Background: 
 
1. 
July 24, 1995: The first known deed to the property with a legal description matching the current 
parcel boundaries was recorded. 
 
2. 
1997: The existing single-family residence was constructed onsite according to the Maricopa 
County Assessor’s Office Parcel Viewer. 
 
3. 
January 7, 2021: The current owner took possession of the subject property with the recording of 
the current deed to the property. 
 
4. 
March 4, 2021: Maricopa County received a code complaint (V202100380) for multiple occupied 
RVs and an occupied garage. On March 25, 2021, Maricopa County closed the violation upon the 
code compliance officer finding no indication of an occupied RV. The referenced RV was parked in 
accordance with County code, not hooked up to power, water, or sewer.

December 11, 2023: Maricopa County received another code complaint (V202302590) for running 
a trailer park on the lot, as well as for the accumulation of junk, trash, and debris, for the storage of 
inoperable vehicles, and for unpermitted building additions to a detached garage. On December 21, 
2023, Maricopa County closed the violation upon the code compliance officer finding no junk, trash, 
or debris on the property. Furthermore, staff could not verify any building additions to the home. The 
code compliance officer reported four RVs parked on the property, but they were kept to the side of 
the house or in the rear yard and were not being occupied. Furthermore, these RVs were reported 
operable and registered. 
 
6. 
October 20, 2025: Maricopa County received the third code complaint (V2501669) on the property 
since the current owner took possession of it. This complaint alleged that the owner had built 
multiple rental rooms in the home without permits or clearances, that garages were being occupied, 
that inoperable vehicles were being stored onsite, and that junk, trash, and debris were accumulating 
onsite. Code Compliance staff subsequently issued a Notice and Order to Comply (NOTC) to the 
property owner confirming the violations.

November 21, 2025: The property owner submitted this TUP request.

December 29, 2025: Maricopa County opened a fourth code violation (V2502039) in response to the 
opposition received to this TUP request.

1302.2.5 
Caretaker(s) Quarters: An additional detached accessory dwelling unit for caretaker(s) may 
be permitted, provided that all of the following conditions are met:  
 
1. The additional dwelling unit may be a manufactured house, mobile home or a 
recreational vehicle. It may not be a site built (permanent) structure.  
 
2. The justification for the caretaker shall not be merely those activities associated with the 
normal responsibilities of a resident to maintain the property, including the care of a 
limited number of farm animals. An unusual condition(s) must exist which requires the 
on-site residency of a caretaker to perform the duties identified. Said condition(s) shall 
be identified as part of the Temporary Use Permit application. An unusual condition(s) 
may consist of:

a. Documented extended absences from the property by the occupant(s) of the 
principal residence.  
 
b. Medical condition(s), when documented by a notarized statement from a physician. 
In the case of a medical caretaker, the caretaker or the recipient of the care may live 
in either the principal residence or the additional permitted residence (caretaker’s 
quarters).  
 
c. Other similar conditions as determined by the zoning inspector.  
 
3. Only one additional dwelling unit shall be permitted on any property by approval of a 
Temporary Use Permit.  
 
Request:  
 
13. 
The property owner is requesting a TUP to allow a caretaker quarters on parcel 219-25-106B in the 
R1-35 zoning district. The subject site is located at 7419 E. Culver St. in the east Mesa area. Per 
MCZO Article 1302.2.5, caretaker quarters may be permitted as a manufactured home, a mobile 
home, or an RV, provided that an unusual condition exists that requires the onsite residency of a 
caretaker. A TUP for caretaker quarters may only permit one additional dwelling unit on a subject 
property. Staff notes that a TUP for caretaker quarters allows for occupancy of an RV whereas a 
traditional detached accessory dwelling unit (ADU) would be permitted only as a site-built 
manufactured or mobile home. An ADU is permitted by right if development standards can be met. 
 
14. 
Per MCZO Article 1302.4.5, caretaker quarters may be permitted in any rural zoning district. Single-
family residential zoning districts (such as R1-35) are not listed as permitted zoning districts. 
However, the updated Maricopa County Zoning Ordinance, due to become effective on January 9, 
2026 (the day after the Commission hears this case), will allow caretaker quarters in all single-family 
residential zoning districts per MCZO Article 1002.2. 
 
15. 
According to the property owner, a caretaker is needed to assist her daughter, who is a person with 
a disability, with activities of daily living. The owner has provided evidence – a letter signed by an 
APRN – confirming this. Per the owner, the caretaker currently requires a separate living 
arrangement that an RV could provide. This RV would be located just to the northeast of the 
permanent residence within the side yard setback. Staff research found no outstanding fees owed 
on the property. A recent code violation (V2501669) on the property was closed on December 16, 
2025. A subsequent code violation (V2502039) was opened on the property on December 29, 2025. 
These and prior violations are discussed further in the “Findings” section of this report.

The site has been posted for the required 10-day posting period in accordance with MCZO Article 
1302.3.1.3. The site was posted on December 19, 2025, and the 10 days expired on December 29, 
2025. As of the publication date of this report, staff has received four items of opposition. The 
consensus of the opposition is that a TUP would be inappropriate for a property that has been 
subject to multiple code violations since the current property owner took possession. These items 
of opposition are discussed further in the “Findings” section of this report.

Site Analysis: 
 
17. 
The subject site meets R1-35 requirements for lot area and lot width. The single-family residence 
and detached garage onsite were developed in 1997. The property is located in a lot-split area in the 
lower foothills of the Usery Mountains. As such, the surrounding area features gentle sloping, 
although no 10’ elevation contour lines cross the property. No washes or areas of floodplain 
encumber the property, although there is a nearby wash that passes the property to the south. Native 
vegetation abounds throughout the lot-split area. Culver Street, which provides access to and from 
the site, is unpaved from Sossaman Road west to the dead end just west of the subject property.

Recent site aerials show multiple RVs and other motor vehicles stored throughout the property, as 
well as what appears to be the accumulation of junk, trash, and debris. These conditions have been 
referenced in multiple code violations reported on the property. These conditions have also been 
referenced in the letters of opposition received regarding this request. 
 
Findings: 
 
19. 
This request for caretaker quarters follows three code violations that have been opened on the 
property since the current owner took possession. The first such violation was opened in early March 
2021, less than two months after the owner took possession of the property. This first complaint 
(V202100380) referenced multiple occupied RVs and an occupied garage, implying that either the 
attached garage or the detached garage was being used as habitable space. This first violation was 
closed upon initial inspection. At the time, code compliance staff observed only one RV, which was 
unoccupied and parked in adherence to applicable codes. The inspection did not reveal an occupied 
garage. No inspection photographs were added to the case file. However, the most recent bird’s-eye 
imagery of the property (dated October – December 2021) published by the Maricopa County 
Assessor’s Office Parcel Viewer does show two campers on the property, as well as several parked 
cars, an enclosed trailer, and some accumulation of debris.

The second code violation (V202302590) was opened on the property in December 2023. However,   
as was the case for the first violation, it was closed upon initial inspection. This second complaint 
alleged that the property owner was running a trailer park on the lot, accumulating junk, trash, and 
debris, storing inoperable vehicles, and making unpermitted building additions to the detached 
garage. Upon inspection, the code compliance officer reported no junk, trash, or debris on the 
property, and could not verify any building additions to the home. The code compliance officer 
reported four RVs parked on the property, but they were kept to the side of the house or in the rear 
yard and were not being occupied. Furthermore, these RVs were reported operable and registered. 
 
21. 
The third and most recent code violation (V2501669) prior to submittal of this TUP application was 
reported in October 2025. This is the only staff-verified violation and, although it was still active when 
this TUP application was submitted, it has since been closed. The violation description included the 
following note as written by the complainant: 
 
“The owner has built many rooms into and onto the home without permits. (About 12) She 
rents these makeshift rooms out to people. There is a garage on the back of the property 
with no running water or bathroom and someone is living in there. She has built rooms in her 
garage also. She has multiple junk cars and boats on the property. She has no trash service. 
She is frequently burning trash. The home has a septic tank for a 5 bedroom home and she 
has around 12 in there now. She has been seen pooping in the yard and she digs holes, I am 
assuming burying trash. She often has trash bags hanging from the bushes. We now have a 
rat problem we never had before. This is an ongoing problem you have been involved with 
before. Something needs to be done. The home values around her are not going to be good.”

Unlike the first two violations, this violation was confirmed by code compliance staff, and a Notice 
and Order to Comply (NOTC) was sent to the property owner on November 6, 2025. The NOTC 
confirmed that multiple rental rooms were added to the home without required permits and 
clearances, that garages were being occupied, that inoperable vehicles were being stored onsite, and 
that junk, trash, and debris were accumulating. Photographs taken by the assigned code compliance 
officer included the following notes: 
 
“On arrival photos were taken of the property showing junk, trash and debris that contains 
household items/appliances, household trash, and plastic bucket containers. There is a tan, 
green vehicle that is unregistered. Travel trailers/RVs that appeared to be occupied as they 
are hooked up to electrical and have miscellaneous household items surrounding the 
entrances. Contact was made with the property owner and discussed about the violation. 
Staff could not get entry permission to the rear yard and inside of the home at the time of the 
inspection. The garage connected to the home is being used as storage.”

Nevertheless, this violation was closed on December 16, 2025, following a subsequent inspection. 
Photographs taken by the assigned code compliance officer included the following notes: 
 
“On arrival photos were taken of the property showing the junk, trash and debris that contains 
household items/appliances, household trash, and plastic bucket containers has been 
removed/maintained. The tan/green vehicle that is unregistered was not on the property at 
the time of the inspection. The travel trailers/RVs that are not being occupied. Contact was 
made with the property owner.”

Staff notes that, when the property owner first submitted this TUP application, the initial site plan 
referenced three RVs. This site plan was rejected during the administrative review process, and the 
owner subsequently submitted a revised site plan showing that only one RV would be used for the 
caretaker quarters if the Commission approves this request.

25. 
Staff received a letter of opposition from a nearby resident on December 23, 2025. This letter alleges 
that the subject property owner is renting rooms by the week and that the Maricopa County Sheriff’s 
Office has been dispatched to the property in intervals ranging from monthly to biweekly. The letter 
also references the numerous campers parked and occupied on the property. 
 
26. 
Staff received a second letter of opposition from another nearby resident on December 23, 2025. 
This letter alleges that multiple calls have been made to police over the last several months, resulting 
in multiple arrests for people paying by the week to stay at the subject property. Furthermore, the 
letter alleges that the subject property owner has not been paying for trash collection service and 
has instead been illegally stacking and burning trash, which in turn has been causing rat problems 
for neighboring properties. The letter also references the derelict cars stored both in front of and to 
the rear of the primary residence. The author of the letter confirms that the subject property owner 
has a family member who requires caretaking services, but alleges that the property is being used 
as a hotel rather than a genuine caretaker quarters. 
 
27. 
Staff received a third letter of opposition from the owner of the neighboring property to the west on 
December 24, 2025. This letter states that the subject property owner places advertisements on 
Zillow to rent out her rooms and trailers. Furthermore, the letter states that, in response to the code 
complaints, the subject property owner moves inoperable vehicles onto the author’s own yard to hide 
them. In addition, the letter alleges that the subject property owner burns and buries garbage and 
throws out food in the yard to rot or be eaten by animals, causing a rat problem. 
 
28. 
Staff received a fourth letter of opposition from a neighbor on December 24, 2025. This letter alleges 
that the subject property owner is applying for the TUP under false pretense, and that one of the 
owner’s tenants has conceded that the TUP is an attempt to keep the three inoperable RVs on the 
property. The letter further alleges that the owner has built multiple rooms inside the home that are 
not consistent with current electrical and sewage allowances. Echoing a previous letter, it states that 
the owner continues to advertise for tenants on Zillow, has multiple broken-down cars on the 
property, throws out food into the yard for animals, burns and buries her garbage, and refuses to 
subscribe to a trash collection service. 
 
29. 
A new zoning violation, V2502039, has been opened for investigation based upon the complaints 
submitted in opposition to this TUP. Staff research confirms that at least one room inside the home 
has been listed for rent on Zillow. As of December 30, 2025, the Zillow listing has been online for 197 
days, and the room would be available for rent for up to one month. The following screenshots show

30. 
The history of code violations on the property, the photographic evidence showing the current or 
recent site conditions, and the Zillow listings for rooms within the home being made available for 
short-term rental, are concerning to staff. The most recent code complaint alleged that the primary 
residence included as many as 12 bedrooms that are being illegally made available for rent. Although 
the NOTC did not confirm the number of bedrooms in the home, there appears to be sufficient 
evidence that, if the use of the site as a lodging space ceases, there would be sufficient room in the 
primary residence for the owner, the owner’s patient family member, and a caretaker to live. 
Furthermore, the owner’s narrative confirms that a caregiver will be needed for the patient’s lifetime 
and yet requests the caretaker quarters for only a year. To staff, this implies that the circumstances 
preventing the caregiver from living in the primary residence are avoidable and could be negated by 
ceasing the illegal use of the property for lodging. 
 
Recommendation: 
 
31. 
For the reasons outlined in this report, staff recommends that the Commission motion to Deny 
TU250049. 
 
32. 
However, if the Commission choses to recommend approval, staff offers the following conditions 
‘a’ – ‘d’ for consideration:  
 
a. 
Use of the site for temporary caretaker quarters shall be in substantial conformance with 
the entitled site plan, “Temporary Use Application Site Plan,” stamped received November 
24, 2025, consisting of one page, except as modified by any condition identified herein. 
 
b. 
Use of the site for temporary caretaker quarters shall be in substantial conformance with 
the entitled narrative report, “Temporary Caretaker Use by Li Lin,” consisting of one page, 
stamped received November 24, 2025, except as modified by any condition identified 
herein. 
 
c. 
This TUP is authorized for caretaker quarters, allowing no more than one occupied RV, 
and shall expire on January 8, 2027. The TUP approval letter must be visibly displayed at 
the front of the property at all times. Failure to meet this display requirement shall result in 
revocation of the TUP if a zoning citation is issued. 
 
d. 
The property owners and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with any condition.

 A caretaker is needed to care for my daughter, Alison Sun, who is handicapped.  This caretaker requires 
a separate living arrangement.  RV#1 can provide this living arrangement.  When I am not home, this 
caretaker can watch Alison and take care of her needs.  
Alison uses a wheelchair and needs constant attention.She needs help with showering, grooming, 
providing meals.taking her to the doctor and dentist.  Alison has limited use of her hands and cannot 
speak.  She use a computerized device to communicate.

This is a single family neighborhood, We are told this residence 
is renting rooms out by the week, and see strangers walking 
our road consistently 
We have been here in our residence for 30 years, this is 
located in the north east portion of Mesa/maricopa county. 
Rent for single room appartments run 1700 minimal for monthly 
rent. Looking to the future we can see our property valuation 
decrease, and suspect possoble increases in crime as we do 
not know the people that come and go from this residence now. 
We se Maricopa County Sheriffs dispatch to this residence 
regularly. Historically we MAY see a Sheriffs vehicle once a 
year not monthly or bi weekly as the residents on our street 
have seen recently. This is not a single room rental that does 
not interupt the neighborhood,, there are numerous campers 
strewn over the lot.  
Please thake this objection in consideration as we are a aerage 
neighborhood in a quiet part of NE Mesa and do not need 
caretakers quarters of any kind zoned here,

We are totally opposed to the request for a Temporary Caretakers Quarters at 7419 E. Culver St. 
Mesa, Az, 85207. 
Case number TU250049. 
This residence is already involved in code compliance complaints.  
She is only applying for this permit to try and get around some of the current issues/complaints. Most 
likely not wanting to remove the 3 unlivable travel trailers she rents out. 
She still currently has false adds out to rent her rooms and trailers on Zillow.  
In response to the complaints she has moved broken down cars around on the property. During one 
inspection she pushed broken down cars in front of my home to hide them.  
She has continued to burn and bury her garbage. 
She throws food out in the yard to rot or be eaten by animals causing a rat problem.  
I have been told that Kyle Swartz (602-527-6796) is working on her current complaints. He is a Code 
Compliance Officer with the Planning and Development Department.
