Variance Request:

The applicant is requesting a variance to the MCZO to eliminate the requirement of a 25’ X 25’ 
sight visibility triangle from  the corner of Stacey Rd. and 170th Pl. in order to finalize building 
permit B202304407 for a 6’ high CMU wall and gate that has already been constructed. The 
original site wall was constructed by the homebuilder in 2023 prior to the initial home sale. The 
wall was positioned 20’ from the western parcel boundary as a 20’ easement was indicated to be 
located on the eastern parcel boundary on the original building plans. The original wall had a 5’X5’ 
SVT built into it. While not a standard size the SVT was presumably placed to accommodate an 
SVT from the parcel boundary. The wall construction permit was issued on 6/6/2023, received 
initial footing inspection on 8/22/2023 and subsequently was closed for inactivity on 8/17/24. 
The permit was reopened on 5/15/2025 after a compliance inspection application (CMPI250088)  
was submitted. The wall permit remained open until a final inspection occurred on 7/1/2025 
which failed due to the location of the wall constructed 20’ to the west as well as the wall not 
meeting drainage requirements of turned block construction. A subsequent permit revision was 
submitted on 7/2/2025.

The squared-shape parcel is approximately one-half acre in size,  and developed as a single-family 
residential home. The home faces west towards 170th Way with 6’ high CMU block walls 
encompassing the parcel on the north, east and south side. The parcel has 3 driveway access 
points on the west, and gate access points on the western and southern wall boundaries. Stacey 
Rd. to the south is owned and maintained by the Town of Gilbert. 170th Way to the east is assumed 
to be comprised of private access easements, staff has been unable to find easement 
documentation and none was provided by the applicant. 170th Way is utilized by approximately 
12 parcels for access.

State Statute / County Zoning Ordinance Tests - ARS § 11-816.B.2 and MCZO Article 303.2.2 states the 
Board of Adjustment may, “Allow a variance from the terms of the ordinance if, owing to peculiar 
conditions, a strict interpretation would work an unnecessary hardship and if in granting the variance the 
general intent and purposes of the zoning ordinance will be preserved.”

Statutory Test -1 Does the applicant’s property contain any peculiar condition– Discuss and 
explain what is/are the peculiar conditions facing the property and include reference to the 
Maricopa County Zoning Ordinance Regulations or Development Standards to be varied.   
 
“I need a varience to no have a visibility triangle at the southeast corner of my property. I 
submitted all the required information to get the work done to build a property line wall and a 
rolling gate at that corner. once the work was done I requested to have the final inspection to 
complete the project. At that time I was told that I “May” need to have a visibility triangle at the 
corner. I went ahead and explained that the visibility from cars going in and out was greater that 
mort property walls on that street (Stacy). Also explained that there is a stop sign and an SRP 
light/power pole east of the corner in question which makes all cars veer east another 10 to 15 
feet away from that corner. I have explained this to several members of your team and they 
have agreed that there should not be a visibilty corner added to that corner.”

Statutory Test 2 – Does applying the requirements of the Ordinance to the applicant’s property 
create an Unnecessary Hardship – Explain how the peculiar condition identified in #1 causes an  
unnecessary hardship to the property when the requirements of the Maricopa County Zoning 
Ordinance are applied.  Explain how the that the peculiar condition of the property came to be and 
whether the condition was created by the applicant or someone in the property’s line of title. 
Explain the proposed use of the property with the variance request. Identify and explain all 
peculiar conditions on your property in regard to the following areas: slope, narrowness, 
shallowness, irregular shape, location, washes, vegetation, and easements, etc. Explain how 
enforcement of the Zoning Regulations or Development Standards would impose a hardship on 
the property. 
 
“This would create a cost of more than $25,000 to complete the work required to add a visibilty 
triangle on that corner. Money that our family doent have to spend nor could we afford at this 
time.”

Statutory Test 3 – General Intent and Purpose of the Zoning Ordinance – Discuss the purpose 
of the zoning requirement from which the variance is being sought. Then, discuss and explain 
how, provided statutory tests #1 and #2 are satisfied, the granting of the requested variance 
would preserve the general intent and purpose of the Zoning Ordinance. 
 
“As I explained on Question #1. The road in and out on the east side of that corner is at least 20 
feet away from my wall and there is a stop sign in the corner. every car stops and has plety of 
visibility in and out of that street” 
 
Findings:

The applicant has the burden of proving to the Board that, in accordance with the standard set 
forth in ARS §11-816.B.2 and MCZO Article 303.2.2, the property requires a variance. To grant the 
relief, the applicant must prove, and the Board must find and identify, a physical condition of the 
applicant’s property that is peculiar and not common to the area or the universe of the zoning 
district. Also, any such peculiarity must not have been created either by the applicant or anyone 
in the chain of title. If the Board determines that there is no such peculiar physical condition, its 
inquiry stops, and the application must be denied.

If the Board identifies a peculiar physical condition of the applicant’s property which is not self-
imposed, then the applicant must prove, and the Board must find and identify, an unnecessary 
hardship imposed upon the property due to the strict application of the requirements of the zoning 
ordinance which the applicant wishes to have varied such that there is no viable use of the 
property without the variance.  
 
If the Board identifies a peculiar physical condition of the property which is not self-imposed, and 
that in applying the requirements of the zoning ordinance to the property, because of the peculiar 
physical condition, an unnecessary hardship exists, the applicant must prove, and the Board must 
find and identify, how the granting of the variance will preserve the general intent and purpose of 
the zoning ordinance. 
 
In order to approve the variance the Board must make findings and articulate them in motion 
memorializing the above.

Based upon what the applicant has submitted and the staff analysis in this report, staff offers the 
following positive and/or negative observations the Board may consider in its findings: 
 
• 
Staff cannot identify any peculiar condition facing the property different and unique from 
other properties in the zoning district, that when the ordinance requirement is applied creates 
an undue hardship not self-created that prevents reasonable development of the property. 
 
• 
The property is already developed containing a single-family residence, and the original wall 
was permitted around the perimeter of the property observing the clear-sight visibility triangle 
at the street corner.  
 
• 
The wall was relocated and constructed by the current property owner encroaching into the 
clear-sight visibility triangle without the benefit of an issued building permit or zoning 
clearance, and not in conformance to the ordinance standard.  
 
19. 
And further, if the Board finds the applicant has satisfied the statutory test, and has stated its 
findings on the record, the grant of this variance will memorialize the following: 
 
a) 
Variance approval eliminates the need for a Sight Visibility Triangle at Stacey Rd. and 170th 
Place at the southeast corner of APN 304-87-415B.

general intent and purposes of the zoning ordinance will be preserved.
