Project Summary: 
 
1. 
This request is for a zone change for approximately 1.53 acres of a 2.19 acre parcel with a plan 
of development to construct a church with a private school/daycare. The site is located southeast 
of the northeast corner of 203rd Ave. and Gordon Ct., which is also southeast of the southeast 
corner of 203rd. Ave. and US Hwy. 60 in the Wittmann area. The site currently has split zoning with 
Rural-43 and C-2 (the latter adjacent to the highway). This rezone request would consolidate the 
site into a unified C-2 zoning district. 
 
2. 
The subject site is shaped like a leaning square with a north-south dimension of approximately 
294’ and an east-west dimension of approximately 337’. There are no existing physical or 
topographic features that appear to have an impact on development of the site. The church is a 
permitted use in the Rural-43 zoning district, but the applicant is requesting unified C-2 zoning 
over the site in order to better facilitate development of a private school/daycare, and additional 
accessory uses to the church such as counselling, after-school programs, and events outside of 
regular church services such as weddings, funerals, conferences, and meetings. Primary church 
operations would occur on Saturdays, Sundays, and Wednesday evenings and the private 
school/daycare would be open Monday – Friday from 6 am to 7 pm.

A proposed 6,000 sf prefabricated metal building will serve as the main church building. Ancillary 
structures would include two 4,000 sf classrooms and offices building. Development would also 
include a children’s playground and open space for outdoor events. A 6-foot masonry wall with 
steel fencing is proposed to secure the site.  
 
4. 
There will be two access points - one for ingress on the east and one for egress on the west - 
along Gordon Ct.. There will be no direct access onto the highway. The applicant is proposing a 
monument sign on Gordon Ct. and a 12-foot free standing sign along US Hw6l 60.

White Tank Grand Avenue Area Plan (adopted 2023): Designates the subject site as Single-family 
– Rural. The Single-family – Rural land use designation supports the rural development/low 
density development. The proposed use would not have a major impact to the rural area.

Wickenburg Scenic Corridor (adopted 1991): The subject site is within the Wickenburg Scenic 
Corridor in Class 4. The proposed rezone and use would not impact the corridor, but would 
preserve and enhance the area by developing the site with a compatible design to the natural 
environment and keeping the northern portion along the highway as desert scape.  Class 4 
category requires signs have a maximum height of 12 feet with a setback of 20 feet, which the 
site plan shows a 26 foot setback for the proposed signage. 
 
Public Participation Summary:

The applicant complied with the public participation requirements according to MCZO Section 
304, including notification of property owners within 300’ of the subject site and posting. 
Registered areas of interest were contacted by the applicant and staff regarding the rezone 
request. To date staff has not received public comments.

The proposed use of a church with a private school/daycare would be appropriate for this area 
and is well suited for this particular site due to the low-density residential development 
surrounding the subject site but with frontage along a highway and access to the highway via 
existing street intersection. The request would unify the zoning district from Rural-43 andC-2 to 
C-2 The proposed use will not generate heavy traffic volume or other adverse impacts. There is 
no known opposition, the proposed development is in compliance with Class 4 category of the 
Wickenburg Highway Scenic Corridor Plan and C-2 zoning district development standards. 
Therefore, staff recommends approval for the reasons noted above.  
 
Recommendation: 
 
13. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z250018 subject to the following conditions ‘a’ – ‘h’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Calvary Chapel Arise”, consisting of one full-size sheet, stamped received September 17,

2025, except as modified by the following conditions. Staff may determine slight 
refinements to remain in substantial conformance with the approved site plan. Minor and 
major amendments to the site plan will be determined in accordance with Chapter 3 of 
the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Calvary Chapel Arise”, consisting of four pages, dated August 15, 2025, and 
stamped received September 17, 2025, except as modified by the following conditions. 
 
c. 
Any amendments to the Plan of Development shall be processed administratively through 
a new Plan of Development application with Maricopa County Planning & Development. 
 
d. 
The following Planning Engineering conditions shall apply: 
 
1. 
Plans submitted for building permit issuance must show that a minimum 25-foot 
separation between septic facilities (including reserve area) and the retention 
basin(s) is maintained. 
 
2. 
The subject site is not located within the County’s Urbanized; and thus will not 
require a Storm Water Pollution Prevention Permit (SWPPP) from the County. This 
does NOT preclude the requirement to obtain a Notice of Intent to Discharge 
(NOID) from the State (ADEQ), as may be required. 
 
3. 
A Traffic Study must be approved by MCDOT prior to Application for Building 
Permit. Any stipulations of approval of the Traffic Study must be incorporated into 
plans prior to Building Permit Issuance.  
 
4. 
If any additional right-of-way dedication is required, applicant, at their own 
expense, must provide Maricopa County with Owner’s ALTA Title Insurance for 
ROW dedication prior to Building Permit approval. 
 
5. 
 Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction permit. 
 
6. 
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the drainage 
infrastructure 
 
7. 
Detailed Grading and Drainage (Infrastructure) Plans and Final Drainage Report 
must be submitted with the application for Final Building Permits. 
 
e. Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required.

f. 
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.  
 
g. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions.  
 
h. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
shall revert to the zoning that existed on the date of application.  It is, therefore, stipulated 
and agreed that either revocation due to the failure to comply with any conditions, does 
not reduce any rights that existed on the date of application to use, divide, sell or possess 
the property and that there would be no diminution in value of the property from the value 
it held on the date of application due to such revocation of the Zone Change.  The Zone 
Change enhances the value of the property above its value as of the date the Zone Change 
is granted and reverting to the prior zoning results in the same value of the property as if 
the Zone Change had never been granted.

Purpose: 
The Applicant proposes to re-zone the property from C-2/RU-43 (split zone) to C-
2. The Applicant intends to construct an approximately 6,000 square foot church 
with two 4,000 SF ancillary buildings to be used for Sunday school and offices. 
The applicant owns the parcel under consideration. 
The Applicant has determined that a C-2 zoning is necessary for their proposed 
activities which may include church services, private schooling, daycare, 
counseling, after-school programs, and community events such as weddings, 
funerals, conferences and meetings. 
Description: 
It is the Applicant’s intent to construct a church with classroom buildings and 
offices. The church building is a prefabricated metal building that has been 
donated to the Church. The ancillary buildings will be single-story prefabricated 
metal buildings or framed with cement plaster finish. Colors will be regional 
desert colors that mimic the natural environments including tans, reds, greens 
and browns. A minimum of 80% of surface materials will use painted cement 
plaster or metal panels that comply with the color palette. 
The site will include a 6 FT masonry site wall with steel fencing in the south 
quarter. The two entrances will be controlled by vehicle gates. These fence walls 
and xeriscape would be provided in combination with selected deciduous 
landscaping. The space between the ancillary buildings will be enhanced with a 
fabric or metal shade structure to provide relief from the sun during the hot 
months. 
The Applicant proposes a monument sign on Gordon Court and requests to 
retain the ability of taller signage along Highway 60. 
The buildings will be used for worship services, Sunday school, church meetings, 
daycare, offices and church related events including weddings, funeral services, 
community events and similar uses. 
Primary church operations will occur on Saturdays, Sundays and Wednesday 
evenings. Office hours will be weekdays from 8AM to 5PM. Daycare will be 
weekdays from 6AM to 7PM.

Surrounding Property: 
The proposed church will have a positive impact on adjacent properties and 
surrounding area, providing services to the growing community. Adjacent 
properties to the east and west are currently undeveloped and have similar 
zoning. Properties to the south and west are single family residences and 
undeveloped residential parcels. Properties to the north and east are mostly 
undeveloped parcels. 
Location and Accessibility: 
The site is located in unincorporated Maricopa County, Arizona on an 
undeveloped parcel. The site fronts Gordon Court to the south and Highway 60 
to the north. Access will be provided from Gordon Court. 
Circulation: 
Vehicular access to the site would occur from Gordon Court on the south via two 
separate drives. One drive will be dedicated to entry and the other to exiting. 
Drives will be paved per pre-application comments. Highway 60 would not be 
used for access. 
Development Schedule: 
The Applicant intends to develop the site and three building concurrently, once 
this application is approved and construction permits have been obtained. 
Community Facilities and Services: 
The parcel is located in a remote area with few public services. The area 
surrounding the parcel is largely undeveloped. The nearest school is Nadaburg 
Elementary, 5 miles to the northwest. The nearest parks are in the City of 
Surprise to the southeast. 
Public Utilities and Services: 
Law enforcement is provided by Maricopa County Sheriff’s Department. Fire 
protection is provided by North County Fire and Medical, with a station 
approximately 3 miles to the southeast. Refuse is provided by Parks and Sons. 
Water service will be provided by an on-site well. Sewer service will be via on-
site septic. 
Compliance with General Plan and Wickenburg Scenic Corridor: 
The applicant believes that the proposed development will further the County’s 
goals of community friendly spaces and facilities. The parcel is located in the 
unincorporated community known as Wittmann, within the Wickenburg Scenic 
Highway Corridor (WSC), part of the Class 4 zone. Our proposed development 
will accommodate the Corridor’s land use goals of high-quality commercial 
developments and more intense development near Wittmann. We comply with 
the WSC goals of maintaining scenic views with native vegetation and color
