1 of 3 COLLECTION AGREEMENT BETWEEN THE ARIZONA GAME AND FISH DEPARTMENT AND THE MARICOPA COUNTY SHERIFF’S OFFICE This Agreement is made this _____ day of _______, 2022, between the State of Arizona, by and through the Arizona Game and Fish Department (“Department”) and the Maricopa County Sheriff’s Office (collectively “Parties” and singularly “Party”). WHEREAS, the Commission, through the Department, has statewide responsibility for administering the watercraft law enforcement and recreational boating safety programs on the state level and to make agreements with other entities for recreational boating safety and related law enforcement; WHEREAS, the Maricopa County Sheriff’s Office is charged with enforcing watercraft Laws and Regulations under A.R.S. §5-391, §11-441, §11-951, §11-952, and is dedicated to educating the boating public and preventing accidents, injuries, and deaths on the Arizona waterways; and WHEREAS, the Parties desire to provide effective and adequate enforcement of laws relating to recreational boating safety on Arizona’s waterways; WHEREAS, the Maricopa County Sheriff’s Office has authority under A.R.S. §5-391 and §11-441 to enter into agreements with other public agencies for recreational boating safety and related law enforcement. NOW, THEREFORE, the Parties agree as follows: 1. Obligations of the Department. The Department shall: A. Provide funding to the Maricopa County Sheriff’s Office in the amount of $61,785.29 for the sole purpose of supporting those recreational boating law enforcement activities set forth in paragraph 1(B) below. B. Funding shall be provided solely to ensure first responder emergency medical services (“EMS”), training associated within those services and critical incident response capabilities to facilitate the following eligible recreational boating safety law enforcement activities: 1. Purchase of - i. (1)- Newport Vessel NV-Series with a 55lb thrust motor ii. (2) 12-volt 55AH Mighty Max deep cycle batteries iii. (2) Newport Vessels 12volt Smart Battery Chargers iv. (1)Newport Vessel trolling motor smart battery box power center v. (1) Newport Vessel 4 foot cable extension kit 2. Training Curricula as provided by Rescue 3(Basics of Swift water Rescue) i. Registration for 44 deputies 2 of 3 ii. Equipment associated with training to includes, but not limited to - NRS Rapid Resuce PFDs, NRS Extreme SAR dry suits, Fox 40 whistles, Twentymile hill, fins, shredder SAR, Pilot Knifes, 7/16 Static Rope, Team Wendy Exfil LTP, CMC clutch, Rescue boards, Crossline Professional B, Rock Exoctica single pulley, and Rock Exotica Double Pulley. 2. Obligations of the Maricopa County Sheriff’s Office. The Maricopa County Sheriff’s Office shall use funds provided under this Agreement solely for the purposes set forth in paragraph 1(B) above and for no other purpose. 3. Termination Generally. Either Party may terminate this Agreement upon thirty (30) days written notice to the Department. Upon such termination, the Parties agree that the Maricopa County Sheriff’s Office shall return to the Department all unspent monies deposited for use under this Agreement. 4. Termination for Unauthorized Use of Funds. If the Maricopa County Sheriff’s Office uses any funds received under this Agreement for purposes not authorized in paragraph 1(B) above, then the Parties agree that the Department at its sole discretion may immediately terminate this Agreement by providing a written notice to the Maricopa County Sheriff’s Office. Upon such termination, the Parties agree that the Maricopa County Sheriff’s Office shall immediately return to the Department: (1) any and all unspent funds provided under this Agreement; and (2) any and all funds provided under this Agreement that were used for purposes not authorized in paragraph 1(B) above. 5. Notices. All written Notices concerning this Agreement shall be delivered in person or sent by certified mail, return receipt requested, to the Parties as follows: A. For the Maricopa County Sheriff’s Office: Sheriff Paul Penzone 550 West Jackson Phoenix, Arizona 85003 6. Audit. Pursuant to A.R.S. § 35-214, all books, accounts, reports, files, electronic data, and other records relating to this Agreement shall be subject at all reasonable times to inspection and audit by the State of Arizona for five (5) years after completion of this Agreement. 7. Effective Date and Duration. This Agreement shall not become effective until signed by all Parties hereto. This Agreement shall expire on June 30, 2023. The Parties agree that the Maricopa County Sheriff’s Office shall immediately return any and all unspent funds to the Department upon expiration of this Agreement. 8. Arbitration. To the extent required pursuant to A.R.S. § 12-1518, the Parties agree to use arbitration to resolve any dispute arising under this Agreement, with each Party to bear its own attorneys’ fees and costs. 9. Termination for Conflict of Interest. This Agreement is subject to termination pursuant to A.R.S. § 38-511.
