RELEASE AND EXTINGUISHMENT OF EASEMENT

This Release and Extinguishment of Easement (“Release”) is made by the Flood Control District
of Maricopa County (“District”), a political subdivision of the State of Arizona, and is effective as

of the date of recordation.

RECITALS

WHEREAS, the District acquired a Floodway Easement and Agreement for Flood Control
Purposes (“Easement”) recorded on February 22, 1991 as Document No. 1991-0074025 in records
of the Maricopa County Recorder (“MCR”) for the benefit of District Parcel known as Parcel A-
13100C-FR, that portion of the Northeast quarter of the Northeast quarter of Section 14, Township
1 North, Range 1 West of the Gila and Salt River Base and Meridian in conjunction with the Agua

Fria River Channel Project.

WHEREAS, said easement states that said rights and easement created therein shall be
relinquished by the District, by separate recordable instrument, in the event the property is
protected from the standard project flood.

WHEREAS, the District has determined that the property meets the criteria for relinquishment of
the Easement and desires to release and extinguish said Easement as it is no longer needed for the

purposes stated herein.

NOW, THEREFORE,BE IT RESOLVED THAT, District hereby releases, extinguishes any
and all interest District holds in and to said Easement recorded as Document No. 1991-0074025

in the MCR, and disclaims any right, title, benefit or interest therein.
