AMENDMENT NO. 5 to INTERGOVERNMENTAL AGREEMENT 
FACILITY USE AGREEMENT 
FOR USE OF REAL PROPERTY 
Between 
PEORIA UNIFIED SCHOOL DISTRICT 
And 
MARICOPA COUNTY 
 
RECITALS 
 
A. 
Maricopa County (“County”) and Peoria Unified School District (“District”) (collectively, 
the “Parties”) are Parties to that certain Intergovernmental Agreement No. G30123, dated 
August 4, 2009 and subsequently amended August 8, 2012, August 14, 2013 and  
September 21, 2016, and April 24, 2019 (collectively, the Agreement”).  The Agreement 
is for the use of District owned space at 10851 W. Williams Road, Sun City, Arizona. 
 
B. 
The term of the Agreement expires on July 22, 2022. 
 
C. 
The Parties now mutually desire to enter into this Amendment No. 5 to the Agreement 
(“Amendment”) to amend the Agreement to extend the term and to allow for execution in 
counter parts and allow for electronic signatures.  
 
 
AGREEMENT 
 
NOW THEREFORE, in consideration of the foregoing and other good and valuable 
consideration, receipt and sufficiency of which are hereby acknowledged,  District and 
County agree to amend Agreement as follows: 
 
1. 
The Agreement term is hereby extended five (5) years, commencing July 23, 2022 and 
expiring July 22, 2027. This Agreement is subject to termination pursuant to the 
provisions of A.R.S. 38-511. 
 
2. 
The effective date of this Amendment is the date of approval by Maricopa County. 
 
3. 
This Agreement may be executed in two or more counterparts, each of which shall be 
deemed and original but all of which together shall constitute one and the same 
instrument.  Electronic signatures shall have the same force and effect as original 
signatures.  
 
4. 
The foregoing paragraphs contain all the changes made by this Amendment.  All other 
terms and conditions of the Agreement and amendments remain the same and in full force 
and effect.
