The applicant is seeking a SUP amendment to expand an
existing RV & boat storage business. The proposed expansion
will allow for two additional development phases for RV and
boat parking. The amendment will also eliminate a status
report condition and alter an undulating setback along
Carefree Hwy.
The subject property is designated as a Rural (0-1 d.u./acre)
in the Daisy Mountain/New River Area Plan and as
Undesignated Area in the City of Phoenix General Plan. There
are thirteen (13) support letters from neighbors and
community groups and no known opposition to the request.
Staff received no concerns from relevant municipalities.
Daisy Mountain Fire Prevention (DMFP) sent staff comments
about fire service requirements to the site to be addressed at
the time of construction permitting. ADOT ROW Project
Management indicated no concerns with the proposal. There
are no concerns from County review agencies.

Recommendation:
On 1/13/22, the Commission voted 6-0 to recommend
approval of Z2021098 subject to conditions ‘a’ – ‘k’:
a.
Development of the site shall be in substantial conformance with the Site Plan
entitled, “Carefree RV Center Expansion” consisting of one full-size sheet dated
December 21, 2021, and stamped received December 21, 2021, except as
modified by the following conditions.
b.
Development of the site shall be in substantial conformance with the Narrative
Report entitled, “Special Use Permit Major Amendment to Z2015014 for Carefree
Crossings RV & Boat Extension”, consisting of 11 pages, dated, revised December
17, 2021, and stamped received December 17, 2021, except as modified by the
following conditions.
c.
The property owner shall submit a ‘will serve’ letter from the Daisy Mountain Fire
District for fire protection services for the project site. A copy of the ‘will serve’ letter
shall be required as part of the initial construction permit submittal.
d.
Deleted.
e.
The following Maricopa County Environmental Services Department (MCESD)
conditions shall apply:
1.
The owner will abandon the septic systems and connect to a public sewer
system when one is available, and participate in a fair share of the public
sewer system funding.
2.
Development and engineering design shall be in conformance with the
Maricopa County Stormwater Quality Management and Discharge Control
Regulation. The owner/developer shall prepare a Stormwater Site Plan
(SWPP) and obtain approval by MCESD prior to construction (a separate
submittal to MCESD is required).
3.
Upon completion of construction, the owner shall fulfill MCESD post-
construction requirements. This will include appropriate operation and
maintenance requirements.
f.
The following Planning Engineering conditions shall apply:
1.
The site contains a small area of regulated floodplain and jurisdictional
washes in its southeast corner. Floodplains must be clearly mapped on
construction plans. Any disturbance to the floodplain will require a
floodplain use permit concurrent with building permit(s). Owner/Applicant
is responsible for identifying and procuring any permit(s) for disturbance of,
or work within delineated jurisdictional (404) washes.
2.
Detailed Grading and Drainage (Site Infrastructure) Plans must be
submitted with the application for Building Permits indicating that the site
will drain to an existing retention basin.

3.
No new driveways to Carefree Highway or 7th Street are included with this
entitlement. Access to the development site shall be via the existing
driveway located on 7th Street.
4.
The subject site is located within the County’s Urbanized Area. A Storm
Water Pollution Prevention Permit (SWPPP) from the County will be required
prior to issuance of any construction permits.
5.
Engineering review of planning and/or zoning cases is for conceptual
design only. All development and engineering design shall be in
conformance with Section 1205 of the Maricopa County Zoning
Ordinance; Drainage Policies and Standards; Floodplain Regulations for
Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of
application for construction.
6.
Based on the conceptual design nature of the information submitted,
changes to the site layout may be necessitated by the final engineering
design of the site’s drainage infrastructure.
g.
Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Special Use Permit as set forth in the Maricopa County
Zoning Ordinance.
h.
The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, and at the time of expiration of the Special Use Permit, the
property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to
comply with any conditions, or the expiration of the Special Use Permit, does not
reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation
or expiration of the Special Use Permit. The Special Use Permit enhances the value
of the property above its value as of the date the Special Use Permit is granted
and reverting to the prior zoning results in the same value of the property as if the
Special Use Permit had never been granted.
i.
The drainage channel included within the SUP area shall be maintained in
perpetuity by the property owners of all parcels within the C-2 CUPD zoning district.
j.
GSA Pavement shall be permitted as an acceptable pavement for parking
spaces and internal driveways with the approval of a dust control plan in
accordance with the requirements of Maricopa County Air Quality Control.
k.
Development of the site shall comply with all conditions of Z2015013 except that
the undulating setback shall comply with the Site Plan entitled “Carefree RV
Center Expansion” consisting of one full-size sheet dated December 21, 2021, and
stamped received December 21, 2021.

Project Summary:
1.
Casey Mahoney is requesting a Special Use Permit Major Amendment to expand an
existing Special Use Permit (Z2015014) to allow for two additional development phases
for RV and boat parking and modify existing conditions of approval. The subject
properties are located in the Daisy Mountain/New River Area Plan, which designates the
subject properties as Rural (0-1 d.u./acre). The properties are also part of the City of
Phoenix Municipal Planning Area. The City of Phoenix General Plan designates the
properties as Undesignated Land.
2.
The site is zoned C-2 CUPD from the Zone Change with Overlay case Z2015013. This case
strictly limited allowed uses based upon whether the uses were appropriate for septic or
whether the uses needed sewer service to the site. There are no sewer lines along
Carefree Highway currently. Additionally, the zone change case set development
standards in line with Carefree Highway scenic corridor guidelines. The Board approved
a subsequent Special Use Permit (SUP) that allowed a self, RV and boat storage facility
to develop on the site. The original area of the zone change was approximately 17.23
acres.
3.
The SUP area covered approximately 8.87 acres or the north-half of the subject site. The
Board also voted to allow the SUP to have no expiration. The proposed request is to
expand the SUP area approximately 5.46 acres to cover a portion of a drainage channel
servicing the site and the two aforementioned new phases. Additionally, the applicant
is proposing to eliminate the status report requirement from the original SUP conditions of
approval and to adjust, but not eliminate the undulating setback to accommodate the
new phases.

The proposed expansion of the development will allow for an additional 190 RV and Boat
parking spaces. Eighty-two (82) proposed spaces will be covered by a canopy while the
remaining spaces will not have a canopy. An emergency access will also be developed
along Carefree Highway; however, there will be no regular public access to the site from
this location. The site will be accessed through the original access point on 7th Street. The
proposal conforms to the existing conditions of approval and development standards of
the C-2 CUPD zone other than the conditions proposed to be altered.
5.
The subject site is currently zoned C-2 CUPD and C-2 CUPD SUP. The applicant is
requesting to extend the SUP to the entirety of the subject site. The base C-2 zone, existing
C-2 CUPD and C-2 CUPD SUP zoning regulations, and requested zoning standards for the
expanded SUP are listed on the next page:

The applicant is proposing to alter the existing undulating front setback from 60’ to 40’ for
a length of 65’ along the undulating setback. This request would allow for additional RV
and Boat spaces in the Phase 4 portion of the site.
7.
The applicant is also proposing to utilize GSA pavement for storage spaces as is used in
the previous phases of the site with the approval of a dust control plan by Maricopa
County Air Quality Control. The ADA spaces will still be required to be paved in
accordance with Maricopa County requirements.
8.
The applicant is also requesting to eliminate the condition requiring an annual status
report as the site has operated in conformance with conditions since approval.
9.

Daisy Mountain/New River Area Plan (adopted 2019): The Daisy Mountain/New River
Area Plan identifies this site as Rural (0-1 d.u./acre). This land use designation promotes
low-density single family homes at or below one home per acre where the natural
environment may determine a home’s location and access to avoid disruption of natural
washes and steeper slopes. The designation also recognizes that public water and sewer
services may not be available, and access to law enforcement, fire protection, schools,
and parks may be limited.

City of Phoenix General Plan (adopted 2015): The undesignated land use category
denotes areas located within the unincorporated Maricopa County adjacent to the City
of Phoenix municipal boundaries.
Public Participation Summary:
18.
The applicant has complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property owners
and HOA’s within 300’ of the subject parcel and notification to interested parties. Two
signs were posted on site in accordance with applicable regulations. A Public
Participation Results Report was submitted to Staff in accordance with County
requirements.
19.
The applicant conducted several other activities to increase public participation
including holding a lunch with leaders from Kiwanis and the New River/Desert Hills
community groups and sent out a second mailer with a drawing explaining the
undulating setback alteration request. In their interactions, concerns included a concern
that the undulating setback would be eliminated and the potential for light pollution.
Staff did not receive any letters of opposition from concerned citizens.
20.
Staff received thirteen (13) support letters from neighbors and community groups
including Ed Taylor, President of New River Kiwanis and Darren Forstie of the New

River/Desert Hills Community Association Board. The support letters included support from
business owners and area property owners.
21.
Daisy Mountain Fire Prevention (DMFP) sent staff comments about fire service
requirements to the site. These comments are related to the precise development of the
site and will be addressed during the construction permitting process. ADOT ROW Project
Management had no concerns with the proposal.
Outstanding Concerns from Reviewing Agencies:

Staff Analysis:

Staff is supportive of the applicant’s request for a Special Use Permit Major Amendment
and the proposal to modify the conditions to eliminate the status report. The request
represents an extension of a development that is previously existing, established and
appropriate in terms of use on the subject site. Staff feels that the status report has served
its purpose as the development is compliant with the original conditions of approval. In
order to make the original site developable, the applicant constructed a large drainage
channel around the perimeter of the site to remove the site from regulatory floodway.
The owners continue to utilize the drainage channel to serve the site and will continue to
maintain the channel in perpetuity.
24.
The applicant is requesting to vary the pattern of the undulating setback, but not
eliminate the setback by adjusting 65’ horizontal feet of the setback while maintaining
the undulating nature. This alteration is small in nature and is in keeping with the Carefree
Highway Scenic Corridor guidelines. Additionally, the applicant is requesting to utilize
wetted groundnut shell ash (GSA) pavement on site for internal driveways and regular
parking spaces. Staff is supportive of this pavement type with a dust control plan
approved by Maricopa County Air Quality Control.
25.
Staff believes that the applicant has acted in good faith to notify key community groups
in District 3 of the expansion. Furthermore, the applicant provided a second notification
letter outlining how the undulating setback along Carefree Highway would be altered so
that there is no confusion in what is being requested. Staff believes the applicant
received additional public support as a result of that action. Staff received no public
opposition and reviewing agencies have no objection to the requests.
Recommendation:
26.
For the reasons outlined in this report, staff recommends the Commission motion for
Approval, subject to conditions ‘a’ – ‘k’.

therefore, stipulated and agreed that either revocation due to the failure to
comply with any conditions, or the expiration of the Special Use Permit, does not
reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation
or expiration of the Special Use Permit. The Special Use Permit enhances the value
of the property above its value as of the date the Special Use Permit is granted
and reverting to the prior zoning results in the same value of the property as if the
Special Use Permit had never been granted.

The drainage channel included within the SUP area shall be maintained in
perpetuity by the property owners of all parcels within the C-2 CUPD zoning district.

Purpose:
This request is for a Major Amendment to the approved Special Use Permit
#Z2015014 (Existing Parcels: 211-52-014B – a drainage channel, 211-52-014C
& 211-52-014E) to further extend South to Lot 3 (211-52-014G) located at the
northwest corner of 10th Street and Carefree Highway, in District 3 of Maricopa
County Arizona. This site is part of larger overall site that was successfully
rezoned C-2 CUPD through a separate companion application (Application No.
Z2015013). This extension will bring the total area under the Special Use Permit
to +/-14.32 acres.
On the mentioned Lots 1 & 2 (211-52-014C & 211-52-014E) directly North of Lot
3 (211-52-014G), a completed & operating Self-Storage and RV/Boat Park under
the name of Arizona Storage Inns - Carefree Crossings Self Storage & RV
Parking. Given that this area is still burdened by not having a sewer solution
necessary to attract a wider range of commercial retail Users and due to the high
demand/success experienced at the existing site (evidenced by a Parking Wait
List), the owners are desirous of expanding the existing RV/Boat Parking onto
the adjacent land in two (2) new Phases 3 & 4. Both Phases will be
UNCOVERED parking.
Phase 3 will consist of +/-106 new parking spaces on roughly 2.74 acres. This
Phase will be developed immediately. Phase 4 will be an additional 2.33 acres,
with development to be slated. The Amendment of the current SUP to include
Phase 4 Expansion is to ensure this Major Amendment will not need to be done
again if the owners decide to further expand as recommended by County Staff in
the October 5th, 2021 TAC Meeting.
As part of this SUP application to build additional RV/Boat Secured & Screened
Parking, Applicants want to amend one section of the current undulating 40’ – 60’
Carefree Highway Scenic Corridor Landscape Setback line. The modification
being sought happens where the 60’ setback reduces to a 40’ on Phase 4’s
planned site. Applicants are seeking to move the location of this landscape
setback reduction +/-65’ West to the new property line formed with QT. A visual
of this is provided in Exhibit “B.”
Furthermore, on the “interim use” note, Applicant wishes to remove stipulation
“D” on the existing November 2016 Maricopa County Case Number #Z2015014
SUP regarding 5-year written reporting to the status of the existing site to the
Maricopa Board of Supervisors. Applicant also wishes to remove any type of
time expiration associated with the completed and existing site currently in
operation.
Requested Use within the SUP Project Area:
With the approved C-2 CUPD underlying zoning and this additional SUP request,
the owner/developer proposes to expand the current Secured RV/Boat Parking
from the north Lots 1 & 2 – to the adjacent east portion of Lot 3.
The anticipated sequence of Development will be as follows:
• Phase 3: Construction of an additional secured & screened +/-106
uncovered surface parking spaces for RVs, boats, trailers & haulers on the
Eastern portion of Lot 3, consisting of approximately 2.74 acres. There
will be NO access to the Secured Parking from Carefree Highway.
RV/Boat customers will still enter/exit the site from ONLY the 7th St entry.
• Phase 4: Immediately West of Phase 3 is an additional 2.33 acres.
Applicant intends to develop an additional +/-85 uncovered spaces for
RVs, boats, trailers & haulers. Again, there will be NO access to the
Secured Parking from Carefree Highway. RV/Boat customers will still
enter/exit the site from ONLY the 7th St entry. This application’s purpose
is more interested in ensuring the SUP extension onto this Phase 4 land
compared to the immediate development of Phase 4.

located on the SW portion of parcel 211-52-014C.
• Building 2: +/-31,548 SF One (1) story outdoor/indoor self-storage. This
building is North of BLDG 1 and South of BLDG 3… Middle building.

Color Palette: Colors on the site are desert in theme (browns & beiges) to match
the surrounding area and existing operation. See attached pictures
Extension Construction Material: GSA dust proof ground cover, light poles, 6’
CMU block wall with 4’ metal screening on top of the block wall along Carefree
Highway & 10th St (Southern & Eastern Boundaries) & 6’ wrought iron securing
the boundary between Phase 3 & 4. These materials & themes match the
existing site/operation.
Upon expansion into Phase 4, we will extend the wall in the same style as Phase
3 along Carefree Highway and move the wrought iron fence to the QT/Phase 4
Property Line.
Sign Detail/Descriptions: No new signage is proposed for the site as there is an
existing sign off the 7th Street entrance and users WILL NOT have access from
Carefree Highway. The only way to enter & leave will be through the 7th Street
access.

Fence Details/Location: Fencing exists on the existing perimeter on parcels
211-52-014C/E. The new fencing will run along the perimeter of the extension on
parcel 211-52-014G.
The SUP extension will be in keeping with the same high-end quality finish to
match the existing secured decorative block fence built with the Carefree
Crossings Self Storage and RV/Boat Parking Facility.
The new East & West wall will also be the same decorative painted block
consisting of CMU block with intermittent Split Face Block & Steel “Corten”
framing. Finally, “Gabion Cages” utilizing stacked rock are proposed at
alternating locations along the Southern Wall.
The new West wall will be wrought iron fencing to allow for the movement of this
wall’s location – based upon the expansion of the secured RV Parking Facility
OR conveyance of any portion of this Lot 3 to commercial/retail Users.
Comprehensive Plan Designation:
This property is designated “Commercial” in the Maricopa County
Comprehensive Plan. It is located within the boundary of the New River Area
Plan and the Carefree Highway Scenic Corridor Study area which has identified
this property as part of the 7th Street and the Carefree Highway commercial
node area.
In the Scenic Corridor Plan Special Permits are identified as a tool that, in
conjunction with the appropriate underlying zoning designation, can be used to
ensure that any potential impact to surrounding properties is mitigated. With that
in mind, this project is in accordance with the Corridor Plan’s adopted Designed
Guidelines and is both appropriate as a use and in keeping with the areas
character.
Project Access:
The site’s sole access will be through a controlled “code only” access gate at the
entrance of the Carefree Crossings SS/RV Facility. This sole access point is
located more than 400 feet north of the 7th Street/Carefree Highway intersection.
The property will also have an already existing secondary “EMERGENCY
VECHILES ONLY” access located in the Southeast portion of Lot 3 on Carefree
Highway.
There will be NO PUBLIC ACCESS to this Lot 3 RV/Boat Secured Parking area
from Carefree Highway.
Traffic Impact:
Per the October 5th, 2021 TAC Meeting on the subject, Maricopa County staff
have said NO Traffic Impact Analysis is required as the only entrance to the site
is 400’ North of Carefree Highway on 7th St.
Signage:
No Signage is proposed other than directional to have RV/Boat customers enter
from the already existing access drive to Carefree Crossings on 7th Street.

Engineering Review has reviewed the second plan and report routed for review on
11/15/2021, for the subject application and has no objections subject to the following
conditions.
1. The site contains a small area of regulated floodplain and jurisdictional washes
in its southeast corner. Floodplains must be clearly mapped on construction
plans. Any disturbance to the floodplain will require a floodplain use permit
concurrent with building permit(s). Owner/Applicant is responsible for
identifying and procuring any permit(s) for disturbance of, or work within
delineated jurisdictional (404) washes.

The Maricopa County Environmental Services Department (MCESD) has reviewed revised
documents received from the Maricopa County Planning and Development Department for the
above referenced project. This project is a request for approval of a Special Use Permit (SUP)
on a 6.38 acre site on the northeast corner of Carefree Highway and 7th Street from for a
proposed retail/commercial center. According to the documents submitted, potable water will
be provided by a private water company, and wastewater service will be by septic system(s).
Septic systems in this area are not consistent with the Carefree Highway Scenic Corridor Study;
however the Planning Department has indicated a willingness to allow septic systems for low
intensity commercial use on a case-by-case basis.
Based on the above, MCESD raised no objections to the Planning & Development
Department in Accela Automation on August 29, 2021.
Assuming the Board of Supervisors approves the applicant’s request to deviate
from the Carefree Highway Scenic Corridor Study requirements which do not allow
septic systems within the Scenic Corridor, the project is approved subject to the
following stipulations:

1. The owner will abandon the septic systems and connect to a public sewer
system when one is available, and participate in a fair share of the public
sewer system funding.
It should be noted that this document does not approve the referenced project. Comments
are provided only as advisory to Maricopa County Planning and Development Department to
assist staff to prepare a staff report. Other Maricopa County agencies may have additional
requirements. Final review and approval will be made through Planning and Development

As neighbors in the Desert Hills Area community, we watched the recent construction and subsequently
welcomed the Self-Storage & RV/Boat Parking Facility located just north of the NEC of 7th Street & Carefree Highway.
The facility is located at 34707 N 7th St in Phoenix, AZ 85086.
We are looking to expand our uncovered RV/Boat Storage side of the business onto adjacent land to the south
of our existing Phase 1 and Phase 2 RV/Boat Storage. To do so, we need to extend our SUP (Special Use Permit). Below
is a 2021 aerial picture of the existing C-2 CUPD & C-2 CUPD SUP site and our proposed SUP expansion on approximately
an additional 5 acres:
This entire Carefree Highway frontage property, from 7th Street to 10th Street, adheres to the existing Carefree
Highway Scenic Corridor (CHSC) . Within this Corridor, development guidelines were established by the local Community
detailing how commercial development will take place.
The QT & Carefree Crossings SS/RV LLC ownership are in full support & will develop their Carefree Highway
frontage land to be in conformance of these CHSC guidelines. This support letter offers your acceptance for Carefree
Crossings SS/RV LLC to adjust, by approximately 65 horizontal feet, the current undulating Carefree Highway setback to
conform to the actual newly formed QT East property line location.
We are seeking support to adjust the 60’ setback down to a 40’ setback for 65 horizontal feet on Our Phase 4
Land. The existing 60’ setback will now be roughly 105 horizontal feet & be fully on QT’s Property. The rest of the site
will maintain the current undulating pattern as can be Evidenced in the attached document titled, “Carefree Crossings
Setback Lines.”

Carefree Crossings RV & Boat Storage’s Expansion
I, Darren Forstie, belonging to New River/Desert Hills Community Association support Carefree Crossings RV &
Boat Storage’s efforts to modify/move one of the four current CHSC undulating landscape setback switches
on the site West +/-65’ to a newly established property line after a 2021 land sale. I recognize this
movement of the setback does not change the overall undulating pattern on the site along with
acknowledging that Carefree Crossings RV & Boat Storage does not wish to seek a continuous setback for the
site.
