Project Summary: 
 
1. 
The applicant on behalf of the property owner is requesting a zone change with overlay from 
Rural-43 SUP to C-3 CUPD for an existing commercial self-storage facility that has operated on 
this site for 20 years.  The owner of the property is making this request because the site is 
presently subject to an SUP that is set to expire on October 17, 2026.  The owner is seeking 
permanent entitlement, which he asserts will allow him to continue operation and make the 
property more marketable or more favorable  for annexation into Town of Gilbert in the future.   
 
2. 
On October 17, 2001, the Board approved an SUP in the Rural-43 zoning district for a commercial 
self-storage facility set to expire in 25 years (Z2000017). On January 29, 2013, the Board approved 
a modification of conditions for new wall signs and perimeter wall signs to market the facility 
from the adjacent freeway that’s north of the site (Z2013082). With the widening of Lindsay Rd. 
by the Town of Gilbert in 2022 the office building that was part of the original SUP site plan was 
removed, and a temporary office was placed near the site’s southeast corner. The applicant first 
applied for this zone change request on November 19, 2025 and staff held a TAC meeting to 
discuss initial review on January 6, 2026.

The self-storage facility is open Monday – Saturday 9 am to 6 pm.  Like most self-storage facilities 
customers have access codes to access the site daily any time of day. C-3 CUPD zoning will not 
limit hours of business operation. This facility does have a live-in caretaker along with two 
employees. The existing site consists of six buildings, four of which are in the center of the facility 
with garage doors to access each individual storage units. All of the buildings are constructed 
using corrugated metal painted off-white color with red trim. Along the back of the lot there are 
RV storage stalls with a shade canopy. There are ten parking spaces with two adjacent to the 
street (one of which is ADA accessible space). The majority of the site is screened by solid fencing 
over 6’ in height and chain link fencing with attached screening. Most of the site that is part of the 
commercial operation is paved.  It should be noted that this request does not include a precise 
site plan and the property owner will pursue a Plan of Development with a site plan after the 
approval of this zone change request.

This request has a CUPD zoning overlay for this site, see table on the next page. Most of the C-3 
development standards will be observed.  However, the owner is  requesting to reduce the depth 
of the north side setback from 10’ adjacent to a rural zoning district to 0’; because there are 
existing buildings along the north property line and the parcel to the north is vacant and owned 
by the Roosevelt Water District to service the adjacent Roosevelt Canal.  The owner is also 
requesting to vary the screening requirements to include not only 6’ tall solid fencing but to 
include chain link fencing with attached screening materials and buildings to reflect what exists 
on this site. Staff is recommending as a condition of approval that the CUPD limit entitled 
commercial uses on site until sewer is available on site to self-storage facilities and ancillary uses 
or use that according to MCESD can have wastewater disposal accommodated via on-site septic 
system.

Gilbert’s General Plan (ratified August 2020): This plan designates the land uses of this site as 
Industrial. The Industrial classification designates areas for a variety of industrial activities, 
ranging from light manufacturing, warehousing, offices, contractor’s yards, laboratories, 
research/development, and screened outdoor storage. The existing commercial self-storage 
facility is a screened facility in concert with the general plan.   
 
Public Participation Summary:

The applicant sent notifications by first class mail to interested parties and adjacent property 
owners within 300’ of the subject parcel. Signs were posted on the site, in accordance with 
applicable regulations. During this process the applicant held a virtual neighborhood meeting, but 
no one responded to the invitation to this meeting, according to the applicant’s Citizen Resulst 
Report.  As of the writing of this report, neither applicant nor staff have received any support or 
opposition from the public. The Town of Gilbert were informed about this request, but staff have 
not received any concerns about this request.

This site has been a commercial storage facility offering mini-storage and RV Storage for nearly 
20 years with a SUP.  Because the site is fully developed and utilized by the local area a permanent 
entitlement with this zone change request is reasonable. Additionally, the site being located on a 
major arterial street near a freeway makes this a prime commercial location.  The area has 
transitioned from rural uses to a predominance of industrial commerce parks since this SUP was 
first approved. Thus staff is in support of this request to C3-CUPD and encourages the 
Commission to recommend approval of this request.  However, until such time as sewer is 
available to the site, it is appropriate to limit the entitled uses to those where wastewater disposal 
can be accommodated via on-site septic systems.

Recommendation: 
 
12. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z250037 subject to the following conditions ‘a’ – ‘g’: 
 
a. 
Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Arizona Self Storage at Lindsay“, consisting of one full-size sheet, dated March 
5, 2026, and stamped received March 10, 2026, except as modified by the following 
conditions. Staff may determine slight refinements to remain in substantial conformance 
with the approved site plan.  Minor and major amendments to the site plan will be 
determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “AZ Self Storage at Lindsay Road”, consisting of four pages, dated March 9, 2026, 
and stamped received March 10, 2026, except as modified by the following conditions. 
 
c. 
Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to 
issuance of a building permit, written confirmation will be required from the emergency 
fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
d. 
The following Planning Engineering conditions shall apply:  
 
1. 
No new site improvements are being proposed with this request. If any new site 
improvements or grading are proposed, then detailed Grading & Drainage Plans 
must be submitted with any Plan of Development and associated building permits 
on this site.  
 
2. 
The applicant and/or the property owner shall contact the Town of Gilbert 
regarding access, right-of-way, and improvements required for Lindsay Rd.  
 
3. 
Due the site’s location near the Loop 202 San Tan Frwy. the applicant and/or the 
property 
owner 
must 
notify 
ADOT 
via 
the

e. 
The following C-3 CUPD development standards shall apply: 
 
1. 
There shall be no interior side setbacks adjacent to rural or residential zoned 
property. 
 
2. 
There shall be a minimum of 6’ tall solid wall, chain link fencing with attached view 
obscuring materials or buildings used  for screening of the site’s commercial uses. 
 
3. 
Entitled uses are limited to storage facilities and ancillary uses or use that 
according to MCESD can have wastewater disposal accommodated via on-site 
septic system until such time as sewer is available to the site.

Noncompliance with any of the conditions assigned to the approval of this Zone Change 
by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance.  
 
g. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for revocation to the zoning that existed on the date of application.  It 
is, therefore, stipulated and agreed that either revocation due to the failure to comply with 
any conditions, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation of the 
Zone Change.  The Zone Change enhances the value of the property above its value as of 
the date the Zone Change is granted and reverting to the prior zoning results in the same 
value of the property as if the Zone Change had never been granted.

Upfront Planning & Entitlements, LLC is pleased to submit for your consideration a rezone request 
on approximately 5-acres along Lindsay Road and just south of the Loop 202 Freeway in Gilbert. 
The parcel is identified as Maricopa Assessor Parcel Number 304-55-016Q (the “Property”). The 
Property is located within unincorporated Maricopa County (the “County”) surrounded by the Town 
of Gilbert and is zoned as RU-43 with an existing SUP to operate a storage facility with outdoor 
storage. The Property owner requests to rezone the parcel to C-3 CUPD, to continue the operation

The Property was purchased by its current owner in 2006 as has been operating as a self-storage 
facility ever since.  There are 6 storage buildings on site, 20 RV stalls along the back of the Property 
and parking alongside the east side of the Property on south Lindsay Road. The site currently has 
an SUP to operate on the site and it will be expiring soon and the owner wishes to make the use 
more permanent given its proximity now to the freeway and its proven history of being a good 
neighbor. Maricopa County, in conjunction with the Town of Gilbert, demolished the office and 
apartment as part of the Lindsay Road expansion project recently. We have a temporary container 
office, and plan to build a replacement office in the future on the site with a POD request at a later 
time.  The caretaker’s quarters also has a temporary replacement for the time being until the office 
and apartment are ready to be submitted as part of a POD for new buildings. An architect is working 
with the owner to prepare these pending the rezone.

DESCRIPTION OF PROPOSAL
The property owner requests a rezone to C-3 CUPD to allow for the continued use of the self-
storage facility on the site. Considering the Property’s location within the Town, it is a prime 
site for annexation and the owner would like to assure the continued use of the site for 
commercial storage uses. The hours of operation are 9:00am to 6:00pm Monday through 
Saturday, closed Sunday. Access hours are 5:00am to 10:00pm, seven days per week. There are 
security cameras on site to monitor the property after business hours as well as a live-in 
manager who watches the property throughout the week and assists customers. There are two 
employees on site. There is one sign advertising the name of the commercial self-storage facility 
along Lindsay Road.  
Penske truck rentals are planned to continue by this storage facility as was outlined in the previously 
approved SUP. The Property is surrounded by solid walls on every side for security, with a gated 
entrance along Lindsay Road. There are 6 self-storage buildings on site, all one story. Along the 
north and south edges of the Property, the storage buildings are smaller, allowing for small, 
economical storage units. The four self-storage buildings in the middle of the Property are larger 
with garage door access for each storage units. All buildings are constructed using corrugated 
metal and are painted off-white with red trim. Along the back of the Property there are 20 
covered RV stalls.  The site typically has up to 20-30 visits per day.

ZONING
The Property is zoned RU-43 along with the property directly to the north. The properties to the 
west and south are located within the Town of Gilbert and are zoned LI (Light Industrial). The 
property to the east is zoned BP (Business Park). Further south along Lindsay Road there are 
properties within the County zoned IND-2 and RU-43 POD.

LOCATION AND ACCESIBILITY
The Property is located along south Lindsay Road with two entrances and exits providing access 
on the east side of the Property. There will be an estimated 20 to 30 visits per day to the facility 
using these access points.

The estimated date the Plan of Development will be submitted at a later date as no changes to 
the site are proposed at this time and will be in line with the existing use on the site and SUP.

To obtain a waiver approval by the MCDOT TSMO Division, the criteria listed below must be 
met at a minimum, however not limited to:
• The average trip generation of the proposed development is less than 5 trips in the AM or 
PM peak hour.
• Access is not being requested to either a State Highway or County arterial roadway.
• The combination of the proposed development traffic plus existing traffic does not exceed an 
average of 150 vehicles per day on any unpaved road.
• No current traffic problems or local area concerns, such as an offset intersection, high 
accident data, or high increase in neighboring development.
