The applicant on behalf of the property owner is requesting a Major 
CPA to change the land use designations listed in the 
Tonopah/Arlington Area Plan from the Belmont DMP to Heavy 
Industrial to accommodate future industrial uses.  
 
There are no outstanding concerns from reviewing agencies. 
Pursuant to state law, staff issued enhanced notification letters to 
all adjacent and internal jurisdictions to Maricopa County, select 
state and regional agencies and Luke Air Force Base who stated 
that this change of designated land use will not have a negative 
effect to the base. Staff received two letters from adjacent/internal 
jurisdictions of Yuma and Pima Counties expressing no concerns 
about this request. Prior to the Commission hearing staff received 
one opposition letter from the public concerning this request. The 
letter’s author believes that this area is more suitable for residential 
land uses and that heavy industrial land uses are incompatible with 
the existing rural residential land uses of the area. During the 
Commission hearing no one from the public spoke concerning this 
request.

Project Summary: 
 
1. 
The applicant on behalf of the property owner is requesting a Major Comprehensive Plan 
Amendment (CPA) to change the land use designations listed in the Tonopah/Arlington Area Plan 
from the Belmont Development Master Plan (DMP) to Heavy Industrial to accommodate future 
industrial uses. Under the current Belmont DMP land use designation the area is envisioned to be 
a diverse mix of dense residential, commercial, mixed uses, and office land uses. This request to 
change the land uses to industrial, is due to a growing demand for more employment 
opportunities, especially adjacent to freeways, according to the applicant. One recent change, in 
this part of the County and on this site is that in 2021, the preferred alignment for the future 
Interstate-11 transportation corridor was published by ADOT and the Federal Highway 
Administration. The Interstate-11 corridor is envisioned to link Mexico with Canada though Las 
Vegas and will be a mix of freeway and heavy rail.  With the future junction of Interstate-10 and 
Interstate-11 very close to this site will create new opportunities for enhanced travel, mobility, 
trade, commerce, employment, and economic development in this area. By changing the land use 
designation on this site to Heavy Industrial will offer the opportunity for distribution/logistic 
facilities, warehousing, and energy production facilities instead of traditional suburban residential 
development with high water demands in an area with limited access to water.  Due to the size of 
the project at 5,156.8acres, a major CPA is required. This request once approved would eliminate 
a large portion of the Belmont DMP. The site is generally located on the northwest corner of 347th 
Ave. and Indian School Rd. The site is comprised of 11 private parcels under a single ownership.  
 
2. 
On May 23, 1991, the Board of Supervisors approved the Belmont DMP subject to stipulations 
(MP 90-1). On December 12, 2006, the Board of Supervisors approved a Major Amendment of the 
Belmont DMP creating the current land use designations of the site for a future mixed use master 
plan community (DMP2006001). On June 18, 2008, the Board of Supervisors approved modified 
stipulations with revised language (DMP2007009). April 11, 2012, the Board of Supervisors 
approved a modification of condition for Belmont DMP that modified a few stipulations and 
removed a five year plating requirement (DMP2011006). On December 6, 2023, the Board of 
Supervisors approved a CPA for 1,402 acres of the Belmont DMP that borders this site to the 
south that modified the land use designation to Mixed-Use to accommodate a future movie studio 
(CPA2023012). On August 6, 2024, the Technical Advisory Committee held a meeting to discuss 
the first submittal comments with the applicant.  
 
3. 
The narrative asserts that the proposed development meets the Comprehensive Plan 
Amendment criteria in the following manner:  
 
Whether the amendment constitutes an overall improvement to the Comprehensive Plan and is 
not solely for the good or benefit of a particular landowner or owners at a particular point in time.  
 
The narrative states that this request improves upon the existing plan by providing more of a 
transition from the planned Interstate-11 transportation corridor and provides a flexible 
framework to adapt development phases to market changes. The Heavy Industrial designation 
will expand the possibility for economic and employment opportunities in the area, focusing on 
economic drivers as opposed to the current residential dominant designation.  
 
Whether the amendment will adversely impact all or a portion of the planning area. 
 
A. 
Altering acceptable land use patterns to the detriment of the plan – According to the 
narrative, the approval of this amendment will not alter the land use patterns to the 
detriment to the Comprehensive Plan. The Heavy Industrial designation is compatible with

future approved land use patterns for this area and is consistent with land uses that are 
generally located adjacent to freeway corridors.  
 
B. 
Requiring public expenditures for larger or more expensive infrastructure - The narrative 
states that this amendment will not adversely impact the expenditures for infrastructure 
improvements as the area is already planned for industrial, commercial, and residential 
development.  The new freeway with interchange will be paid for and maintained by ADOT. 
Moreover, the development of new roadways or improved existing roadways will be paid 
for by future developers. Lastly, water and sewer infrastructure will be developed and 
maintained by a private company in this area.  
 
C. 
Adversely impacting planned uses because of increased traffic – The narrative indicates 
that this amendment will not cause adverse impacts to the area due to increased traffic. 
Future developers will create new roadways and improve existing roadways capable of 
moving much more traffic throughout the site much more efficiently.  
 
D. 
Affecting the livability of the area or health or safety of present and future residents – 
According to the narrative, this amendment will allow for the development of employment 
centers creates a sustainable community that was always envisioned in this location.  
 
E. 
Adversely impacting the natural environment or scenic quality of the area in 
contradiction to the plan – The applicant states that during the design and development 
phases of each project will be thoughtfully created to not adversely impact the natural 
environment.  
 
F. 
Whether the amendment is consistent with the overall intent of the Comprehensive Plan - 
The applicant’s narrative states this amendment will allow for uses that would use less 
water than a typical dense residential or commercial retail developments which are 
currently designated for this site.  
  
H.      The extent to which the amendment is consistent with the specific goals and policies 
contained within the plan - The applicant’s narrative contains a substantial list of Goals 
and Policies from the Vision 2030 Maricopa County Comprehensive Plan and the 
Tonopah/Arlington Area Plan. This staff report identifies which Goals and Policies the 
applicant’s narrative addressed, see below.

Vision 2030 Maricopa County Comprehensive Plan 
 
a. Land Use Element – Goal 1, Policy 17:  The applicant states that this amendment will 
provide more flexibility for employment and economic opportunities along major 
freeway corridors while providing a transition to future planned residential 
developments, creating a better balance of land uses in the immediate area. Moreover, 
according to the applicant, the proposed amendment will provide a better balanced 
land use patterns that include non-residential and employment uses into the overall 
area.  
 
b. Transportation Element –Policy 9: The narrative states that by appropriately locating 
industrial uses along the future freeway, adjacent to the junction of two major 
interstate freeways, will provide for mot employment for the area, as well as goods 
and services with a reduction in the length of vehicular trips would be expected.

c. Environment Element –Policy 2: The narrative states that the proposed amendment 
supports balanced and efficient land use patterns by providing a flexible framework 
for employment to develop, thus being a catalyst to encourage new residential and 
retail development in the adjacent area.  
 
d. Economic Growth Element – Goal 1 & Goal 2: The narrative state that this amendment 
will contribute to the regional economy and will be a catalyst for more employment 
growth in the immediate area.  Moreover, the narrative stats that this amendment will 
provide long-term economic stability to the area with new employment opportunities.  
 
e. Growth Area Element – Goal 1: The narrative states that this amendment will be more 
fiscally and environmentally responsible than the existing approved plan for Belmont 
DMP as it will provide more mixed uses and employment/economic opportunities, as 
opposed to the planned predominantly residential use base.  
 
f. Water Resources Element –Goal 4, Policy 2: The narrative states the at the time of 
construction, the future developers will adhere to modern water conservation 
techniques.  
 
g. Cost of Development Element – Goal 2: The applicant states that infrastructure and 
utilities associates with any development within the amendment area will be dedicated 
or constructed by the future developers as each phase is developed.

Tonopah/Arlington Area Plan (adopted September 6, 2000): This plan designates the site within 
the Belmont Development Master Plan (DMP), which planed a variety of residential, retail, mixed-
use, office, and industrial land uses with a primary focus residential land uses. Development 
within DMPs should allow flexibility in the master planning of communities and shall consider 
innovative designs, mixed land uses, open space preservation, and employment opportunities.

Staff Analysis:

Staff believes the proposed major CPA amendment meets the goals and objectives of both the 
Tonopah/Arlington Area Plan and the County’s Comprehensive Plan. The original Belmont DMP 
forecasted this area for a large mixed-use master-planned community – essentially a future city 
(previously described as akin to Tempe) with a variety of residential, commercial, and recreational 
open space land uses. However, current climate and water concerns in this region of the Sonoran 
Desert makes developments like the current Belmont DMP less feasible. Moreover, the future 
Interstate–11 freeway and rail corridor adjacent to the site makes uses such as distribution 
facilities, trucking facilities, and power generation (which tend to use less water than 
residential/commercial land use) more optimal for this part of the County. Staff supports this 
CPA.  
 
Recommendation:

For the reasons outlined in this report, staff recommends the Commission adopt a motion 
recommending that the Board of Supervisors approve CPA2024003.

EXECUTIVE SUMMARY 
 
The Belmont Development Master Plan (the 
“Belmont DMP”) was approved by the Maricopa 
County Board of Supervisors in 1991 with the 
intention of providing a diverse mix of uses including 
commercial, office, business, manufacturing and 
mixed residential use zones. In the time since its initial 
approval, the Belmont DMP has undergone two (2) 
Major Amendments which updated the land use plan 
to reflect changed market conditions and more 
modern approaches to planning.  The most current 
Belmont DMP was unanimously approved by the 
Maricopa County Board of Supervisors on June 18, 
2008 (Case No. DMP2007009) and encompassed 
approximately 24,800 acres, as shown on the image to 
the right.  Belmont was envisioned to be a sustainable 
community and was designed around a Town Center 
with surrounding smaller Villages of predominantly 
residential development.  Although the Belmont DMP 
is primarily residential in nature, Mixed-Use 
Employment Center (MUEC) and Regional Retail 
Center (RRC) land use designations were located 
around the several existing and planned interchanges 
with the I-10 Freeway.   
 
Since the approval of the latest Belmont DMP land plan, markets have shifted, demanding more 
mixed uses and employment opportunities, especially near major freeway intersections.  In 2023, the 
applicant processed a Comprehensive Plan Amendment requesting to remove 1,147 acres from the 
Belmont DMP and amend the land use designation on a total of 1,402-acres to Mixed-Use, to allow for 
the development of a movie studio along with retail, hospitality, and light industrial near the 
intersection of 339th Avenue and Indian School Road.  The most recent amendment to the 
Comprehensive Plan was approved by the Board of Supervisors on December 6, 2023 (CPA2023012). 
Additionally, in 2021, the preferred alignment for the future I-11 was published by the Arizona 
Department of Transportation (ADOT) and the Federal Highway Administration (FHWA).  The preferred 
alignment is situated along the western edge of Belmont and is envisioned as a multi-use corridor that 
will connect Las Vegas to Mexico, creating new opportunities for enhanced travel, mobility, trade, 
commerce, job and economic growth.  The intersection of two major national highway systems is a 
catalyst to spur new economic development in the area.

The subject property is approximately 5,147 acres as 
shown in the image to the right and attached as Exhibit A - 
Aerial, (the “Property” or the “Site”).  The Property is currently 
vacant, desert land that is designated as Belmont DMP.  See 
Exhibit B – Existing Land Use.  The purpose of this request to 
modify the land use designation to Heavy Industrial, removing it 
from the Belmont DMP.  This will allow for greater flexibility of 
design and potential uses as the Property develops around the 
future major freeway intersection corridor.    These future uses 
may include a dynamic variety of light industrial (including 
warehousing and distribution) and heavy industrial (including 
utility generation).  By requesting the Heavy Industrial land use 
designation, the Site will be primed for these future 
developments. This will ultimately lead to the creation of a 
major core providing entertainment, employment, and 
commercial services to the County. 
PURPOSE OF REQUEST 
 
Statement of Specific Application 
 
To facilitate the development of the Site, the Applicant respectfully requests the following:   
 
1. Comprehensive Plan Amendment from Belmont DMP land uses to Heavy Industrial 
 
See Exhibit C, Proposed Land Use Map.

There are essentially no immediately adjacent neighbors with several large residential sites 
located approximately one-quarter of a mile to the east and west of the Site.

LOCATION AND ACCESSIBILITY 
 
The Property is located approximately 7 miles east of Tonopah and generally located between 
347th Avenue and 371st Avenue and between Indian School Road and Northern Avenue.  The Site is ideally 
located for industrial development as it is both remote from any settled areas while being adjacent to 
both the future I-11 and Interstate 10.  With the Buckeye airport a few miles away and short 4-hour drive 
from Los Angeles this is an ideal location for such uses.   
 
COMPREHENSIVE PLAN ANALYSIS 
 
According to the Maricopa County Comprehensive Plan’s Land Use Guide, the Site is located within 
the Tonopah / Arlington Area Plan (the “Area Plan”). Under the designated land uses in the Eye to the 
Future 2020 Area Plan, the Site is located within the Belmont DMP land uses.  Below is an analysis of how 
the amendment meets the intent of the overall Comprehensive Plan.  
 
1. Whether the amendment constitutes an 
overall improvement to the Comprehensive 
Plan and is not solely for the good or benefit 
of a particular landowner or owners at a 
particular point in time. 
 
The proposed amendment thoughtfully 
considers not only existing land uses but the 
future planned/approved land uses for the 
area.  It improves upon the existing plan by 
providing more of a transition from the 
planned I-11 freeway and by providing a 
flexible framework to adapt development 
phases to market changes.  The Heavy Industrial designation will expand the possibility for 
economic and employment opportunities in the area, focusing on economic drivers as opposed 
to the dominant residential designation as previously approved. 
2. Whether the amendment will adversely impact all or a portion of the planning area by:  
Altering acceptable land use patterns to the detriment of the area plan? 
Approval of this amendment will not alter land use patterns to the detriment to the 
Comprehensive Plan.  The Heavy Industrial designation is compatible with future approved land 
use patterns for the area and is consistent with land uses that are generally located along freeway 
corridors.  The amendment will in fact provide a more acceptable transition to designated 
residential uses to north and east. 
 
Requiring public expenditures for larger and more expensive infrastructure improvements to 
roads, sewer, or water systems than are needed to support the planned uses.  
The amendment will not adversely impact the expenditures for infrastructure improvements as 
the area is already planned for industrial, commercial, and residential development. The new 
freeway and freeway interchange will be paid for and maintained by ADOT.  Additionally, the

development of new roads or improved existing roadways will be paid for by future developers.  
Lastly, water and sewer infrastructure will be developed and maintained by a private company.  
 
Adversely impacting planned uses because of increased traffic? 
The amendment will not cause adverse impacts to the area due to increased traffic.  Although 
currently vacant, as stated above, the area is already planned for a large sustainable community.  
This change from the Belmont DMP land uses to Heavy Industrial will not adversely impact traffic.  
Additionally, the developers will create new roadways or improve existing roadways that can 
move much more traffic throughout the site much more efficiently.  
 
Affecting the livability of area or the health or safety of present and future residents? 
Again, the change in designation from the Belmont DMP land uses to Heavy Industrial will not 
adversely impact the livability as this amendment will allow for the development of employment 
centers creating a sustainable community that was always envisioned and intended here. 
 
Adversely impacting the natural environment or scenic quality of the area in contradiction to 
the plan.   
The amendment is simply to allow more flexibility and will not adversely impact the natural 
environment.  During the design and development phases each project will be thoughtfully 
designed to not adversely impact the natural environment.   
 
3. Consistent with overall intent of CP 
 
The proposed amendment is consistent with the overall intent of the Comprehensive Plan.  This 
CPA will allow for uses that would use less water than dense residential/commercial 
developments that are currently designated for this site.  The area was planned and approved to 
be developed into its own sustainable community.  This amendment simply allows flexibility to 
develop along the future freeway corridor. 
 
4. Consistent with specific goals and policies 
 
The proposed amendment supports specific goals and policies set forth for both the 
Comprehensive Plan and the Area Plan as follows: 
 
Maricopa County Comprehensive Plan 
 
Land Use 
 
Land Use Goal #1: Achieve balanced and efficient development patterns. 
Response: The proposed amendment appropriately provides more flexibility for 
employment and economic opportunities along a major freeway corridor while 
also providing a transition to future planned residential developments, creating a 
better balance of land uses in the area. 
 
 
Land Use Policy #17: Maricopa County supports balanced land use patterns that include 
various residential, retail, non-retail employment, and public and civic land uses. 
Response: While the previously approved Belmont DMP is heavily focused on 
residential land uses, the proposed amendment will provide a better balance of

land use patterns that include non-residential uses and employment into the 
overall area. 
 
Transportation 
 
Transportation Policy #9: Maricopa County supports balanced and efficient land use pat- 
terns that reduce the number and length of vehicle trips. 
Response: By appropriately locating industrial along the freeway, near the 
intersection of two major national freeways, providing more employment 
opportunities for the area, as well as goods and services, a reduction in the length of 
vehicular trips would be expected. 
 
Environment 
 
Environment Policy #2: To help improve air quality Maricopa County supports balanced 
and efficient land use patterns where employment, retail and residential land uses are 
proximate rather than separate. 
Response: The proposed amendment supports balanced and efficient land use 
patterns by providing a flexible framework for employment to develop being a catalyst 
to encourage new residential and retail development in the immediate area. 
 
Economic 
 
Economic Growth Goal #1: Contribute to an effective regional economy.  
Response: The proposed amendment will contribute to the regional economy, not to 
mention be a catalyst for more employment growth in the immediate area. 
 
 
Economic Growth Goal #2: Have a diverse and balanced economy to promote long-term 
economic stability and economic resiliency. 
Response: The proposed amendment will provide long-term economic stability to 
the area with new employment opportunities. 
 
Growth Areas 
 
Growth Areas Goal #1: Achieve orderly urban growth that is fiscally and environmentally 
responsible, protects public health and safety and promotes sensible annexation 
patterns. 
Response: The proposed amendment is in fact, more fiscally and environmentally 
responsible than the existing approved plan as it provides more mixed use and 
employment/economic opportunities, as opposed to the predominantly 
residential base.  
 
Water Resources  
 
Water Resources Goal #4: Increase water conservation. 
Response: At time of development and construction, the developer will adhere to 
modern water conservation techniques. 
 
 
Water Resources Policy #2: Maricopa County supports water conservation techniques in 
the planning and design of new development. 
Response: At time of development and construction, the developer will adhere to 
modern water conservation techniques.

the costs of new infrastructure, services, and other public improvements. 
Response: Infrastructure and utilities associated with any development within the 
amendment area will be dedicated or constructed by the developer as each phase 
is developed.  
Tonopah Area Plan 
 
Land Use Objective L.1 
 
Create orderly, efficient, and functional development patterns and create high quality 
residential, commercial, and industrial land developments that are compatible with 
adjacent land uses. 
Response: As stated above, the proposed amendment will provide more effective 
and functional development patterns along the future I-11 corridor.  
 
Economic Development Goal 
 
Promote a growing balanced, efficient, and diversified economy, consistent with available 
resources, that enhances quality employment opportunities, improves quality of life, and 
is sensitive to the natural and cultural environment.  
Response:  As stated above, the proposed amendment will allow for the 
development of a diverse, quality employment opportunity with many supporting 
uses. 
CONCLUSION 
 
 
The proposed amendment will provide the framework for the development of economic 
sustainability within the Belmont area.  The County will greatly benefit from the increase in the diverse 
economic and employment opportunities that are envisioned for this Site.

Thank you for the opportunity to review and comment on Maricopa County Major Comprehensive 
Plan Amendments CPA240003, CPA24004, CPA24005 and CPA24006 for industrial, rural low 
density residential, solar energy, and intermodal/logistics facility projects in the county. 
 
The Belmont Industrial major comprehensive plan amendment area is located generally north of 
Interstate 10, about 40 miles west of central Phoenix, adjacent to ADOT’s preferred alignment for 
I-11. If the proposed I-11 ultimately comes to fruition, the subject property will be located at the 
intersection of I-10 and I-11. This proposed amendment will facilitate development of uses to 
support trade and commerce.  
 
The Preserve at Goldfield Ranch major comprehensive plan amendment area is located generally 
north of State Route 87, east of the Fort McDowell Yavapai Nation.  The proposed amendment 
requests to change the Preserve DMP land use designation to Rural Densities, resulting in a 
reduced residential density.  As the amendment site area is undeveloped or developed at very 
low densities, this request is compatible with surrounding area. 
 
The Grande Verde Energy Solar project is located at the intersection of State Highway 85 and 
Komatke/Gas Pipeline Road, about 10 miles south of the Town of Buckeye and 25 miles north of 
Gila Bend. The proposed solar energy generation and storage project is located in a region of 
high solar exposure, including other existing solar energy farms and energy production uses, and 
is in proximity to adequate energy transmission infrastructure. The project should have minimal 
impact on surrounding properties and generation of renewable energy would be a benefit to the 
region.  
 
The BNSF intermodal/logistics facility is located between the City of Surprise and Morristown on 
the east side of U.S. Highway 60, south of State Road 74. The proposed Intermodal Facility, 
Logistics Park and Logistics Center will connect with the existing road and rail networks providing 
employment and economic development to the region.

Pima County Development Services Department, Planning Division has no opposition to the 
proposed major comprehensive plan amendments.

The Yuma County Planning and Zoning Division has reviewed Case CPA240003. At this time, 
we have no comments to offer other than the following observation: the proposal, as mentioned, 
is a predictable subsequent step following the major amendment in 2023. It also prepares 
potential uses that align more closely with the future I-11 Corridor. The current mixed-use area 
of rural-residential properties to the west will be most affected by the proposed change.

Thank you for allowing Luke AFB to make comments on the Major Comprehensive Plan 
Amendment to change the land use designation of a 5,157-acre site from Mixed-Use Employment 
to Heavy Industrial.   
 
As described in the application, this request will not have a negative impact on Luke AFB Flight 
Operations.  Since the site will be located inside the “territory in the vicinity of a military airport,” it 
will be subjected to approximately 165 over flights per day.

this case.  The letter was from an adjacent property owner of the site who is concerned that this 
request for Heavy Industrial is incompatible with the area’s growing residential developments. 
Moreover, industrial developments will disrupt the tranquility of the area and devalue property

Dear Members of the Board, 
 
I am writing to express my opposition to the Major Comprehensive Plan Amendment (CPA) request 
associated with case # CPA240003, which seeks to change the designation in the Tonopah/Arlington 
Area Plan from Belmont DMP to Heavy Industrial. As the owner of property located within 300 feet of 
the proposed site, I am particularly concerned about the implications this change would have for our 
community and my plans for the future. 
 
The request for heavy industrial zoning in this area is incompatible with the growing residential 
developments nearby. The establishment of industrial operations would disrupt the tranquil 
environment and undermine the property values and quality of life for current and future residents. I 
have long considered the possibility of building my own home in this area, I urge the Board to reject this 
amendment and maintain the current designation. 
 
Thank you for considering my concerns. I hope you will take the necessary steps to protect our 
community’s future.
