Project Summary:
1.
The applicant, on behalf of the property owner, is requesting a modification of condition ‘e.3’ of
Z2022126, which requires a min. 8’ tall solid wall adjacent to or abutting any rural or residential
boundary. The applicant’s request is to eliminate the required solid fencing along the site’s east
boundary, a 40’- wide abandoned right-of-way (39th Ave.). An 8’ high solid wall exists along this
east boundary of the parcel to the east of this site that serves as screening to the adjoining
residential zoning. The former right-of-way parcel is within the City of Phoenix and according to
the applicant, is solely an access easement to the neighboring residence. Although the language
of the condition would change, it would not alter the IUPD’s original intent to screen adjacent rural
residential land uses. Shown below is condition ‘e.3’:
e-3. Screening – Industrial use on the site must be screened from rural or residential
land uses by a minimum 8’ solid wall.

On February 8, 2023, the BOS approved IND-2 IUPD zoning to accommodate an outdoor storage
facility that specializes in in truck parts (Z2022126). With exception of the screening wall in
question, development of the site has been in conformance with the approved site plan by
providing screening walls and area surfacing to minimize dust pollution.

Vision 2030 Maricopa County Comprehensive Plan (adopted 2016): The site is designated as
Rural Development Area (0-1 du/ac). This designation is designed to encourage low-density
residential and agricultural uses in areas that lack urban services. However, this site is located
within the Phoenix municipal planning area and is adjacent to urban services.

City of Phoenix General Plan (adopted 2015): This site is designated as Commerce/Business
Park which denotes areas where major employment centers can take place. These uses consist
of professional offices, research/development centers, wholesale, warehouses, utility centers,
and manufacturing facilities. The existing outdoor storage facility is in concert with this general
plan designation.
Public Participation Summary:

The applicant has complied with the requirements listed in the County’s Citizen Review Process
such as posting the site and notifying the public about this request. The applicant has submitted
a Citizen Participation Results Report and according to the applicant received two inquiries from
the public who requested more information about this proposal. As of the writing of this report
staff nor the applicant has received any opposition or support of this request from the public. The
City of Phoenix was notified about this request and since the writing of this report staff has not
received any concerns about this request.

Staff Analysis:

Staff supports the requested modification of condition of ‘e-3.’. This modification would allow
the removal of the required screening wall along the east lot line of the site but maintains the
requirement to screen the industrial uses on the site from any rural/residential land uses. The 40’-
wide parcel directly to the east of the subject site does have an existing 8’ tall solid wall along its
east boundary that will effectively screen the industrial uses on the site. Approval of this

modification would hardly be noticeable by the public and will have no impact on neighboring
properties. There is no known opposition to the request.
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z250036 subject to conditions ‘a’ – ‘k’:
a.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “All Truck Auto Parts Expansion Project”, consisting of three pages, dated January
19, 2026, and stamped received January 27, 2026, except as modified by the following
conditions.
b.
Prior to final approval of construction permits, the Owner or Developer shall process a
lot combination or record a cross-access agreement between APN 105-69-007P and
APN 105-69-007M.
c.
The following Planning Engineering comments shall apply:
1.
At the time of application for construction permits, the following comments shall
be addressed within the Grading and Drainage Plan and Drainage Report.
i. Include the analysis of offsite flows that could impact the project and
describe where the water will run and how it impacts adjacent lots.
ii. Complete the analysis of onsite runoff for APNs 105-69-007P and 105-69-
007M. The Rational runoff coefficients are 0.95 for the entire lot, except that
the area below the retention basin high water can use 0.50.
iii. Complete the layout and design of the retention basins for APN 105-69-007P
and 105-69-007M.
iv. Soils testing and drywell selection for infiltration of the runoff in 36 hours
shall be completed.
v. The drainage report shall be completed for APN 105-69-007P and 105-69-
007M and within this drainage report, drainage blocks are required for all new
CMU walls, and hydrologic, hydraulic and retention calculations shall be
included.
vi. Add the finished floor elevation for the new 10’ x 32’ building which is the
unlabeled building with the septic system connection and the existing house.
2.
Broadway Rd. is in the jurisdiction of the City of Phoenix. At the time of
acquisition of construction permits, the owner or developer shall submit
correspondence from the City of Phoenix indicating that there are no objections
to the driveway use change and access permission remains valid.

Engineering review of planning and/or zoning cases is for conceptual design only.

All development and engineering design shall be in conformance with Section
905 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
4.
Based on the conceptual design nature of the information submitted, changes
to the site layout may be necessitated by final engineering design of the site’s
drainage infrastructure.
5.
Detailed Grading & Drainage (Site Infrastructure) Plans must be submitted with
the application for Building Permits.
d.
The following IND-3 IUPD Zoning District development standards shall apply:
1.
Uses Permitted – The only permitted uses shall be the following uses: heavy
vehicle, truck, semi-truck, and automobile repair; on-site storage and sale of
vehicle, truck, semi-truck and automobile parts; contractor yard, industrial
storage, and; accessory buildings and uses customarily incidental to the above
listed uses including a single caretaker residence. All other uses shall be
prohibited.
2.
Sight Visibility Triangles (SVTs) - Two SVTs waived at the access point off of the
easement leading to the residence. All other SVTs are required. Driveways,
Parking and Obstructions greater than 2’ in height are not permitted within
required SVTs.
3.
Screening – industrial use on the site must be screened from rural or residential
land uses by a minimum 8’ solid wall.
e.
A will serve letter for fire shall be required prior to receiving approval of construction
permits.
f.
Outdoor lighting shall be placed so as to reflect the light away from adjacent residential
districts. All outdoor light fixtures shall be fully shielded and directed downward.
g.
Noise, odor or vibration shall be emitted so that it exceeds the general level of noise, odor
or vibration emitted by uses outside of the site.
h.
Open storage shall be no higher than 6’ plus 1’ in heigh for each additional 3’ of
setback form a property line.
i.
Noncompliance with any of the conditions assigned to the approval of this Zone Change
by the Maricopa County Board of Supervisors may be grounds for revocation in
accordance with the requirements and procedures as set forth in the Maricopa County
Zoning Ordinance.
j.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.

k.
The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date
of application, subject to conditions. In the event of the failure to comply with any
condition, the property may be considered for revocation to the zoning that existed on
the date of application. It is, therefore, stipulated and agreed that either revocation due
to the failure to comply with any conditions, does not reduce any rights that existed on
the date of application to use, divide, sell or possess the property and that there would
be no diminution in value of the property from the value it held on the date of application
due to such revocation of the Zone Change. The Zone Change enhances the value of
the property above its value as of the date the Zone Change is granted and reverting to
the prior zoning results in the same value of the property as if the Zone Change had
never been granted.

Purpose of Request
We are requesting to modify Condition 'e(3)' of Z2022126, which requires a minimum 8' solid wall
adjacent to or abutting any rural or residential zoning boundary. Our request is to eliminate the
required solid fencing along the site's east property line but keep this requirement for the rest of the
property lines that abut rural or residential zoning boundaries. The reason for this new request is that
the 40' wide parcel to the east is an access easement inside the City of Phoenix and because there is
an existing 8' tall solid wall to provide screening along the easement's east side that abuts residential
zoning.
Our proposed modification for Condition 'e(3)' of Z2022126 is as follows:
Screening - Screening - industrial use on the site must be screened from rural or residential
land use by a minimum 8' solid wall.
Description of Proposal
This project will comply with all stipulations and the approved narrative from Z2022126 except
for requested modification.
The applicant also owns a third parcel directly east (APN 105-69-007Q), which was originally
intended as right-of-way for 39th Avenue, but has since been abandoned. This narrow property is
used for access to the residential home at the south end of the site, and will provide a buffer
between the operations on site and the residential uses to the east.
Relationship to Surrounding Properties

East: R1-6 (Phoenix)/single family residential

The Broadway Road corridor, stretching all the way from 7th Avenue, has been a hub for auto and
truck storage business for decades, and has expanded to 43rd Avenue since Broadway Road was
extended further west in the 1990s. The approval of this zone change will allow the expansion of an
existing auto and truck storage business along the Broadway corridor, supporting the hub of such
activity and clustering of like uses. As such, the expansion of this use is consistent and
compatible with the adjacent industrial uses to the west along Broadway Road. The expansion of this
business will also benefit the community by providing a productive, tax-generating uses on a property
that is challenging to develop due to the elongated shape.

Location, Accessibility, and Circulation
The subject site will be accessed from the adjacent property immediately west, APN #105-69-
007M on which the existing business that is proposing expansion is currently operating. The
adjacent property has access directly from Broadway Road and contains a 20-foot drive aisle directly
across the middle of the site. This drive aisle provides access to a gate at the south end of the site,
which will provide controlled access to the site in subject. This internal drive aisle will provide access
to all storage areas on site.

Community Facilities and Services
The property is within the Laveen Elementary School District and Phoenix Union High School
District. This project will have a negligible effect on the local school districts as it will convert 2.6
acres of rural residential property, which could support only 2 dwelling units, into an industrial use
that will not generate student-aged children to the local schools. This site is also less than a mile
from Playa Margarita Park. However, as a proposed industrial use, will not impact the local park
system.
Compliance with the City of Phoenix General Plan
The property is located within the City of Phoenix Metropolitan Planning Area, and is designated
Transition Commerce/Business Park to Residential 3.5-5 du/ac. This request is consistent with the
Commerce/Business Park land use designation. The property will not be annexed into the City of
Phoenix at this time. However, if the property is annexed in the future, the proposed development is
low-impact and will not construct any new structures on site. This low-impact development will
facilitate an easy transition to residential redevelopment in the future.

Dear Mr. Jassim,
On February 8, 2023, the Maricopa County Board of Supervisors (BOS) by a vote
of 5-0 approved your request for a Zone Change with Overlay from RU-43 to IND-
3 IUPD for case Z2022126 (conditions ‘a’ – ‘l’). The subject site is approximately
2.06 acres generally located 2,654’ west of the southwest corner of 35th Ave. &
Broadway Rd. in the south Phoenix area.
Approval of Z2022126 is subject to the following conditions:
a.
Development of the site shall be in substantial conformance with
the Site Plan entitled, “Site Plan” consisting of two full-size
sheets dated December 27, 2022, and stamped received
December 27, 2022, except as modified by the following
conditions. Staff may determine slight refinements to remain in
substantial conformance with the approved site plan. Minor and
major amendments to the site plan will be determined in
accordance with Chapter 3 of the Maricopa County Zoning
Ordinance.
b.
Development of the site shall be in substantial conformance with
the Narrative Report entitled “All Trucks Auto Parts Expansion”,
consisting of 4 pages, dated revised December 12, 2022 except
as modified by the following conditions.
c.
Prior to final approval of construction permits, the Owner or
Developer shall process a lot combination or record a cross-
