REQUEST Upfront Planning & Entitlements, LLC is pleased to submit for your consideration a CUP – Conditional Use Permit on approximately 5,000 square feet for a boutique exercise studio located within an existing shopping center on the east side of 59th Avenue just north of the Loop 101 Freeway in Glendale, AZ. The property is identified as Maricopa County Assessor Parcel Number 200-23-980B (the "Property"). The Property is located at 20329 N 59th Avenue, Suite A5 in Glendale, AZ 85142 zoned as SC– Shopping Center. The project is comprised of 4,780 square feet which is comprised of four (4) suites, A2, A3, A4 and A5, with primary access through suite A5. The property owner requests an CUP – Conditional Use Permit to operate a boutique exercise facility within these suites which is just under 5,000 sq. feet and is required as of January 2025 in the SC zoning category as a health and fitness center. 2. BACKGROUND The Burn Boot Camp is a boutique-style exercise studio that offers one-on-one training in a group setting. Focused on community, the exercise studio offers specialized, up-scale classes and equipment at convenient times for working residents. The Burn Boot Camp is a franchise with locations across the country, including Arizona. The classes have a set time and structure for the members to attend, with a typical schedule looking similar to this: Monday - Friday 5:00am, 6:00am, 7:00am, 8:30am, 9:30am, 5:00pm and 6:00pm Saturday 7:00am and 8:00am with typically no classes on Sunday. When classes are not scheduled, members are not permitted to use the facility. Classes are small, with between 20-50 members depending on the popularity of camp time. Burn Bootcamp offers childcare to children 8 weeks to 12 years old for mothers and fathers in order to facilitate independence and peace of mind for clients that are parents during their workouts. Childcare is only available to members while they are working on onsite and not during other hours. Every day’s workout classes follow a different protocol so clients never do that same workout twice and are constantly challenged. Burn Bootcamp’s high-quality trainers are able to accommodate people of all ages and abilities, including elderly and pregnant patrons. PROPOSAL The property owner requests a CUP – Conditional Use Permit to operate a boutique exercise facility within suite A2 on site with limited classes and class sizes. The site operates shall typically operate Monday – Friday between 5:00am to 7:00 pm and Saturday between 7:00am to 10:00 am with no classes on Sunday 4. RELATIONSHIP TO SURROUNDING PROPERTIES The parcels surrounding the property include commercial developments to the north, west, and south and a residential development to the east. The surrounding commercial properties are zoned SC – Shopping Center, as is the Property. The residential development is zoned R1-7 and is separated from the commercial developments by a wall and extensive landscaping. The Property itself contains multiple restaurant locations, an orthodontist and a title service agency. Other commercial properties in the area, not on the Property, are insurance agencies, a bank, a dental office, a large gym and a realtor’s agency. ZONING The parcel is zoned SC – Shopping Center. The property owner is requesting a CUP – Conditional Use Permit to allow for the use of a boutique exercise studio. 6. COMMUNITY FACILITIES AND SERVICES The property is within the Glendale Elementary School District. This project does not anticipate generating any demand for the school district. 7. PUBLIC UTILITIES AND SERVICES Sewer – The Property is within the Glendale service area. Water – The subject site is within the service area of Glendale Power – The subject site is served by APS (Arizona Public Service) Police – Glendale Police Department Fire – Glendale Fire Department 8. CUP FINDINGS OF FACT The following demonstrate the required findings of fact for this case to be approved. 1. That the proposed use is consistent with the policies, objectives, and land use map of the Glendale General Plan and the purpose of the zone district in which the site is located; The proposed Conditional Use Permit is in line with the policies, objective and land use map of Glendale. This use is allowed in the existing center and zoning district provided the CUP has been reviewed and is found compatible. This use continues to provide healthy activities to CUP Narrative Glendale, AZ 5 residents and is a positive addition to the community and does not cause any negative effects by its operation as a boutique health and fitness center with restrictions. 2. That the proposed use will not be materially detrimental to the health, safety or general welfare of persons residing or working within the neighborhood of the proposed use, or have an adverse effect on the property, adjacent properties, the surrounding neighborhood or the city when consideration is given to the character and size of the use and hours of operation; The proposed Conditional Use Permit is in line with similar uses within the commercial complex. The entire operation shall be conducted indoor and will make no impacts to the parking, health or safety of the nearby residents or users of the complex. 3. That the proposed site is adequate in size and shape to accommodate the intended use and that all requirements for the zone district, including but not limited to: setbacks, walls, landscaping and buffer yards are met; The proposed Conditional Use Permit is adequate in size to operate within the suite proposed and has been reviewed by building safety for compliance and meets all zoning development standards. 4. That the proposed site has adequate access to public streets and highways to carry the type and quantity of traffic which may be generated by the subject use, and that on-site circulation is adequate to permit driveways, parking, and loading requirements in a manner which is safe and efficient; The proposed Conditional Use Permit utilizes the existing streets and parking area for circulation and has adequate capacity for the use and will be safe and efficient and has been reviewed by building safety. 5. That adequate conditions or stipulations have been incorporated into the approval of the conditional use permit to ensure that any anticipated detrimental effects can be mitigated. The proposed Conditional Use Permit has put in place standards to ensure there are no detrimental effects upon its use with regulated class sizes, operating hours and methods of operation. 9. CONCLUSION The proposed CUP – Conditional Use Permit application will allow the site as a boutique exercise facility in line with similar commercial adjacent uses. The proposed development plan is consistent with the surrounding development in the area and will be a positive additional to the center and create little to no impact on the surrounding businesses and community.
