Project Description On behalf of Phoenix Cement (“Applicant”), this Citizen Participation Final Report documents the implementation of the Citizen Participation Plan for an amendment to a Special Use District (SUD) Overlay (“Application”). Phoenix Cement owns the industrial property located at the southeast corner of Glendale Avenue and 115th Avenue bounded by Glendale Avenue to the north, the Glendale Municipal Airport to the east, the City West Area Water Reclamation Facility to the south, and 115th Avenue to the west, specifically Maricopa County Assessor Parcel Number 102-59-241 (the “Property”). The purpose of the Application is to request an expanded Special Use District Overlay to add an additional +/- 55 acres, a portion of the Property, to the sand and gravel mining area. Because of the expanded footprint, the Applicant is also requesting an additional five years for the Special Use District, from 2033 to 2038. The vicinity map is attached in Tab A. This Plan includes the notification technique, notification, affected parties, citizen participation, project communication, and timeline. 2. Notification Technique A notice of filing was sent to residents within 1,000 feet of the Property on February 18, 2020. The Applicant far exceeded the City’s required 300-foot notification boundary. Please see Tab B for the mailing labels and 1,000-foot property ownership list that were generated for this public outreach effort. In addition to the mailing address label, each envelope was affixed with a “City of Glendale Land Use Application” label. A copy of the notification letter is provided in Tab C, and the Neighborhood Notification Letter Affidavit of Mailing is provided in Tab D. 3. Notification Map The Neighborhood and Notification Area map is provided in Tab E, and the Property Ownership List in Tab F. The Applicant implemented a 1,000-foot notification boundary, far exceeding the required 300-foot notification boundary. 4. Affected Parties Notification was sent to all parties who may be affected, directly or indirectly, and those individuals who expressed interest or concern, including individuals identified by the City of Glendale: City of Glendale Planning Department, Mayor’s Office and Council Office. A complete mailing list, including all individuals located in the notice area, homeowners associations, registered neighborhood groups / associations, individuals on the district’s “Interested Parties” list and individuals on the Additional Notification list is attached in Tab G. 04/24/2020 6639.6.1615011.2 The Applicant and development team thoughtfully contemplated the project from the perspective of individuals affected or otherwise interested, as well as some of the concerns these individuals may have. Although notice of filing notifications were sent to stakeholders within 1,000 feet of the Property, no comments were received. 5. Citizen Participation Following the initial filing notification, interested parties and residents within 1,000 feet of the Property were sent a notification of application filing for review and comment. Per staff direction, no public meeting was required. Individuals were free to call and/or e- mail the Applicant or the City of Glendale Planning Division at any time during the application review process. Between February 18, 2020 and April 22, 2020, no public comments were received. 6. Project Communication Should any material changes or amendments to the proposed development occur after the Applicant’s initial notice of filing has been mailed to residents and interested parties (“affected parties”), the affected parties will be contacted with a follow-up letter describing the changes. This follow-up letter will be provided to the City of Glendale Planning Division prior to being sent out. 7. The purpose of this letter is to inform you that we recently filed an application (Case No. SR19-0303) with the City of Glendale (“City”) to expand a Special Use District (SUD) Overlay to add approximately 55 acres to the existing sand and gravel mining area on the Property, within the existing 215-acre Property. The overall Property is currently zoned M-1, Light Industrial in the southern portion while the north portion is zoned as Planned Area Development (PAD). Please see the enclosed Aerial Map. On December 10, 2013 the City approved the original SUD Overlay in case ZON 13-05 to allow mining and extraction of sand and gravel on 99.3 acres for a period 15 years on land zoned M-1, until 2028. On September 14, 2016, the City approved rezoning case ZON 16-05 to increase the boundaries of the existing sand and gravel operation from 99.3 to 159.9 acres. That Special Use District permits the mining and extraction of sand and gravel until the year 2033. The Applicant has been engaged in sand and gravel mining on the approximate 160-acre property since that time. The mining operations have been successful and without any adverse impacts on surrounding lands. The purpose of the rezoning application is to request an expanded Special Use District Overlay to add an additional +/- 55 acres to the sand and gravel mining area (the “Sand & Gravel Site”). Because of the expanded footprint, the Applicant is requesting an additional five years for the Special Use District, from 2033 to 2038. From a day-to-day perspective, there will be little change in the operation of the facility with respect to traffic, noise, or any other activity. The expansion of the SUD will require public hearings before the Glendale Planning Commission and Glendale City Council. The City has not yet scheduled public hearings for the request. You will receive mailing notice of scheduled public hearings at a later time. In addition, signs identifying the applicable public hearing dates and information will be placed on the Property prior to the first scheduled public hearing. This letter is being sent to all property owners within 1,000 feet of the Property and additional persons at the request of the City of Glendale Planning Department.
