C-22-25-011-X-01 Amendment No. 1 UMOM CDBG-ESG FY25 Emergency Shelter Page 1 of 4 AMENDMENT NO. 1 TO THE CONTRACT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND UMOM NEW DAY CENTERS I. Maricopa County (“County”) administered by its Human Services Department and UMOM New Day Centers (“Subrecipient”) entered into a financial agreement (“Agreement) on or about September 10, 2024. The Agreement term is July 1, 2024, through June 30, 2025. The purpose of the Agreement is for the Subrecipient to provide emergency shelter and case management services for individuals and families at risk of or experiencing homelessness. The County provided the Subrecipient with $188,479.00 in U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funds under Assistance Listing Number (ALN):14.218 and $52,490.59 in Emergency Solutions Grant (ESG) funds under Assistance Listing Number (ALN):14.231, for Program Year 2024, Fiscal Year 2025. The total Agreement funding amount for the Work statement activities is $240,969.59. The County and the Subrecipient may be referred to individually as the “Party” or collectively as the “Parties.” II. The Parties now agree to modify the Agreement as authorized by Section 1 (General Provisions), Paragraph 4.0 (Amendments) of the Agreement as follows: A. Revise Contract Amount on Page 1 from $240,969.59 to $269,436.84. B. Revise Section 1 (General Provisions), Paragraph 5.0 (Administrative Change Orders) by removing in its entirety and replacing with the following: 5.0 ADMINISTRATIVE CHANGE ORDERS 5.1 The Chairman of the Board of Supervisors is authorized, upon the recommendation of the Human Services Department Director and Legal Counsel, to review and execute administrative changes to the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders will be effective upon execution by both the Parties. Administrative Change Orders shall address any of the following changes: 5.1.1 Modifications to the project timeline if the last day of the project timeline is within the Agreement term; 5.1.2 Modifications to Budget line items if the Agreement amount remains unchanged; 5.1.3 Modifications required by federal, state, or County regulations, ordinances, or policies; and/or 5.1.4 Modifications to Administrative requirements such as changes in reporting periods, frequency of reports, or report formats required by federal, state, and local regulations, policies, or requirements. Revise Section 3 (Work Statement) Paragraph 2.0 (Budget) by removing it in its entirety and replacing with the following: 2.0 BUDGET Activity: Emergency Shelter Services (ESG) Budget ESG Program Year 2023/Fiscal Year 2024 $28,467.25 ESG Program Year 2024/Fiscal Year 2025 $240,969.59 ESG Total $269,436.84 2.1 The County shall provide an amount not-to-exceed Two Hundred Sixty-Nine Thousand Four Hundred Thirty-Six and Eighty-Four hundredths ($269,436.84) subject to the terms of this Agreement and availability of funds. Funding is provided by the U.S. Department of Housing and Urban Development (HUD) as follows: $188,479.00 in Community Development Block Grant (CDBG) funds for Program Year 2024-Fiscal Year 2025, $28,467.25 in Emergency Solutions Grant (ESG) funds for Program Year 2023 - Fiscal Year 2024, and $52,490.59 in ESG funds for Program Year 2024 - Fiscal Year 2025. This Agreement amount constitutes the County’s entire participation and obligation in the performance and completion of all work to be performed under this Agreement. 2.2 Funding for this Agreement is through the following published programs in the Federal Register by the executive departments and agencies of the Federal Government of the United States under Assistance Listing Number (ALN): $188,479.00 - 14.218 Community Development Block Grant, and $80,957.84 - 14.231 Emergency Solutions Grant C-22-25-011-X-01 Amendment No. 1 UMOM CDBG-ESG FY25 Emergency Shelter Page 3 of 4 2.3 Itemized Service Budget: Emergency Shelter Budget D. The Agreement is amended to incorporate the changes contained in this Amendment No. 1. All other terms and conditions of the Agreement remain in full force and effect as executed by the Parties. This Amendment No. 1 is subject to and incorporates the provisions of A.R.S. § 38-511. IV. The Parties have authorized the undersigned to execute this Amendment No. 1 on their behalf and it shall be effective upon approval and signature by both Parties.
