37% of surrounding parcels by area and 38% by number.  This triggers (at least 20% 
in both area and number) a super-majority (four affirmative) vote of the Board for

We are long-term residents of this community and strongly oppose Mr. Benavides's activities. Although 
we do not reside within the 300-foot notification boundary and do not own the home in which we live 
(it is owned by Rayann's family), my family and I have been significantly impacted. 
Prior to Mr. Benavides and his family moving into the area, the neighborhood was relatively quiet. Since 
that time, weekends have become unpredictable due to increased traffic and loud music continuing late 
into the evening. 
A neighborhood meeting was held only after the organizers were required to do so. During that meeting, 
residents' concerns were not meaningfully addressed. When concerns were raised, Mr. Benavides's 
daughter, Melissa, became hostile. Following the meeting, Mr. Benavides contacted me requesting a 
"do-over," stating that the meeting had not gone well and asking what he could do to gain my support. 
When I declined to support the events, the behavior toward me escalated into harassment. 
On multiple occasions, I have spoken with the neighbor who lives directly east of Mr. Benavides's 
property and have contacted law enforcement due to excessively loud music. During these incidents, 
Mr. Benavides sat in his vehicle and shined a spotlight directly at my car, impairing my vision. 
On September 15, 2025, Mr. Benavides's wife drove at a high rate of speed and swerved into my yard, 
striking my children and me with rocks and dirt. On October 30, 2025, as I was leaving my home, I 
stopped my vehicle when Melissa swerved into my lane at a high rate of speed, narrowly avoiding a 
collision and striking my vehicle with debris. Both incidents are documented in police reports, and one 
was captured on my dash camera. 
These individuals are members of the family hosting the events, and Melissa is the primary organizer. 
Their actions demonstrate a disregard for the safety of residents, particularly children. Alcohol is served 
at these events, and I have personally observed visibly intoxicated individuals driving away from the 
neighborhood. Event attendees frequently drive at excessive speeds, including at night, despite the 
absence of street lighting or posted speed limit signs. 
My children are autistic and are unable to sleep during these events due to excessive noise and bass that 
is clearly felt inside our home, despite being approximately 700 feet away. I must constantly monitor 
traffic when assisting my children into vehicles out of concern that ongoing harassment and reckless 
driving could result in serious injury. 
For these reasons, I submit this statement out of serious concern for the safety and well-being of my 
family and the surrounding community, and I respectfully request that the Board deny the special use 
permit.

My family opposes this activity. The operators did not follow the proper approval process before 
beginning operations and have introduced excessive traffic into the area. This creates serious 
safety concerns, as the roads are unpaved and lack streetlights, traffic signals, and stop signs. 
Vehicles frequently speed in and out of the neighborhood, increasing the risk to residents. 
The events are consistently loud and regularly keep my young children awake at night. Bass 
from the amplified sound system is strong enough to shake the windows and walls inside our 
home. I understand the operators were previously instructed to discontinue events, yet they 
have continued to operate in disregard of that directive. 
They have failed to comply with the rules and conditions imposed by the county and other 
agencies. I am concerned that approval of this application would only encourage continued 
noncompliance, further compromising the safety, peace, and livability of the surrounding 
residential neighborhood.

I oppose the permit application number SU250009. 
The event hall has brought a significant increase in traffic to the area. Our roads are not 
designed to accommodate commercial traffic and are not equipped with traffic signs or lighting. 
Vehicles frequently enter and exit the area at excessive speeds, creating a dangerous situation 
for residents. 
The individuals involved have not complied with County Code requirements and have 
disregarded a County-issued Cease and Desist order.

​I am writing this letter in protest for application ID  SU250009.​
​There are several reasons this permit should be denied.​
​I. Adverse Impacts on Residents and Vulnerable Individuals​
​1.​ ​The proposed use has caused direct, ongoing, and foreseeable harm to nearby​
​residents, including members of my household.​
​2.​ ​A resident of my household diagnosed with Parkinson’s disease has been unable to​
​sleep during event nights due to excessive noise.​
​3.​ ​A resident of my household with special needs and significant sensory sensitivities​
​experiences severe distress from amplified music, including covering his ears, rocking,​
​and visible emotional agitation.​
​II. Escalation and Frequency of Events​
​1.​ ​Events initially occurred once per week and later increased to twice per week.​
​2.​ ​On multiple occasions, events occurred on three consecutive days, including Fridays,​
​Saturdays, and Sundays.​
​3.​ ​This escalation persisted despite repeated law enforcement responses and direct​
​notification to the applicants that the events were causing significant disruption to​
​neighboring residences.​
​III. Ignorance of Laws, Codes, and Permit Requirements​
​1.​ ​Shortly after the first event, the individual acting as event coordinator was informed of​
​applicable noise ordinances and county codes through e-mail correspondence.​
​2.​ ​Despite this notice, the applicants failed to apply for a special use permit for a period​
​exceeding one year.​
​3.​ ​The timing of the application strongly suggests it was submitted only after repeated​
​sheriff responses to loud music complaints.​
​IV. Unpermitted Construction and Continued Operations​

​1.​ ​Renovations and site modifications were completed without required permits.​
​2.​ ​After submission of the special use permit application, the applicants were instructed to​
​cease operations, including the use of amplified music, until approval was granted.​
​3.​ ​Despite this directive, events with amplified music continued, including within days of this​
​submission.​
​4.​ ​The center has attempted to hide operations by changing their name and not putting​
​their address on Instagram and Facebook accounts that are associated with the new​
​name.  Pictures on those pages display the location.​
​V. Creation of Traffic and Safety Hazards​
​1.​ ​The applicants constructed an approximately eight-foot fence and extended it to the​
​roadway without a permit, despite existing code violations under review.​
​2.​ ​This unpermitted construction obstructs visibility when exiting my driveway and creates a​
​significant traffic safety hazard.​
​3.​ ​This safety hazard impacts servicing of my dumpster since Waste Management has no​
​visibility to exit my property safely.​
​4.​ ​These hazards are exacerbated by frequent and excessive speeding by individuals​
​associated with the property.​
​VI. Unauthorized Commercial Use of Adjacent Properties​
​1.​ ​Mr. Benavides installed millings and rented parking spaces to semi-trucks on a vacant lot​
​directly across from his property without ownership or authorization.​
​2.​ ​After being instructed to discontinue this activity, the millings was relocated to a parcel at​
​the corner of 183rd Drive and Moreland, owned by the Arizona Department of​
​Transportation, where unauthorized commercial parking activity resumed.​
​3.​ ​This activity ceased only after enforcement action, and the property was subsequently​
​fenced.​
​4.​ ​An ADOT representative indicated that fines or criminal charges were likely.​
​5.​ ​Following the loss of access to these properties, Mr. Benavides began parking a​
​semi-truck on another vacant parcel along 183rd Drive without ownership or​
​authorization.​
​VII. Apparent Lack of Required Food and Alcohol Licensing​
​1.​ ​Public reviews and posted menus indicate that food is served at events; however, no​
​food service license has been obtained.​

​2.​ ​Reviews state that licensed bartenders are provided, while other reviews indicate that​
​family members act as bartenders.​
​3.​ ​No bartender licenses or alcohol service licenses appear to be on record with the state​
​licensing authority for the individuals or the business.​
​4.​ ​Since licensing requires 60 hours of education this raises serious concerns regarding​
​underage drinking, overserving, impaired driving, and public safety in a residential​
​neighborhood.​
​VIII. Hostile Conduct and Abusive Behavior Towards Neighbors​
​1.​ ​During a required neighborhood meeting, the individual acting as event coordinator​
​expressed hostility toward residents opposing loud events and alcohol-related activity​
​near their homes and families.​
​2.​ ​Following that meeting, a neighbor who had been especially vocal in opposition to the​
​activity, and his autistic children, were placed at risk when a vehicle associated with the​
​applicants swerved onto their property, throwing dirt and debris toward the neighbor and​
​his children while they were standing in their own yard.​
​3.​ ​In a separate incident, a vehicle associated with the applicants swerved toward the​
​same neighbor at high speed, serving at the last minute narrowly avoiding a collision.​
​4.​ ​Both incidents were reported to law enforcement, and one was captured on dash​
​camera footage.​
​5.​ ​These events appeared to be some form of intimidation.​
​IX. Noise Impacts Beyond the Notification Radius​
​1.​ ​Noise impacts extend well beyond the 300-foot notification radius.​
​2.​ ​Music has been audible approximately 800 feet away, including at the intersection of​
​Roosevelt and 180th Drive.​
​3.​ ​Event lighting has been visible from major intersections, including Roosevelt and Citrus.​
​4.​ ​Events have continued until approximately 3:00 a.m.​
​5.​ ​Bass from amplified sound systems causes vibrations that shake windows and can be​
​physically felt​​INSIDE​​homes located 800 feet from the venue.​
​X. Crime and Unsafe Road Conditions​
​1.​ ​Despite many years of very little crime since the events started we’ve had the Air​
​Conditioning Copper stolen from under our home, several items stolen from our property,​
​and screws drilled into the tires on our car.​

​2.​ ​The surrounding area consists primarily of narrow, unpaved dirt roads that are not​
​designed to accommodate high volumes of traffic or commercial activity.​
​3.​ ​The roadways lack overhead lighting, creating limited visibility during evening and​
​nighttime hours when events are held.​
​4.​ ​There are no traffic control devices in the area, including stop signs, yield signs, traffic​
​signals, or marked lanes.​
​5.​ ​Increased event traffic, including impaired drivers leaving late-night events, significantly​
​elevates the risk of collisions, pedestrian injuries, and property damage under these​
​conditions.​
​6.​ ​The combination of alcohol service, excessive speeding, limited visibility, and​
​unregulated roadway conditions creates a heightened risk of criminal activity, hit-and-run​
​incidents, and other public safety hazards.​
​7.​ ​These roadway conditions make the location unsuitable for a commercial event venue​
​and incompatible with the safe use of surrounding residential properties.​
​XI. Conclusion and Request for Denial​
​1.​ ​The applicants have demonstrated a sustained pattern of noncompliance with laws,​
​regulations, and permit requirements.​
​2.​ ​The applicants have shown disregard for public safety and the reasonable use and​
​enjoyment of neighboring properties.​
​3.​ ​The proposed use is incompatible with the surrounding residential area.​
​4.​ ​Approval of the petition would reward prior violations and create ongoing risks to​
​residents and patrons.​
​For these reasons, the petition should be denied.​

I am writing to formally oppose the permit application for Mr. Benavides, application number 
SU250009. 
My grandchildren frequently spend weekends with me, and during event nights it is extremely 
difficult to maintain a reasonable bedtime. The music is often so loud that I have had to turn my 
television to maximum volume just to hear it inside my own home. 
I am also deeply concerned about the safety hazards this operation creates. The volume of 
vehicles is excessive for this area, which consists of narrow, unlit dirt roads with no traffic signs 
or controls. This is not an appropriate location for a commercial operation. The increased traffic 
and noise disrupt the peaceful use of our neighborhood and intrude into the interior of our 
homes. 
It is unreasonable for residents to endure these disturbances so that one individual can operate 
a business in a non-commercial area. If the center is as successful as it appears to be, Mr. 
Benavides should relocate to a properly zoned commercial venue. 
For these reasons, I respectfully urge the board to deny this application.
