Comments: 
Little Ranch School is an existing pre-school as a special use 
(SUP) at an office complex in the C-O zoning district. The SUP 
was originally approved per Z2007026. The applicant seeks to 
modify the SUP conditions of in order to extend the validity 
period for an additional twenty (20) years from 5/16/22 to 
1/12/2042 to increase the number of students that can attend 
from 64 to 82, and to eliminate the periodic status report 
requirement. The subject property has been identified as 
being within the White Tank/Grand Ave Area Plan designated 
as Large Lot Residential (1-2 d.u./ac.) and within the City of 
Glendale General Plan as a Corporate Commerce Center. 
The continued operation of the subject site as a childcare 
facility & preschool under the existing SUP will have no 
adverse impact on the County Area Plan or the City of 
Glendale’s Municipal Plan.  Staff has not received any 
comments from relevant municipalities and staff has not 
received any letters of opposition.

Recommendation: 
On 12/9/21, the Commission voted 8-0 to recommend 
approval of Z2021116 subject to conditions ‘a’ – ‘k’:  
 
a. 
Development and use of the site shall comply with the site plan entitled 
“Imagination Childcare” consisting of one (1) full-size sheet, dated March 24, 2021, 
and stamped received September 28, 2021, except as modified by the following 
stipulations. 
 
b. 
Development and use of the site shall be in substantial conformance with the 
narrative report entitled “Little Ranch School DBA Imagination Childcare & 
Preschool” consisting of five (5) pages and stamped received September 28, 2021 
except as modified by the following stipulations. 
 
c. 
All trees shall be double-staked when installed. 
 
d. 
The canopy shade structure must be painted to match the existing building. 
 
e. 
The number of students attending the school shall not exceed 82. 
 
f. 
The applicant or his successor shall obtain approval of any development plans 
from the Office of the Arizona State Fire Marshal prior to any construction. 
 
g. 
All transformers, back-flow prevention devices, utility boxes and all other utility 
related ground equipment shall be painted to compliment the development and 
shall be screened with landscape material where possible. All HVAC units shall be 
ground-mounted or screened. 
 
h. 
This Special Use Permit shall expire on January 12, 2042, or upon termination of the 
use for a period of 90 days, whichever occurs first. 
 
i. 
Major changes to this Special Use Permit shall be processed as a revised 
application in the same manner as the original application, with final 
determination made by the Board of Supervisors following recommendation by 
staff and the Planning and Zoning Commission. Minor changes may be 
administratively approved by staff of the Planning and Development Department. 
Major changes to the Special Use Permit may require a new Citizen Participation 
Process as determined by the Planning and Development Department.

Project Summary: 
 
1. 
The property owner’s agent, Robert Pearson, is requesting a modification of conditions 
to Special Use Permit Case# Z2007026 for Imagination Childcare & Preschool, approved 
by the Maricopa County Board of Supervisors on May 16, 2007. The subject site is approx. 
5,240sq. ft. located in Building B of Veranda Commons, which is a commercial business 
park zoned C-O CUPD and C-S CUPD (ref: Z2003085). Primary access to the site is via 
internal driveways with access to Colter St. on the northeastern portion of the site and a 
secondary combined ingress/egress driveway onto Dysart Rd. to the southeast.  
 
2. 
Z2021116 is an amendment to modify is made to modify conditions ‘e’, ‘h’,‘i’, and ‘j’ in 
order to allow the continued operation of the school, increase the number of children 
that attend by 18 students (28% increase), and eliminate the periodic status report 
requirement. There are no other requested changes to the use, building, or circulation of 
the site. Staff also offers modified conditions ‘a’ and ‘b’ in order to update the narrative 
and site plan of record for the subject site. The conditions requested to be modified are 
the following: 
 
a.

“Montessori in the Park Z2007026” consisting of one (1) full-size sheet, dated revised 
March 23, 2007 and stamped received March 26, 2007 except as modified by the

designated in the area plan for large lot residential uses (1-2 d.u./ac.). With private 
schools permitted in residential areas, the subject use is in concert with the area plan. The 
subject site is also located within the City of Glendale general plan.

Envision Glendale 2040 (Adopted 2016) The City of Glendale General Plan designates 
the site as a Corporate Commerce Center generally for the development of mixed-use 
employment centers and community retail.  
 
Public Participation Summary:

The applicant complied with the Maricopa County Public Participation Process with the 
required posting of the property and notification to the adjacent property owners within 
300’ of the subject site and the area of interest groups. In addition, the applicant emailed 
the project information to the areas of interest identified via the County’s PlanNet 
database. The public participation has generated three (3) individual responses from the 
City of Glendale, City of El Mirage, and an area property owners association in which 
these organizations noted they had no concerns or objections to the request. Staff 
received one (1) letter from Luke Air Force Base, stating that the request would not have 
a negative impact on Luke AFB flight operations. Staff has not received any other letters 
and there is no known opposition.

Staff is supportive of the request to modify the conditions for Imagination Childcare & 
Preschool so that the facility can continue to operate and expand childcare services to 
residents of the area. The use is consistent with the county area plan and staff notes that 
the facility has been operating on the site for approximately 14 years with no active code 
violations. Further, since the approval of the original SUP in 2007, the residential 
development in the west valley has grown, increasing the demand for childcare and 
early child education services. As noted in the aerial below, the west valley is rapidly 
urbanizing as shown with two (2) recently approved residential developments that will 
bring in approx. 280 families within one mile of the site. Staff is of the opinion that 
increasing the capacity of the facility is complimentary with the growth in the area.

Purpose of Request 
 
 
This request is for a modification of conditions of an existing Special Use Permit for 
Imagination Childcare, a Childcare and Preschool in Building “B” of Veranda Commons, a 
condominium complex which is currently zoned for CO/CUPD. The property is located just north 
of the strip mall located at the northwest corner of Camelback and Dysart Roads in unincorporated 
Maricopa County. This request is made to modify the conditions “e”, “i”, and “j” as they were 
approved per stipulation on May 17, 2007, relation to the current SUP, Maricopa County Zoning 
Case Z2007026.   
 
 
The applicant is requesting a modification of stipulation “e” to the May 17, 2007 approval 
letter. This will allow the applicant to increase the number of students from the currently approved 
number of 64, to a requested maximum child occupancy of 82 children. Employees for the 
applicant total 15; 13 teachers and 2 administrative workers are included. This number may vary 
from time to time but will never exceed 17 total employees. 
 
The applicant is also seeking a renewal of the special use permit, for a time frame of 
twenty (20) years, for Building B in the development Veranda Commons, a modification of 
stipulation “i” which states the current SUP would expire in 2022. This modification would allow 
the applicant to continue operating as a child care and preschool which serves children and students 
between infancy and 5 years old. Hours of Operation for the applicant is 6:00 a.m. to 6:30 p.m., 
Monday through Friday, for an additional twenty (20) years.  
 
 
Finally, the applicant is requesting, upon consultation with the Maricopa Count Planning 
& Development assigned Planner, Jose Castañeda, a removal or modification of stipulation “j,” 
which references status report submission to occur every five (5) years.  
 
 
 
There will be no changes needed to the building, parking, or traffic flow.

Description of Proposal 
 
 
The applicant is currently operating as a child care and preschool which serves children 
and students between infancy and 5 years old. The Hours of Operation for the applicant is 6:00 
a.m. to 6:30 p.m., Monday through Friday, and will not be modified. The applicant is seeking an 
increase to the child occupancy from 64 to 82. The total number of employees for the applicant 
total 15; 13 teachers and 2 administrative workers are included. This number may vary from time 
to time but will never exceed 17 total employees. The building is part of a larger office complex 
and is current with all applicable building and zoning codes and requirements.

Relationship to Surrounding Properties 
 
The subject property is in Building “B” of Veranda Commons, a condominium complex 
located just north of a strip mall located at the northwest corner of Camelback and Dysart Roads. 
A retail center is also established across the street on the northeast corner of Camelback and Dysart, 
with Basha’s and Walgreens as featured retailers. A small park and Litchfield Park/Wigwam Creek 
homes occupy the southwest corner of the intersection. The remaining land in the immediate 
vicinity is zoned, being planned or already occupied with single-family residential development. 
 
Litchfield Park grew at the fifth fastest rate of any Arizona municipality between 2017 and 
2018, according to population data the U.S. Census Bureau published in May 2019. Litchfield Park 
grew from 6,046 to 6,310 people between 2017 and 2018. The increase of 272 people was only 
the 32nd largest of 91 Arizona cities and towns, but the growth rate of 4.4% was topped by only 
Buckeye (8.5%), Queen Creek (8.3%), Wickenburg (5.2%) and Marana (4.5%). Between 2010 to 
2018, Litchfield Park increased from 4,901 to 6,310, an increase of 15.2%, which ranks 21st in the 
state. The exponential residential growth has resulted in overcrowding in the public schools and a 
real need for options in education. The applicant has historically been providing those services at 
this location, and an increase in occupancy will allow the applicant to serve more children and 
families in the area. 
 
Location and Accessibility 
 
 
The subject property is located just north of a strip mall located at the northwest corner of 
Camelback and Dysart Roads. The main point of entry is at Dysart and Colter Street, but the 
property can also be accessed through at least  two additional entryways on Dysart, south of 
Colter, as the strip mall to the south has a shared parking lot. 
 
Circulation System 
 
Imagination Childcare at Veranda Commons is serviced by one major section line arterial 
roadway, Dysart Road. The main access to the site is located approximately 1,345 feet north on 
Dysart Road from Camelback Road at Colter Street. This access drive aligns with a residential 
development on the east side of Dysart Road. 
 
The entrance from Dysart Road into Veranda Commons is shared with Veranda II Estates, 
a residential gated community. This entrance is accessible from southbound and northbound traffic 
and provides full access -- left in, left out, right in and right out. There are three (3) points of access 
through Camelback Place at Dysart will allow vehicles to travel to and from the shopping center, 
as well as access to Camelback Road. The commercial property can be entered from Dysart Road 
and Camelback Road. There is a Reciprocal Easement Agreement dated 02/06/2006, at recording 
number 20060172120, on file with the Maricopa County Recorder’s Office. 
 
Children will arrive by car from either the primary access point onto Colter Street or from 
the three (3) access points from the commercial property directly south of Veranda Commons. 
Children may also arrive, with a guardian, by walking on the sidewalks, from Veranda II Estates,

a residential community directly west of Veranda Commons. Parking is available on the east and 
south sides adjacent to the building.

13 covered parking spaces exist dedicated to Imagination Childcare for teacher and parent 
use. In addition, parents will use any of the open shared parking spaces available at the 
condominium complex; however, they will be encouraged to use the designated covered spaces 
first. 
 
Parents will be physically walking their children into the building where they will sign 
them in. We will be installing an electronic sign-in and sign-out mechanism that provides an 
additional level of security for our children. Children cannot leave the building without being in 
the physical custody of their adult sponsor.

The Maricopa County Environmental Services Department (MCESD) has 
reviewed revised documents received from the Maricopa County Planning and 
Development Department for the above referenced project. This project is for 
SUP Mod of Conditions at APN # 501-62-890A. Water and wastewater  
services will be provided by Liberty Utilities, MCESD has no concerns, ATC 
must be obtained prior to building plan approval if applicable. 
 
Based on the above, MCESD raised no objections to the Planning & 
Development Department in Accela Automation on October 8, 2021. 
 
 
It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other 
Maricopa County agencies may have additional requirements. Final review and 
approval will be made through Planning and Development Department

Thank you for allowing Luke AFB to make comments on the Little Ranch School Application.  This
modification of conditions application is to allow an increase in staff and children.  The site is located
at 5220 N. Dysart Road in Litchfield Park, AZ.  It is approximately 1.7 miles outside the Luke AFB 1988
JLUS 65 Ldn, “high noise or accident potential zone” as defined by A.R.S. § 28-8461 and is inside the
“territory in the vicinity of a military airport” also defined by A.R.S. § 28-8461. 
 
As described in the application, this request will not have a negative impact on Luke AFB Flight
Operations.  Since the site will be located inside the “territory in the vicinity of a military airport,” it
will be subjected to approximately 165 over flights per day, as low as 1,500 feet above the ground. 
We recommend you review the sound attenuation requirements found in A.R.S. § 28-8482.  In
addition, a strong notification program on the part of the applicant is essential to inform the tenant
about Luke AFB operations.
