D R A F T MINUTES PLANNING COMMISSION GLENDALE CIVIC CENTER 5750 GLENN DRIVE GLENDALE, ARIZONA 85301 NOVEMBER 13, 2025 6:00 P.M. 1. CALL TO ORDER Chairperson Crow called the meeting to order at 6:00 p.m. 2. ROLL CALL Present: Vern Crow, Chair Edwin Nyberg, Vice Chair Tom Cole, Commissioner John Crow, Commissioner Sergio Arellano, Commissioner John Geurs, Commissioner Absent: Bryan Hooper, Commissioner Also Present: Duane Hoskins, Interim Deputy Director, Development Services James Gruber, Chief Deputy City Attorney Phil Martinez, Senior Planner Tawanda Walker-Hall, Administrative Support Supervisor 3. APPROVAL OF THE MINUTES a. Planning Commission Minutes of October 23, 2025. Chairperson Crow called for a motion to approve the minutes. Motioned by Vice Chair Edwin Nyberg, seconded by Commissioner Sergio Arellano to approve the October 23, 2025, meeting minutes. AYE: Chair Vern Crow Vice Chair Edwin Nyberg Commissioner Tom Cole Commissioner John Crow Commissioner Sergio Arellano Commissioner John Geurs Passed 4. WITHDRAWALS AND CONTINUANCES There were none. 5. PUBLIC HEARING ITEMS 1. CUP25-10, a request by Carol Alkhouri on behalf of NWC Olive, LLC, for approval of a Conditional Use Permit (CUP) to allow a Retail Smoke and Vape Shop in the C-2 (General Commercial) zoning district. The 1.14-acre site is located north of West Thunderbird Road and west of North 51st Avenue at 13810 N. 51 st Avenue in the Sahuaro Council District. Presented by: Phil Martinez, Senior Planner Commissioner Crow requested an explanation of legal nonconforming use. Mr. Martinez explained that the use previously existed, but the license had expired, requiring a new application for a conditional use permit. The applicant chose not to present. With no further comments or questions. Chairperson Crow closed the public hearing for CUP25-10 and called for a motion. Motioned by Commissioner Tom Cole, seconded by Vice Chair Edwin Nyberg to approve CUP25-10. AYE: Vice Chair Edwin Nyberg Commissioner Tom Cole Commissioner John Geurs NAY: Chair Vern Crow Commissioner John Crow Commissioner Sergio Arellano Failed Chief Deputy City Attorney Gruber told the Commission that the motion failed because of a lack of support; another vote could be held if a change was possible. Chairperson Crow stated that the vote is dead due to a lack of support; no additional comments or questions were raised. Chief Deputy City Attorney Gruber's denial actions are final for CUP25-10, unless an appeal is filed within 15 days. NEXT MEETING The next regular meeting of the Planning Commission is scheduled for December 11th at 6:00 p.m., in the Civic Center located at 5750 W. Glenn Dr., Glendale, Arizona, 85301. 11. ADJOURNMENT Chairperson Crow called for a motion to adjourn. Motioned by Vice Chair Edwin Nyberg, seconded by Commissioner Tom Cole to adjourn.
