Foundation. For more information on available pets, please visit Pets.Maricopa.gov.
Chairman Sellers asked the Clerk if there were any announcements or corrections to
the agenda. The Clerk said agenda item #24 is withdrawn from the agenda.

Residential Development
Site Location: Generally located at the SWC and SEC of Broadway Rd. and 83rd Ave. in
the Phoenix area
Commission Recommendation: On 10/21/21, the Commission voted 5-0, Commissioner
Danzeisen recused, to recommend approval of Z2021031 subject to conditions ‘a’ – ‘j’:
a. Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “83rd & Broadway”, consisting of one full-size sheet, dated and stamped received on
September 10, 2021, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “83rd Avenue and Broadway Road”, consisting of 14 pages, dated and stamped
received on September 10, 2021, except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to drainage design, access and roadway
alignments. These items will be addressed as development plans progress and are
submitted to the County for further review and/or entitlement.
2. A traffic impact study must be submitted with the preliminary plat or plan of development
application.
3. Dedication of right-of-way along the following roadway alignments will be required prior to
any development on the site:
a. Broadway Road: 65 feet (ultimate half-width)
b. 83rd Avenue: 65 feet (ultimate half-width) and/or 130 feet (ultimate full width)

Note that the above widths are considered minimum widths. Additional dedication may be
required pending improvements that may be required by the MCDOT approved Traffic
Impact Study.
4. The preliminary plat application must indicate the realignment of 83rd Avenue to its section
line alignment to remove the offset at Broadway Road. Any associated right-of-way
abandonment must be performed in accordance with MCDOT requirements.
5. The applicant must notify ADOT about development through the Red Letter Process due
to proximity of the SR30 alignment and potential interchange, RedLetter@azdot.gov.
6. The applicant is advised that coordination between County Real Estate, the Bureau of
Reclamation and SRP will be required related to the irrigation facilities crossing 83rd Avenue
as part of any improvements to 83rd Avenue.
7. A Warrant Study will need to be provided in the TIA for Broadway Road and 83rd Avenue.
8. If the internal roadways are planned to be dedicated to the county, any straightaways
longer than 1000ft may need speed humps to mitigate potential speeding concerns within
the development.
9. Offsite improvements and any additional right-of-way will be determined by MCDOT Traffic
Design and MCDOT Permits based on submittal of a TIA/TIS.
10. Applicant to contact the City of Phoenix to notify them of work adjacent to their
jurisdiction.
11. All development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for construction.
12. Engineering review of planning and/or zoning cases is for conceptual design only and
does not represent final design approval nor shall it entitle applicants to future designs that
are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and
Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the
MCDOT Roadway Design Manual.
d. The following R-5 RUPD standards shall apply:

e. Three-story residential homes shall be prohibited. Revised exhibits to be submitted within
30 days of Board approval.
f. Prior to approval of the initial final plat or precise plan of development approval, the
applicant shall provide the Maricopa County Planning and Development Department with an
executed pre-annexation service agreement with the City Phoenix that identifies the detail
for when the proposed project will be annexed and the provision of water and sewer service.
In lieu of pre-annexation service agreement the developer must provide a ‘will serve’ letter
from the certificated water and sewer provider(s).
g. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
i. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation of the Zone Change. The Zone Change enhances the
value of the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change had never
been granted.
j. Development shall include a 10-foot non-vehicular multi use trail within an open space tract
along the north perimeter of the R-5 RUPD and C-2 zoned properties abutting Broadway
Road.
However, since the Commission hearing the applicant provided a revised narrative report
and zoning exhibit to address the Commission’s recommendation in condition ‘e’ for updated
documents addressing the prohibition against 3-story buildings. Staff concurs and offers the
following revisions to conditions ‘a’, ‘b’ and ‘e’ from the Commission recommendation::
a. Development of the site shall be in substantial conformance with the Zoning Exhibit

TEXT AMENDMENT – OFF-SITE ADVERTISING SIGNS (BILLBOARDS)

Request: Text Amendment to amend Chapter 2, Definitions, Section 1112.7.1, Section
1301.1.21, and Chapter 14, Articles 1403 and 1404 of the Maricopa County Zoning
Ordinance (MCZO) relating to Off-Site Advertising Signs (Billboards).
Commission Recommendation: On 9/9/21, the Commission voted 3-2-1 to recommend
approval of TA2018001 with staff recommended changes per paragraph 12 of the
Commission report.
This item was continued from the October 6, 2021 meeting. (C-44-22-353-X-00)
Chairman Sellers asked Tom Ellsworth, Director of Planning and Development, and Darren Gerard,
Planning Division Manager, to come forward for this item.
Mr. Ellsworth introduced the item which was heard by the Planning and Zoning Commission on
September 9, 2021, with a recommendation for approval that included modifications agreed upon
by the applicant. He said those text modifications were received by the Board this morning, the
Second Revised Memo dated November 17, 2021, and are included in this document below. Mr.
Ellsworth said this is an applicant driven amendment and covered the modifications included to
date. He explained the modification of the text is primarily to amend chapter 14 of the Maricopa
County Zoning Ordinance, allowing a digital medium for billboards.

Mr. Ellsworth reviewed the above slide adding the proposed modifications included modifications
to definitions in chapter 2, lighting, and illumination of billboards in chapter 11, and the Special Use
Permit process in chapter 12.
Mr. Ellsworth reviewed the above slide and talked about the existing standards and proposed
changes. The proposed changes do not affect the urban billboard regulations as much as the
billboards in rural settings. Changes/modifications will involve the distance between billboards.

The above slide covers the minimum setback requirements. Mr. Ellsworth sited the specific section
1403.3.1(b) that requires a minimum zero-foot setback, reducing variance requests.

Mr. Ellsworth reviewed the above slide and said it shows the size of signs currently and the
proposed size (the highlighted information is proposed change). The slide below illustrates the
current height measured from the grade of the adjacent travel lane. If the travel lane is elevated
above the adjacent property, the billboard cannot exceed 70 feet above the property grade and no
higher than 48 feet above the travel lane

Mr. Ellsworth said lighting was a big issue with the stakeholders. He said illuminated billboards are
currently allowed and the lumens per fixture has not changed.

Mr. Ellsworth stated currently there are two protected Scenic Corridors as seen on the left side of
the slide. The proposal would expand to include any identified Scenic Corridors be included as
named on the right side of the slide (previously allowed 660 feet of that right of way along the
Scenic Corridor).
Mr. Ellsworth reviewed the slide above regarding the Digital Medium. The current standard allows
for static billboards and the proposal would allow for Digital Medium with changes as highlighted
on the slide. The new proposal would apply to existing freeways and not to new freeways and only
within three miles of an urban area or an incorporated city or town.

Supervisor Gates asked if the 300-foot distances from a freeway will apply inside a county island.
Mr. Ellsworth said that was correct.
The additional standards on the slide above were reviewed by Mr. Ellsworth. Horizontal louvers
beyond 500 feet of residential area (limit up lighting), 500 feet or less will require vertical louvers to
screen billboard messaging from adjacent properties.
Supervisor Gates asked if the louvers are required by the City of Phoenix. Mr. Ellsworth responded
that louvers were not part of other municipalities zoning codes.
Mr. Ellsworth said that of the billboards that are currently out there, they would be “legal non-
conforming” and if there was an interest to transition to digital, it would require the applicant to go
through the Special Use Permit (SUP) process with the Board of Supervisors. This would not
include a billboard that has been established with a variance or rezone as part of an Urban Planning
and Design process.

The slide above shows a summary of the proposed changes in the various locations of billboards
around Maricopa County. The highlighted items indicate changes.
Mr. Ellsworth reviewed the above slide listing the concerns of the various stakeholders. He said
this process would be the same whether it was staff driven or stakeholder driven. Four stakeholder
meetings have taken place from 2018 to current and each concern has been addressed. He
reiterated that the concerns for dark skies was being addressed by keeping the digital billboards
with-in the urban area and the “illumination dome”.

The Planning and Zoning Commission last met on September 9, 2021, with the recommendation
to make certain modifications that are covered in the above slide.

facing lighting. The Summary slide was shown again, and Mr. Ellsworth said he would be glad to
answer any questions.
Chairman Sellers asked if there were any questions. He said the Board has taken years to get to
this point and has taken input from the industry and citizens and have heard Staff recommendation.
He said there were some speakers who were on the webinar and wanting to speak on this item.
Chairman Sellers said there would be a three-minute limit for speakers and asked the speakers to
be concise.
William Lally, Tiffany & Bosco, representing the applicant. Mr. Lally thanked the Board for their time
and said he would review just a few of the slides.

Mr. Lally said the above slide shows the timeline that began in 2018 and added that most of the
work and dialog has taken place in the last 60 days. He said the applicant worked to consider all
sides and cover all possibilities to come up with a significant zoning code for billboards to cover the
entire valley.

Mr. Lally reviewed the Amendments slide and said an aspect of this amendment will allow for Digital
Billboard conversion. Every city in the valley allows for digital billboards and so these amendments
will align with other municipalities. He emphasized the new louvered technology and mandating its
use in this application will help protect dark sky and minimize the light impact on adjacent neighbors.

Mr. Lally reviewed the above slide and said the proposed code would mandate the use of the
louvered technology. It is state of the art technology and has been proven to work and will protect
residential properties from “light trespass”.

Mr. Lally reviewed the slide above and said the proposed code changes would require the legal
non-conforming billboards use the SUP process for a conversion. He thanked everyone’s
involvement in the last four years with the hundreds of changes that moves Maricopa County
toward a leading code in Arizona.
Chairman Sellers acknowledged the applicant was given extra time to make some important points
for this case and asked the Clerk to call on the registered speakers.
Luke Edens, resident and current Vice President of the International Dark Skies Association,
Phoenix area chapter spoke in opposition. He said it is well documented that light pollution has a
detrimental effect on wildlife and human health. Sky Glow is the result of light reflected on dust and
is the main source of light pollution and would not be significantly reduced by the louvers. He
reviewed the detrimental effects of light pollution on our region and thanked the Board for their time
and offered to answer questions.
Harvey Shulman, resident, spoke in opposition. He said he wanted to make two points. One was a
procedural issue and suggested there was not a quorum when the Planning and Zoning
Commission voted. The second point had to do with the louvered technology and said in a recent
lighting case, a Phoenix Hearing Officer rejected the louvered aspect saying it directed the light
toward traffic and residential homes. Supervisor Gates asked Andrea Cummings, the Board’s Open
Meeting Law Attorney about the question of quorum from the previous speaker. She said she did
not have the details of the case and could not comment on the quorum issue.
Alison Tiffany, resident, said she was disturbed with the whole issue. The Maricopa County
Comprehensive Plan was developed by stakeholders over many years which developed 13 area
plans that did not include digital billboards. The Dark Skies communities in Arizona include

thousands of stakeholders who were not in favor of the digital billboards when the Comprehensive
Plan was developed or currently.
Ralph Jenson, resident, and astronomer, spoke on behalf of the Arizona Astronomical Consortium
and represented the professional observatories in the state of Arizona. He stated that even with
the louvered technology, billboards send light above the horizontal plane and light pollution is
scattered into the night sky. Mr. Jenson talked about how the light dome negatively impacts the
observatories in Arizona and the financial impact in funding for development which is contingent
on long term local protections. He urged opposition to the text amendment.
Claude Haynes, resident, questioned if the text of the amendment that was projected on the screen
had changed from the text as published in the agenda. Tom Ellsworth responded to the question
and said the “new” text clarified the current code with a shut off time of 11:00 p.m., information
which had been inadvertently left out. Mr. Haynes said he was concerned there were no density
limits stated and there are currently over 70 digital billboards today many of which have upward
facing lighting. He stated there are many issues that have been left out of this discussion and the
matter should return to Planning and Development for revision.
Richard Green, resident, astronomer, and Assistant Director of the Astronomy Program at
University of Arizona. He said, like his colleagues, there are major concerns about digital billboards
verses the conventional billboards that shine light on a surface. The louvered billboards produce
light pollution as it is projected above horizontal, sending light out in the night sky that effects the
large telescopes in the state of Arizona. The state of Arizona has 10% of world’s largest telescopes
including the largest telescope and this amendment runs counter to the needs of the most visible
and high-impact industries in the state.
Larry Whitesell, resident, stated he was opposed to this item in its entirety and had a presentation.
Mr. Whitesell said the applicant would like us to believe that this amendment is more restrictive
than what is currently in place. He reviewed the above slide and asked how this text amendment
would “enhance the physical appearance of the community” and stated the billboards would impact
some of the beautiful scenery on the highways.

In reviewing the above slide, he noted even small road signs can have a negative impact on the
beauty of the environment. Mr. Whitesell concluded by saying that the Board of Supervisors are
the custodians of the public assets with a job to protect those assets and this text amendment
represents a for-profit gain for the billboard companies over the interest of the public.
Neil Haddad, resident, spoke in opposition and rejected the text amendment in its entirety. Mr.
Haddad stated there are many unanswered questions regarding the long-term effects of the
decisions being made and there will be negative economic impact that light pollution will have on
the Dark Sky Communities and Astronomy. This text amendment needs to include stakeholder
input and be scrutinized by more than Planning and Development and the applicant, Becker Boards
Small, LLC. He proposed it go through a two-step quasi-judicial process to be thorough.
Dan Penton, resident, spoke in opposition. He said there is a lot of opposition from residents and
questions about the flawed notification process, many of whom found out about the hearings
through other means. Mr. Penton reviewed the timetable from 2015 to 2021 regarding this highly
controversial subject and when stakeholders learned of the hearing, there were over 700 people in
opposition who responded.
Lisa Perez, resident, echoed previous comments about lighting pollution, distraction, and how
public policy is being made. She added that public outreach has been deficient, and as one of the
largest counties in the country, Maricopa County should lead the charge when considering a
change to the Maricopa County Zoning Ordinance, not a billboard company. She said she was
disturbed that, when asked, the County does not know how many billboards are currently in use
and yet are prepared to pass a text amendment regulating them.
The Clerk stated resident, Tom Mosden registered his opposition.
The speakers in favor:
Taylor Earl spoke in favor on behalf of Clear Channel Outdoor. Mr. Earl said since the last hearing
until now, the applicant and staff have worked hard to clean up and clarify the amendment draft,
addressing all concerns. He said compromise was critical and the main difference between the

current code and the applicant’s proposed change to the code was the current code allowed 150

Brent Wood, representing Out Front Media, thanked the Board and staff for all the time and effort
that has gone into cleaning up the verbiage of this amendment. He spoke in favor of the 500-foot
separation amendment for residential.
Amy Phillips, registered in favor, did not wish to speak.
Chairman Sellers asked Mr. Lally if he would like to speak to any of the opposition. Mr. Lally said
he wanted to clarify on how the code is read. One example is standard billboards can be illuminated
from bottom up or top down and Maricopa County is very specific on how those are used. The
various municipalities may not be as specific and that may be confusing, City of Phoenix being an
example. This proposed text amendment covers up-lighting and down-lighting and follows the state
laws in place since 2012, requiring codes to be followed precisely. Conversion to louver technology
is what is being proposed and this will minimize the light spillage that occurs with standard
billboards. Nine other jurisdictions in the County have allowed digital billboards and commercial
zoning is required for billboards under this code. The SUP process in Maricopa County provides
the opportunity for the public to attend hearings and give their input. This process is much more
robust. The 500-foot separation code has been in effect for many years and today’s proposal is the
best draft that has been presented to date. This text amendment would mandate louvered
technology when billboards are located inside of 500 feet of a residential area.
Chairman Sellers asked the Clerk if the language being voted on today is current. The Clerk
deferred to staff saying that updated language was submitted. Mr. Ellsworth said the document in
front of the Board, the 2nd Revised Draft, is the up-to-date version from the industry representatives
that describe the clarifications.
Supervisor Gates said he had some previous experience on this subject having served on the
Phoenix City Council and knows it is a sensitive subject. He asked Mr. Ellsworth about the question
of quorum at the Commission meeting. Mr. Ellsworth explained that a quorum was present at the
time of the vote, as confirmed by legal counsel present at the meeting. Supervisor Gates asked if
digital billboards were allowed along rural freeways. Mr. Ellsworth said this text amendment does

not allow for billboards along rural freeways except within three miles of an incorporated city or
town. In response to Supervisor Gates’ other question regarding applicant driven text amendment,
Mr. Ellsworth replied that whether this amendment process is applicant driven or staff driven, the
Enhanced Regulatory Outreach Program (EROP) is the process that is followed.
Supervisor Gates said, as the District 3 Supervisor, he has been active on the subject of billboards
and was instrumental in restricting billboards on Piestewa Parkway. This text amendment will
prohibit billboards on Carefree Highway, I-17 north toward New River, as well as 7th Street and
New River.

(SR) Loop 101, SR Loop 202, SR Loop 303, SR 24, Northern Parkway, and U.S.
Highway 60 (U.S. 60 – Superstition Freeway). Billboards are a prohibited use on any
other freeway now existing or to be constructed within the County
SCENIC CORRIDOR:
For the purpose of the location of Off-Site Advertising Signs (Billboard(S)), scenic

SECTION 1112.7.1
1112.7.1. Bottom-Mounted Outdoor Advertising Lighting: Outdoor advertising sign
boards which exceed 301 square feet per sign face and are illuminated by an approved
bottom-mounted outdoor advertising fixture shall be equipped with an automatic device
which shuts off the fixture between midnight and sunrise. Any lawfully existing bottom
mounted upward lighting is SHALL BE permitted to remain., BUT SHALL BE
EQUIPPED WITH AN AUTOMATIC DEVICE WHICH SHUTS OFF THE FIXTURE
BETWEEN THE HOURS OF 11:00 P.M. AND SUNRISE. However, any FUTURE
alteration to said billboard SIGN OR SUPPORT STRUCTURE SHALL will require the
UPWARD lighting to be removed and replaced with downward lighting in conformance
with Article 1112.3.2. All new billboards are required to be in conformance with Article
1112.3.2.
SECTION 1301.1.21
1301.1.21. Signs for off-site advertising or for directing attention to a business,
profession, commodity, service or entertainment conducted, sold, or offered elsewhere
than upon the same premises (bBillboard(S) subject to the following:
1.
The billboard(S) is a lawfully existing structure made legal-nonconforming as
of [DATE] with regard to the requirements of Chapter 14 of this Ordinance.
a.
The billboard is located in a C-2, C-3, IND-2 or IND-3 zoning district.
b.
The billboard may be modified or converted to digital display with a
Special Use Permit.
c.
If illuminated the billboard shall be digital or lighting shall be mounted
at the top of the sign face so that it is directed downward and
shielded so that it is only illuminating the sign face in conformance
with Article 1112.3.2.

The Special Use Permit may be approved without an expiration date
or validity period.
1.2.
FOR BILLBOARDS SUBJECT TO GOVERNMENTAL ACTION;
a.
The STATIC OR DIGITAL BILLBOARD is relocated from a parcel of
property, located within the perimeter boundary of Maricopa County or
within the corporate boundary of a city or town located partially within
Maricopa County and partially within an adjacent county, that is acquired
by a public entity for public use by condemnation, purchase or dedication.

as the original BILLBOARD to be relocated.

No further variance to the C-2 standards may be granted by either the

Development Standards:

LED’s, and horizontal louvers (as well as vertical

.480” to minimize light trespass.
3.
Network time shall be made available on all digital sign
faces to federal, state, and local public safety agencies
for emergency messaging. Such messages shall
override all copy for one hour and shall then be
displayed for no fewer than eight seconds in every
minute as long as needed.
4.
Digital billboards SHALL adhere to the provisions of
Article 1401.3 of this Chapter, except that from 11:00
p.m. until sunrise all DIGITAL billboard illumination
shall be extinguished, and all DIGITAL billboards shall
be equipped with an automatic devise to assure
compliance. These illumination requirements shall not
be applicable to the display of any Amber Alert or other
governmental emergencies, or for other emergency
situations as determined by the Zoning Administrator.
Further, in the event of an electronic malfunction the
sign shall be shut off until repairs have been made to
restore the electronic messaging system.
5.
Display time shall not change-message more than
once every 8 seconds. There shall be no animation,
flashing, blinking or moving lights. In the transition
between copy changes, there shall be no sense of
movement from one image to the next.
6.
Dimmers on all digital billboards shall be set in the
evening hours (from sunset to 11:00 p.m.) not to
exceed 300 nits.
7.
The digital billboard shall have an automatic turn-off
mechanism in case of malfunction.
8.
All lawfully existing static billboards on [EFFECTIVE
DATE] that become non-conforming due to Ordinance
amendment on said date may not be modified or
converted to digital unless brought into conformance
with all requirements of this Ordinance; with the
exception, that support columns may be relocated a
maximum of 20 feet from the existing location, AND
OR
REPLACE

Supervisor Hickman commented on the importance of stakeholder and constituent
involvement and leadership experience. Supervisor Hickman made the clarification that
this zoning code revision applies to unincorporated Maricopa County not the many
jurisdictions that have been talked about during this meeting. This text amendment is
good for District 4 and good for the County. This is a case where the applicant has
spent their own time and money to work on this code update, for the last three-plus
years, adopting most if not all the changes that our staff recommended. This new code,
while allowing some existing signs on freeways to convert to digital, will put into place
new restrictions, restricting billboards and scenic corridors including in District 4: the
inclusion of the Olive Ave, the Carefree Highway, and the Castle Hot Springs corridors.
This code also requires a first in the state, state of the art, louvered technology to
mitigate any light spillage. It also requires any digital sign to be turned off at 11:00 p.m.
every night. That is a very important point that was not made. He said stargazing trips
are not at 8:00 p.m. These trips are taken in the early morning, or late at night just
because of the growth of Phoenix and all the other municipalities in that glow. He asked,
“what if everyone started turning off their lights at 11:00 p.m. Currently our code allows
lights on signs to shine into the sky all night long. The cities in my district that allows
digital billboards include Avondale, Goodyear, Glendale, Buckeye, Tolleson, El Mirage,
and now recently, Surprise. None of these cities have gone as far as this text
amendment by using light shielding technology. He said that Maricopa County is
leading the way in this space and hopes other jurisdictions adopt similar technology
and protect our dark nights and scenic corridors.
Chairman Sellers made a brief final comment stating that with all the public forums and
media coverage, he was surprised to hear people say they had not heard about this.
He added that this is an important and significant step forward for Maricopa County.

INVESTIGATION FOR THE JOINT TERRORISM TASK FORCE - FFY22
Approve the Notice of Limits for FFY22 State and Local Overtime Reimbursements and
acceptance of up to $19,372.00 in reimbursement funding from the US Department of
Justice, Federal Bureau of Investigation for officers assigned to FBI managed task forces.
The FBI Joint Terrorism Task Force agreement commenced February 27, 2007 and will
continue for an indefinite period until terminated by one or both parties. Acceptance of this
agreement was most recently approved by the Board of Supervisors on December 10, 2014
under C-19-15-017-G-00. The FFY22 reimbursement funding began retroactively October 1,
2021 and will terminate September 30, 2022.
In accordance with paragraph 3 of the agreement, the agreement allows a 0% rate for indirect
costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County for the
administration of this agreement. The County Attorney’s indirect cost rate for FY22 has been
calculated as 20.3%, or $3,933.00. The non-recoverable indirect cost of $3,933.00 will be
covered by the department general fund. This agreement is recurring, non-competitive and
does not require a match. The agreement does not require on-going cash contributions after
the period end date. This funding indirectly supports the overall mandated function of
prosecution of criminal cases.
Approval of this agreement allows for reimbursement of overtime paid to the detective
assigned to the FBI Joint Terrorism Task Force. The purpose of the agreement is to ensure
that a capability exists in Maricopa County to deter, defeat, and respond vigorously to
terrorism through the joint investigation of suspected terrorist threats and sharing of
information and intelligence. The County Attorney has cooperated with the FBI since 2005.

Approve a reduction in the County Attorney’s Office fleet and direct Equipment Services to
dispose of vehicle #76601 a 2006 GMC Envoy.
Approve the permanent addition of five previously approved one-time additions to the County
Attorney’s Office Fleet (C-19-11-035-V-00). On January 12, 2011, the Board of Supervisors
approved the one-time addition purchases of multiple vehicles used for law enforcement
investigative purposes.
Approve the acquisition of three of the five above mentioned vehicles that are ready for
replacement using funds from the County Attorney (D190) RICO fund (213).
Approve the acquisition of one vehicle from agenda item C-19-09-037-V-00 that is ready for

AMENDMENT TO AGREEMENT WITH TOWN OF QUEEN CREEK
Approve amendment #2 to the Agreement for Law Enforcement Services with the Town of
Queen Creek concerning termination. The MCSO will terminate law enforcement services
with the Town of Queen Creek at the end of the last shift on January 10, 2022.
Also approve the sale and transfer of 27 vehicles, including 2 ATVs, itemized in the
Amendment, for $1 each; the transfer of devices and equipment; and credits to the town for
devices and equipment that will be retained by the Sheriff’s Office. Credits are limited to
items reimbursed by the Town when there were contractual increases in service. The value
of the credits for 21 radio units is $35,403. The value of credits for various non-capital
employee specific/employee-assigned devices and items such as tasers, body cameras, i-
phones, weapons, and body armor to be retained by MCSO is $22,273. Credits will be
applied to the final invoice for Law Enforcement Service to be issued by January 31, 2022.
Also approve in accordance with A.R.S. 42‐17106(B) the following amendment to the FY
2022 Annual Budget:
1. Increase the FY 2022 revenue and expenditure authority for the Sheriff (D500) General
Fund (100) Non-Recurring (NRNP) budget by $187,121.
2. Decrease the FY 2022 expenditure authority for the Non-Departmental (D470) General
Fund (100) Non-Recurring (NRNP) Contingency (4711) in the line “Revenue and
Expenditure Contingency” by $187,121.
3. Decrease the FY 2022 revenue authority for the Non-Departmental (D470) General Fund

US IMMIGRATION AND CUSTOMS ENFORCEMENT FUNDING FOR OVERTIME IN
RELATION TO JOINT OPERATION EXPENSES
Approve for FY22, acceptance of up to $30,000 in reimbursement funding from US
Immigration and Customs Enforcement Treasury Forfeiture Fund for officers assigned to the
Joint Operation. The US Immigration and Customs Enforcement agreement commenced
February 29, 2008 and will continue for an indefinite period until terminated by one or both
parties. Acceptance of this agreement was approved by the Board of Supervisors on
February 20, 2008 under C-50-08-546-2-00. The FY22 reimbursement funding began
retroactively October 1, 2021 and will terminate September 30, 2022.
The Sheriff’s Office indirect cost rate for FY22 is 14.74%. Unrecoverable indirect costs have
been calculated as up to $4,422. The unrecoverable indirect cost of up to $4,422 will be

covered by the department General Fund. This agreement is recurring, non-competitive and

MOU WITH ARIZONA DEPARTMENT OF PUBLIC SAFETY FOR RAPID DNA SITE
Approve a Memorandum of Understanding (MOU) between Arizona Department of Public
Safety and Maricopa County by and through Maricopa County Sheriff’s Office (MCSO) for
MCSO’s participation in the Arizona Law Enforcement Rapid DNA Program as a partner site.
This MOU establishes responsibilities and functions of the parties. This is a non-financial
MOU and is effective upon the last date of signature on the last page of the MOU. The term
is one year from the last date of signature with automatic renewal for one-year terms every
year for a total of five (5) successive years, not including the initial term, with the provision
that MCSO must successfully complete an annual audit by AZDPS Rapid DNA Program
Manager and remedy any findings within a 30-day period. Either party may terminate the

Sheriff’s Office and Grand Canyon University (GCU) for detention booking and housing. This
Agreement is retroactive to July 1, 2020, and becomes effective as of the date of the last
signature and will remain in effect through June 30, 2030, unless terminated by either party,
for any reason, by providing not less than five business days’ written notice. GCU will pay
rates established by the County and posted at the County Department of Finance website
for the applicable fiscal year. The initial agreement with GCU for these services was

Authorize the permanent addition of five positions that were originally established for the
Sheriff’s Office (MCSO) Law Enforcement Contract Services operations in Queen Creek
which is terminating effective January 11, 2022. These five positions were budgeted through
December 31, 2021 and need to be retained for reassignment in the MCSO’s re-organized
Investigations Bureau. The positions are required to maintain operational effectiveness and
include one Law Enforcement Captain position (PCN 66602), two Law Enforcement
Lieutenant positions (PCN’s 65777 and 78703), one Criminal Intelligence position (PCN
70231) and one Admin/Ops Specialist (PCN 76501).

NEW HOPE AGREEMENT WITH K9S FOR WARRIORS, INC.
Approve an agreement between K9s for Warriors, Inc. and Maricopa County, administered
by Maricopa County Animal Care and Control, to allow said rescue to transfer animals that
have been deemed eligible for the New Hope program. Maricopa County will provide a rabies
vaccination, dog license tag, and new owner transfer fee within the first year of transfer for
each dog three months of age or older at no cost to the Contractor. The cost for these
services is $52 for each animal transferred in FY 2021 and thereafter. Animal Care and
Control estimates two hundred (200) New Hope transfers over the term of the agreement for
a total of $10,400. The term of this agreement shall commence upon approval and execution

WAIVER TO DONATION POLICY A2508 FOR ANIMAL CARE AND CONTROL
Approve a waiver for the Animal Care and Control Department (790) to section IV.B. of
Maricopa County Internal Policy A2508 - Receiving Donations, requiring monthly reporting
of donated funds to the Board of Supervisors for FY 2021-22.
On September 15, 2021, Animal Care and Control was approved by the Board of Supervisors
to create a budgeted Animal Care Donations Fund (575) to allow further transparency
recognizing and accounting for materiality of in-kind donations, and the use of restricted and
unrestricted funds donated by citizens and groups, for the benefit of Community and Shelter
cats and dogs.
The Animal Care and Control maintains segregated fund (575) approved annually by the
Board during the budget cycle and requests a waiver to the monthly reporting policy under
A2508 section IV.C.
Per policy A2508, section IV.C. “Any Department that maintains a budgeted Donation fund
may request an annual waiver to this policy utilizing the Board of Supervisors agenda
process.” Animal Care and Control Department maintains the Animal Care Donations Fund
(575), strictly for the receipt of funds gifted to Animal Care and Control.
Public donations are used to support a variety of programs and services such as providing
supplies or equipment to the shelter to support shelter pets, underwriting of public adoptions
or return to owner fees, including microchips, adoption events, and other public outreach
activities.
Approval of the waiver will allow annual reporting which will include the date of the donation,
the donor name, a description of the time, the value and whether the donation was restricted
or non-restricted, as outlined in Attachment A of the policy. By August 1, 2022, Animal Care
and Control will provide an annual report of all donations accepted during FY 2021-22 to the
Board of Supervisors, the Clerk of the Board, Internal Audit and OMB. (C-79-22-028-X-00)

ASPCA TRANSPORT PROGRAM GRANT CARRY-OVER AND BUDGET
ADJUSTMENT
In accordance with A.R.S. §42-17106(B), authorize the increase of expenditure authority in
the FY 2022 Animal Care and Control (D790) Animal Care and Control Grant Fund (573)
Non-Recurring Non-Project (NRNP) by $20,730.
Grant funds from the American Society for the Prevention of Cruelty to Animals (ASPCA)
was previously awarded/approved in FY 2020 in the amount of $60,000 to support the
relocation of animals to collaborating shelters with available space and a community need
for adoptable pets. Due to relocation challenges during the Covid-19 Pandemic and the
recent Distemper outbreak, animal relocations between shelters have been difficult and
delayed. The one-time expenditure adjustment will allow Animal Care and Control to spend
the remaining grant fund balance in FY 2022.
The grant allows a 0% rate or $0 for indirect costs to administer this grant. The Maricopa
County Department of Finance has calculated the Fiscal Year 2022 indirect rate at 14.30%.

Total grant indirect costs on this carry-over are estimated to be $2,964.00 and are not
recoverable. Costs will be absorbed into the Animal Care and Control Fund 572 Operating
Budget.
The grant award was a one-time, non-recurring funding opportunity. Grant funds are
provided using the advance funding method where funding is received in advance of actual
expenditures. The grant award does not require a cash contribution, nor an in-kind
contribution, and there are no future or ongoing contributions required following the grant
period. The grant award does provide funding for a mandated service, which is to provide
adequate care of animals that are sheltered with the Animal Care and Control Department.
This grant was competitively bid.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The
approval of this action does not alter the budget constraining the expenditures of local

APPROPRIATION ADJUSTMENT FOR GRANT FUNDING FROM ARIZONA
DEPARTMENT OF HOMELAND SECURITY
Approve and authorize the Elections Department for the application of the Homeland
Security Grant Program Award administered by the Arizona Department of Homeland
Security (AZDOHS) and authorize the Chairman to approve the receipt of any and all such
funds awarded.
In accordance with A.R.S.42-17106(B), approve a revenue and expenditure appropriation
adjustment increasing the FY 2022 Elections Department (210) Elections Grant Fund (248)
Non-Recurring/Non-Project (NRNP) in the amount of $132,000. Grant revenues are not local
revenues for the purpose of the constitutional expenditure limitation, and therefore,
expenditure of the funds is not prohibited by the budget law. This budget adjustment does
not alter the budget constraining the expenditure of local revenues duly adopted by the Board
pursuant to A.R.S. §42-17105.
The program will support the continued hardening of Maricopa County’s critical election
equipment and data infrastructure. The acquisition of hardware, software, and critical
services will harden security for both hard and cyber targets. The request represents the
Office's efforts to continue to strengthen elections infrastructure and the mitigation and/or
elimination of any security gaps identified during the 2020 election cycle and subsequent
audits. Elections remain the cornerstone of American democracy and funding from the

AZDOHS Homeland Security Grant Program will aid in the department’s mandate to provide
fair, safe, and secure elections.
The total amount of funds requested is $132,000. The grant period will cover the periods
October 1st, 2021 through September 30th, 2022. The grant does not allow for indirect costs
for which the County is eligible. The Maricopa County Elections Department composite
indirect cost rate for FY 22 is 69.66% or $91,951.20. The recoverable indirect cost of
administering this grant is $0; the non-recoverable indirect cost is $91,951.20. Non-
recoverable indirect costs will be covered by the departmental general fund budget. This
grant is competitive and does not require a match or on-going cash contributions after the
grant period end date. The grant award is nonrecurring and has not been awarded to the
department in past years.
Maricopa County and the Elections Department are eligible to apply for and receive grant
funding through various state agencies. Maricopa County must apply for these funds and the

Approve an increase to the FY 2022 transfer of funds from the General Fund to the Detention
Fund for the Jail Excise Maintenance of Effort Above Base Transfer Out in the amount of
$411,554.
Pursuant to A.R.S. §42‐17106(B), approve the following transfer of expenditure authority in
the FY 2022 Budget for market adjustments impacts beginning 11/15/2021.
1. Increase the FY 2022 General Fund (100) expenditure budgets by the amount indicated
for the departments and appropriation unit groups listed by market range title on the attached
schedule in the total amount of $977,639.
2. Increase the FY 2022 Detention Fund (255) expenditure budgets by the amount indicated

ACCEPTANCE AND USE OF GIFT CARDS FOR THE TUBERCULOSIS CONTROL
INCENTIVE ROGRAM
Approve the acceptance and use of gift cards provided by Arizona Department of Health
Services (ADHS), to Maricopa County by and through its Department of Public Health
(MCDPH), Tuberculosis Control Program. The MCDPH TB Clinic has received a donation
of 400 cards, including 200 Bashas’ and 200 Chevron, at $10 each for a total value of $4,000.
Gift card and voucher donations have been received by the TB program for several years.
We expect them to continue. Cash and/or in-kind match is not applicable, nor will ongoing
cash contributions be required should they cease to be provided. TB Services are a
mandated function and donations such as these incentivize the treatment program.
Awareness and treatment of TB patients is a benefit to our citizens. To our knowledge, the
donations to the TB program are not given in a competitive manner. Program costs
associated with the donations are absorbed by the TB programs grant budget. Administration
costs are absorbed the department’s operating budget.
MCDPH’s indirect rate for FY21 is 17.97%. This in-kind donation does not allow for indirect,

Approve a Public Health Contract #PH NOI 21021, between Maricopa County (County), a
political subdivision of the State of Arizona, through its Department of Public Health
(MCDPH) and Unlimited Potential (“Contractor”) for services related to advancing health
literacy to advance equitable community responses to COVID-19. The term of the contract
is two (2) years, beginning on July 1, 2021 and ending June 30, 2023. The cost of the
services is in a not to exceed amount of $149,325 for each year for a combined term total of
$298,650. The County may, at its option and with the agreement of the Contractor, renew
the term of this Contract for additional terms up to a maximum of three (3) additional years,

FOR MIECHV, HOME VISITATION PROGRAM
Approve Purchase Order (PO) PO371937 for Inter-Governmental Agreement (IGA) Contract
No. (ADHS17-155910, Nurse Family Partnership (NFP) for MIECHV, between the Arizona
Department of Health Services (ADHS) and Maricopa County through its Department of
Public Health (MCDPH) to provide additional funding for the NFP, Maternal, Infant, and Early
Childhood Home Visiting (MIECHV). The additional amount is $815,761.50, bringing the total
not to exceed amount from $1,631,523 to $2,447,284.50, for the IGA term of October 1, 2017
through March 31, 2022. The Contract term is modified to read May 1, 2017 through March
31, 2022.
The NFP MIECHV IGA award is reoccurring and has been awarded to the department for
many years. This grant does not require an in-kind match, indirect cost is fully recoverable
and ongoing cash contributions are not required. The IGA award is not a mandated function
but provides a benefit to the citizens of Maricopa County by providing evidence-based home
visiting models to communities identified to be at risk. The award is competitive.
MCDPH indirect rate for FY22 is 17.97%. The pass thru amount to sub-recipient Southwest
Human Development is not subject to indirect and is in the amount of $249,615.50. Indirect
cost on the eligible amount of $566,146 at 17.97 is $86,239 is recoverable. Program costs
not covered by the grant will be subsidized by the MCDPH indirect cost pool. Departmental
indirect rates are re-established at the beginning of each fiscal year and the future indirect
rates will be collected at the corresponding rates.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law.
This Amendment does not alter the budget constraining expenditures of local revenues duly
adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted
as necessary to accommodate this grant through a future reconciliation. Funding for this

The software applications provided by Bentley Systems, Inc. are only available for purchase
with Bentley Systems, Inc. All upgrades, improvements, enhancements and Bentley LEARN
educational materials are provided directly by Bentley Systems to MCDOT. The licensing
agreement renewal is provided directly with Bentley Systems and cannot be provided by a
secondary or alternate vendor. Some advantages include local seminars, users groups and
training programs provided under the agreement.
Annual LS Fees:
The LS Fee for 1 Year of the Term (December 1, 2021 through November 30, 2022) shall

VALLEY ROAD PROJECT
Request approval of the attached single source Competition Impracticable and the
associated contract modification with Aztec Engineering for completion of the project
documents and post-design services for the Maricopa County Department of Transportation
TT0248 Deer Valley Road project.
This project will construct a bridge over the Agua Fria River to connect Williams Drive on the
west to Deer Valley Road on the east, improving the street network, and widening the road
to provide two lanes in each direction with center turn-lane, in partnership with the City of
Peoria. The change order covers additional drainage design including coordination with
adjacent development, and post-design services. The scope of the post-design activities
has expanded to include additional responses to requests for information and developer
coordination.

Approve a three-year extension of the Intergovernmental Agreement (Agreement) between
Maricopa County (MCDOT) and the Arizona Board of Regents, for and on behalf of Arizona
State University (ASU), to provide Research-Oriented Traffic and Intelligent Transportation
Systems (ITS) Development Studies.
This Agreement acts as a master document, under which project-specific Task Orders will
be later approved by the partners upon their respective funding receipt and acceptance. This
Agreement will support all funding sources.
There is no fiscal impact at this time for this Agreement, as grants/federal funds are yet to
be determined. As they come up, individual agenda items will be submitted for approval by
the Board of Supervisors for the application, (if needed), acceptance and expenditures of
such funds. Task Orders will then be expedited to better address ITS projects as they come
up.

that cross jurisdictional boundaries.
The Agreement provides the opportunity to focus on specific maintenance tasks or
emergency highway projects and the availability of the most economical resources by
extending beyond jurisdictional or geographical boundaries. The Agreement's application will
benefit areas in the County and the Town where the other Party could complete specific
types of routine maintenance or emergency highway project activities based on scheduled
work within the area. Individual tasks performed by either Party will be executed upon
completing a Letter of Agreement (LOA) approved and signed by the County Department of

designated to the city of Phoenix for distribution to other entities based upon transit needs in
the region. Maricopa County is responsible for accessibility to transit stops on roads owned
and operated by MCDOT. This one-time pass-thru grant is designated to provide ADA
facilities to two transit stop locations.

Under this Intergovernmental Agreement, the Board of Supervisors will authorize the
Maricopa County Director of Transportation, or her designee, to accept federal grant funds
for $140,000, as a pass-through from the City of Phoenix Public Transit Department.
Lower Buckeye Road from 125th Avenue to El Mirage Road is a Maricopa County
maintained road in an unincorporated strip of land bordered by the City of Avondale on the
north, south, and east. There are two bus stops in this segment serving the Avondale Zoom
through the Valley Metro Regional Public Transportation Authority and are identified in the
MCDOT ADA Transition Plan. The County will improve the segment by adding sidewalk,
curb and gutter, and ADA ramps to meet the 2010 ADA Accessibility Standards. The
Americans with Disabilities Act of 1990 requires accessible routes to all public facilities. This
grant provides funding to install sidewalks to two transit stops along Lower Buckeye Road
that are identified in the MCDOT ADA Transition Plan.
The County will lead the efforts to design and construct the sidewalk, curb, and gutter. The
total amount of the improvements is $175,000. The County will be financially responsible for
$35,000 of the local match of the 5307 Grant funds budgeted in FY2022 Transportation
Department (640) Transportation Capital Project Fund (234) Five Year Program in the
Transportation System Management Project, sub-project TT0700. The grant will fund the
remaining $140,000.
This was non-competitive bid process. The transit stops are located within MCDOT rights of
way and any and all improvements are the sole responsibility of MCDOT. Work will be done
utilizing a Jobs on Contract agency which was established through a competitive process.
Indirect costs are not refundable. Any indirect cost will be funded through the Transportation
Improvement Program, TMAN bin. There are no ongoing contributions related to the grant.
Routine sidewalk maintenance will be performed as part of regular roadway maintenance
and covered by the Operation Budget.
Grant revenues are not local revenues for the constitutional expenditure limitation, and
therefore, expenditure of the funds is not prohibited by the budget law. The approval of this
requested action does not alter the budget constraining the expenditures of local revenues
duly adopted by the Board pursuant to A.R.S. Section 42-17105.
The terms of the agreement are in effect as of the Board of Supervisors' approval and shall
remain in full force and effect until all stipulations have been satisfied, except that it may be
amended upon written agreement by all parties.

MANAGEMENT PROGRAM
Authorize the Maricopa County Department of Transportation (MCDOT) to accept federal
funding reimbursements and expend the grant funds for the Department of Transportation:
Transportation System Management Project, sub-project TE064 Regional Archived Data
System (RADS) Upgrades and Data Management Program.
Estimated cost of the project is $354,200. Federal Highway Administration (FHWA) has
authorized $334,011 in federal reimbursement funds which are available in FY 2021-22.

MCDOT’s local match portion is $20,189 and will be absorbed by the department operating
budget from Operation funds.
The grant awarded is a one-time award. There are no future or ongoing contributions
required after the grant period ends. The grant fulfills a mandated service that the department
is required to perform. The grant award is a competitively bid and other eligible agencies
may or may not bid on this grant award.
The County’s FY 2020 indirect cost rate is 14.84%. All costs under this agreement are for
capital expenditures which are not subject to indirect cost recovery.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This
budget adjustment does not alter the budget constraining the expenditure of local revenues

Approve revisions to the Limited English Proficiency Policy A1112 effective November 17,
2021. This policy provides for Spanish language assistance at formal Board of Supervisors
meetings to persons with limited English language proficiency. These revisions update
instructions and policy language for consistency with the current policy format.
This Policy applies to all employees of Maricopa County elected offices and appointed
departments as well as the Flood Control District of Maricopa County and the Maricopa
County Library District (Special Districts). The Board of Supervisors is authorized to jointly
adopt policies applying to the Special Districts under the Intergovernmental Agreement, C-

Supervisor Gates said Happy Thanksgiving to all the County employees who have been
through so much this past year. He added that there are 22 applicants for District 2
vacancy, and he is looking forward to the process of adding a colleague to the Board.
Chairman Sellers wished everyone a Happy Thanksgiving. He added that he is pleased
to be able to recently work on transportation infrastructure goals and is hopeful that
funding for Arizona is coming. Chairman Sellers said he enjoyed spending time with
Recorder Richer to give a tour of Maricopa County Tabulation and Election Center
(MCTEC) for representatives Osborne and John. He said he appreciated the Elections
team being available to showcase the facility and answer questions.

CASITAS BONITAS SANITATION SEWER IMPROVEMENT DISTRICT
It is recommended by the Superintendent of Streets that the Board of Supervisors approve
the agreement with Liberty Utilities Corporation to provide operations, maintenance, and
management services to the existing Improvement District.
The current management company for Casitas Bonitas Sanitary Sewer Improvement District,
First National Management, is going out of business and a new management company is
needed. The District’s purpose is to operate and maintain the existing sanitary sewer
facilities serving the area and to bill and collect from residential customers on a monthly
basis. Liberty Utilities Corporation will assume those duties in accordance with the terms of
the agreement.
(The district is in the vicinity of Dysart Road and Maryland Avenue. Supervisor District No.

ON-CALL CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES
Award Contract FCD 2021C022 On-Call Construction Management and Inspection Services
to HDR Construction Control Corp., in order to provide On-call Construction Management
and Inspection Services for the District’s various construction projects. The Contract will be
effective for 730 calendar days from the date of execution or the expenditure of $3,000,000,
whichever comes first. As an option, the Contract may be extended by change order for an
additional period up to 1,095 calendar days, or expenditure of the remaining funds,
whichever comes first.
The Flood Control District of Maricopa Country (District) and HDR Construction Control
Corp., will mutually agree to a detailed scope of work for each work assignment. This is a
qualifications-based selection in accordance with the Maricopa County Procurement Code,
Article 5, Paragraph 504 and Article 5 Procurement Procedures Manual, Chapter II – Section
2.

IGA WITH THE UNITED STATES GEOLOGICAL SURVEY AND THE FCD FOR WATER
RESOURCES INVESTIGATIONS
Approve Intergovernmental Agreement (IGA) FCD 2021A010, between the United States
Geological Survey [Agreement #22ZFJFA00079400 (USGS)] and the Flood Control District
of Maricopa County (District), for the period of October 1, 2021 to September 30, 2022, for
collection of stream flow data on local watersheds throughout Maricopa County. The total
cost of the IGA is $387,340. The District’s costs under this agreement will be $242,990, with
the USGS contributing the remaining $144,350. Payments from the District are to be made
quarterly.
The agreement covers costs associated with the maintenance, collection, and publication of
stream flow data and river reach characteristics at nine continuous stream flow monitoring
stations and 22 peak flow monitoring sites throughout Maricopa County. This agreement
further will develop and evaluate long term flood histories on watercourses in Maricopa
County, and provide information critical to the determination of the risk of flooding in these
watercourses. The information generated by the USGS’s ongoing work is vital to the safety
of Maricopa County residents, and to the continuing hydrologic studies performed by the
District.
