Dear Mr. Cannon:  
As you know, our firm represents the Dos Rios Community Association 
(“Association”). The Association renews its opposition to the proposed zoning 
change for the construction of a recycling and transfer station by Republic Services 
in Zoning Change Case No. Z2021090.  
The Association, with its 432 single family homes, is located in close proximity 
to this proposed recycling and transfer station. To construct this proposed recycling 
and transfer station, Republic Services seeks to rezone a 10 acre parcel of land 
within the WestWing Business Park from I-2 Light Industrial Zoning District to I-3 
Heavy Industrial Zoning District.  
In my previous letter dated October 4, 2021 to you as the representative of 
Maricopa County, the Association set forth its concerns regarding the following: 
 Additional diesel trucks coming and going from the recycling and 
transfer station, resulting in increased truck traffic noise and odors from 
diesel exhaust fumes.  
 Pungent odors from the waste being stored at the transfer station being 
wind blown into the neighborhood.  
 Safety concerns of fire(s) at the transfer station given its close proximity 
to the power substation.

 Potential increase of rodents, birds and other wild animals that may be 
attracted to the transfer station and then becoming a nuisance in the 
Association  
Additionally, the Association raises the concerns of the possibility of 
contaminants from the transfer station entering the water run off that drains into the 
Association’s Common Area. 
All of these factors will likely have a negative impact on the property values of 
the homes within the Association. 
 Based on these concerns, the Association again formally and strongly 
opposes the zoning change requested by Republic Services. The Association 
requests that Maricopa County does not approve Republic Services’ proposed 
zoning change to I-3 Heavy Industrial Zoning District. 
 
 
In conclusion, the Association does not believe that a recycling and waste 
transfer station at this site is consistent with the character of the surrounding 
single-family developments. The Association appreciates your attention to this 
matter.

Rezoning land to heavy industrial that is near existing 
neighborhoods is inappropriate. Including a Waste Transfer 
Station within that zoning is unacceptable. Particularly since 
Republic doesn't service our community. Further there are 
seniors and children living in that area. It is unacceptable to 
build such a facility near a vulnerable population. It is 
disgraceful that the group that fought the first proposed location 
recommended this site. Based on their concerns, I would have 
expected Republic to find a site within their service area yet 
away for senior and family communities. If Republic doesn't do 
the honorable thing and drop this request for rezoning, I expect 
our officials to stop this and listen to their constituents.

When I heard of the proposal sited above I immediatly went on 
line to determine what I could learn about the project but more 
importantly the project owner. I do not have the resources to do 
detailed examintation of their record but in the case of Republic 
Services (I believe the record of the firm enumerated below is one 
in the same,) but I cannot be sure. I suspect 
our commissioners and supervisors who oversee the process and 
make recommendations should be able to vet the proposer to the 
extent required to make a public vote, up or down and defend it to 
the public.If the petioner is one and the same as the vviolation 
record we see here, i for one would be very skeptical of a 
recommendation to proceed.

Please do not approve this project. The location is too close to 
multiple single-family housing developments and it will have a 
negative impact on our property values, as well as result in 
excessive noise, truck traffic, and safety concerns. Finally, 
approving the zoning for this facility will open the door for other 
heavy industrial uses. Heavy industrial use of the land seems 
to be in coflict with the definded purpose in the Zoning 
Ordinance: 
 
PURPOSE: The principal purpose of this zoning district is to 
provide for heavy industrial uses in locations which are suitable 
and appropriate, taking into consideration land uses on 
adjacent or nearby properties, access to a major street or 
highway, rail service or other means of transportation, and the 
availability of public utilities while encouraging sustainable 
development practices.

become the norm. Place heavy truck will be coming off the 303 
and El Mirage or drive on El Mirage north from Bell. Please to 
not give an Exception to the present zoning status if you give it 
to one you’ll have to give it to others and before you know it the 
land will be resigned to something that was not its intent thank

Please do not allow the zoning changes the Zone was set up 
with great research do not undermine that former process. We 
do not want the waste management building and process in our 
neighborhood. This will have an impact on traffic noise and 
pollution. The heavy truck coming on of off exit on el mirage 
and 303 could create safety concerns. That’s why changes to 
the zoning would be inappropriate based on the intent of the 
original land use.

Regarding the permit and zoning for this waste transfer station, 
it is unbelievable to me this is the only site they could find. It is 
in close proximity to homes and not to mention a huge power 
and transmission plant. REALLY. These folks do not pick up in 
our area, they are adding more traffic and unnecessary noise, 
when they could go to a less densely populated area. Please 
do not permit this company to place this station here.  
All the choices for this site are bad. I realize the NIMBY issue: 
however, they do not operate in this immediate area and 
therefore are going out of their area to bring this site near us. 
Please consider the homes and residents that will be affected

I am writing to once again state my opposition to the building of
the WestWing Transfer Station. This site is way to close to both
established and future planned homes. It is also located under an
ever expanding power substation. Transfer stations are known
for fires and a fire in this location, under and next to power lines,
could be disastrous. Republic Services does not service the
surrounding homes and is pleading it’s case as a positive for the
city of Surprise and not the surrounding residents. Over 5000
residents have signed a petition stating their opposition to this
facility and their voices should be acknowledged. Thank you.
