Good afternoon Ms Griemsmann,
In response to your letter dated 9/1/21, regarding Zoning Case Z2021090, Western Area Power
Administration (WAPA) has no objection to the rezoning case. However, WAPA requests that the
landowner and/or their representative contact WAPA, prior to any construction activities, to discuss
the potential impact to our easement, by the future development of this parcel.
Based on the site map provided, WAPA has a Transmission line, identified as the MEAD-
PERKINS(MDE-PES) 525-kV. It appears that the access road to the new Republic facility will cross
WAPA’s MDE-PES circuit in 2 locations. I have provided a WAPA site map reflecting the approximate
location of these crossing. WAPA requests a License application/agreement to be completed, prior
to construction, to make sure that the construction of the road does NOT impede WAPA’s ability to
maintain access thru our easement and is a safe distance from any structures.
I have included a License Application together with instructions on how to complete the form and
information regarding what may be allowable within our easement.

After further review and a site visit of the proposed zoning change, the following concerns related to the
2018 International Fire Code (IFC) with local amendments are below.
D103.4 Dead-end fire apparatus access roads in excess of 150 ft. shall be provided with width and
turnaround provisions in accordance with Table D103.4. It is recommended a secondary egress
roadway be identified for final review. The single ingress/egress point is a concern for emergency
response should the current access become limited due to an emergency at this location. The roadway
can be identified for fire department use only.

I.
Introductory Statement
Republic Services has engaged in an unprecedented level of community outreach both in advance
of filing and during the processing of this rezoning application. The subject property is located
more than a quarter mile from any resident, separated from all homeowners by either a Freeway
or a 185 acre power station, and will use a brand new road system that serves no existing
residents.
Despite the complete isolation of its proposed site from any home, Republic has personally met
with hundreds of area residents, contacted more than three dozen community associations, and
engaged directly with hundreds of residents on line and in writing. Specifically, Republic has
already:
Contacted all 37 HOAs within ten miles of the site, and offered to meet with them; 14
agreed to meet, and we did so.
Hosted four Open Houses on the site attended by more than 100 residents.
Hosted four Tele Town Halls attended by more than 600 people.
Participated in HOA virtual meetings with Corte Bella, Sunleya, Vistancia and Trilogy at
Vistancia, attended by around 220 people.
Toured the Corte Bella Government Affairs Committee on site at the existing Cave Creek
Recycling and Transfer Station, including a visit to the tipping floor itself (13 residents), as
well as the closest single family home (11 of the 13 residents).
Hosted a community clean-up in the Agua Fria Riverbed.
Distributed eight project newsletters to more than 750 people.
Operated a project website which contains all information about the site, including a
video tour, all of our technical reports (noise, traffic and property values), and a contact
point.
Responded via e-mail and the project website to more than one hundred individual
citizen comments.
While differences of opinion will remain, there is no question that Republic has left unanswered.
This extensive effort has occurred despite the challenge of the ongoing Covid-19 pandemic. None
of these efforts are required by the County’s Ordinance; Republic undertook all of these efforts
voluntarily. As the rezoning application continues to move through the County process, Republic
will continue to be available to answer questions and listen to concerns throughout the
processing of its rezoning request.
II.
Description of the Proposal
Republic has filed a Zone Change Application (“Application”) with Maricopa County to rezone
approximately 10 acres of property located immediately south of the southwest corner of the
WestWing Power Substation (in the northwest corner of Maricopa County Assessor Parcel
Number 503-53-025U) (“Property”). The Property is currently zoned Light Industrial Zoning
District Industrial Plan of Development (IND-2 IUPD), and is vacant with no improvements. The

Application requests to rezone the Property to Heavy Industrial Zoning District Industrial Plan of
Development (IND-3 IUPD) to allow for the development of a recycling and transfer station on
the Property.
III.
General Purpose and Scope of Public Outreach Prior to Submittal
As explained above, Republic selected the Property because it is isolated from both any single
family residential subdivision and any access road that any single family residential subdivision in
the broader area uses to reach either a Major Arterial road or the Loop 303. In an effort to notify
communities beyond the buffers of the 303 and the WestWing substation, Republic took a broad
array of steps to ensure public awareness of the forthcoming proposal before filing its rezoning
application. This broad public outreach effort provided the public with an opportunity to acquire
information, ask questions and offer comments. Despite the pandemic, much of this contact was
in person or by live video or audio in a public setting.
IV.
In-Person Contacts
A.
Homeowners Associations
To begin, in February 2021, Republic notified the Management Company or the Board of each
Homeowner’s Association within ten (10) miles of the Property. See Table 1 below for a list of
the thirty-seven HOA entities that Republic reached out to, and those entities’ respective
responses. Of those 37 HOAs, fourteen of them accepted our offer to meet at least once, more
than a third of the total contacted. The Applicant met, either virtually or person, with the Boards
or appropriate Government Affairs Committee of each of these fourteen HOAs, engaged in
dialogue about the project, and solicited public input.

Corte Bella HOA Governmental Affairs Committee. There are two existing HOAs that are
located on the south side of the El Mirage and Loop 303 interchange, Corte Bella and Sunleya.
Because Republic’s proposed facility will also be using the El Mirage interchange, these are our
neighbors with whom we attempted to have significant interaction.
Republic values its regular and frequent interaction with the Corte Bella Governmental Affairs
Committee (GAC), and appreciates the courtesy and civility the GAC has extended to us. Neither
the GAC nor the Corte Bella HOA have taken a position on this rezoning proposal at this time, so
we extend this gratitude to these volunteer leaders of the Corte Bella community without
expectation.

In addition to regular logistical interaction with the Corte Bella GAC to arrange meetings and
communications, the highlights of that dialogue are as follows:
March 3, 2021: Virtual Town Hall meeting. The GAC hosted a Town Hall at which Republic
representative appeared in person at Corte Bella and fielded questions from callers into
a video broadcast. More than 100 residents of Corte Bella and other area communities
attended and asked questions for about 60 minutes. Following the meeting, and at the
request of the GAC, Republic representatives developed a written summary of issues
discussed during the Town Hall. See Exhibit 1.

April 19, 2021: Traffic Study shared with Corte Bella GAC prior to public announcement

May 13, 2021: Republic hosted a tour at its existing Cave Creek recycling and transfer
facility for the Corte Bella GAC. Eleven residents attended, see Exhibit 2. Attendees were
taken on a walking tour around the facility and onto the tipping floor. They also visited
the home nearest to the facility to experience if they could see, smell or hear the facility
from that distance.
September 20, 2021: Noise Study shared with Corte Bella GAC and agreement made for
Republic to provide quarterly updates to the Committee.
November 17, 2021: Republic hosted a tour at its existing Cave Creek recycling and
transfer facility for the Corte Bella GAC Chair and two residents who were new to Corte
Bella. Attendees were taken on a walking tour around the facility and onto the tipping
floor.

Sunleya HOA. Sunleya is the other community that is close to the south side of the El
Mirage interchange. Republic attended Sunleya’s virtual HOA meeting on March 11, 2021.
Twenty-five residents attended and Republic answered questions about traffic, property values
and bulk trash. Residents were encouraged to reach out to Republic with any additional
questions/concerns moving forward.

HOA Community Meetings. Since the unveiling of the proposed WestWing facility,
representatives from Republic Services have hosted and/or attended nine public meetings
hosted by HOAs, reaching approximately 225 residents directly.

B. Open Houses
As previously indicated, the Property is isolated from any and all homes in the area. We believe
that the isolation of the Property is best appreciated by visiting the Property itself. Republic
Services has hosted four (4) in-person Open Houses on the Property while the weather was nice,
on February 13, 2021; March 6, 2021; October 9, 2021 and October 30, 2021. At the Open
Houses, members of the project team were also available to answer questions about the
proposed facility.
To ensure safe social distancing per the Centers for Disease Control and Prevention (CDC)
recommendations regarding the COVID-19 pandemic, Republic divided the Spring 2021 events
into time slots, with a maximum of 40 attendees on the Property per time slot. Allowing up to 40
attendees on a 10 acre parcel allowed ample distancing per person. Masks were required of all
attendees and Republic representatives.
To publicize the Open Houses, Republic extended invitations in each of its first four newsletters
(see below), on its project website (see below), at its Tele Town Halls (see below), and at its
meetings with the Corte Bella HOA. In addition, Republic extended invitations to each HOA
representative and individual whom Republic met with in early February. Finally, Republic ran
an advertisement for the February and March Open Houses in The Peoria Times. In all of its

invitations for the Spring 2021 Open Houses, Republic directed interested attendees to its
website so that they could RSVP and understand the Open House Covid protocols.
The first Open House had 65 attendees, the second Open House had 23 attendees, the third
Open House had 11 attendees, and the fourth Open House had no attendees. The diminishing
attendance at the Open Houses is a clear result of diminished interest in this proposal, because
all of Republic’s public outreach efforts have provided an overwhelming abundance of
information about the proposal. See Exhibit 3 for the sign in sheets from these events. The
Applicant discussed the proposed project, answered attendees’ questions, and also solicited
attendees’ input. Complimentary food and beverages were made available in accordance with
CDC guidelines. To capture attendees’ input, comment cards were made available each Open
House, see Exhibit 4. See Exhibit 5 for the newspaper advertisement, flyers, e-mail and social
media post advertising the Open Houses.
C. Tele Town Halls
In an additional effort to make information safely and publicly available during the pandemic,
Republic Services held four (4) separate, virtual, open public meetings, called Tele Town Halls.
These Tele Town Halls were promoted through more than 8,000 direct and automated phone
calls to residents in the area, including concerned HOAs. The recorded calls invited residents to
stay on the line to participate in the live tele town hall, and the message also invited residents to
attend the in-person Open House events. The Tele Town Halls were conducted on February 11,
2021; February 16, 2021; September 19, 2021 and November 7, 2021.
Each Town Hall was approximately 1 hour long. 145 participants attended the first Town Hall,
164 participants attended the second Town Hall, 120 participants attended the third Town Hall,
and 180 participants attended the fourth Town Hall, for a combined total of 600 attendees. See
Exhibits 6, 7, 8 and 9 for lists of the Town Hall attendees. Audio recordings of each of the Tele

D. Community Cleanup
During ongoing communication with the community, the Applicant learned of illegally dumped
material near the Agua Fria River bed and Tierra del Rio. On March 3, 2021, the Applicant hosted
a free cleanup of this area and hauled away more than eleven (11) tons of trash. See Exhibit 10
advertising and summarizing the cleanup. Two community members participated in the cleanup
alongside Republic Services, successfully removing couches, carpet, bottles, cans and a large
amount of concrete.
E. Other Meetings with Interested Citizens
The Applicant also met with Vanessa Angell and Thomas Angell on February 5, 2021 to continue
ongoing discussions about the northwest valley’s need for a transfer station. The Applicant met
again with Mr. and Mrs. Angell, and JJ Fowlie, on February 9, 2021 to discuss the upcoming rollout
of the proposed WestWing facility. Mr. and Ms. Angell and Mr. Fowlie lead opposition against

the Applicant’s rezoning case at 115th Avenue and Happy Valley Road (Case Z2020017). Mr.
Fowlie is a Phoenix Firefighter and was the face of the “Stop the Stinky Station” opposition
campaign in Case Z2020017. Republic Services continued to keep in direct contact with Mr.
Fowlie via phone and an in person meeting through early March 2021. Mr. Fowlie was invited to,
but did not participate in, the March 3, 2021 community clean up lead by Republic Services.
V.
Multi-Media General Outreach
In addition to the hundreds of in-person contacts detailed above, Republic has simultaneously
been operating a multi-faceted general outreach campaign to make project information readily
available to interested members of the public.
A. Project Website
The key to Republic’s general outreach effort has been its website. Beginning February 9, 2021,
a project website was made publicly available 24/7, https://westwingtransfer.com/. The website
contains information about Republic Services, Frequently Asked Questions, a video tour of the
Property, and contact information for Republic Services.
To assess what impact the proposed transfer facility could have on surrounding residences,
Republic Services commissioned the following studies and publicly posted them at
https://westwingtransfer.com/resources/:

and QuikTrip traffic studies to the website.

Republic will continue to publicly post information throughout the processing of its rezoning
application, including the application itself and any and all public hearing dates.
Republic responds to all questions received through the website. From February 9, 2021 through
December 15, 2021, Republic received a total of 145 contacts through the website. Of those, 80
contacts posed questions to which Republic responded. Republic will continue to respond to all
substantive questions received.

B. Newsletters
Republic has periodically issued newsletters via e-mail to hundreds of interested citizens about
the project. To compile this mailing list, Republic utilized the e-mail addresses of all residents
who submitted public comments on Case Z2020017, and to those additional residents who have

reached out to the Applicant regarding the proposed WestWing Transfer Facility. The newsletter
mailing list currently includes 778 residents, see Exhibit 15 for the distribution list.
The newsletters contain information about the proposed facility in relation to noise, traffic, and
property values, and address frequently asked questions. See Exhibit 16 for all nine of the
newsletters that have been published to date:

In addition, on February 25, 2021 Republic ran an ad in the Peoria Times notifying readers of its
exploration of the WestWing site for a potential transfer station. See Exhibit 17.
C. E-mail Correspondence
Republic Services embraces the importance of stakeholder communication. In addition to direct
correspondence through the website, Republic and its representatives have engaged in direct e-
mail communication with interested parties. Stephen Herring, Municipal Relationship Manager
for Republic Services, has served as a community liaison since this new, proposed location was
unveiled to residents in February 2021. He has, and will continue to maintain, communication
with interested residents and HOAs, answering questions and providing requested information
via phone, e-mail and in-person meetings.
On behalf of Republic, Gammage & Burnham also continues to engage with the community via
e-mail, responding to questions in a timely manner.
VI.
Outcomes of Early Community Outreach
In addition to providing copious amounts of information to interested citizens, Republic has
received useful feedback through this continued dialogue, and as a result, has made multiple new
commitments to the community. These commitments will foster a harmonious relationship with
regard to the proposed transfer facility:
Providing free monthly bulk disposal for nearby residents
Providing a dedicated telephone hotline for residents to report issues immediately

VII. Republic Actions upon Submittal of Rezoning Application
A. Description of the Minimum Required Community Involvement Area
In accordance with Sections 305.4, 305.5.1, and 305.5.2 of the County Zoning Ordinance, and
within 30 days upon submitting the Application, Republic sent written notice by first class mail
to:
i)
each real property owner as shown on the last assessment of Property within three
hundred (300) feet of the proposed rezone boundary,
ii)
the heads of any homeowners associations within three hundred (300) feet of the
proposed rezone boundary, and
iii)
the City of Peoria, the Arizona Department of Transportation, and other potentially
affected citizens who have requested that they be placed on the routing list
maintained by Maricopa County.
The notice by mail included the description of the area of the proposed change, the name of the
applicant, and contact information for the applicant. The notice was sent to 19 stakeholders.
Republic submitted a copy of the notice and an affidavit demonstrating proof of such notification
to Maricopa County on September 1, 2021, within 30-days of Application submittal (see Exhibit
19).
There are no homes or HOAs within this 300 foot range. Indeed, there are no homes or HOAs
within one quarter mile of the Property. All residences in the broader area are separated from
the Property by the Loop 303 and its large sound wall to the south, and the WestWing substation
to the north.
The County has identified additional parties in interest affected by this proposal as Arizona
Department of Transportation (ADOT), Property Owners & Residents Association for Sun City
West (PORA), Mining District, Lafarge North America, Concerned Citizens of Cross River, Philip
Spiller, Ed Grant, Maricopa Association of Governments, ADOT Right of Way Project
Management, Sun City West Independent, North County Fire District, Maricopa County Parks and
Recreation, WestWing Business Park, Insight Land, City of Surprise and City of Peoria (see Exhibit
20).
B. Additional Notice of Filing Outreach
In addition to the parties required by the County Zoning Ordinance, Republic also directly notified
all 14 of the HOA contacts with whom we have previously met, identified in Table 1 above. As

part of this notification, Republic offered to once again meet with these HOAs if they wished to
do so. For a complete list of the direct notices of filing, see Exhibit 21.
As indicated previously, Republic believes that the best way to view the remote nature of this
proposal is from the site itself. Republic expects that its resubmittal will be in the County staff’s
review process, and public hearings before the Commission will not have taken place, so there
will be ample time for interested citizens to continue to see the site in advance of public hearings.
As we did for all four of the Open House events, Republic will continue to follow COVID-19
protocols that are in place at the time for any additional site visits.
Republic also found Tele Town Halls to be an effective way to reach a lot of people in a short and
effective manner, allowing people to ask questions from the comfort of their home. Thus,
Republic held a fourth Tele Town Hall in early November 2021 to maintain lines of direct
communication.
In the Introductory Statement, Republic identified an array of public outreach measures. The list
above, when combined with the website and e-mails, each separately addressed below,
illustrates that we will continue to deploy the most effective means of direct communication we
have used throughout this project.
C. Website
Republic has posted its entire application on its existing project website for any interested citizen
to review. In its notices, Republic has directed all interested parties to the project website. This
continues Republic’s practice of making all public documents readily available to interested
citizens. The web address for the project website is https://westwingtransfer.com/resources/
D. Site Posting
In accordance with Section 305.3 of the Zoning Ordinance, and on September 1, 2021 (within 30
days upon submitting the Application), Republic posted notification signage near the property
regarding the proposed zoning change.
Republic selected this Property because of its extreme isolation. Thus, sign postings on the
Property, as required by the County, would be seen by no one. Therefore, in an effort to ensure
visible signage, Republic voluntarily posted signs at the south corner of the intersection of
Vistancia Parkway and Happy Valley Road and at the southeast corner of the interchange of El
Mirage Road and the 303 (see Exhibit 22). In addition to the County’s standard text, these signs
clearly indicate the actual, remote location of the Property.
The postings include a brief description of the area of the proposed change, a general explanation
of the nature of the proposed change, the name of the applicant, and contact information for the
applicant. Republic submitted a signed sign posting affidavit, along with photographic evidence,

to Maricopa County to demonstrate proof of posting within 30 days of the Application submittal
(see Exhibit 23).
E. Response Procedures
In accordance with Section 305.5.3 and 305.5.4 of the Zoning Ordinance, property owners and
other interested stakeholders are encouraged to contact Republic to discuss any questions or
concerns they have regarding the Application. Republic has posted the entire Application for
zoning case Z2021090 on its publicly available project website. A copy of the Application is also
on file with the Maricopa County Planning and Development Department.
Individuals are free to contact Republic or the Maricopa County Planning & Development
Department at any time during the application review process. Republic anticipates receiving
additional inquiries throughout the rezoning process, either through the project website or to its
representatives at Gammage & Burnham. We will continue to respond to all substantive
inquiries.
F. Status Procedure
Should any material changes or amendments to the proposed development occur after
Republic’s initial notification has been mailed to residents and interested parties, Republic will
contact the affected parties describing the changes. Republic will provide a record of this follow-
up to the Maricopa County Planning & Development Department.
In accordance with Sections 305.6 and 305.9 of the Zoning Ordinance and prior to the notice of
public hearing, Republic will submit a written report with results of the citizen participation
effort. Republic will prepare this report in accordance with Sections 305.9.1 and 305.9.2 of the
Zoning Ordinance.
VIII. Stakeholder Response to Date
A. Neighbors
To reiterate, the Site has no residential neighbors at all. Our only neighbors are public
infrastructure providers.
The Western Area Power Administration has expressed no objection to the rezoning case, see
Exhibit 24. They have expressed no concern about public safety or fire issues.
Arizona Fire & Medical Service operates a fire station just northwest of the Power Station. They
have already issued a will serve letter for the proposed Facility. See Exhibit 25. Republic has met
with Arizona Fire & Medical, and is engaged in ongoing dialogue with them. They have asked
Republic to provide an emergency-only secondary access to the Site, and republic has modified
its site plan to do so.

The Arizona Department of Transportation has also expressed no objection, see Exhibit 26.
B. Public Response
Public reaction has shown some support, some opposition, and some neutrality after learning
more about the proposal. Documentation of both opposition and support are on file with the
Maricopa County Planning & Development Department, and are available from the Applicant
upon request.
As suggested above already, as Republic continues to host both virtual and in-person community
events, interest in and opposition to the case has continued to decline. This downward trend
demonstrates effective communication about the proposed project, including its risks and
benefits. See Exhibit 27, Open House Attendance for a graphical representation of declining
interest in the case. Likewise, Republic’s fourth and most recent Tele Town Hall only lasted about
45 minutes, also indicating a general public satisfaction with the amount of available information
about the proposal.
Community leaders and organizations have expressed support for the Recycling & Transfer
Facility. This begins with the entire Legislate delegation of District 22, each of whom took the
time to provide their individual thoughts to the County. It includes Surprise Mayor Skip Hall, who
touted the recycling aspects of the Facility, and Phoenix City Councilman Jim Waring, whose
District includes a similar facility. The Peoria Chamber of Commerce, an important community
business organization, has indicated their support. See Exhibit 28, Community Leadership
Letters of Support.

Details and Techniques Used to Involve the Public
Republic has personally met with hundreds of area residents, contacted more than three dozen
community associations, and engaged directly with hundreds of residents on line and in writing.
Specifically, Republic has:
Contacted all 37 HOAs within ten miles of the site, and offered to meet with them; 14
agreed to meet, and we did so.
Hosted four Open Houses on the site attended by more than 100 residents.
Hosted four Tele Town Halls attended by more than 600 people.
Participated in HOA virtual meetings with Corte Bella, Sunleya, Vistancia and Trilogy at
Vistancia, attended by around 225 people.
Toured the Corte Bella Government Affairs Committee on site at the existing Cave Creek
Recycling and Transfer Station, including a visit to the tipping floor itself (13 residents), as
well as the closest single family home (11 of the 13 residents).
Hosted a community clean-up in the Agua Fria Riverbed.
Distributed eight project newsletters to more than 750 people.
Operated a project website which contains all information about the site, including a
video tour, all of our technical reports (noise, traffic and property values), and a contact
point.
Responded via e-mail and the project website to more than one hundred individual

Tele Town Hall was approximately 1 hour long. There were 609 attendees across all four
of the Tele Town Halls. Audio recordings of each of the Tele Town Halls are available to
the public on the WestWing website at https://westwingtransfer.com/resources/.
Community Cleanup: During ongoing communication with the community, the Applicant
learned of illegally dumped material near the Agua Fria River bed and Tierra del Rio. On
March 3, 2021, the Applicant hosted a free cleanup of this area and hauled away more
than eleven (11) tons of trash. See Exhibit 10 advertising and summarizing the cleanup.
Two community members participated in the cleanup alongside Republic Services,
successfully removing couches, carpet, bottles, cans and a large amount of concrete.
Other meetings with interested citizens: The Applicant also met with Vanessa Angell and
Thomas Angell on February 5, 2021 to continue ongoing discussions about the northwest
valley’s need for a transfer station. The Applicant met again with Mr. and Mrs. Angell, and
JJ Fowlie, on February 9, 2021 to discuss the upcoming rollout of the proposed WestWing
facility. Mr. Fowlie was invited to, but did not participate in, the March 3, 2021 community
clean up lead by Republic Services.
Notice of Filing: In accordance with Sections 305.4, 305.5.1, and 305.5.2 of the County
Zoning Ordinance, and within 30 days upon submitting the Application, Republic sent
written notice by first class mail to:
i)
each real property owner as shown on the last assessment of Property within
three hundred (300) feet of the proposed rezone boundary,
ii)
the heads of any homeowners associations within three hundred (300) feet of the
proposed rezone boundary, and
iii)
the City of Peoria, the Arizona Department of Transportation, and other
potentially affected citizens who have requested that they be placed on the
routing list maintained by Maricopa County.

The notice by mail included the description of the area of the proposed change, the name
of the applicant, and contact information for the applicant. The notice was sent to 19
stakeholders. Republic submitted a copy of the notice and an affidavit demonstrating
proof of such notification to Maricopa County on September 1, 2021, within 30-days of
Application submittal (see Exhibit 19).
The County has identified additional parties in interest affected by this proposal as
Arizona Department of Transportation (ADOT), Property Owners & Residents Association
for Sun City West (PORA), Mining District, Lafarge North America, Concerned Citizens of
Cross River, Philip Spiller, Ed Grant, Maricopa Association of Governments, ADOT Right of
Way Project Management, Sun City West Independent, North County Fire District,
Maricopa County Parks and Recreation, WestWing Business Park, Insight Land, City of
Surprise and City of Peoria (see Exhibit 20). These additional parties were included in the
Notice of Filing mailing.
E-mail newsletters: Republic has issued newsletters via e-mail to hundreds of interested
citizens about the project. Republic utilized the e-mail addresses of all residents who
submitted public comments on Case Z2020017, and to those additional residents who
have reached out to the Applicant regarding the proposed WestWing Transfer Facility.
The newsletter mailing list currently includes 778 residents, see Exhibit 15 for the
distribution list. The newsletters contain information about the proposed facility in
relation to noise, traffic, and property values, and address frequently asked questions.
See Exhibit 16 for all nine of the newsletters that have been published to date.
Newspaper ad: Republic ran an ad in the Peoria Times on February 25, 2021 notifying
readers of its exploration of the WestWing site for a potential transfer station. See Exhibit
17.
E-mail communication: Republic responded via e-mail to more than one hundred
individual citizen e-mails.
In summary, more than 8,000 residents were individually invited to participate in the process.
Across the Open Houses, Tele Town Hall meetings, HOA meetings, facility tours, community clean
up, direct e-mail dialogue and individual meetings, residents directly interacted with Republic
approximately 1,052 times.

Summary of Concerns, Issues and Problems
Residents attended Tele Town Halls, HOA meetings, Open Houses and facility tours to learn
more about and ask questions about the projects. Residents expressed concerns about traffic,
noise, odor, property values, health and genetic mutations. Republic addressed these concerns
by commissioning, and publishing on the WestWing project website, the following: Traffic Study,
Property Values Study, Noise Study, and an Economic Impact Report. In addition, all application

materials and audio recordings of the Tele Town Halls are available for download from the
WestWing website, as are all of Republic’s submittals to the County associated with this case.
Republic had previously proposed a zone change for a waste transfer and recycling facility in
zoning case Z2020017. This case was withdrawn due to public concern. Republic invested
additional time and finances to explore a better location and, with continued dialogue with the
community, identified this ideal property approximately 3,060 feet northeast of the intersection
of Loop 303 and El Mirage Road. Ongoing dialogue with the community lead to free bulk trash
service for nearby residents and the agreement to establish of a hotline to report concerns.
Republic has and will continue to work with the community regarding the necessary
development of this critical infrastructure.

Virtual Town Hall Summary
Questions related to re-zoning and site location
Question: Why not the Lake Pleasant Parkway industrial zoned areas off Rt. 303 and away from housing
developments?
Answer: The Lake Pleasant Parkway/Loop 303 interchange is too remote for any existing trash
streams to be useful as a transfer station. The reduction in local trash truck travel distances would not
be significant.
Question: What other sites have been considered for this? Why isn’t an area on the 60/Grand Avenue,
toward Wickenburg being explored?
•
Answer: We evaluated over 40 potential properties in the Northwest Valley, and we feel
the proposed location is ideal. It is located close to the Loop 303 and would utilize no
existing residential roads. It is in a future industrial park and does not require rezoning
from either commercial or residential uses. And, as noted earlier, transfer stations are
most effective when located near existing waste collection and recycling routes. This is
one of the fastest growing zip codes in Maricopa County.

Question: When will the rezone be made to the County for the rezoning from I-2 to I-3 associated with
this proposed project? Who will be making the application, Republic Services or the WestWing Industrial
Park, LLC developers?
•
Answer: Republic Services has filed a pre-application for the rezoning. Once the pre-
application process is complete, Republic Services will be permitted to file the rezoning
application, and that lengthy, public process is expected to take about 9 months.
Republic Services will be making the application with the authorization of the WestWing
Industrial Park owners.
Question: Will the rezone allow public comment as part of the Board of Supervisors review and
approval?
•
Answer: Yes. Public comment is welcome and encouraged during any rezoning process.
Question: If the area is rezoned as I-3, would this not create the potential for other I-3 uses/industry to
move in?
•
Answer: The rezoning application would only be valid for our 10-acre parcel. The 65-
acre remainder of the existing industrial park would remain zoned I-2, allowing a full
range of manufacturing, trucking, and warehouse activities.
Question: What is the difference between i-2 and I-3 zoning?
•
Answer: Maricopa County I-2 zoning allows truck depots, warehouses, and
manufacturing. I-3 zoning is intended for uses that are not included in the I-2 list, and
that includes transfer stations.
Question: What, to your knowledge, is going in the rest of the industrial park?
•
Answer: We don’t know. The existing zoning allows manufacturing truck depots and
warehousing.
Question: Is the property already owned by you, thereby making it attractive to you?
•
Answer: No, Republic Services is under contract to purchase the property, and that is
contingent on a successful rezone.
Question: Will Republic Services notify the Corte Bella HOA when the rezoning application is filed?
•
Answer: Yes, Republic Services will remain in contact with Corte Bella through the
process.
Question: When was this land zoned for industrial?
•
Answer: The County Board of Supervisors approved the I-2 rezoning of the WestWing
Industrial Park in Fall 2019.
Question: We are not serviced by Republic Services. How would this keep our prices down as is being
promoted in your literature?
•
Answer: The same way any business competition keeps prices under control. One gas
station in a community can charge higher prices. Multiple gas stations in an area can
keep prices under control as businesses compete. Transfer stations reduce labor,
maintenance and fuel costs to municipalities, saving cities money and those savings
could be passed along to you, the customer. In addition, because trucks do not have to
travel as far to recycling centers or landfills, there are fewer vehicle emissions and less
wear and tear on roads.
Questions related to operations and safety
Question: You’ve talked about tipping floors earlier. What is a tipping floor?
•
Answer: The tipping floor is the concrete pad inside the transfer facility. It is where the
local trash and recycling trucks “tip” or empty their contents.
Question: The danger of an electrical substation in the area is very real. I don’t understand proposing
such a facility in that location.
•
Answer: We do not believe the substation proposes any fire risk to any of its neighbors,
whether it be the fire station the single-family rental homes, the RV storage facilities or
the existing industrial park. That would include our facility as well. Regardless, the
transfer station will be equipped with best-in-class equipment, including fire
suppression, along with well-trained employees.

Question: What cities or communities in the Northwest Valley does Republic serve now? And who are
you planning to serve?
•
Answer: Republic Services serves commercial and industrial customers throughout the
Northwest Valley. Like any business that is growing and competing, we hope to expand
our customer base. We think other local haulers in the area will see the economic
benefit to them to stop driving their local trucks long distances and use our facility
instead. This would dramatically shorten their travel times.
Question: It has been said to me by Stephen Herring that Republic plans to have in the beginning 3 to 5
trucks with one transfer truck at the site.
•
Answer: We anticipate 3 to 5 trucks will utilize the facility each hour while it’s open. This
estimate includes both local and transfer trucks.
Question: What are the proposed daily tonnages the facility will handle?
•
Answer: That will vary depending on the size of the trucks using the facility. Typically,
we estimate between 100 and 175 tons per day.
Question: Where are the empty trailers parked while waiting to be filled with garbage? How are these
empty trailers cleaned to prevent odor and rodent infestation?
•
Answer: The transfer vehicles will queue on the property and leave as soon as they are
loaded with materials. Empty trailers are stored off-site at another location.
Question: How will transfer trucks be stored if they are only half full at the close of business? Will you
pull it into a bay or leave it outside?
•
Answer: One or two transfer trailers (for trash and recycling) half-full at the close of
business would be tarped and stored within the “tunnel” inside the facility. Every
evening all bay doors of the facility would be closed. No transfer trailers would be
stored overnight outside the facility.
Question: Will the trucks have back-up alarms and how far will that noise travel? Will we hear the
alarms?
•
Answer: Local vehicles do have back-up alarms. Our site plan calls for the local vehicles
to back up on the north side of the facility (where the bay doors are located), thus
mitigating any noise. Regional vehicles would not back up at the site. We believe any
sound coming from the facility will be negligible, compared to existing noise on the Loop
303.
Question: Is there any hazardous materials or medical waste deposited at this location? If yes, and there
is a spill, what is your operational plan for this type of emergency?
•
Answer: No. Republic Services does not accept or haul hazardous or medical waste at
this facility. Those materials are handled by specialized waste hauling businesses.
Question: How do you guarantee that no toxic materials will get to the station?
Answer: We have screening to detect and reject any such material.
Question: Who inspects the transfer station and how often? The website says up to 80 trucks daily.
•
Answer: ADEQ and Maricopa County have jurisdiction. A quick clarification: the website
says 80 truck trips daily. One vehicle entering and then subsequently exiting counts as
two traffic trips. So only 40 trucks daily.
Question: How do we know you will abide by your expressed commitments? It’s easy to say things now
but as this area grows over the next 5-10 years, what keeps you from changing your mind?
•
Answer: These commitments would be submitted as part of our public approval
process. If we don’t adhere to them, the County can cite us and, ultimately, revoke our
permit.
Question: Where do you next take the waste & recycle material? Is it to the landfill off I-17 and 101?
Would it make sense to have a transfer station closer to the landfill?
•
Answer: Trash would be taken to the Republic Services landfill located in Buckeye and
the recycling would go to either the City of Phoenix’s facility or a Republic-owned
property under construction in the East Valley. It would not make sense to locate the
transfer facility near the landfill for the reasons noted previously.
Questions related to odor and traffic
Question: How often do you rinse the area?
•
Answer: We do a dry sweep of the floors each night. We do not typically rinse the
tipping floor as water can result in leachate production.
Question: The proximity to planned communities is not acceptable. You cannot promise that this service
will not affect our communities with increased truck traffic and potential smells.
•
Answer: Actually, the very purpose of a transfer station is to eliminate truck traffic off
the 303, cutting truck trips by two-thirds. There would be more trucks on the 303
without a transfer station. We think the absence of a transfer station to serve the
communities in this area, when the rest of the Valley already has this service, is not
acceptable. Republic Services has a long-standing commitment to being a good
neighbor. We are taking extra precautions to ensure that truck traffic and odor is not a
nuisance. For example, the truck bay doors will be located on the north side of the
facility, at the furthest point from residential developments, and they will be closed
nightly. We propose to build an access road that will allow trucks to enter and exit
directly from the Loop 303, away from neighborhoods.
Question: Heat and garbage mean smell. How can you promise that in the hot months of summer that
your facility will have sufficient cooling to mitigate this situation?
•
Answer: As you know, Republic Services is an Arizona-based company and we operate
several transfer stations and other facilities throughout this region, so we’re very
familiar with the market. The operational commitments we’ve made, and the odor
mitigation efforts we employ, are designed to work in both the winter and summer
months.
Question: There is no question that the increase in truck traffic may create a significant increase in
noise, including those accelerating and heading north on El Mirage. Is Republic Services prepared to help
the community find effective noise mitigation techniques and is Republic services prepared to fund
those efforts.
•
Answer: We do not believe there will be a need for noise mitigation. Here’s why. Trucks
will not be accessing the transfer facility from El Mirage. They will be accessing the
facility from a not-yet-built-access-road at Exit 123, on the north side of the Loop 303.
Further, daily traffic to and from the facility is estimated to be 40 trucks, which
represents less than 0.2% of the 30,000 daily trips on the 303.
Question: Why do you say this won’t impact roads? Are you committing that you will not drive garbage
trucks or transfer trucks on the 303, El Mirage and Grand Avenue?
•
Answer: Local trucks are already driving these roads today. If we can cut those trips by
two-thirds, with the addition of a transfer facility, then the 303 will be in better shape
than it is today, with fewer long-distance truck trips. We are conducting a traffic study
and are confident that this transfer facility will have a negligible impact on existing
traffic counts. The vehicles that service you now will continue to do so, but one of the
benefits of this critical infrastructure is the reduction of wear and tear on local roads.
The traffic study will be shared on WestWingTransfer.com as soon as its available.
Question: You said no additional traffic on local roads, but by opening to landscapers and others, they
will use El Mirage as an access point, which would increase traffic in our local housing areas.
•
Answer: As a follow-up to the previous answer: the vehicles (landscape or otherwise)
that service you now will continue to do so. But any vehicle wishing to utilize the
transfer facility will only be able to access it via Exit 123, on a yet-to-be-built road, north
of the Loop 303. The facility will not increase vehicle traffic in area neighborhoods, and
we are currently conducting a traffic study that includes El Mirage and the 303.
Question: The trucks that currently exit the 303 at El Mirage are noisy and the sound barrier is
ineffective. What will you do to mitigate this noise?
•
Answer: We are prohibiting our larger transfer trucks from using their air or “jake”
brake, which will greatly reduce noise coming from vehicles that enter or exit the 303
from Exit 123.
Question: Will noise impact be part of the traffic study?
•
Answer: No, it is not.
Question: What hours would the trucks be coming and going and creating noise?
•
Answer: The proposed hours of operation are 5 a.m. to 6 p.m., Monday through Friday,
with reduced hours of operation on Saturday. There will be more restricted hours of
operation for landscapers and residential customers utilizing the bulk drop off option,
but those have not been established yet.
Question: How does a highway or power station mitigate airborne odors?
•
Answer: They don’t, although a highway obviously generates an enormous amount of
emissions, more than any single other business operating in your community. But our
proposed location utilizes the Loop 303 and the substation as buffers between the
transfer station and residential areas. Further, we have committed to using best-in-class
technologies and design to mitigate noise and odor issues. These include sweeping the
tipping floor nightly, utilizing anti-odor misting systems, closing the bay doors every
evening, locating the bay doors on the north side of the parcel, away from residential
areas, and building a future access road from the Loop 303 to the facility.
Question: Have the misters been used at other Republic transfer stations? If so, which ones?
•
Answer: Yes, misters are present in most of our transfer facilities nationwide.
Question: How far does this misting scent travel? Would we smell this in our community?
•
Answer: The misters are located on the inside of the facility, by the bay doors, on the
north side of the building, and are meant to keep any odor within the building. We do
not anticipate the scent will leave the site.
•
Questions related to property values
Question: How can you state that there is no impact on property values, odor and noise and the location
is not close to residential areas?
Answer: We feel confident in saying this because we are unaware of any study showing
a correlation between transfer facilities and decreased property values. In fact, there
are 32 transfer stations in Maricopa County, and home values throughout the county
increased by more than 17 percent in 2020.

Question: Are you aware of the EPA’s 63-page study that states that transfer stations in fact decrease
property values?
•
Answer: We are aware of the document you are referring to, but it is not a study. There
was no evaluation or examination of property values and there were no conclusions
drawn backed by data. Rather, the EPA document detailed considerations for siting a
transfer station. In one paragraph, the agency noted that locating too many industrial
and environmental facilities in low-income communities could potentially further
depress property values in the area. None of these factors are relevant to the WestWing
site.
Question: Who was there first – you or the homes?
•
Answer: Homes. Rapidly growing communities require infrastructure and services to
support the residential and commercial development. For example, who was here first:
the homes or the grocery stores? The grocery stores did not arrive until after the people
did. The same is true for us. That’s why this recycling and transfer facility is now needed.
It was not needed before. Your trash and recycling are what makes this business viable.
Questions that don’t immediately fit into other categories
Question: Are you aware there is a petition with over 1,900 signatures opposing your request?
•
Answer: Yes. We encourage anyone with questions or concerns to visit
westwingtransfer.com
Question: How much community input has been scheduled to discuss the feasibility of this project and
the impact on residents?
•
Answer: We have conducted three town halls, organized two site tours, responded to
more than 100 emailed questions, and met with several community HOAs. These
outreach efforts are continuing now and throughout the re-zoning process.
Question: I have spoken to Mayor Carlat and if violations occur it would not be the City of Peoria that is
responsible. That would be up to Maricopa County.
•
Answer: That is correct. The proposed site is in unincorporated Maricopa County and it
would have jurisdiction.
Question: What independent studies have been done in other Phoenix metro areas to evaluate the
value and effectiveness of these transfer facilities?
•
Answer: We are not aware of any such studies in Maricopa County. However, transfer
facilities are effective when they reduce truck traffic, reduce wear and tear on roads,
provide efficient disposal options and exist in convenient, easy to access locations.
There is a reason these facilities exist all over the Valley today: they work.
Question: Will you combine your trash facility at this location with corporate services like you have at
other locations?
•
Answer: No. This will be a recycling and transfer facility only.
Question: With a 17,000 square foot facility there is lots of land to expand on. What guarantee do we
have that there are no plans for additional growth?
•
Answer: The facility is designed to accommodate at least 15 years of growth. If an
expansion is required in the future, there is only room for one additional bay. That
would bring the total footprint to a maximum of 20,000 square feet.
Question: What is the timeline for opening of this site?
•
Answer: The rezoning application takes 9 months. After that we would have to
construct the proposed access road. Assuming no delays, we anticipate being
operational in 2023.
Question: Who are your commercial customers? What kind of trash is coming from them?
•
Answer: Potential customers include municipalities, other haulers, and Republic
Services. Trash will be what is considered standard “front load” waste. Think items that
might come from a department store, office building or gas station.
Question: What other transfer facilities are located so close to residential areas? Google Earth
measurement shows this facility would only be about 2,200 feet from the nearest residence.
•
Answer: All the existing transfer stations we have suggested that you and your neighbors drive
by are within a quarter of a mile of homes. It’s not uncommon for transfer facilities to be within
½ a mile, or even a ¼ of a mile from the nearest residence, and that’s true in Maricopa County as
well. We feel this site is particularly advantageous because it’s sheltered from residential areas
by the Loop 303 freeway and the WestWing substation.
Question: Please clarify your statement about once a month bulk drop off. Is it true that it will not be
picked up and residents will have to take their bulk waste to your facility?
•
Answer: Yes, the free monthly bulk disposal is a benefit to residents. You will have to
bring your items to the facility. We cannot pick them up as other providers have
exclusive contracts for waste disposal.
Question: Would you please ask about a traffic light that could be installed at the new access road exit?
•
Answer: Traffic lights are installed based on the traffic volume and flow of each intersection.
Maricopa County Department of Transportation would be the governing body responsible for
deciding whether to install a traffic light at that location.
Question: On average, how much in property taxes do your facilities pay?
•
Answer: At Cave Creek we paid a little over $100,000 last year. At Chandler, a smaller facility
without business offices, we paid a little over $30,000 last year.
Question: Can you discuss the Rainbow transfer station in California and how that situation will not
occur here?
•
Answer: Republic Services acquired the Rainbow transfer station when it purchased
Rainbow Environmental Services, which means we inherited the facility in an “as is”
state. We have since funded tens of millions in improvements to the site, including a
new 45,000 square foot building, best-in-class ventilation systems and filtration and
other odor mitigation measures. We don’t consider Rainbow and WestWing to be
comparable because we will be constructing this site ourselves as a best-in-class facility.
Question: What about security at the facility after hours?
•
Answer: Our property will be surrounded with fencing and gates and will be equipped
with security cameras and monitoring. The bay doors of the transfer facility will also be
closed nightly. We do not anticipate any issues with trespassing.

The proposed location for the WestWing Recycling and Transfer Facility is in an
industrial area south of the WestWing Power Station and north of the 303.
The site was selected after considerable input from residents who had opposed
locating a transfer facility at 115th Ave. and Happy Valley Road. In fact, this new site
was suggested by some in the community.
The 17,000 square foot facility will be nearly impossible to see from residential
neighborhoods and there will be no additional truck traffic in residential
neighborhoods.
The WestWing Recycling and Transfer Facility will also help keep trash rates low and
preserve recycling.
It will not impact property values but it can help preserve recycling for Northwest valley
communities.
