General Location: The proposed Project is located northwest of Saddle Mountain, east of Granite
Mountain, and northeast of the Eagle Tail Mountains in Sections 5, 6, and 7 Township 1 North, Range
8 West. The site is approximately 20 miles west of the City of Buckeye, Arizona in unincorporated

1. PURPOSE OF REQUEST
HV Sunrise, LLC, (“Applicant”) on behalf of the property owners, Kawala One, LLC and CV Harquahala,
LLC, request approvals of a Zone Change with Overlay (rezone) from RU-43 to IND-2 IUPD Zone for
the Harquahala Sun Photovoltaic Solar Energy Generation and Storage Project (Project) on
approximately ±1,142.14 net acres. The Project will implement the approved Comprehensive Plan
Amendment (CPA) of underlying properties from Rural Development Areas to Utilities (Case #
CPA2021007) to construct and operate a 150-MWac hybrid solar photovoltaic (PV) and battery power
plant and associated infrastructure.
2. DESCRIPTION OF PROPOSAL
3.1 Site Summary Information:
The ±1,142.14 net acres included are inclusive of the following nine (9) underlying parcels: 506-29-001,
506-29-002, 506-29-004, 506-29-006B, 506-29-022A, 506-29-022B, 506-29-023C, 506-29-023D, &
506-29-023E. The Project will include approximately 400,000 solar modules mounted on single axis
trackers, inverters to convert direct current into alternating current, transformers to increase the voltage
of the electricity generated, a 500 kV utility substation, battery energy storage system, and one or more
small buildings to house telecommunication equipment. The Project will interconnect to the
transmission grid at the Arizona Public Service (APS) Delaney Substation. On-site overhead electrical
structures be a 140-foot maximum.
Off-site supporting improvements, infrastructure, and/or uses include a 200-foot wide gen-tie route
corridor that extends approximately 4 miles through a combination of private land, land owned by Flood
Control District of Maricopa County (FCDMC), Maricopa County Department of Transportation
(MCDOT), Arizona State Land Department (ASLD), and land administered by the Bureau of Land
Management (BLM). Offsite improvements will be approved via separate applications with supporting
site plan exhibits through MCDOT, FCDMC, ASLD, and BLM.
3.2 Proposed Uses (Summary):
Hours/Days of Operation:
The site will be in operation and/or production 24 hours a day, seven (7) days per week. Solar
generation activities would be limited to daytime (daylight) hours which will vary seasonally but would
generally range from around 5:00 AM to 9:00 PM during summer months when daylight hours are
longest. Energy storge activities and operations will be continuous and energy transmission into the
power grid will occur on demand as needed throughout the daytime and nighttime hours.
Number of Employees:
Construction activities are anticipated to employ up to 240 workers in varying phases in the
construction, contracting, administrative, and Project management fields during the construction and
implementation phase.

Operation of the site will not require full-time employees on site. Routine maintenance activities will
require up to 15 part-time or seasonal employees and up to 20 employees for equipment repair and
replacement as needed.
Description/Location of Buildings:
Electrical and telecommunication equipment may be contained within housing units or cabinets that are
a manufactured protective outer covering for the internal equipment. No permanent habitable buildings
are proposed which will be occupied by employees. Self-enclosed units include small
telecommunications equipment cabinets and Battery Energy Storage System (BESS) equipment
cabinets/shelters. BESS cabinets/shelters located in the northeast portion of the site near the BESS
system components. BESS components will be housed in pre-fabricated steel containers located within
the identified BESS area in the northeast section of the site as depicted on the POD. Smaller
communication and electrical equipment is located among the PV array fields as depicted on the POD.
Color Palette:
All materials coatings, finishes, and colors, where practicable, will be selected to blend facility
components to the natural setting. Selection of color palettes for electrical cabinets and PV solar
equipment will be selected from factory specifications and options provided by the respective
manufacturers. Color palette selection will conform to generally accepted and adopted industry
standards for PV solar equipment and support structures. Final color selections will seek to minimize
heat absorption and glare and blend with surrounding natural environment so far as is practicable.
Sign Details:
Signage will be limited to site identification signs, OSHA approved safety signage, and security signage
in accordance with Chapter 14 of the Maricopa County Zoning Ordinance.
Screening Wall/Fence Details and Location:
As discussed below, the property is surrounded mostly by vacant and agricultural lands along with the
Rose View Estates subdivision to the east. This is a development (244 lots) that was platted in the
1960’s that remains almost 90% vacant with one adjacent active residential property.
To ensure proper site security, related to these surrounding uses, the site perimeter will be enclosed
with chain link fence (6 feet in height) with gates where needed along the perimeter of the project.
Fencing section elevation details have been provided on the POD which depict typical fencing types
and proposed opaque screening. One (1) foot of barbed wire strands will be incorporated atop 6-foot
fencing for additional security. Barbed wire will not be placed on perimeter fencing adjacent to
residential zoned properties.
Enhanced screening will be provided against the eastern site boundary at N. 483rd Ave which separates
the site from the residential Rose View Estates development. Screening against this boundary will
include opaque screening in the form of vinyl slats to create visual opacity to screen the internal facility
components and operations from public roadways and adjacent residential views. Proposed opaque
fencing may be combined with berming to enhance mitigation of visual impacts.

Enhanced screening will be provided around the BESS and Substation to mitigate visual impacts to
surrounding views.
Security Lighting
Security lighting will be limited to motion activated lighting associated with the BESS and Substation
and other security sensitive areas such as entry gates, and parking areas, as shown on the Plan of
Development. All lighting installed will be directed downward and into the site, in compliance with
Maricopa County Zoning Ordinance Article 1112, to ensure lighting will not be cast onto neighboring
properties. Lighting required for safety operations during nighttime operational or maintenance activities
will be provided by the associated staff/employee personnel.

The surrounding area has limited and sparsely distributed residential land uses. The Rose View Estates
(RVE) and Rose View Estates Unit 2 (RVE2) subdivisions, platted in 1964, are located east of 483rd
Avenue which forms the eastern edge (3,636.14 feet/0.647 miles) of the proposed solar Project area.
These subdivisions contain 244 platted lots zoned RU-43 (173 lots), R-5 (65 lots), and C-3 (6 lots).
Currently, there is only one active residential property adjacent to the perimeter boundary. Beyond that,
three residences are located within 500 feet of the development boundary, eleven residences are
located within 501 to 1000 feet of the proposed solar development within the R-5 zone and the
remaining thirteen residences are located greater than 1,000 feet from the Project’s eastern boundary.
Additionally, 43 of the 244 lots (17.6%) are owned by the Flood Control District of Maricopa County.
Overall, since its approval, the subdivision is still almost 90% vacant with only 28 lots developed for
residential use
The rest of the surrounding area is characterized by active and passive agricultural land uses, Bureau
of Land Management (BLM) and Arizona State Land Department (ASLD) owned and managed lands,
natural gas-powered electric generation facilities, solar powered electric generation facilities, and native
desert lands. The predominant surrounding private land uses within the area is Utilities as designated
by approved Comprehensive Plan Amendments which have changed the underlying future land uses
from Rural Development Area to Utilities.
The proposed Zone Change with Overlay and Plan of Development is consistent with similar approved
and implemented solar projects within an approximately 4-mile radius of the Project site. Associated
facilities within this radius include approved CPA’s for Utility (solar) land uses, PV solar generation
facilities, utility corridors, transmission lines and a utility substation.

4. LOCATION AND ACCESSIBILITY
Location:
The proposed Project is located northwest of Saddle Mountain, east of Granite Mountain, and northeast
of the Eagle Tail Mountains in Section 6, Township 1 North, Range 8 West, and Section 5, Township 1
North, Range 8 West. The site is approximately 20 miles west of the City of Buckeye, Arizona in
unincorporated Maricopa County, Arizona with parcels lying southwest and southeast of the

intersections of N. 491st Ave and W. Courthouse Road. The Project area is bound on the north by W.
Courthouse Road and on the south by an unimproved segment of Van Buren Street right-of-way (ROW)
located at the west line of the east one-half of Section 6, Township 1 North, Range 8 West.
Access:
x The Project is located south of Interstate 10 (I-10), approximately 30 miles west of the State Route
85 (SR 85) connection to I-10.
x Regional access to the site will be from I-10 to Harquahala Valley Road southward to Courthouse
Road easterly to the site. Alternatively, Salome Highway southeasterly from I-10 to Courthouse road
westerly to the site. Access to 491st Avenue may be achieved from Courthouse Road easterly from
Harquahala Valley Road or westerly the intersection of Courthouse Road and Salome Highway.
x Access to the site will be established by the five (5) full-access driveways shown in the illustration
below. Two of the driveways will be located on Courthouse Road (Driveway A, just east of 499th
Avenue and Driveway B, just east of 487th Avenue) and the other three (3) driveways on 491st
Avenue south of Courthouse Road (Driveway C & Driveway E) on the west side of 491st Avenue
and Driveway D, on the east side).
x Maricopa County Department of Transportation (MCDOT) requires that driveways be spaced a
minimum of 250 feet from adjacent intersections on major collector roadways. As currently planned
Driveway A is approximately 0.15-miles from 499th Avenue, Driveway B is approximately 0.10-miles
from 487th Avenue, and Driveways C and D are approximately 0.5-miles from Courthouse Road.
Driveway E is located approximately 1.16 miles from Courthouse Road.

5. CIRCULATION SYSTEM
Off-site Circulation (Access)
The roadway network serving the proposed Project from the I-10 corridor includes the I-10/Salome
Highway interchange that connects Salome Hwy to Harquahala Valley Rd and 491st Ave southerly to
W. Courthouse Rd. The site can be accessed from the I-10/ Salome Highway interchange. Salome
Highway provides connections to both Harquahala Valley Road and 491st Ave which both extend
southerly to W. Courthouse Road. Primary access to the site is from the adjacent W. Courthouse Road
on the northern site boundary and 491st Ave that intersects W. Courthouse Road and extends southerly
into the overall development area. There are several smaller, existing roads, both named and unnamed,
that traverse the Project site, which are anticipated to be used and improved for construction and
ongoing operations of the Project. Site access will be identified with the Zone Change with Overlay and
Plan of Development. Final access locations will be determined in accordance with access
management policies and permitting requirements of Maricopa County.
Properties within the Project area are located along the southern ROW of W. Courthouse Road at the
southwest intersections of W. Courthouse Road and 483rd, 487th, and 491st Aves. Van Buren Street on
the southern boundary is an existing unimproved agricultural road (within existing County ROW). There
are currently no identified public or private plans to make public improvements to Van Buren Street.
The Maricopa County Department of Transportation has required ROW dedication or preservation of
the section and mid-section line ROW alignments adjacent to and through the site that include:

The Zone Change with Overlay and Plan of Development identify required half ROW dedications for
Courthouse Road on the northern property boundary and Van Buren Street on the southern property
boundary. Half dedication is identified for the 483rd Avenue and 499th Avenue ROW are provided. 487th
and 495th Avenues are unplatted and unimproved roads within half-section line reservations.
Potential additional section line alignments and/or extensions of unimproved segments will require 55’
and 40’ half width right-of-way dedications, per the Maricopa County Zoning Ordinance Section 1105,
unless otherwise reduced or deemed unnecessary in coordination with MCDOT.
Final dedication, preservation, alignments, terminations, and vacations of unneeded ROW will be
determined in negotiation with MCDOT.
On-site Circulation
Internal circulation is planned via a network of private maintenance and service drive aisles to provide
vehicular access to the solar arrays, associated equipment, and BESS and substation facilities. All
driveway aprons (as specified by MCDOT), shall be paved with a minimum asphalt millings bound with
a liquid binding emulsifier, or comparable, with the remainder of the typical 20’ internal drives being
compacted decomposed granite (DG), or similar road base material to minimize imperviousness and
stormwater runoff, as proposed with an approved dust control permit from Maricopa County Air Quality
Control. Construction and maintenance of the drives will conform to applicable requirements of the
Maricopa County Air Quality Control Department
Parking and Loading
With no occupied buildings or full-time employees on-site, there is no proposed formal parking spaces
or ada spaces. During operations maintenance parking, loading, and temporary maintenance staging
will occur within an ±190 by 478-foot (±1.98-Acre) area within the substation/BESS Yard area. Loading
during maintenance activities in the solar field will occur on private 20-foot (typical) all weather surfaced
roads among the solar arrays and BESS Yard as shown on the Plan of Development.
6. DEVELOPMENT SCHEDULE
A power purchase agreement (PPA) has been executed with an Arizona corporate entity for energy
from Harquahala Sun. The Project is scheduled to deliver energy in 2023. The Applicant has a Facility
Study with APS to interconnect the Generation Facility to APS’s 500-kV Delaney Switchyard. The final
execution of the Generator Interconnection Agreement is anticipated to occur in March 2022.
Construction is anticipated to begin in Q4 2022.

Engineering Review has reviewed the first plan and report routed for review on
1/17/2022, for the subject application and has no objections subject to the following
conditions:
1. At the time of application for building permits, the plans or a drainage exhibit
must identify (quantity) offsite flows entering the site,
2. At the time of application for building permits, retention basin design for basins
located in a floodplain must be revised to provide excavated basins.
3. Retention basin volumes must be sized for the 100 year, 2 hour storm event.
Retention basins must drain within 36 hours.
4. At the time of application for building permits, the weighted runoff coefficient to
size retention basins must be verified and be based on C=0.95 for the panels,
C=0.88 for gravel access roads; and C=0.5 for unimproved areas.
5. At the rime of application for building permits, detailed grading and drainage
plans must show diversions necessary to direct flows from solar development
site to a retention basin. No flow from the solar development site shall be
permitted to flow directly offsite (unretained).
6. Electrical equipment, including inverters must be elevated to be at or above
the regulatory flood elevation for each respective flood zone; or otherwise
floodproofed.
7. Work with the floodplains will require a floodplain use permit issued concurrent
with the building permits.
8. Extension of the gen-tie across FCDMC owned properties will require
procurement of a Flood Control District R/W permit.
9. Extension of the gen-tie within County (MCDOT) right-of-way may require
procurement of a lease or license to occupy the right-of-way.

10. Driveways C and D along 491st Avenue, south of Courthouse Road must align.
11. The following R/W dedication and preservation will be required. R/W dedication
must occur prior to issuance of building permits.

GENERAL REQUIREMENTS FOR PAVEMENT MARKING PLANS:
1. Any Project located fully or partially within Maricopa County Jurisdiction shall require a pavement marking
plan to be submitted to MCDOT for approval.
2. All pavement markings shall be in compliance with the Manual on Uniform Traffic Control Devices (MUTCD) as
supplemented by the Arizona Department of Transportation, and this Maricopa County Department of
Transportation Pavement Marking Manual. Any deviation shall require the specific approval of the County Traffic
Engineer.
3. When the final approved plans are submitted include:

Pavement Marking: Submit a separate set of pavement marking plans that shall be prepared at a scale
of 1”= 40’.

A redline copy of the last traffic review comments.

Final hard copy of the plans.
4. Show the existing roadway conditions, including the entire right-of-way width. Show how the proposed project
ties into the existing roadway.
5. Show the existing roadway and striping 500 feet (minimum) prior to the beginning of this project and for 500
feet (minimum) beyond the end of this project.
6. Show the existing pavement marking in dashed lines (line wt. 0) & proposed pavement marking in solid lines
(line wt. 1). Show all lane widths (12', 14', etc) & the length of all left-turn/right-turn lanes, (100', 160' etc).
All existing/proposed pavement marking on the plans are to be exactly as they exist in the field, i.e., 10' line
/ 30' gap.
7. Identify and show stationing for all accesses, excluding single residential access, i.e., roadways, commercial
pavement marking centers, emergency facilities, schools, post office, hospitals, etc.
8. Dimension and show all City Limits & County Right-of-Way.
9. Show all advance traffic signal loops in the pavement (where applicable). This is critical in producing

GENERAL NOTES TO BE WRITTEN ON THE PAVEMENT MARKING PLANS:
MCDOT GENERAL PAVEMENT MARKING NOTES:
1. It shall be the responsibility of the contractor to provide a MCDOT approved traffic control plan
and all temporary traffic control devices necessary for the safety of the public and the workers before any
pavement marking layout begins.
2. Contractor shall spot the entire project before applying pavement markings. Contractor to call Maricopa County
Department of Transportation Project Inspector, to make arrangements for inspection prior to applying pavement
markings. The permanent pavement marking plans may be modified as directed by the engineer, or his
representative. ANY PAVEMENT MARKINGS APPLIED BEFORE LAYOUT APPROVAL BY INSPECTOR
SHALL BE SUBJECT TO REMOVAL AND RESTRIPING AT THE CONTRACTOR’S EXPENSE.
3. All no passing zones shown on the plans are subject to change in the field by the County’s Traffic Engineer, or his
representative. Pavement Markings quantities could vary.
4. All pavement markings shall be done in approved thermoplastic materials. Crosswalks, stop bars, holding bars,
all longitudinal lines, such as lane lines, edge lines, center lines and taper lines shall be installed with a thickness
of ninety (90) mils. Pavement markings in paint if approved shall be installed with a thickness of fifteen (15) mils.
Thermoplastic shall not be applied to Chip Seal projects.
5. Thermoplastic pavement markings shall not be applied to any new Superpave or Marshall asphalt pavement
surface within the first 72 hours.
6. Thermoplastic pavement markings shall not be applied to any new asphalt-rubber pavement surface within the
first 30 days after the pavement placement. The contractor shall install painted temporary pavement markings at
the locations where thermoplastic pavement markings are required.
7. Thermoplastic pavement Markings shall not be applied to any new surface treatment (Slurry Seal, Microsurfacing
and other Surface Treatments) within the first 30 days after placement. Contractor shall install painted temporary
pavement markings at locations where thermoplastic pavement markings is required.
8. Raised pavement markers will be installed on the new pavement if raised pavement markers were existing within
the project.
9. For construction projects where new pavement markings shall match existing pavement markings and
obliteration is necessary, it shall be accomplished by water blasting or other approved methods. The contractor
shall seal the area with slurry as per MAG Standard, Specification 715, with emulsified asphalt slurry type ll or as
directed by the project inspector, The contractor shall verify with the MCDOT inspector or his representative of
the time lapse the slurry was applied to coordinate installation of new thermoplastic markings.
10. Painting over pavement markings does not constitute pavement marking obliteration. Pavement marking
obliteration may go beyond designated project limits. Pavement marking obliteration shall extend as needed to
allow appropriate matching of the new pavement markings with the existing pavement markings.
11. Pavement Marking dimensions are to the center of stripe for single lines and to the center of the space between
two lines for double lines except where there is curb and gutter the dimension is taken form the face of curb.
12. All symbols and word legends shall be Preformed Pavement Markings per the Specification Section 462.24

GENERAL NOTES TO BE WRITTEN ON THE SIGNING PLANS:
1. Installation of all signs shall be in compliance with the MCDOT Supplement to the Maricopa Association of
Governments’ (MAG) uniform standard specifications for Public Works construction; sections 464 and 465, these
plans and the special provisions.
2. All station locations and offsets shown on the signing plans are approximate. The Contractor shall mark all sign
locations and contact the MCDOT project inspector, to coordinate inspection with the County’s Traffic Engineer, or
his representative prior to any permanent sign installation. All signing installed prior to inspection, if modification is
required, shall be removed and reinstalled at the Contractor’s expense. Permanent signing may be modified as
directed by the County’s Traffic Engineer or his representative.
3. The Contractor shall provide and install all traffic control signing, perforated posts, u-channel posts, and
foundations for the sign posts, at the approved locations. All traffic signs shall be attached to the street light poles if
the pole is within 25 feet of the sign location as shown on the plans. Any questions concerning signing, contact the
project inspector.
4. Standard offset for all signs is 12 feet from the near edge of sign to the edge of pavement without curb and gutter,
and 2 feet minimum from the near edge of sign to the face of curb with curb and gutter. The sign height, measured
vertically from the bottom of the sign to the elevation of the near edge of the pavement shall be 5 feet for Rural and
7 feet for Urban areas.
5. All face of bolts and nylon washers used for mounting signs shall match the color in the part of the sign panel in
which they are to be placed.
6. Post lengths indicated on the Sign Summary sheets are approximate. The Contractor shall verify actual post
lengths.
7. All posts, foundations, and sign panels shall be new unless otherwise directed.
8. All street name sign installations shall be in conformance with MCDOT Standard Details 2054-1 or 2054-2. Metro
street signs shall conform to MCDOT Standard Detail 4780-2 unless otherwise noted.
9. All foundations for perforated posts shall be in conformance with MCDOT Standard Detail 2058.
10. All U-channel posts installations shall be in conformance with MCDOT Standard Detail 2059.
11. All signs shall be made of flat sheet aluminum panels unless otherwise directed with the retroreflective sheeting
and direct applied or silk screened characters per sections 465.2.3 and 465.2.4 of the MCDOT Supplement to the
Maricopa Association of Governments’ (MAG) uniform standard specifications for Public Works construction.
12. Signs that need to be removed during construction shall be removed by the Contractor. The Contractor shall
remove all permanent signing that is no longer applicable and store sign panels and posts in the Contractor’s on-
site construction yard. Contractor shall schedule with inspector the delivery of salvaged signing material (sign
panels & posts, etc.) to 2909 W. Durango St.

project falls within the COUNTY jurisdiction.
2. All signs shall be in compliance with the Manual on Uniform Traffic Control Devices (MUTCD), The
Maricopa County Department of Transportation (MCDOT) Signing Manual, and the MCDOT
Supplement to the Maricopa Association of Governments’ (MAG) Uniform Standard Specifications for
Public Works Construction.
3. When the final approved plans are submitted include:
x Signing plans: Use the Striping plans as the base sheets to place the signing. Plans shall be
prepared at a scale of 1”= 40’.
x A compact disk in MicroStation format: .dgn.

4. Show the existing roadway conditions including the entire right-of-way width. Show how the proposed
project ties into the existing roadway.
5. Show the existing roadway including signing and striping for 500 feet (minimum) prior to the beginning
of this project and for 500 feet (minimum) beyond the end of this project.
6. Show stationing for all intersections, existing signs, and new signing.
7. Show a depiction of all existing and new signing within the County Right-of Way. All existing
signing on the plans shall be shown exactly as they exist in the field. All new signing shall be
shown exactly as they are to be installed. Orientate all signing so that they are parallel with the
roadway and are facing the direction of intended traffic. Below each sign depiction show the
sign code, dimension and stationing. For an existing sign; show whether the sign is “To
Remain” or to “Remove & Salvage”. Above each sign depiction show whether the sign is
“Existing” or “New”.
8. Identify and show stationing for all accesses, excluding single residential access, i.e., roadways,
commercial strip centers, emergency facilities, schools, post office, hospitals, etc.
9. Show Design Speed of roadway(s) on the Signing Summary Sheet.
10. Dimension and show all City Limits & County Right-of-Way.
11. Prepare and submit Signing Summary Sheet with all pertinent information.
12. Resubmit the redlined plans along with a reply to the Review Comment Sheet with each revised
plan submittal.

GENERAL REQUIREMENTS FOR SIGNAL PLANS:
I.
This project falls within the COUNTY jurisdiction. The contractor shall furnish and install all
signal equipment and materials, (unless otherwise noted).
II.
All signal equipment and materials shall be in compliance with the MCDOT Supplement to the
Maricopa Association of Governments’ Uniform Standard Specifications for Public Works
Construction, latest edition; Sections 470 through 478, and the MCDOT Standard Details.
III.
It is the responsibility of the consulting engineer to provide the contractor with all construction
and material specifications, standard details, and drawings. The contractor shall have all this
information prior to applying for a permit.
IV.
When the final approved plans are submitted include:

Signal plans: Submit signal plans using the MCDOT standard border sheets.

Scale shall be 1”= 20’. CD-ROM in Microstation Format (DGN) files only.

A redline copy of the last traffic review comments.

Final hard copy of the plans.
V.
The final plans shall be submitted to Traffic Engineering prior to the issue of the permit for the
signal construction. Upon approval, the consultant shall furnish an electronic file and two (2)
hard copies of the proposed signal improvements, (Sealed & Signed).
VI.
The contractor shall furnish MCDOT with two (3) copies of the proposed list of materials that
are to be installed at the signal location. This list shall include all specifications and standard
drawings for all proposed materials. The list shall be submitted prior to applying for a permit for
the signal installation.
VII.
Show the existing roadway conditions (include existing signal, if applies), striping, utilities, and
right-of-way widths.
VIII.
Show and dimension all City Limits & County Right-of-Way.

Thank you for reaching out to the Department about our letter. After review of the letter, it was
determined that there was an error on the letter as the information for the project was not updated. I
have attached an updated letter that has been corrected. I also reviewed the area again, and based on
the proposed location, we do not believe this project will have significant impacts to bighorn sheep
movement in the area. Bighorn sheep tend to take the shortest distance possible between mountain
ranges. Based on the topography and the bridges on I-10, most of the bighorn movement would likely
occur east of the project area. Any projects proposed in the undeveloped areas east of the agricultural
fields for this area would have far more significant impacts to bighorn sheep, especially if fenced. Please

RE: Harquahala Sun Solar and Storage Project
Dear Mr. Banker:
At the request of Maricopa County, the Arizona Game and Fish Department (Department) has
reviewed the Comprehensive Plan Amendment Application (CPA), CPA2021007, for the
proposed solar facility. The proposed Project is located northwest of Saddle Mountain, east of
Granite Mountain, and northeast of the Eagle Tail Mountains approximately 20 miles west of the
City of Buckeye, Arizona. The Department understands that HV Sunrise, LLC, is proposing the
construction, operation, and maintenance of 150-MWac hybrid solar photovoltaic (PV) and
battery power plant and associated infrastructure. The Project will include approximately
400,000 solar modules mounted on single axis trackers, inverters to convert direct current into
grid-compatible alternating current, transformers to increase the voltage of the electricity
generated, a 500 kV utility substation, battery energy storage system, and one or more small
buildings to house telecommunication equipment. Additionally, the project includes a 200-foot
wide gen-tie route corridor that extends approximately 4 miles. It is the Departments
understanding that this gen-tie route is still under development and RWE will coordinate with the
Department once this route is finalized.
Under Title 17 of the Arizona Revised Statutes, the Department, by and through the Arizona
Game and Fish Commission (Commission), has jurisdictional authority and public trust
responsibilities for management of the state's fish and wildlife resources. It is the mission of the
Department to conserve and protect Arizona’s diverse fish and wildlife resources and manage for
safe, compatible outdoor recreation opportunities for current and future generations. Similarly,
the Department recognizes the importance of planning efforts that contribute to the county and
the state’s economic growth needs and opportunities to develop renewable energy locations. The
Department recognizes that appropriate coordination, proper planning, and voluntary
implementation of best management practices allow projects to be developed that avoid,
minimize, or mitigate potential impacts to wildlife habitat and populations.

To the extent possible, the Department encourages pre-construction surveys and monitoring to
determine species presence as referenced in our Guidelines for Solar Development in Arizona .

The Department is available to review survey designs, provide input on developing
best-management practices, and to assist in developing this economically-important facility
while also minimizing any potential impacts to wildlife during construction and operation of the
facility.
The western burrowing owl ( Athene cunicularia hypugaea ) is a special status species that is
regulated under the Migratory Bird Treaty Act (MBTA). The Department recommends
conducting an occupancy survey for western burrowing owls to determine if this species occurs
within your project footprint. Guidelines for conducting this survey are found in Burrowing Owl
Project Clearance Guidance for Landowners which can be accessed on-line through the

Department’s website. Please note that the survey should be conducted by a surveyor that is
certified by the Department. If an active burrowing owl burrow is detected, please contact the
Department and the U.S. Fish and Wildlife Service for direction, in accordance with the
Burrowing Owl Project Clearance Guidance for Landowners .
In addition, the Department would like to provide the following general recommendations:
● Artificial night lighting may attract insects and the species that prey on them (e.g. bats). It
could also impair the ability of nocturnal animals to navigate. The Department
recommends using only the minimum amount of light needed for safety. If feasible,
narrow spectrum lighting is wildlife-friendly and should be used as often as possible to
minimize the number of species affected by lighting. It is also beneficial that all lighting
is shielded, canted, or cut to minimize the amount of upward shining light.
● Birds of prey such as raptors, owls, vultures, and eagles are vulnerable to electrocution
and powerline strikes during construction and operation. There are a number of design
features that can minimize these impacts to these important species. Tuk Jacobson is the
Department’s raptor expert and will be willing to share information on best management
practices; he can be contacted at KJacobson@azgfd.gov or 623-236-7575.
● Power poles can serve as perches for many birds of prey and there are design features for
structures that can reduce impacts to these important species. Another possible alternative
to reduce mortality is using bird flight diverters to decrease avian mortalities. Again, Mr.
Jacobson has expertise in all of the best management practices and would be available to
share his knowledge in the pre-design phase of this project.
● The Department’s Wildlife Compatible Fencing Guidelines provide information on how

fencing impacts wildlife, ways to design fencing to prevent wildlife entanglement and
impalement, and to ensure wildlife movement is not restricted. The Department
developed these guidelines to assist landowners, project managers, land management
agencies, and others in designing wildlife compatible fences. The focus is on fence
design rather than detailed fence construction specifications. The goal is to provide

guidance in designing a fence that will achieve its objective with minimum impact to
wildlife.
● If trenching will occur for the proposed project, the Department recommends that
trenching and backfilling crews be close together to minimize the amount of open
trenches at any given time. Where trenches cannot be back-filled immediately, the
Department recommends escape ramps be constructed at least every 90 meters. Escape
ramps can be short lateral trenches or wooden planks sloping to the surface. The slope
should be less than 45 degrees (1:1). Trenches that have been left open overnight should
be inspected and animals removed prior to backfilling.

After receiving the letter from Luke Air Force base stating that our project, “could possibly impact
flying operations at Luke AFB”, and requesting that we route our project through the DOD Siting
Clearinghouse for Energy, Installations and, Environment, our team reached out to LAFB. In
discussions with Reggie Christianson, the representative listed in the letter, Reggie expressed that
this was a standard letter, that the base had not identified specific concerns with our project, and
that they just wanted us to route our project through the DOD Clearinghouse process.
See the DOD Clearinghouse website here. A Formal Review under the DOD Clearinghouse is only
required for, “energy projects greater than 199’ above ground level”. The maximum height of our
project is planned to be 140’ for the project gen-tie. However, given the letter from Luke AFB, and
our desire to address any potential concerns about our project, we submitted for an Informal Review
with the DOD Clearinghouse on December 6, 2021. See the attached correspondence. We are still in
discussions with the DOD Clearinghouse, but they have not identified any significant concerns to
date. Note that the Military Training Routes in this area already fly nearby to several existing solar
facilities, several already approved solar facilities, and cross numerous existing high voltage power
lines, and planned high voltage lines. The portion of the MTR nearest to our project crosses an
existing 500kV line in this area that tops out at 155’, which is higher than our planned maximum
height of 140’. In summary, all of the analysis we have done and the discussions we have had
indicate that our project is compatible with Luke AFB military training in this area, and we are
committed to continuing to coordinate with Luke AFB and the DOD through the DOD Clearinghouse
process.

But, in regards to the AZ SHPO, Cultural resource surveys are complete on both generation site and
all gen-tie alternatives. BLM, as lead federal agency, initiated SHPO and Tribal consultations on
February 10, 2022. The results of SHPO and tribal consultation are being documented in the BLM’s
NEPA process.

associated with this as I finish the staff report that is substantive to respond to questions you
or I will receive at hearing.
2. AZ SHPO comments about a cultural resource survey. Note, I am requiring a condition related

resources, including Traditional Cultural Properties (TCP), pursuant to Section 106 of the

The BLM Lower Sonoran Field Office initiated consultation with the Ak-Chin Indian
Community for this project November 18th, 2021, requesting input on the Area of Potential
Effect (APE). Additionally, two class I overview studies, A Cultural Resources Assessment of
23,897 Acres in Support of the Maricopa Solar and Storage Project Transmission Line
Alternatives, Maricopa County, Arizona by Christopher A Taylor (2021) and Class I Cultural
Resources Site File Search and Literature Review of 12,600 Acres for the Maricopa Solar Plus
Storage Project, West of Tonopah, Maricopa County, Arizona by Chris North (2019), were
provided. To date, no response has been received.
PaleoWest, LLC, completed Class II and III cultural resource inventories of the APE in the
summer of 2021 and January 2022. All data have been gathered and incorporated into a draft
report. The cultural resource inventory resulted in the assessment of three sites within the APE,
AZ S:12:46(ASM),) AZ S:12:80(ASM), and AZ S:8:29(ASM). Sites AZ S:12:46(ASM) and AZ
S:12:80(ASM) is recommended not eligible to the National Register of Historic Places (NRHP).
Site AZ S12:80(ASM) was recorded as a historic refuse scatter dating to the 1960s and is
recommended as not eligible to the National Register of historic Places.
Site AZ S:8:29(ASM) is the Buckeye-Salome Road. Archaeologists from Archaeology
Consulting Services (ACS) most recently revisited this cultural resource in 2012. According to
historic maps, this road generally dates between A.D. 1880s-present, but alignments of certain
segments have shifted over time. Only segment 1 crosses the current APE. This segment is an in-
use 1967 re-alignment of the historic road and is a bladed, well-maintained, gravel road. The
road was previously recommended as eligible for inclusion in the NRHP, but ACS archaeologist
recommended segment 1 is not contributing to the overall eligibility of the resource.
PaleoWest identified 14 isolated occurrences within the APE. All remaining isolated occurrences
were recommended as not eligible to the NRHP. Based on the above information, the BLM has
determined no historic properties would be affected.
A copy of this report is included with this letter to each Tribe’s or Nation’s Tribal Historic
Preservation Officer. We look forward to continuing work with you on this project. We would

Site AZ S:8:29(ASM) is the Buckeye-Salome Road. Archaeologists from Archaeology
Consulting Services (ACS) most recently revisited this cultural resource in 2012. According to
historic maps, this road generally dates between A.D. 1880s-present, but alignments of certain
segments have shifted over time. Only segment 1 crosses the current APE. This segment is an in-
use 1967 re-alignment of the historic road and is a bladed, well-maintained, gravel road. The
road was previously recommended as eligible for inclusion in the NRHP, but ACS archaeologist
recommended segment 1 is not contributing to the overall eligibility of the resource.
PaleoWest identified 14 isolated occurrences within the APE. All remaining isolated occurrences

National Historic Preservation Act. HV Sunrise, LLC, applied on November 9, 2021, for a 30-
year ROW to construct, operate, maintain, and decommission a 500-kV transmission line on
public lands administered by the BLM. This proposed ROW is located in Section 34 of
Township 2 North, Range 8 West, in Maricopa County, Arizona, approximately 60 miles west of
Phoenix, Arizona.
The BLM Lower Sonoran Field Office initiated consultation with the Salt River Pima-Maricopa
Indian Community for this project November 18th, 2021, requesting input on the Area of
Potential Effect (APE). Additionally, two class I overview studies, A Cultural Resources
Assessment of 23,897 Acres in Support of the Maricopa Solar and Storage Project Transmission
Line Alternatives, Maricopa County, Arizona by Christopher A Taylor (2021) and Class I
Cultural Resources Site File Search and Literature Review of 12,600 Acres for the Maricopa
Solar Plus Storage Project, West of Tonopah, Maricopa County, Arizona by Chris North (2019),
were provided. To date, no response has been received.
PaleoWest, LLC, completed Class II and III cultural resource inventories of the APE in the
summer of 2021 and January 2022. All data have been gathered and incorporated into a draft
report. The cultural resource inventory resulted in the assessment of three sites within the APE,
AZ S:12:46(ASM),) AZ S:12:80(ASM), and AZ S:8:29(ASM). Sites AZ S:12:46(ASM) and AZ
S:12:80(ASM) is recommended not eligible to the National Register of Historic Places (NRHP).
Site AZ S12:80(ASM) was recorded as a historic refuse scatter dating to the 1960s and is
recommended as not eligible to the National Register of historic Places.
Site AZ S:8:29(ASM) is the Buckeye-Salome Road. Archaeologists from Archaeology
Consulting Services (ACS) most recently revisited this cultural resource in 2012. According to
historic maps, this road generally dates between A.D. 1880s-present, but alignments of certain
segments have shifted over time. Only segment 1 crosses the current APE. This segment is an in-
use 1967 re-alignment of the historic road and is a bladed, well-maintained, gravel road. The
road was previously recommended as eligible for inclusion in the NRHP, but ACS archaeologist
recommended segment 1 is not contributing to the overall eligibility of the resource.
PaleoWest identified 14 isolated occurrences within the APE. All remaining isolated occurrences
were recommended as not eligible to the NRHP. Based on the above information, the BLM has
determined no historic properties would be affected.

Thank you for helping me understand this proposal.
We are concerned regarding the solar project planned near Saddle Mountain - which is not
mentioned.
The AZGF review covers an area 40 miles southeast of the site in Harquahala Valley.
This project is not near Gila Bend which AZGF noted incorrectly.
Our concerns are regarding wildlife linkages for Desert Bighorn Sheep which need
connections to the west – Eagletail Mtns and south past an existing solar site to the
southeast to reach the north bend in the Gila River.
Saddle Mountain is an Area of Critical Environmental Concerns (ACEC) which continues to
be negatively affected by power projects and other stresses.
Please review this project regarding the power line connections which may affect this
project considering the increasing impacts on wildlife and scenic beauty of Saddle Mountain
ACEC.

Were working with BLM on the exact gen-tie route/alignment now.
But, in general, I will note that our connection to the Delaney substation wont cause any additional impacts in this area given the existing lines that already exist in this area. You’ll see (below) that there’s already
existing lines going from the Harquahala Generating Facility to the APS substation.
As mentioned the Desert Bighorn Sheep movement area is located to the east. The Biological Evaluation for the gen-tie is currently undergoing agency review. The public will be invited to review and comment on
the material once the documents are made available to the public, anticipated to be on March 14, 2022. The documents will be available here: https://eplanning.blm.gov/eplanning-ui/project/2017052/510

Thank you for reaching out. Ginger is correct in her assessment regarding your concerns about the Desert Bighorn Sheep. Furthermore, it has been determined that Bighorn sheep are not present in the project
area and would not be impacted by the proposed project. A Biological Evaluation (BE) was prepared of the project, which includes the power line connections outside of the subject rezoning boundary, for review
by the BLM. The BE notes the following:
ADOT, the AGFD, the FHWA and representatives from other agencies have completed a Wildlife Linkages Assessment to address important wildlife movement corridors in Arizona. The AGFD OERT included a standard
response regarding local or regional needs of wildlife movement, connectivity, access to habitat needs and design of various roadway features such as culverts and bridges.
The Maricopa County Wildlife Connectivity Assessment:
Report on Stakeholder Input prepared in 2012 denotes one Movement Area within the study area (AGFD 2012). The movement area is denoted as a Landscape Movement Area and described as Bighorn Belmont – Saddle
Mountain Movement Area. The Bighorn Belmont – Saddle Mountain Landscape Movement Area connects habitat blocks associated with the Big Horn Mountains and Saddle Mountain (AWLW 2006). The existing wildlife
connectivity within the study area would not be affected by the proposed project.
I also wanted to thank AZGFD for the correction of the project location. For clarification, Mr. Weaver, our project is located near the Harquahala Generating Facility, much further to the north than the Hyder Solar
facility, as seen below. I wasn’t sure if you still had the same response based on the corrected location, but hopefully this alleviates your concern.

Thank you for reaching out to the Department about our letter. After review of the letter, it was determined that there was an error on the letter as the information for the
project was not updated. I have attached an updated letter that has been corrected. I also reviewed the area again, and based on the proposed location, we do not believe this
project will have significant impacts to bighorn sheep movement in the area. Bighorn sheep tend to take the shortest distance possible between mountain ranges. Based on the
topography and the bridges on I-10, most of the bighorn movement would likely occur east of the project area. Any projects proposed in the undeveloped areas east of the
agricultural fields for this area would have far more significant impacts to bighorn sheep, especially if fenced. Please let me know if you have any other questions or concerns.

Hello Mr. Cavalcant,
In a July 28, 2021 letter to developers of another solar project, the Harquahala Sun Solar and Storage Project (M/C Z2021111), wildlife concerns are noted. However, the project
is listed as: “….proposed solar facility at a location approximately 2 miles northeast of central Gila Bend in Maricopa County”, Arizona”.
The listed project is not near Gila Bend. It is west of Tonopah AZ, on Courthouse Road within Harquahala Valley.
It is also near Saddle Mountain ACEC (SM) which the AGFD focused on two decades ago regarding Desert Bighorn Sheep (DBS).
The DBS are again under significant stress due to winter campers at Saddle Mountain and poaching. Additionally, several natural gas plants have been built to the west and
southeast of Saddle Mountain. The future is more bleak due to approval of numerous solar projects - one by one.
While southeast from SM is one large, fenced, solar array, currently exists; many more have been approved to the north, northwest, and southwest of Saddle Mountain.
This project is simply one more of dozens (not built yet) which threat wildlife such as DBS becoming isolated at Saddle Mountain. Today, poaching DBS at Saddle Mountain
continues along with other stresses.
However, projects like this one along with the proposed - unidentified plan - for more power lines simply affect more wildlife, as you know.
While we appreciate the efforts to preserve the western burrowing owl. This proposed solar project is approximately NNW of Gila Bend by about 40 miles. If they exist within the
Tonopah Desert or Harauahala Valley it would be interesting to learn of the borrowing owl with this region and how we can help to preserve them in this area.
Please review this project listed as Z202111 or CPA 2021007 within Maricopa County and let me know if fenced solar projects surrounding Saddle Mountain ACEC will negatively
affect DBS and other wildlife – “to ensure wildlife movement is not restricted”.

Since the publishing of the staff report for the above case, the applicant requested
adjustments to the conditions of approval ‘a’ and ‘e’. The specific conditions relate to
the comment letter received by Luke Air Force Base on November 1, 2021 that requested
the applicant route their request through the Department of Defense (DOD) siting
clearinghouse process. Staff is supportive of these adjustments as the applicant is
currently undergoing an informal review through the process and Staff does not expect
much if any in the way of recommendations by the DOD for the applicant to implement
that will substantially alter the development. Additionally, Staff is correcting a minor error
in condition ‘d.9.’.
Shown below are the revised conditions in leg-edit format with new language underlined
and bolded and removed language struck-through.
a.
The initial Plan of Development shall be developed in substantial
conformance with the Site Plan entitled “Harquahala Sun Site Plan”
consisting of 17 full-size sheets, dated March 1, 2022, and stamped received
March 1, 2022., except as modified by the following conditions and except
that a revised site plan shall be submitted to Staff and Luke Air Force Base
for review and approval if required by Luke Air Force Base in accordance
with Luke Air Force Base comments dated November 1, 2021. The Plan of
Development may be amended administratively under separate
application as long as the amendment complies with the established IUPD
development standards as approved by the Board of Supervisors. Staff may
determine slight refinements to remain in substantial conformance with the
approved site plan. Minor and major amendments to the site plan will be
determined in accordance with Chapter 3 of the Maricopa County Zoning
Ordinance.
d.
The following IND-2 IUPD Zoning District standards shall apply:

The Owner or Developer applicant shall receive clearance route their plans
through the Department of Defense (DOD) siting clearinghouse process by
Luke Air Force Base in accordance with the letter from Luke Air Force Base
dated November 1, 2021., and must receive a favorable finding from Luke
Air Force Base following the process prior to the issuance of building
permits. Based on those findings, Aa revised site plan shall be submitted in
accordance with condition ‘a’ if required.
Lastly, Staff would like to point out a correction in the Staff Report related to the
generating capacity of 125 megawatts (MWs) of electricity. The correct amount is 150
megawatts (MWs).
Staff recommends approval of Z2021111 subject to conditions ‘a’ – ‘k’ with the proposed
additional conditions. Shown below are the proposed conditions in final format:
a.
The initial Plan of Development shall be developed in substantial
conformance with the Site Plan entitled “Harquahala Sun Site Plan”
consisting of 17 full-size sheets, dated March 1, 2022, and stamped received
March 1, 2022, except as modified by the following conditions. Staff may
determine slight refinements to remain in substantial conformance with the
approved site plan. Minor and major amendments to the site plan will be

Development of the site shall be in substantial conformance with the
Narrative Report entitled “Harquahala Sun Narrative Report”, consisting of
14 pages, dated February 25, 2021, and stamped received March 1, 2022
except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1. At the time of application for building permits, the plans or a drainage
exhibit must identify (quantity) offsite flows entering the site,

2. At the time of application for building permits, retention basin design for
basins located in a floodplain must be revised to provide excavated
basins.
3. Retention basin volumes must be sized for the 100 year, 2 hour storm
event. Retention basins must drain within 36 hours.
4. At the time of application for building permits, the weighted runoff
coefficient to size retention basins must be verified and be based on
C=0.95 for the panels, C=0.88 for gravel access roads; and C=0.5 for
unimproved areas.
5. At the time of application for building permits, detailed grading and
drainage plans must show diversions necessary to direct flows from solar
development site to a retention basin. No flow from the solar
development site shall be permitted to flow directly offsite (unretained).
6. Electrical equipment, including inverters must be elevated to be at or
above the regulatory flood elevation for each respective flood zone; or
otherwise floodproofed.
7. Work with the floodplains will require a floodplain use permit issued
concurrent with the building permits.
8. Extension of the gen-tie across FCDMC owned properties will require
procurement of a Flood Control District R/W permit.
9. Extension of the gen-tie within County (MCDOT) right-of-way may
require procurement of a lease or license to occupy the right-of-way.
10. Driveways C and D along 491st Avenue, south of Courthouse Road must
align.
11. The following R/W dedication and preservation will be required. R/W
dedication must occur prior to issuance of building permits.
Dedication:
491st Avenue – 40’ half width (80’ full) right-of-way for a collector
roadway
Courthouse Road – 65’ half width right-of-way
Preservation:
483rd Avenue – 40’ half width right-of-way
499th Avenue – 65’ half width right-of-way

12. Based on the conceptual design nature of the information submitted,
changes to the site layout may be necessitated by the final engineering
design of the site’s drainage infrastructure.
13. Detailed Grading and Drainage (Site Infrastructure) Plans must be
submitted with the application for Final Plat Approval and Building
Permits.
14. Engineering review of planning and/or zoning cases is for conceptual
design only. All development and engineering design shall be in
conformance with Section 1205 of the Maricopa County Zoning
Ordinance; Drainage Policies and Standards; Floodplain Regulations for
Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of
application for construction.
d.

Inspector and/or their designee shall review the applicant’s response, and
any subsequent comments received from AZGFD, to determine whether
the response issued by the Owner or Developer addresses AZGFD

comments in good faith. Should the Zoning Inspector and/or their designee
decide that the Owner or Developer has not substantially addressed
AZGFD comments in good faith, the Owner or Developer shall be required
to propose and implement alternatives to the recommendations made by
AZGFD.
g.
The Owner or Developer shall receive approval of a Cultural Resource
Survey accordance with the comments received by AZSHPO in the letter
dated July 8, 2021 prior to the issuance of building permits.
h.
The IND-2 IUPD shall limit the use of the site exclusively to a solar electric
generating facility including ancillary offices and ancillary uses. Any other
site uses shall require a Zone Change Major Amendment.
i.
Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Zone Change as set forth in the Maricopa
County Zoning Ordinance.
j.
The property owner/s and their successors waive claim for diminution in
value if the County takes action to rescind approval due to noncompliance
with conditions.
k.
The granting of this change in use of the property has been at the request
of the applicant, with the consent of the landowner. The granting of this
approval allows the property to enjoy uses in excess of those permitted by
the zoning existing on the date of application, subject to conditions. In the
event of the failure to comply with any condition, and at the time of
expiration of the Zone Change, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, or
the expiration of the Zone Change, does not reduce any rights that existed
on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation or expiration of the
Zone Change. The Zone Change enhances the value of the property
above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone
Change had never been granted.
