Project Summary:
1.
The applicant proposes industrial storage yards and inert materials recycling in the Rural-43
MAAMF zoning district along Frontier Dr. west of 195th Ave. The site is to be leased to individual
users for storage of construction materials, construction equipment and/or inert materials
recycling yards. The project lies within the 65 and 70 LDN noise contours and Accident Potential
Zone 2 of Luke Airforce Base Auxiliary Field #1.

The applicant received a Use Compatibility and Consistency Determination (UCCD) under
UC2024005 indicating the request may be of concern. After clarification, Luke AFB revised the
UCCD to indicate “Luke Air Force Base considers the proposed construction equipment storage,
sales, service, rental; and, construction materials recycling of asphalt, concrete and other inert
material to be compatible and consistent with the high noise or accidental potential of the military
airport or ancillary military facility.”

The subject site consists of seven parcels not proposed for consolidation into a single parcel.
Each storage yard will be accessed from Frontier Dr. with individual access gates. Frontier Dr. is
currently a private access easement on the site. It will be improved and paved as part of the
project. Access will be terminated at a new cul-de-sac with gates for the two furthest yards. The
site will be entirely enclosed with an 8’ high block wall. The wall will be reduced to 6’ at the
southeast corner due to neighbor feedback. Interior yards will be delineated by chain-link fencing.

There are no buildings or structures currently proposed with the development. The site will be
utilized for outdoor storage uses. The applicant would like to offer flexible storage spaces with
the understanding that activities can be expanded upon, although it would be up to each individual
user to file and obtain approvals for future site design and development. As the development is
within the MAAMF, any future development will be required to submit a new POD that will require
specific design approval of the Maricopa County Board of Supervisors.

The applicant is deviating the Rural-43 MAAMF zoning district’s development standards for ease
in development. As the individual storage yards are part of a larger complex, the applicant is
requesting to amend standards to reflect setbacks from the larger development as opposed to
the individual parcels within. Setbacks from all interior lot lines and LDN/APZ boundaries will be
reduced to 0-feet. The project will maintain a 40-foot setback boundary for the western, southern
and eastern boundaries with a 20-foot setback on the northern extent.

Streets and Routes Plan. MCDOT has determined that a 195th Ave will require left and right turn
deceleration lanes as part of this development. MCDOT has approved the submitted traffic report.

White Tank/Grand Avenue Area Plan (Updated: 2023): The county’s plan identifies the subject
parcel for Military Compatible land uses. The Military Compatible designation includes areas
located within the state-statute defined High Noise or Accident Potential Zone of Luke Air Force
Base and auxiliary airfields. The purpose of this designation is to ensure that development is
consistent and compatible with the high noise and accident potential generated by military airport
and ancillary military facility operations that have or may have an adverse effect on public health
and safety. Per UC2024005 as amended the proposed outdoor industrial storage yards are
consistent and compatible with miliary airbase operations

Wickenburg Highway Scenic Corridor Plan (adopted January 1991): The site is located within the
Class 1 intensity level of this scenic corridor. This designation corresponds with that portion of
the corridor between ¼ mile and two miles from the Wickenburg Highway (US 60) right-of-way
and requires that new zoning entitlements be consistent with the corridor’s goals and policies. As
they correspond with the periphery of the corridor, the Class 1 regulations do not establish
specific height, screening, setback, or design regulations distinct from base zoning standards.
The site is also within the plan’s “urban area” land use category, which the plan describes as being
best suited for urban development within the corridor, although development would require paved
roads, sufficient utilities such as water and sewer, and public services such as fire protection.

City of Suprise General Plan (Revised: July 2024): This plan identifies the subject parcel as
“Employment Character Area” and “Luke Compatibility District”. The City of Surprise did not
comment on this proposal.
Public Participation Summary:

The applicant has met all public notification requirements for the MCP application with posting
in multiple locations. A neighbor notification letter was sent out to all property owners within 300’.
Additionally, the applicant held a virtual public meeting on March 26, 2025 to help facilitate
discussion with adjacent neighbors. One neighbor participated in the meeting and provided
valuable comments, the applicant worked with the neighbor to address additional screening
setback and additional roadway design for Swayback Pass to accommodate visibility at

intersections. Neighbor comments also influenced site design, removing site access from access
shared with residences to the south which was shown in earlier submissions.

Staff Analysis:

Staff is supportive of the storage yard use in the MAAMF overlay zoning district. As the parcels
are prohibited from any future residential uses, the storage proposal compliments the allowed
and developed uses in the area. The applicant has worked well with the active neighbor to listen
to concerns to redesign the site in a way that compliments the existing residential neighbors by
eliminating truck access to the south portion of the site. The applicant has also done a great deal
of engineering design work with drainage and flows impacting the site. The additional drainage
tracts will provide drainage relief for the immediate area.
Recommendation:
15.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve MCP250001 subject to the following conditions ‘a’ – ‘g’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“Domres 90 Site Plan“, consisting of 2 full-size sheets, dated January 2026, except as
modified by the following conditions. Staff may determine slight refinements to remain in
substantial conformance with the approved site plan. Minor and major amendments to
the site plan will be determined in accordance with Chapter 3 of the Maricopa County
Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Application for Military Compatibility Permit for Domres 90”, consisting of 35
pages, dated August 13, 2025, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1. Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
2. Based on the conceptual design nature of the information submitted, changes to the
site layout may be necessitated by the final engineering design of the site’s drainage
infrastructure.
3. Maricopa County does not supply water, fire or sewer services. It is the
applicant/owner’s responsibility to coordinate and secure water, fire and sewer
services for this site.
4. Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final
drainage report must be submitted with the application for Building Permits
5. Lintel openings and calculations with final drainage report at building permit phase
shall have 50% clogging factor. Flows shall represent the 100yr flows.
6. All channels shall have 1 foot of freeboard.

7. Drainage and private access easements shall be dedicated for this site in
accordance with the DPSM. Recordation must be provided prior to building permit
issuance.
8. Percolation methods for retention basins shall be provided to drain entire basin
within 36hours.
9. Roadway- 195TH Avenue- Maintain/dedicate the 55’ ROW.
10. Roadway- Frontier Drive shall remain private roadway but driveway connection to
195th Ave shall be per MCDOT Roadway design manual.
11. An updated traffic impact study is required for each additional new use and must be
approved by MCDOT.
d.
The following Rural-43 MAAMF standards shall apply:
1. Setbacks: 195th Ave – 40’, 199th Ave – 40’, South MCP Boundary – 40’, North MCP
Boundary – 20’, Interior lot lines, noise contours, APZ2, and Frontier Dr. – 0’
2. Screening: Minimum 6' solid wall along MCP perimeter
3. Paving: Pavement off 195th Ave (Frontier Dr.) then stabilized milled asphalt
e.
All buildings subject to noise attenuation as per ARS § 28-8482(B).
f.
Prior to issuance of a building permit, written confirmation will be required from the
emergency fire protection jurisdiction having authority that the facility has been designed
in accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy,
local fire protection jurisdiction review and approval will be required.
g.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
may be considered for revocation to the zoning that existed on the date of application. It
is, therefore, stipulated and agreed that either revocation due to the failure to comply with
any conditions, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation of the
MCP. The MCP Development enhances the value of the property above its value as of the
date the MCP is granted and reverting to the prior zoning results in the same value of the
property as if the MCP had never been granted.

Purpose of Request
On behalf of Speedworld LLC (owner/developer), Gilmore Planning & Landscape
Architecture (Applicant) respectfully submits for consideration this Application request for
a Military Compatibility Permit (MCP) with a Plan of Development (POD). The property
ownership includes 92.44 gross acres (90.5 net acres) situated approximately 1,500’
south of the W Jomax Road on the west side of 195th Ave in the unincorporated area of
Maricopa County. Please refer to attached Aerial Location Map - Exhibit 1 for the
location of this subject property. The County Assessor identifies seven parcels as: 503-
79-003Q, 503-79-003S, 503-79-002A, 503-79-002J, 503-79-002K, 503-79-002G, and
503-79-002H. Please also refer to Exhibits 2A, 2B, and 2C – ALTA Surveys and
Topography Map for the location of these parcels. This subject property is located
approximately 2 miles due east of Luke AFB’s Auxiliary Field #1 and entirely within the
65LDN and 70LDN noise contours. Approximately 70% of the property towards the
northwest is also within Luke’s Accident Potential Zone 2 (APZ 2) designated boundary.
Please refer to attached Exhibit 3 – Context Plan - PlanNet Land Use Map that
illustrates the site’s location, noise contours, and the APZ-2 boundary. Exhibit 4 –
Jurisdictional Map illustrates the sites position between the City of Surprise and the
Arizona State Land Dept.
3.
Description of Proposal
The proposed land use will be oriented to construction industry users who seek
properties for lease that will permit the open storage of construction equipment. This is
a permitted land use listed in Section 1010.6.1 of the Maricopa County Zoning
Ordinance under Industrial/Manufacturing LDN 65-74 and APZ 2. Because of the
growth in this northwest area, Domres 90 knows that there are construction industry
users who are currently seeking locations that can offer sites for secured equipment
storage. There are no structures proposed with this application. Site improvements will
be limited to the installation of one access drive off 195th Ave at the current Frontier
Drive alignment, the installation of precast concrete screen walls around the perimeter of
the property, and either precast walls or chain link fencing to define the internal lease
yards. Mass grading on-site will be designed to accept the historic flow from the north
and allow it to pass through the property within a defined swale that will be separated
from on-site retention. Individual storage yards will be leased. Lease tenants may elect
to install small modular offices and/or canopies for their specific need, which will require
subsequent POD applications. Because these 90-acres are situated within a restricted
area associated with Luke AFB’s 65-70LDN noise contours and the APZ-2 boundary,
our project team believes this proposed use is appropriate for this location, where it may
not be as desirable in other non-restricted areas.
As this northwest market matures, future development along the Grand Ave Corridor is
expected to attract a variety of industrial development oriented to light manufacturing
and distribution uses, which will initially support and be compatible with this MCP
application. As water and sewer services are extended to this location, market demand

may ultimately justify higher and better employment uses, which will be subject to future
UCCD review, new MCP and Plan of Development Applications.
4.
UCCD Determination
A Use Compatibility and Consistency Determination (UCCD) has been submitted and an
initial determination of support was issued by Luke AFB for the initial 60 acres
associated with PA2024084. Luke AFB issued two letters associated with the 60 acres,
the first dated May 17 2024, and second letter in response to some requested
clarifications dated June 13, 2024. An additional 30 acres has since been acquired and
a new UCCD Application (UC240046) was submitted. Luke AFB issued a subsequent
determination for the 30-acre expansion dated January 28, 2025 that reflects the same
review comments as their previous determination letters. These three determination
letters are identified as UC2024005, and include as Exhibits 5A, 5B, and-5C. These
determination letters support these proposed land uses subject to Luke AFB’s ability to
review development plans to confirm appropriate mitigation of potential mission risks and
hazards for the following:
a) Steam, dust and smoke. Maricopa County has strict permitting requirements for dust
control. Relevant to this UCCD Application is Rule 316 - Nonmetallic Mineral
Processing / Sand and Gravel. Processing plants that mine, excavate, separate,
combine, crush, or grind any nonmetallic mineral are governed by ‘Rule 316’.
Nonmetallic minerals include (but are not limited to) crushed and broken stone, sand
and gravel, clay, rock salt, gypsum, sodium compounds, and mixtures of these
minerals such as concrete and asphalt. Rule 316 specifically identifies; crushing and
screening of nonmetallic minerals, and sand and gravel operations. While there is
no proposed extraction of sand or gravel included with this request, various types
and sizes of crushed rock may be stored on-site for distribution. A permit issued by
ADEQ is required for all types of facilities and activities governed by Rule 316.
b) Direct or indirect reflective light emissions: The construction equipment storage yard
and the material recycling will not involve any uses that will direct or emit light
emissions. These uses may elect to utilize motion activated security lighting, which
will be downlit with shields to direct security lighting towards the interior of property.
c) Electrical emissions that would interfere with aircraft and air force communications or
navigational aid systems or aircraft navigational equipment. The proposed
construction equipment storage yard and recycling operation will not create or omit
any communications or electrical signals that would interfere with instrument landing
systems, tactical air navigation systems, avionics or weapons systems on the
airframe.
d) The attraction of birds or waterfowl such as operations of sanitary landfills or
maintenance of feeding stations. There will be no open water ponds that might
attract water fowl. All domestic water for the project and water storage for fire flow
will be in tanks.

e) Explosives facilities or similar activities (e.g. chemical storage). There are no
explosives or similar activities including any chemical storge associated with the
storage of construction equipment or the recycling of inert construction material. The
crushing of asphalt, concrete and other inert material is a mechanical system.
In coordination with Maricopa County Planning and Development, the Project Team will
include Luke AFB in the review of POD documents to establish the appropriate
mitigation of these listed concerns. Domres 90 will also include signage at strategic
locations within their administrative office and employee areas that identifies their project
location as being within an area subject to Luke AFB flight operations.
5.
Existing & Proposed Zoning
The existing zoning is RU-43 MAAMF. The proposed zoning will be RU-43 MAAMF
Military Compatibility Permit (MCP) specific for the uses proposed in this narrative
report. The MAAMF overlay zoning district prohibits the development of new residential
uses. Non-residential uses may be permitted subject to review of a UCCD and
determination of compatibility by Luke AFB, which is the prerequisite to obtain approval
of the Board of Supervisors for the MCP. Please refer to Exhibit 2 – Context Plan that
illustrates the existing zoning and surrounding land uses, and Exhibit 6 – MCP Legal
Description that describes the perimeter MCP boundary.
6.
Surrounding Land Uses
North: Immediately north is vacant land zoned RU-43 MAAMF. A MCP application was
submitted for the Jomax Storage Facility (MCP2022002), a 32-acre Boat and RV
Storage project that has since lapsed.
East: The east side fronts onto 195th Ave that terminates at W Jomax Road to the north
and continues south to Happy Valley Road. East of 195th Ave is Arizona State Trust
Land (ASTL) property that was formerly leased for a racetrack operation. The 65LDN
impacts the portion of the State Land that is directly opposite of the subject property.
South: The land area immediately south of the subject property is defined by four
parcels, each of which are approximately 660’ in length. The east parcel is a 1.5-acre
single family lot fronting onto 195th Ave. This residential parcel is relatively narrow with
the existing single-family home situated on the east side outside the 65LDN noise
contour. There are two additional single-family homes further south that are within the
300’ boundary from the subject property. The next three parcels to the west are each 5
acres, the first is vacant and the next two each have a single-family home. Except for
the three homes fronting onto 195th Ave, these six parcels are all impacted by the
65LDN noise contour. All six parcels are zoned RU-43 MAAMF.
West: The west side is defined by the mid-section boundary (199th Ave alignment). The
area west of the mid-section is Arizona State Land Dept (ASLD) property all of which is
within the 70DNL noise contour and the APZ 2 Accident Potential Zone.

Domres 90 considered a number of locations prior to deciding on this site. Some of the
features that helped select this location include:
•
The presence of Luke AFB’s 65LDN, 70 LDN, and the APZ-2 would not restrict these
proposed uses.
•
The extensive area surrounding this project site is also impacted by these same
noise contours and the APZ-2 overlay, which will restrict any new residential
development. The Surprise General Plan 2035 designates the subject property and
the adjacent properties as Employment, promoting other similar employment-
oriented uses.
•
The location is fronting onto 195th Ave, a section line arterial that will allow direct
access north to W Jomax Rd and south to Happy Valley Rd, both of which connect
directly to US60/Grand Ave.
•
Except for five single family homes within the 300’ perimeter along the south side of
the property, the balance of the surrounding properties is all vacant.
•
FEMA has designated the central portion of the property as Floodplain - Zone AE,
which indicates a 1% chance of annual flooding. With the understanding that there
are no structures proposed, appropriate mass grading can direct the historic storm
flow through the property allowing the balance of the property to be available for
equipment storage.
•
There are other employment/industrial-uses with MCP applications in process in the
immediate area, including All Things Metal, a 43-acre steel fabrication facility located
at the southwest corner of 195th Ave and W Jomax Road.
It is the combination of these existing site conditions and regional opportunities that
facilitated Domres 90’s decision to select this location.
7.
Area and General Plan Conformance
This property is within the White Tank / Grand Avenue Area Plan (WTGAAP), which
assigns a future land use category of “Military Compatible” to the subject site. This land
use category is congruent with the MAAMF overlay zoning district. As such, approval of
a MCP is required to entitle any development within this land use category. The Board
of Supervisors adopted the current WTGAAP in December 2023. Land Use Goal #2 and
Land Use Policy #6 both emphasize the County’s support and coordination with Luke
AFB to ensure compatibility and consistency with flight operations. Exhibit 3 - Context
Plan is a copy of the County’s interactive PlanNet Map that illustrates that the subject
property is within a regional area designated as ‘Military Compatibility’, which requires
this MCP overlay application and approval.

The Surprise General Plan Land Use Map – Exhibit 7, locates the subject property, the
65 and 70LDN noise contours, the APZ-2 boundary, and illustrates the proposed
General Plan land use as ‘Employment’. Due to the incompatibility of residential land
uses within the High Noise and Accident Potential Zone surrounding Luke AFB Auxiliary
Field #1, the City of Surprise has designated the entire area within this zone for non-
residential employment uses. The uses proposed in the narrative report are compatible
with this land use designation. Communication has been initiated with the City of
Surprise Planning Dept. to determine if there is any entitlement activity in the
surrounding area that may influence this application.
In 1991, Maricopa County approved the Wickenburg Highway Scenic Corridor Plan that
includes a 34-mile area of US60. In addition to the immediate frontage, the Plan
extends 2-miles outward from both sides of the highway. That Corridor Plan further
defines the area into 4 intensity levels based on proximity to the highway. This subject
property is situated approximately one mile southwest of the highway and by definition is
designated as Class 1 (1/4 mile to 2 miles from the Wickenburg Highway ROW). The
Corridor Plan is generally focused on managing higher intensity uses and circulation for
projects within the first quarter-mile along the highway. The Class 1 designation
requires that new zoning entitlements be consistent with the goals and policies of the
Scenic Corridor. Some of the relevant goals include: promoting higher intensity uses
along arterials, as well as minimizing impacts to regional drainage washes, preserving
the native landscape, and encouraging the use of native and indigenous plant material,
all of which have been incorporated in the site planning for Domres 60. It should also be
noted that the site is located within the “Urban Area” land use area designated by the
Scenic Corridor plan.
8.
Location, Accessibility, On-Site Circulation
N 195th Ave is a section line arterial that will provide the primary access to the property
from either W Jomax Rd or Happy Valley Rd. This arterial has been designated as an
Urban Minor Arterial that will eventually expand from its current 2 paved lanes to 5-
lanes. The ALTA Survey indicates an existing 55’ highway easement for the west half of
195th Ave that will be dedicated to MCDOT.
W Frontier Dr is identified on the Assessor’s website, but there is no ROW: This existing
Frontier Dr is an unimproved dirt road located approximately 2,000’ south of W Jomax
Rd and approximately 540’ south of the north property line. Domres 90 will install a
northbound left turn lane and paved access drive off 195th Ave that will be designed to
accommodate semi-trailers with a WB-67 turning radius. All other off-site improvements
will be deferred until there is an opportunity for a light industrial development that will
include structures requiring common infrastructure improvements. This private access
drive will extend to the center of the property for the four proposed storage yards as
illustrated on the Preliminary Site Plan (Exhibit 8). Frontier Dr will cross through the
drainage swale for the historic flow, which will be designed to allow storm flow to pass

over the drive during major storm events. As indicated on the site plan, internal
circulation will share this private drive using stabilized milled asphalt within a 40’ private
access easement that will extend west to a proposed cul-de-sac. Access into the
storage yards will also use the WB67 turning radius. Future light industrial development
may require the dedication of an 80’ wide right-of-way for Frontier Drive to become a
mid-section collector. This dedication will be subject to a future UCCD, MCP, and POD
Applications.
At the request of the neighbors located at the southwest corner of 195th and W
Swayback Pass, the proposed screen wall will be located 20’ north of the common
property line, which parallels the existing 15’ ingress egress easement on-site. The
current site plan illustrates that the screen wall will follow a 20’ x 20’ diagonal at the
southeast corner to improve the corner visibility.
9.
Grading & Drainage
There are no structures or paved roads on site that are proposed with this MCP
Application. Within the center portion of the Property, is an approximate 22-acre area
impacted by a 100-year floodplain. This floodplain has been analyzed and results
included within a separate Preliminary Drainage Report prepared by ALTA Southwest,
included as a separate attachment with his application. The proposed mass grading on
the property will collect the historic flow and channel it to the south side in an
approximate 55’-60’ wide swale, where it will be allowed to spread and continue south to
follow its historic outfall. Retention basins will be provided to accept and retain storm
flows separate from the historic flow. Please also refer to Exhibit 8 – Site Plan, and
Exhibit 9 – Preliminary Grading & Drainage Plan for additional site information that
illustrates the historic flow through the property and the retention basins. Where historic
flow is received, the precast screen walls will incorporate drainage cutouts within each
and every 8’ precast block used for the base course to allow the historic flow to pass
through.
10. Development Plan
This MCP Application includes a Preliminary Site Plan (Exhibit 8) that illustrates four
proposed storage yards, site access, internal circulation, and the initial perimeter
screening. As referenced earlier, there are no structures proposed with the initial
development. Leased yards for equipment storage will not have any employees on-site,
except to drop off and pickup equipment. If these construction storage tenants require
services or choose to include structures requiring power, water and wastewater service,
then each tenant will file separate applications for UCCD approval, if required, and a
Plan of Development (POD) for those improvements. Domres 90 expects that the
property will develop in one phase beginning with the access drive, mass grading to
control the historic flow, and securing the perimeter of the property. There are four wells
on-site which may be utilized by the tenants for dust control.

11. Project Landscape
The selection of landscape material prescribed for trees, shrubs, groundcovers and
accents will be selected from the Arizona Department of Water Resources low water use
plant list for the Phoenix Active Management Area (Phoenix AMA). There is no initial
landscape proposed for this project. Future development that may introduce light
industrial manufacturing and/or distribution uses will require a MCP Application that will
also require domestic water and sewer services. Ideally, a water provider will have
expanded a CC&N to provide these services, at which time a low water landscape
theme for the 195th Ave streetscape and appropriate areas on-site will be installed.

12. Screening
The major portion of the MCP perimeter boundary shall be defined by a minimum 6’-8’
screen wall using precast concrete blocks (2’x2’x8’) produced by Domres 90, see
Exhibit 10 – Screen Walls. This precast screen wall will extend around the perimeter of
the property. As referenced earlier, the portion of the perimeter wall that parallels the W
Swayback Pass at the southwest corner of 195th Ave and W Swayback Pass will be
reduced to 6’. The secured storage yards on-site and the recycling operation may also
use these same precast blocks in combination with 6-8’ chain link fences. Please refer
to Exhibit 8 - Preliminary Site Plan for the location of these screen walls and fences.
13. Public Utilities & Services
Water: There are four existing wells on-site that the Owner believes will satisfy the initial
development of the property. Since the primary program for development is intended to
lease construction storage yards with no structures, there will not be any on-site
employees associated with these yards. The water demand will be limited to the initial
site grading and future dust control. One or more of these wells may be shared for these
leased yards. Elevated storage tanks will be utilized dust control.
The lack of access to a local water provider requires that Domres 90 must rely on these
existing water wells to future support domestic and fire flow requirements. This condition
will require that the existing parcel boundaries will need to remain in place until a water
provider can service this area. Combinations of some of these parcels may be
necessary for the efficient use and distribution of services. This will depend on the
tenant’s site requirements and may be subject to future UCCD and POD applications.
The local water provider is Liberty Utilities: however; the subject property is outside their
CC&N service area. Future expansion of their CC&N service area may allow a
connection for the later phases.

Thank you for the opportunity to comment on the Use Compatibility and Consistency
Determination application for construction related activities. The application references
proposed uses of construction material recycling (asphalt, concrete, and other inert material),
construction material sales and storage, construction equipment sales, service, rental, and
storage, light manufacturing, and warehouse/distribution. The site sits on approximately 60.85
acres and is located south of Jomax Road and west of 195th Avenue in unincorporated Maricopa
County, AZ. The site is located inside the Luke AFB Aux-1 2004 JLUS 70 DNL and Accident
Potential Zone 2 (APZ2), “high noise or accident potential zone,” as identified by A.R.S. § 28-
8461, and is within the “territory in the vicinity of a military airport,” also defined by A.R.S. §
28-8461. This area for flight operations is critical for the training of 56th Fighter Wing pilots.
Luke AFB continually appreciates the opportunity to provide comments, acknowledging
that we are not the approval authority. Luke AFB follows A.R.S. § 28-8481 when evaluating
compatible land use within the “territory in the vicinity of a military airport”. Given the location
of this development project, we have identified actual and/or potential mission risks and hazards
should the development encompass the following:
A.R.S. § 28-8481 (16) No new buildings or improvements or expansion of
nonagricultural buildings or improvements for uses that result in the release of any substance into
the air that would impair visibility or otherwise interfere with operating aircraft, such as any of
the following:
(a) Steam, dust, and smoke.
(b) Direct or indirect reflective light emissions
(c) Electrical emissions that would interfere with aircraft and air force communications
or navigational aid systems or aircraft navigational equipment.
(d) The attraction of birds or waterfowl such as operation of sanitary landfills or
maintenance of feeding stations.
(e) Explosives facilities or similar activities (chemical storage).
Luke AFB reserves the right to comment as the development plan matures and/or as
amended plans become available. Until a project narrative and site plan become available, Luke
AFB will not be able to fully ascertain whether the project proposal is compatible with flight
operations at the Aux-1 auxiliary airfield. Any proposed buildings, structures, or tall equipment
will also be subject to the results of an FAA Obstruction Evaluation/Airport Airspace Analysis
and Spectrum Analysis (OE/AAA).
Since the development will be located within the “territory in the vicinity of a military
airport,” it will be subjected to approximately 170 over flights a day. We recommend you
review the sound attenuation requirements found in A.R.S. § 28-8482. A strong notification
program on the part of the applicant is essential to inform potential occupant(s) about Luke AFB
operations.
If applicable, it should be noted that certain investments and real estate transactions
within the military installation footprint of Luke AFB may be subject to review by the
Committee on Foreign Investment in the United States (CFIUS) to determine the effect of such
transactions on the national security of the United States. The CFIUS regulations, Foreign
Investment Risk Review Modernization Act of 2018 (FIRRMA) provisions, and related
resources can be found on the Department of the Treasury’s website:

WITHIN 36 HOURS, SIGNED BY A REGISTERED ARIZONA PROFESSIONAL ENGINEER, SHALL BE SUBMITTED
FOR APPROVAL WITH THE AS-BUILT PLAN DOCUMENTATION. TEST RESULTS OBTAINED IN DESIGN PHASE

THIRD PARTY INSPECTIONS:
THE NAME AND QUALIFICATIONS OF THE THIRD PARTY INSPECTOR SHALL BE SUBMITTED FOR APPROVAL TO
MARICOPA COUNTY PRIOR TO THE START OF WORK ON IMPROVEMENTS REQUIRING THIRD PARTY
INSPECTIONS AS SPECIFIED BY PERMIT CONDITIONS. THIRD PARTY INSPECTOR SHALL NOT BE THE OWNER,
APPLICANT, ENGINEER OR CONTRACTOR UNLESS APPROVED BY MARICOPA COUNTY. WEEKLY REPORTS
SHALL BE SUBMITTED TO THE COUNTY AS AN ADDENDUM SEALED BY AN ARIZONA REGISTERED
PROFESSIONAL ENGINEER, DOCUMENTING PROGRESS, COMPACTION, MATERIAL TESTING, AND OVERALL

Description-Application for a plan of development on subject parcels. Requesting a
military compatibility permit with a plan of development (POD) for industrial
development of 92.44 gross acre site.
Engineering Review has reviewed the fifth plan set and report routed for review, for
the subject application on 1.29.2026 and has no objections subject to the following
conditions:
DRAINAGE PLAN REVIEW
1. Lintel openings and calculations with final drainage report at building permit
phase shall have 50% clogging factor. Flows shall represent the 100yr flows.
2. All channels shall have 1 foot of freeboard.
3. Drainage and private access easements shall be dedicated for this site in
accordance with the DPSM. Recordation must be provided prior to building
permit issuance.
4. Percolation methods for retention basins shall be provided to drain entire basin
within 36hours.
5. Roadway- 195TH Avenue- Maintain/dedicate the 55’ ROW.
6. Roadway- Frontier Drive shall remain private roadway but driveway connection to
195th Ave shall be per MCDOT Roadway design manual.
7. An updated traffic impact study is required for each additional new use and must
be approved by MCDOT.
General Conditions:
1. Engineering review of planning and/or zoning cases is for conceptual design
only. All development and engineering design shall be in conformance with

Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway
Design Manual; and current engineering policies, standards and best practices
at the time of application for construction.
2. Based on the conceptual design nature of the information submitted, changes
to the site layout may be necessitated by the final engineering design of the
site’s drainage infrastructure.
3. Maricopa County does not supply water, fire or sewer services. It is the
applicant/owner’s responsibility to coordinate and secure water, fire and
sewer services for this site.
4. Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final
drainage report must be submitted with the application for Building Permits

General Project Summary:
The proposed development consists of proposed roadway construction vehicle/equipment storage facility located along west side of 195th Avenue between Jomax Road and Happy
Valley Road. The proposed development is planned on three contiguous parcels with APNs 503-79-002A, 503-79-002G, 503-79-002H, 503-79 -002J, 503-79 -002K, 503-79 -003Q, and
503-79-003S, situated within an unincorporated section of Maricopa County. The site has approximately 1,531 feet of frontage along 195th Avenue. The site accees will be through a
private roadway at future Frontier Drive alignment that is currently unpaved and located on the south side of the site. The developer plans to provide a 26-foot paved surgace and a 7-
foot unpaved surface on either side of 40-foot private road access easement. The site is expected to generate 584 daily trips, 38 AM peak hour trips, and 52 PM peak hour trips.
Previousexpected opening year is anticipates as 2025 based on permit approvals. As this is year 2026, new opening year is assumed to be 2026 or soon permits are secured. Material
Recycling facility previously proposed is totally eliminated for this site with possibility of inclusion in future.

Thank you for the opportunity to comment on the Use Compatibility and Consistency
Determination application for construction related activities. The application references
proposed uses of construction material recycling (asphalt, concrete, and other inert material),
construction material sales and storage, construction equipment sales, service, rental, and
storage, light manufacturing, and warehouse/distribution. The site sits on approximately 60.85
acres and is located south of Jomax Road and west of 195th Avenue in unincorporated Maricopa
County, AZ. The site is located inside the Luke AFB Aux-1 2004 JLUS 70 DNL and Accident
Potential Zone 2 (APZ2), “high noise or accident potential zone,” as identified by A.R.S. § 28-
8461, and is within the “territory in the vicinity of a military airport,” also defined by A.R.S. §
28-8461. This area for flight operations is critical for the training of 56th Fighter Wing pilots.
Luke AFB continually appreciates the opportunity to provide comments, acknowledging
that we are not the approval authority. Luke AFB follows A.R.S. § 28-8481 when evaluating
compatible land use within the “territory in the vicinity of a military airport”. Given the location
of this development project, we have identified actual and/or potential mission risks and hazards
should the development encompass the following:
A.R.S. § 28-8481 (16) No new buildings or improvements or expansion of
nonagricultural buildings or improvements for uses that result in the release of any substance into
the air that would impair visibility or otherwise interfere with operating aircraft, such as any of
the following:
(a) Steam, dust, and smoke.
(b) Direct or indirect reflective light emissions
(c) Electrical emissions that would interfere with aircraft and air force communications
or navigational aid systems or aircraft navigational equipment.
(d) The attraction of birds or waterfowl such as operation of sanitary landfills or
maintenance of feeding stations.
(e) Explosives facilities or similar activities (chemical storage).
Luke AFB reserves the right to comment as the development plan matures and/or as
amended plans become available. Until a project narrative and site plan become available, Luke
AFB will not be able to fully ascertain whether the project proposal is compatible with flight
operations at the Aux-1 auxiliary airfield. Any proposed buildings, structures, or tall equipment
will also be subject to the results of an FAA Obstruction Evaluation/Airport Airspace Analysis
and Spectrum Analysis (OE/AAA).
Since the development will be located within the “territory in the vicinity of a military
airport,” it will be subjected to approximately 170 over flights a day. We recommend you
review the sound attenuation requirements found in A.R.S. § 28-8482. A strong notification
program on the part of the applicant is essential to inform potential occupant(s) about Luke AFB
operations.
If applicable, it should be noted that certain investments and real estate transactions
within the military installation footprint of Luke AFB may be subject to review by the
Committee on Foreign Investment in the United States (CFIUS) to determine the effect of such
transactions on the national security of the United States. The CFIUS regulations, Foreign
Investment Risk Review Modernization Act of 2018 (FIRRMA) provisions, and related
resources can be found on the Department of the Treasury’s website:

(c) Electrical emissions that would interfere with aircraft and air force communications
or navigational aid systems or aircraft navigational equipment.
(d) The attraction of birds or waterfowl such as operations of sanitary landfills or
maintenance of feeding stations.
(e) Explosives facilities or similar activities (e.g. chemical storage).
Luke AFB finds that if potential mission risks and hazards are mitigated by the
landowner, the proposed uses will be compatible and consistent with the high noise or accident
potential of Luke AFB and will not negatively impact flight operations.
Since the development will be located within the “territory in the vicinity of a military
airport,” it will be subjected to approximately 170 over flights a day. We recommend you
review the sound attenuation requirements found in A.R.S. § 28-8482. A strong notification
program on the part of the applicant is essential to inform potential occupant(s) about Luke AFB
operations.
If applicable, it should be noted that certain investments and real estate transactions
within the military installation footprint of Luke AFB may be subject to review by the
Committee on Foreign Investment in the United States (CFIUS) to determine the effect of such
transactions on the national security of the United States. The CFIUS regulations, Foreign
Investment Risk Review Modernization Act of 2018 (FIRRMA) provisions, and related
