Project Summary: 
 
1. 
The applicant is requesting a zone change with overlay from Rural-43 to IND-2 IUPD to allow for 
the operation of a dispatch yard for a solid waste management company. The subject property is 
generally located at the SEC of Sunland Ave. & 47th Ave. alignments in the south Phoenix area. 
The site is approximately 3.19 acres. Access to the site is via private easement on an established 
driveway from Southern Ave. The western perimeter of the site is a mid-section line alignment, 
requiring the setback line to start from a future half-street right-of-way of 40-feet per the Maricopa 
County Zoning Ordinance. 
 
2. 
Current conditions include an outdoor storage yard operation; however, no entitlement exists for 
this operation. The site was used previously as a machine and repair shop for vehicles and heavy 
equipment since 1998. There is no history of violations on the property. The proposed IND-2 IUPD 
zoning district will enable Atlas Disposal to continue to utilize the site similar to other surrounding 
industrial uses operating in the RU-43 zoning district. The conceptual zoning exhibit provided with 
this application demonstrates the proposed layout to include outdoor storage, outdoor roll off 
truck storage, parking spaces and an existing 900 sq. ft. office improved with ADA accessible 
bathroom for three on-site employees and a 5,000 sq. ft. shop. The repair shop has four service 
bays and two roll-up doors and two swing doors. The southwest portion of the property hosts a 
parking shade canopy.

Business hours are proposed between 2:30 am to 6:00 pm seven days a week (but this will not 
be controlled by the IND-2 IUPD zoning district). The on-site office will have three employees 
during business hours and 17 transitory employees leaving and entering the property using 
approximately 17 trash and roll-off trucks. No refuse or garbage is not intended to be stored on 
the property. The exterior of the property is improved with chain-link fencing with mesh covering 
for site screening and dust control. Two access gates are provided at the western end of the 
property along the mid-section line alignment.

The following proposed IUPD development standards are being requested:

rural or residential zone boundary. Although surrounding zoning is Rural-43, these 
properties are operating as industrial uses and likely not to develop residential uses.

County Comprehensive Plan Vision 2030 (adopted January 2016): Unincorporated areas outside 
of county area plans are designated Rural Development Area (RDA) by default and are appropriate 
for rural land uses and rural zoning. However, urban services and infrastructure are readily 
available, and the site may be considered within an urban growth area as the site falls into the 
City of Phoenix municipal planning area.

City of Phoenix General Plan (adopted April 3, 2024): The site is located within the City of Phoenix 
municipal planning area and the city’s general plan designates the site as Large-Lot Residential 
(1-2 du/ac). The request is not consistent with this designation.

City of Phoenix Laveen Southwest Growth Study which designates the site for residential use of 
2-5 du/ac. The growth study does not consider existing industrial zones within County

Staff is supportive of the request. Although the site is inconsistent with the general land use 
designations of applicable land use plans it does arguably further land use planning goals. The 
surrounding area is characterized by heavy industrial development even within the Rural-43 
zoning district. Continued development within the foreseeable future can be anticipated to remain 
industrial. The proposed IND-2 IUPD is in concert with surrounding land use and development 
patterns, and will enhance long-term operational capabilities of Atlas Disposal.

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve subject to the following conditions ‘a’ – ‘k’: 
 
a. 
Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Atlas Disposal Dispatch Yard“, consisting of 4 full-size sheets, revision dated 
3/23/26, and stamped received 3/24/26, except as modified by the following conditions. 
Staff may determine slight refinements to remain in substantial conformance with the 
approved site plan.  Minor and major amendments to the site plan will be determined in 
accordance with Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Project Narrative Zone Change Request Atlas Disposal Dispatch Yard”, consisting 
of 7 pages, revision dated 3/24/26, and stamped received 3/24/26, except as modified by 
the following conditions. 
 
c. 
The following Engineering conditions shall apply:  
1. 
Further entitlement such as a Plan of development (POD), will require a submittal 
of an approved traffic impact statement (less than 1 year old), updated TIS or TIS 
waiver. 
2. 
Engineering and drainage review was based on a zone change without a plan of 
development. Therefore, without the submittal of a precise plan of development, 
no development approval is inferred by this review, including, but not limited to 
number of proposed building lots/units, drainage design, access and roadway 
alignments. These items will be addressed as development plans progress and 
are submitted to the County for further review and/or entitlement.  
3. 
Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa 
County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction.  
4. 
The County does not provide fire service, therefore, it is incumbent that the 
applicant seek service and approval of plans from the jurisdictional fire service 
provider. 
 
d. 
The following Maricopa County Environmental Services Department (MCESD) condition 
shall apply:  
1. 
A Minor Plan Review application must be submitted for any existing septic 
system(s) if being utilized and if the applicant believes the existing system(s) are 
adequate in size to support the new use; otherwise, a new septic permit/install 
may be required. 
e. 
The following Maricopa County Department of Transportation condition shall apply: 
1. 
A mid-section line alignment is located on the western perimeter of the proposed 
development requiring the setback line to start from a future half street Right-of-
Way of 40-feet per the Maricopa County Zoning Ordinance Section 1105. 
 
f. 
Prior to precise Plan of Development approval, the applicant shall provide the Maricopa 
County Planning and Development Department with an executed pre-annexation service 
agreement with the City of Phoenix that identifies the detail for when the proposed project 
will be annexed and the provision of water and sewer service.  In lieu of pre-annexation

service agreement the developer must provide a ‘will serve’ letter from the certificated 
water and sewer provider. 
 
g. 
The following IND-2 IUPD standard shall apply: 
1. 
Minimum site screening: 6’ chain link fence with mesh screening or solid masonry 
wall adjacent any side or rear property line abutting any rural or residential zone 
boundary. 
 
h. 
Until such time as the site is served by sewer, uses on the site shall only be those 
acceptable to the Maricopa County Environmental Services Department (MCESD) where 
wastewater disposal can be accommodated by onsite septic systems. A public water 
system and public sewer system shall be required prior to establishment of any non-
residential use that requires potable water. 
 
i. 
Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to 
issuance of a building permit, written confirmation will be required from the emergency 
fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
j. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for revocation to the zoning that existed on the date of application.  It 
is, therefore, stipulated and agreed that either revocation due to the failure to comply with 
any conditions, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation of the 
Zone Change. The Zone Change enhances the value of the property above its value as of 
the date the Zone Change is granted and reverting to the prior zoning results in the same 
value of the property as if the Zone Change had never been granted. 
 
k. 
Prior to precise Plan of Development approval, a licensed engineering investigation of the 
site shall be conducted and submitted identifying any land subsidence or earth fissuring 
which affect the site and the report shall include suggested mitigation.  The Final Plat shall 
have a note that the property is within an area of known land subsidence and/or earth 
fissuring.  Further, notice that the property is in area of known land subsidence and/or 
earth fissuring and a definition of both land subsidence and earth fissures shall be 
displayed on the front door in the sales office, written in the covenants, conditions and 
restrictions (CC&Rs), and written in any disclosure statements for conveyance 
documents.  However, if said report concludes negative impact regarding land subsidence 
and/or earth fissuring the required notification should include such results.

Purpose of Request: 
 
 
Zone Change with Overlay from Rural-43 to I-2 IUPD.  This request allows Atlas 
Disposal Industries to operate in a complaint zoning classification, as a dispatch location 
for its trash collection business where its fleet of trucks and roll-off cannisters will deploy 
at the beginning of the morning and return upon end of the business day.  In addition, minor 
fleet repair will occur, however, it is worth noting, no outside premises waste or trash will 
be stored on-site. 
 
Description of Proposal:  
 
 
The Zone Change with Overlay request is for a parcel totaling 3.192 acres of land, 
parcel #’s 104-76-007K in Maricopa County.  The property consists of a securely fenced 
property with a majority of the property being a laser-leveled, open yard with a 5,900 
square foot repair & fabrication shop and office.  The site access is via an easement running 
north of Southern Avenue along the 47th Avenue alignment.  The access easement is 
granted by Calmat/Vulcan Companies for the favor of the property owner and SRP.  The 
subject property is approximately 1,300 feet north of Southern Avenue and the access 
easement is utilized by heavy industrial vehicles, equipment and trucks attributed to the 
current property owner’s, Vulcan and SRP.  The property, under a previous owner, had 
been utilizing it as a machine & repair shop for vehicles and heavy equipment since at least 
1998.  The request, if approved for a Zone Change with Overlay from Rual-43 to IND-2 
IUPD, would allow the property to officially change the zoning to its historical utilization 
and better align with surrounding neighboring uses. 
 
 
Atlas Disposal will operate the property as a dispatch location for its commercial 
trash collection business.  The hours of operation will be from 2:30 a.m. to 6:00 p.m., seven 
days a week.  The occupancy will be very minimal with 3 staff members being on-site 
continually during business hours and 17 transitory drivers leaving and entering the 
property for routes on a day-to-day basis with approximately 17 trash and roll-off trucks.  
No refuse/garbage will be stored on the property.  The property is secured by chain-link 
fencing with two gated ingress/egress access points.  The storage area is a dirt laser-leveled 
dust-mitigated sprayed area.  
 
 
 
The existing office and fabrication shop is 900 square feet and 5,000 square feet, 
respectively; not to mention it is very non-descript, but it serves the owner of Atlas Disposal 
and operators needs perfectly.  The office has an ADA compliant bathroom for the three 
regular office administrators.  The fabrication shop has four service bays with two roll-up 
doors and two swing doors.  There is also an equipment and parts storage area within the 
shop.  At the southwest corner of the property is a shaded parking awning that would be 
used for a future use.

The exterior property is lined with a chain-link fence with a mesh covering for dust 
mitigation.  As mentioned, the property was recently laser-leveled and compacted millings 
were laid down through the site to further mitigate dust inundation.  There are two-gated 
ingress/egress locations from the 47th Avenue alignment for safe and efficient access. 
 
 
Proposed improvements to the property and building(s) will be proposed through a 
Plan of Development.  While the existing building is large and accommodating enough for 
the owner, site upgrades and potential structures will need to be proposed. 
 
 
 
 
 
 
 
 
 
 
 
 
Relationship to Surrounding Properties: 
 
 
The request for a Zone Change will solidify the subject property’s entitlement to 
continue operations in its historic manner.  In addition, given the property is surrounded by 
industrial uses and activities, it removes the subject parcel from rural uses and residential 
home(s) and consolidates the area to like-kind businesses and activities. 
 
 
North: The north side of the property according to Maricopa County’s interactive 
zoning map is zoned Rural-43, owned by Calmat/Vulcan Companies and being utilized as 
a mining/milling operation.  Given the property indicates the land is zoned Rural-43, we 
only assume they are operating under a Use Permit in Rural-43 zoning. 
 
 
 
East: To the east is similar to the North, the property is owned by Calmat/Vulcan, 
being utilized for industrial purposes and appears to be utilized as a large pond, assumed 
to be operational water run-off collection.  The zoning on that parcel, though being utilized 
in an industrial manner appears to be zoned Rural-43. 
 
 
South: To the south is an SRP vacant land parcel utilized for truck, equipment and 
material storage with a sub-station located along the frontage of Southern Avenue.  This 
parcel is zoned Rural-43. 
 
 
West: The west side of the subject property is identical to the north and the east 
side of the subject property as well.  Owned by Calmat/Vulcan, the parcel is zoned Rural-
43 according to Maricopa County’s interactive zoning map.  However, they are operating 
a mining and milling operation on the property.  This parcel shares access with the subject 
parcel via the previously stated easement.  This access road is a dead-end at the north 
boundary of the subject property.  The road does not serve any residential or even 
commercial homes/building/uses.   
  
Community Benefits & Recent Changes: 
 
 
The Zone Change to IND-2 IUPD will allow a long established, family owned and 
operated business to continue to serve the nearby community and the greater Phoenix area.  
Further, the Southern Avenue and Broadway Avenue corridor where the  subject property 
is located, has been a long established industrial area for uses similar to Atlas Disposal 
Industries; in addition to mining, auto sales and salvage, etc.

Location and Accessibility: 
 
 
The subject property is strategically positioned right in the center of industrial and 
mining uses and close to the Salt River bottom area.  The property is isolated with similar 
uses adjacent to the property on all sides and access is restricted to only the subject parcel, 
Calmat/Vulcan and SRP.  The property is accessed from Southern Avenue on the 47th 
Avenue alignment, heading north, which is a mid-section right-of-way governed by 
MCDOT.  If the right-of-way was ever to be developed, the only uses with frontage would 
be industrial uses and the road would end at the Vulcan mining operation.  The location is 
lastly beneficial to the waste disposal trucks because it has easy access from Southern 
Avenue to the Loop 202 freeway, Interstate 10 and Interstate 17. 
 
Circulation System:  
 
 
Onsite:  Given the size of the parcel and the existing two-gated access points, 
internal circulation for seventeen disposal trucks is incredibly easy.  Internal turn-around 
areas as well as a looping access through the property ensure safe ingress and egress out of 
the site.  The property is treated with compacted millings for dust mitigation benefitting 
the business and surrounding neighbors.  The internal driving and parking areas will from 
time-to-time and as needed, use anti-dust applications over the millings to keep the air 
quality the highest possible. 
 
 
Offsite:  Though the 47th Avenue alignment is a MCDOT future mid-section right-
of-way, the current driveway is an easement controlled by Vulcan.  This access road 
currently serves not only waste disposal trucks but large industrial trucks, dozers and 
machinery from Vulcan and SRP.  Upon a future Plan of Development submittal, the 40’ 
feet of the western boundary will potentially need to be dedicated for MCDOT right-of-
way.  Although, there is no reason for any pedestrian/vehicular uses down this easement 
road and any residential or commercial future development adjacent to the subject property, 
the easement reverting to a County road highly unlikely in coming decade(s). 
 
 
Development Schedule:   
 
 
Atlas Disposal just recently filed a parcel merger from the two historic parcel 
numbers to a singular parcel, #104-76-007K and is working with County staff for re-
addressing.  Upon approval of a Zone Change to IND-2 IUPD, a single-phase Plan of 
Development or “POD” will be submitted as well for future improvements to the property 
to better serve the business.    
 
Community Facilities and Services:   
 
 
The school districts in the area are Laveen Elementary School District and Phoenix 
Union High School District.  The proposed Zone Change will not impact the or be a burden 
to those districts as the approval is non-residential.  Amenities and parks in the area are

Change would be compliant to the City of Phoenix overall vision goals.  The General Plan 
Map designates this area of the property for industrial uses with minor consideration for 
traditional residential lots.   
 
Drainage Report & Plan: 
 
 
 
Upon approval of  rezoning, Atlas Disposal intends to file a Plan of Development 
for site development/upgrades, applicant’s civil engineers will submit Site Plans as 
Drainage Plans for the project and submit to SWPP for compliance.   
 
Traffic Impact:   
 
 
A Traffic Impact Statement has been acknowledged as required for the Plan of 
Development submittal.  As part of that future application, Atlas Disposal will submit a 
Traffic Impact Study through the Maricopa County Planning staff and MCDOT, including 
visibility triangles at the property boundaries.  Ultimately, the proposed use through the 
Zone Change will have little effect on the traffic volume on the 47th Avenue alignment and  
Southern Avenue with the already cited truck count and the fact those trucks are 
continuously on the routes off-campus and travelling throughout the valley during 
operational hours.  Ultimately, from a traffic perspective, this Zone Change and use would 
great a safer environment from a traffic perspective at the micro-level as 47th Avenue is 
utilized for mining and infrastructure vehicles from Vulcan and SRP.

This application is requesting a zone change without a plan of development from RU-
43 to IND-2, light industrial for trash collection trucks, in which no trash will be stored 
onsite.   The request is for two pacels which have a total acreage of 3.192 acres.  The 
zone change was presented without a plan of development.   
 
PND Engineering Plan Review (DPR, FCD and PND Transportation) has reviewed the 
1st submittal of the subject application routed for review on 11.24.2025 and has no 
objections subject to the following conditions:  
 
 
DRAINAGE General Conditions: 
 
1. Further entitlements such as a Plan of development (POD), will require a 
submittal of an approved traffic impact statement (less than 1year old), updated 
TIS or TIS waiver. 
 
2. Engineering and drainage review was based on a zone change without a plan 
of development. Therefore, without the submittal of a precise plan of 
development, no development approval is inferred by this review, including, 
but not limited to number of proposed building lots/units, drainage design, 
access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review 
and/or entitlement.

3. Engineering review of re-zone cases is conceptual in nature. All development 
and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design 
Manual; and current engineering policies, standards and best practices at the 
time of application for construction.  
 
4. The County does not provide fire service, therefore, it is incumbent that the 
applicant seek service and approval of plans from the jurisdictional fire service 
provider.
