Comments:
The applicant is requesting R-5 RUPD zoning for a future residential
development. The applicant proposes to develop the site with a mix
of housing stock, such as detached residences, attached/semi-
detached housing, townhomes, and apartments.
There are no outstanding concerns from reviewing agencies. The
site is in Phoenix’s municipal planning area and the City’s General
Plan designates the site as Rural. To date the City has not
commented on this request. Prior to the Commission hearing staff
received 12 letters of support. Additionally, staff received a petition
with 279 signatures, 23 letters of opposition, and 8 appeals to the
Commission. The opposition considers the potential residential
density proposed to be incompatible with the existing rural
residential lots and worry that this development will create too
much traffic on roads not designed to handle increased traffic.
During the Commission hearing six members of the public spoke in
opposition echoing these concerns. After the Commission hearing
staff received one opposition letter against this request who shared
the same concerns mentioned in the opposition letters. The
opposition has not triggered requirement for a super-majority vote
of the Board

Board of Supervisors approve Z2024063 with conditions ‘a’ – ‘p’:
a.
Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “La Salvia Dairy – Rezone”, consisting of three full-size sheets, dated September
9, 2024, and stamped received September 11, 2024, except as modified by the following
conditions.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “La Salvia Dairy”, consisting of 14 pages, dated September 10, 2024, and stamped
received September 11, 2024, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Without the submittal of a precise plan of development, no development approval
is inferred by this review, including, but not limited to number of proposed building
lots/units, drainage design, access, and roadway alignments. These items will be
addressed as development plans progress and are submitted to the County for
further review and/or entitlement.
2.
The traffic impact study will need to be submitted and reviewed with the future
entitlement (POD) application.
3.
Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa
County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards, and best practices at the time of application for
construction.
d.
Prior to approval of the initial final plat or precise plan of development approval, the
applicant shall provide the Maricopa County Planning and Development Department with
an executed pre-annexation service agreement with the City of Phoenix that identifies the
detail for when the proposed project will be annexed and the provision of water and sewer
service. In lieu of pre-annexation service agreement the developer must provide a ‘will
serve’ letter from the certificated water and sewer provider(s).
e.
If the site remains unincorporated the developer shall provide a written notification to
future property owners that this is an area that contains rural residential, equestrian, and
agricultural activities may occur in proximity of the site. Such notification shall be in any
subdivision public reports, such as a Covenants, Conditions & Restrictions (CC&Rs) and
noted on any subdivision plat or plan of development for this site. Such notice shall state:
“You are purchasing a property near a rural residential properties that may have livestock
and may have equestrian activities that may produce dust, noise, light, and odor.”
f.
If the site remains unincorporated all transformers, back-flow prevention devices, utility
boxes, and all other utility related ground mounted equipment shall be painted to
complement the development and shall be screened by landscaping materials where
possible.
g.
If the site is not annexed into the City of Phoenix, a ‘will serve’ letter shall be required from
the Laveen Fire District with any final plat or plan of development.

h.
The developer must provide documentation from the Laveen Elementary School District,
Roosevelt Elementary School District, and Phoenix Union High School District stating their
awareness of any residential development on this site with any final plat or plan of
development submittal.
i.
The following requested R-5 RUPD development standards shall apply to this site:
1.
Minimum font yard setback of 10 feet.
2.
Minimum rear yard setback of 12 feet.
3.
Minimum lot area of 4,000 square feet.
4.
Minimum lot width of 30 feet.
5.
Maximum density of 15 dwelling units per acre.
6.
A minimum 15% of any subdivision plat or plan of development within this R-5
RUPD zoning district must consist of passive and active open space.
j.
Prior to initial Final Plat approval or initial precise plan of development approval, the
applicant shall submit to the Maricopa County Planning and Development Department
confirmation of service by the City of Phoenix and verification of approval of a 208
Amendment approved by the Maricopa Association of Governments Regional Council if
the site remains unincorporated.
k.
Prior to initial Final Plat approval or initial precise plan of development approval, the
applicant shall submit to the Maricopa County Planning and Development Department
confirmation of service by the City of Phoenix and an approved Certificate of Convenience
and Necessity (CC&N) issued by the State of Arizona if the site remains unincorporated.
l.
Prior to the submission of a final plat or plan of development, the developer must conduct
a Class I Cultural Resources Inventory of the site to determine the extent of any known
cultural resources. The developer shall take measures to avoid and minimize the impact
of any known or found cultural resource during the construction of any phase of the
development. Prior to the submission of a final plat or plan of development the developer
shall provide a letter from the State Historic Preservation Office (SHPO) stating if or if not,
the site is in an area of historical or cultural significance.
m.
The landowner or developer shall coordinate with the Arizona Game & Fish Department in
each phase of development to determine best management practices to minimize
impacts on the area’s wildlife. The landowner or developer shall coordinate with the
Arizona Game & Fish Department to determine the appropriate wildlife and habitat surveys
that will need to be conducted during the development of the site.
n.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
o.
Noncompliance with any of the conditions assigned to the approval of this Zone Change
by the Maricopa County Board of Supervisors may be grounds for revocation in

accordance with the requirements and procedures as set forth in the Maricopa County
Zoning Ordinance.
p.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
shall revert to the zoning that existed on the date of application. It is, therefore, stipulated
and agreed that either revocation due to the failure to comply with any conditions, does
not reduce any rights that existed on the date of application to use, divide, sell or possess
the property and that there would be no diminution in value of the property from the value
it held on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the Zone Change
is granted and reverting to the prior zoning results in the same value of the property as if
the Zone Change had never been granted.

Project Summary:
1.
The applicant is requesting a zone change with overlay from Rural-43 to R-5 RUPD for a future
residential development. The site consists of approximately 64.8 acres and is generally located
300 feet northwest of the northwest corner of 27th Ave. and Dobbins Rd. in the Laveen area.. Once
the zoning entitlement is approved the applicant proposes to develop the site with a mix of
housing stock, such as detached residences, attached/semi-detached housing, townhomes, and
apartments. Thus, the focus of this rezoning request, according to the applicant, is to address
housing stocks that are missing in this area and to offer variety to today’s homebuyers.
2.
Currently, the property is being used as a dairy farm which has been the use of the site for the last
six decades. Prior to this the site was used for irrigated agriculture for many decades. The site
has a land use designation of Rural Density Area (RDA). Presently, a Comprehensive Plan
Amendment (CPA) has been submitted to modify the land use designations outlined in the
County’s Comprehensive Plan from RDA (0-1 du/ac) to Multi Family – Intermediate (12-20 du/ac).
The CPA is on this agenda and will accommodate the proposed R-5 RUPD zoning. On July 16,
2024, the applicant meet with staff in the Technical Advisory Committee (TAC) Meeting to
discuss the first submittal comments of this case. On August 8, 2024, the applicant meet with
staff in a separate TAC Meeting to discuss the first submittal comments of CPA240001 for this
site.
3.
With this zone change to R-5-RUPD the applicant has requested to vary several development
standards due the unique shape of this site and the various housing types that will occupy this
property once rezoned. The applicant will request to vary two of the required yard depths, lot area,
lot width, and density. According to the applicant, the requested varied development standards
will create a community with a wide range of housing products with smaller lots to take care of
with an amenity rich neighborhood designed for today’s homebuyer. The RUPD table below
indicates proposed variations from the base R-5 zoning district.

Vision 2030 Comprehensive Plan (adopted January 13, 2016): The comprehensive plan
designates the site as Rural Development Area (0-1). This designation denotes an area with
limited or no access to urban services such as, water or sewer. However, this site is unique in the
fact that it is adjacent to these urban services and according to the applicant is current
negotiations with the City of Phoenix for future access to these urban services.

Phoenix General Plan: The general plan designates the site as Rural (0-1). As of the writing of this
report staff have not received any comments from the City.
Public Participation Summary:

The applicant complied with the Maricopa County Citizen Review Process with the required
posting of the site and notification by first class mail to adjacent property owners within 300 feet
of the subject site and area interested parties. Signs were posted on the site in accordance with
applicable regulations. Staff received a public participation results report in accordance with
County requirements. According to the report the applicant received one phone call from an
individual who opposed this request fearing that this zone change will allow for apartments on
this site. During the applicant’s public participation process, staff received 12 letters of support
from individuals who believe that this request will facilitate more housing diversity in an area with
primarily traditional single family residential homes. Additionally, staff received 16 letters of
opposition against this request, believing that high density development on this site will be
incompatible with their rural lifestyle that have existed for many decades and will bring in too
much traffic to the area.
Outstanding Concerns from Reviewing Agencies:

Staff Analysis:

Staff believe since this site is adjacent to streets with City of Phoenix urban infrastructure
(water/sewer lines), that it should be annexed and developed in the City of Phoenix. The R-5 RUPD
zoning is to facilitate development of a unique community with a mix of traditional homes,
duplexes, triplexes, townhomes, and apartments with community amenities that is lacking in this
area. Future developers will be able to dedicate and improve the adjacent arterial streets to
accommodate the traffic impact this development will create. This site is in a transitioning area

of Laveen that is converting from primarily agricultural uses to suburban residential and
commercial land uses, thus this request is reasonable.
Recommendation:
12.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2024063 subject to the following conditions ‘a’ – ‘p’:
a.
Development of the site shall be in substantial conformance with the Zoning Exhibit

I. Purpose of Request
This proposal is to rezone the subject parcel (APN’s 300-14-007J, 300-14-003C, 300-14-
009H, 300-14-009R, 300-14-009T, 300-14-009G, 300-14-009V, 300-14-009S, 300-14-
009U & 300-14-009K), “The Property” from RU-43 to R-5 (Multiple-Family Residential
Zoning District) with a Residential Unit Plan of Development (RUPD) overlay, for the entire
64.83± gross acres, 2,823,921 gross Sq. Ft. The parcel is located on the northwest corner
of W Dobbins Road and S 27th Avenue, in the Laveen area of Maricopa County, “County”.
The requested change to R-5, RUPD would allow for Single- Family, Two-Family and
Multiple-Family uses. (See Exhibit A: Existing Zoning and Exhibit B: Proposed
Zoning).
II. Description of Proposal
The Property is currently utilized as a dairy farm and located on west Dobbins Road and
27th Avenue and is comprised on ten parcels, APN’s 300-14-007J, 300-14-003C, 300-14-
009H, 300-14-009R, 300-14-009T, 300-14-009G, 300-14-009V, 300-14-009S, 300-14-
009U & 300-14-009K. (See Exhibit C: Context Aerial). The Property is in a prime location
for single-family and multi-family uses, as it is surrounded in different densities of
residential homes and is located within the Laveen area, in the County jurisdiction. APN
300-14-009U has a small portion in the southeast corner which is currently zoned C-3,
General Commercial Zoning District (approximately 64.963± SF). This 39,989± SF portion
of APN 300-14-009U is excluded from this rezoning request, and will remain C-3.
The Property is easily accessible and located on Dobbins approximately four (4) miles east
of the Loop 202 (South Mountain Freeway). Loop 202 connects to Interstate 10 in the west
valley, and Interstate 10 in the south east valley, joining the two opposite sides of the
Phoenix Metro area.

Family. The proposed modifications are intended to create development standards that
allow for variations in housing product, meet today's buyer preferences, and provide
flexibility for homebuilders to craft communities that appeal to a greater range of home
buyers for diverse neighborhoods.
The proposed RUPD development standards, compared with MCZO R-5 standards are
detailed within the table below:

The above requested modification standards to the R-5 RUPD will enable homebuilders to
develop and design homes with the above design standards for detached single-family
residential, attached single-family residential townhomes, as well as attached multi-family
residential and detached multi-family residential product. Attached multi-family residential
and detached multi-family residential product may include a combination of attached and
detached products, as well as private, enclosed patios varying size and shape specific to
each unit. The proposed development standards allow for 30' lot widths and the option of
a side-loaded garage, which enhances the street scape and contributes to the overall
neighborhood aesthetic. Potential homebuilders may prefer a lower lot width for certain
situations, including, current market conditions, adjustment to smaller home product, or to
adapt the lots to potential curvilinear roads.

The proposed standards allow for 1,000 square foot average lot area product to provide a
denser/urban product. The building maximum height is requested at 40' for all home types.
This flexibility ensures similar development standards to R1-6 zoning for single-family,
detached products, and ensures that if this development option is used, that the density
and maximum number of dwelling units will be lower than expected for traditional R-5
development. The rear yard setback has been modified from 25' to 12' to allow for the
denser products situated on a smaller lot.
Smaller lot sizes with reduced setbacks will allow for generous, useable open space in the
community, meeting today's market demand for a smaller individual footprint with amenity-
rich, central areas. Indeed, fifteen-percent (15%) open space is proposed to ensure
creation of active and passive open spaces, which may include trails, playgrounds,
ramadas, barbeques, and/or benches to foster community. Additionally, these
neighborhoods will all be part of homeowners' associations that will govern and maintain
open spaces and common areas, and enforce maintenance over the limited non-common
areas. With the popularity and demand for common areas, homeowners' associations have
become integral parts of communities not only in terms of upkeep, but also in terms of
bringing the community together and creating communication between neighbors.
The development standards proposed herein are minimum standards that will create a
diversity of lot sizes, parks, and expansive open spaces and amenities. These features
combined will create a distinctive, vibrant community with a wide-range of product offerings
to future homebuyers.
III.
Relationship to Surrounding Properties
Contiguous properties to the north, west, and east are zoned RU-43 and are currently
utilized for residential homes. Dobbins Road is directly to the South of the Property acting
as a buffer to frontage of the Property.
North:

IV.
Location, Accessibility, and Circulation
The Property is currently adjacent to residential properties and farmland. The dairy is zoned
RU-43, is adjacent to the City of Phoenix on the south side of the property and across 27th
Avenue, and unincorporated Maricopa County to the west and north. Agricultural fields are
to the northwest of the property, with the west and north zoned RU-43 in unincorporated
Maricopa County and the east across 27th avenue, zoned S-1 within the City of Phoenix.
To the south is R1-10 City of Phoenix, single-family residential and to the southwest is
County, multi-family R-3 zoning. The northwest hard corner on 27th Avenue and Dobbins
is zoned C-3 in Maricopa County and the southeast corner being zoned C-2 in the City of
Phoenix. The Property is located within Maricopa County zoning jurisdiction, where the
County’s Comprehensive Plan designates the site as Rural Densities (0-1 du/ac) we have
submitted a separate Comprehensive Plan Amendment (CPA) to change the land use
designation of the site to Multiple Family-Intermediate (CPA240001). The flexibility in
density for home types, allows for appropriate home type to abut similar densities.
There are numerous options for access the Property such as 27th Avenue and Dobbins
Road. Loop 202 is less than 4± miles from the Property and feeds into Interstate 10, serving
both east and west valley.

applied subsequent to obtaining residential zoning entitlement approval once specific land
use(s) are determined.
VIII. Conclusion
In addition to the justifications provided above for the various home products, the proposed
R-5 zoning districts and RUPD overlay will enable the site to develop consistent with the
current residential markets in the area. Nearby growing developments have provided
current residents with housing options, but this area of Maricopa County is growing
primarily as greater infrastructure investments are made by the larger developments and

nearby jurisdictions, including roads, water and sewer improvements. The Project intends
to create a livable, marketable residential development at an appropriate density for a wide-
range of products.
Overall, the Project is proposing smaller individual lot sizes with greater, useable open
space that will be present in either single-family subdivisions or multi-family communities.
The amenities may include a tot lot, ramada, barbeques, field areas, and/or trails promoting
interconnectivity. These amenities will be maintained homeowners' association and/or
property management, which is desirable for today's homebuyer seeking to alleviate the
burdens of upkeep. Our proposal brings a diversity of products to this area, and creates
opportunities for homebuilders to be creative in their product offerings and designs,
resulting in organically diverse communities.

Fence recommendations will be dependent upon the goals of the fence project and the wildlife species expected to be
impacted by the project. General guidelines for ensuring wildlife-friendly fences include: barbless wire on the top and
bottom with the maximum fence height 42", minimum height for bottom 16". Modifications to this design may be
considered for fencing anticipated to be routinely encountered by elk, bighorn sheep or pronghorn (e.g., Pronghorn
fencing would require 18" minimum height on the bottom). Please refer to the Department's Fencing Guidelines located
on Wildlife Friendly Guidelines page, which is part of the Wildlife Planning

During the planning stages of your project, please consider the local or regional needs of wildlife in regards to movement,
connectivity, and access to habitat needs. Loss of this permeability prevents wildlife from accessing resources, finding
mates, reduces gene flow, prevents wildlife from re-colonizing areas where local extirpations may have occurred, and
ultimately prevents wildlife from contributing to ecosystem functions, such as pollination, seed dispersal, control of prey
numbers, and resistance to invasive species. In many cases, streams and washes provide natural movement corridors
for wildlife and should be maintained in their natural state. Uplands also support a large diversity of species, and should
be contained within important wildlife movement corridors. In addition, maintaining biodiversity and ecosystem functions
can be facilitated through improving designs of structures, fences, roadways, and culverts to promote passage for a
variety of wildlife. Guidelines for many of these can be found

Consider impacts of outdoor lighting on wildlife and develop measures or alternatives that can be taken to increase
human safety while minimizing potential impacts to wildlife. Conduct wildlife surveys to determine species within project
area, and evaluate proposed activities based on species biology and natural history to determine if artificial lighting may
disrupt behavior patterns or habitat use. Use only the minimum amount of light needed for safety. Narrow spectrum bulbs
should be used as often as possible to lower the range of species affected by lighting. All lighting should be shielded,
canted, or cut to ensure that light reaches only areas needing illumination.
Minimize the potential introduction or spread of exotic invasive species, including aquatic and terrestrial plants, animals,
insects and pathogens. Precautions should be taken to wash and/or decontaminate all equipment utilized in the project
activities before entering and leaving the site. See the Arizona Department of Agriculture website for a list of prohibited
and restricted noxious weeds at https://www.invasivespeciesinfo.gov/unitedstates/az.shtml and the Arizona Native Plant

To build a list: zoom to your area of interest, use the identify/measure tool to draw a polygon around your area of
interest, and select “See What’s Here” for a list of reported species. To export the list, you must have an
account and be logged in. You can then use the export tool to draw a boundary and export the records in a csv
file.
The Department recommends that wildlife surveys are conducted to determine if noise-sensitive species occur within the
project area. Avoidance or minimization measures could include conducting project activities outside of breeding
seasons.

Good day. I am a neighbor of La Salvia Dairy. The properties in
our neighborhood are all horse properties of an acre or over an
acre. The dairy is the reason I purchased my home years ago.
I'm not against progress but this plan on rezoning to a high-
density property would ruin our way of life. As we all have
animals and farms that would be right up against this new
project. At some point, someone is going to complain about our
horses. We have so many new subdivisions and apartments
around us that already complain about riders we don't need
then next door. The amount of traffic that this would bring to an
already congested two-lane back street would be horrid.
Laveen is supposed to be a rural area and a small town feel
not an overpopulated County island. I wouldn't mind other acre
homes being built with the same ranch style as the rest of our
neighborhood. But I am totally against a high-density project.

I am a long-term resident of this area. I am very concerned
about this change negatively impacting my life here. Traffic
down 27th Ave. is already at high capacity and no streetlights
are leading to danger and people getting hurt. The stop sign at
27th Ave. and Baseline Rd. cannot handle this growth. Putting
apartments at this location also does not fit the community
style. We have the orange groves/farms, del Monte, and acre
horse properties in this area. Apartments will ruin our area's

The community is historically a more rural community with
equestrian properties and 1-acre lots providing access to South
Mountain Preserve. The DelMonte Market on the Southeast
corner of 27 Ave is a historic landmark that has been operating
as a general store / market since 1908. The subject property, if
developed as a high density community would significantly alter
the character of the community forever destroying the rural
character that have drawn many long-time current residents to
this area. Additionally, the infrastructure in this area can not
support the additional influx of traffic that a high-density project
would bring.
The subject property should be developed under the principles
set forth in the Rio Montaña Area Plan adopted by the Phoenix
City Council in 2000. The Rio Montaña Area is bound by the
Rio Salado to the north, South Mountain Park to the south,
South Central Avenue to the east and 27th Avenue to the west.
This plan focuses on preserving the
rural character of the area, the natural desert and open space,
encouraging pedestrian
and equestrian activities, sense of community and economic
development.
A lower-density project would be more in keeping with the spirit
of the Rio Montaña Plan and the existing character of the
neighborhood while at the same time encouraging
development and opportunity in the area.

Hello, This area should be reserved for sprawling lots, low profile homes that preserve as much of
the desert and views as possible. There is already a boom of housing growth in the area that
includes sufficient high density options - to name only a few:
Over 200 unit multifamily units on Dobbins Rd. and 38th Ave, a 27-unit rental apartment

Hello, I am writing to address my concerns with the proposed
density of the zoning change request at the current La Salvia
Dairy. I am not against development but this particular proposal
is irresponsible and not correct for this neighborhood at this
time. No governing authority is willing to do the development on
Dobbins Road that is necessary to support this density of
development. All the surrounding roads are 2 lane roads that
already get very backed up - as far as half a mile during rush
hour. Until the infrastructure is fully in place - not depending on
developers to expand the road in tiny sections at a time, no
development of this density should be permitted along Dobbins
Road. As I leave a half mile down the road I drive Dobbins
almost every day and see/hear so many accidents due to the
current density and lack of development. Thank you for

Dear Martin,
We are formally writing this letter of opposition on behalf of the neighbors of the Vista del
Valle subdivision in Laveen Arizona that will be negatively affected by the proposed
development of a residential planned units on the LA Salvia Dairy property.
Our neighbors/community stand in unity against this plan wholeheartedly. We understand
growth around us is inevitable, however, this planned development will destroy the character
and heritage that Laveen is known for. Majority of the neighbors have horses and agricultural
livestock that would be disrupted by such planned units.
Another point that our neighbors would be negatively affected is by the strain and safety a
planned muti-unit community would bring. That would include already congested traffic, and
schools not equipped for poorly planned developments that would cause overcrowding. With
overcrowding, education would be negatively impacted for a certainty.
A 3rd way our neighborhood would be negatively impacted is environmentally. Scenic views
and lifestyles would be dramatically changed. A possible multilevel structures would completely
erase beautiful and natural mountain views of South Mountain, as well as privacy issues with a
multilevel structure soo close to properties. Protected wildlife would be severely impacted as
their habitats would be changed if not destroyed.
And finally, economic impact to all our subdivision will be severely impacted negatively.
Property values would decline based on the types of zoning, and marketability of home sales
would bring values down tremendously.
In all, we respectfully ask that those with a difficult decision, make the right decision and
consider the strong opposition to the proposed development by all in our subdivision as well as
surrounding neighborhoods. Laveen will no longer be Laveen as we know it. The environment
and character of Laveen, as well as the natural beauty and wildlife wish to continue as is.
