The SUP was approved on August 16, 2006, per Z2005138, subject to conditions including an 
expiration date of August 16, 2026. The subject request is to extend the SUP through August 16, 
2051. Staff carried forward the original SUP conditions, but updated language where appropriate 
and deleted conditions that have already been fulfilled. This is requested in the Commission’s 
recommendation below. The applicant requested no modifications to the facility itself.

There are no outstanding concerns from reviewing agencies. There is no known opposition. 
Approval of this modified SUP will require majority vote of a quorum.

a. 
Development and use of the site shall be in substantial conformance with the site plan 
entitled “Cingular Wireless PIR #P753 Special Use Permit Z2005138 ”, consisting of five 
(5) full size sheets, dated May 24, and stamped received June 15 2006; and with the 
revised site plan stamped approved in substantial conformance July 24, 2007; except as 
modified by the following stipulations. Staff may determine slight refinements to remain 
in substantial conformance with the approved site plan. Minor and major amendments to

the site plan will be determined in accordance with Chapter 3 of the Maricopa County

The following Drainage Review stipulations shall apply:

Prior issuance of any building permits or the issuance of drainage clearance, the 
developer or his representative is required to contact the Drainage Permitting 
Office at (602) 506-7149 and the Planning and Zoning Office, both located at 501 
N. 44th Street, second floor, for a building permit. 
 
d. 
The following Flood Control District stipulations shall apply: 
 
1. 
Prior to any new development building permits, Floodplain Use Permit will need to 
be obtained from Regulatory Division of the Flood Control District.

All panel antennae and related hardware and cables that are mounted on an existing 
structure shall be painted to match that of the existing structure or camouflaged to reduce 
visual impacts.

This Special Use Permit shall expire forty-five (45) years from the date of approval by the 
Board of Supervisors (August 16, 2051), or upon expiration of the lease to the applicant, 
or upon termination of the use, whichever occurs first. All of the site improvements related 
to the wireless communication facility shall be removed within 60 days of such 
termination or expiration.

the same manner as the original application, with final determination made by the Board

Participation Process as determined by the Planning and Development Department. Minor 
changes may be administratively approved by staff of the Planning and Development

Services Department, Maricopa County Department of Transportation, Drainage Review 
Division, Planning and Development Department, or the Flood Control District of Maricopa 
County may be grounds for initiating a revocation of this Special Use Permit as set forth

Project Summary:

The applicant, Michael J. Campbell, is requesting a modification of conditions to a special use 
permit (SUP) for a wireless communications facility (WCF) in the Rural-43 zoning district to extend 
the timeline by which the SUP remains valid. The WCF is a monopole with a height of 102’ and 
currently supports two commercial carriers. The facility is located near the northwest corner of 
Indian Springs Rd. and 133rd Ave., approximately two miles west of the Phoenix International 
Raceway (PIR). The Board of Supervisors approved the original SUP on August 16, 2006, per case 
Z2005138. The approved SUP included condition ‘f,’ which stipulated that the SUP was to expire 
20 years from the date of approval (or upon expiration of the lease to the applicant, or upon 
termination of the use, whichever was to occur first). The facility remains in use and is subject to 
expiration on August 16, 2026. The applicant is requesting to extend the SUP an additional 25 
years. The applicant is requesting no changes to the WCF or other modifications.

City of Goodyear General Plan 2035 (ratified May 21, 2024): Goodyear’s general plan places the 
site within its “scenic neighborhoods” land use category. This category provides areas for the 
preservation and growth of neighborhoods that are more rural in character. 
 
Public Participation Summary:

The applicant complied with the requirements of the citizen review process by posting the site 
and sending notification by first class mail to interested parties and adjacent property owners 
within 300’ of the site. Two signs were posted onsite in accordance with applicable regulations. 
To date, staff has not received any citizen comment regarding this case. The Arizona State 
Historic Preservation Office (ASHPO) responded to staff routing confirming that it has no 
concerns with the request, as no new ground disturbance is being proposed.

Staff Analysis:

Staff supports the applicant’s request to extend the SUP an additional 25 years. No physical 
modifications are currently proposed to the facility itself. As such, the request would have no new 
impact on surrounding land uses. Furthermore, the WCF provides cellular service for the 
surrounding large-lot residential neighborhood, as well as for traffic along Indian Springs Rd., 
which can reach an extremely high volume during events at the nearby PIR.

Staff notes that, in the original condition ‘a’, the Board stipulated approval upon compliance with 
a site plan dated May 24, 2006, and stamped received June 15, 2006, but that within 30 days of 
Board approval (by September 15, 2006), the applicant would be required to submit a revised site 
plan correcting the SUP area (which the site plan stated as being 0.16 acres, although the actual 
lease area measured 10,000 square feet, or approx. 0.23 acres).The original applicant did submit 
the revised site plan as stipulated, albeit not until July 24, 2007. In the years since, staff has 
approved multiple minor amendments (per cases Z2012113, Z2015064, and Z2016011) and 
additional modifications with building permits. Staff offers modified language to condition ‘a’ that 
acknowledges the revised site plan approved in substantial conformance with the original 
condition and confirms that amendments to the site plan are determined in accordance with 
Chapter 3 of the MCZO. Staff also offers to modify condition ‘b’ to acknowledge the narrative 
report received with this request. Finally, staff offers to delete outdated stipulations whose 
requirements were fulfilled prior to initial construction. 
 
10. 
The modified condition language is summarized below. All other conditions would remain 
unchanged. 
 
a.

Development and use of the site shall comply with requirements for fire hydrant 
placement and other fire protection measures as deemed necessary by the applicable fire 
department. Prior to issuance of zoning clearance, the applicant shall seek review and 
comment from the applicable fire protection agency, and shall provide written confirmation 
that the site will be developed in accordance with their requirements. DELETED.

Prior to zoning clearance, developer(s) and/or builder(s) shall establish emergency fire 
protection services, covering all real property contained within the project area during 
course of construction and shall obtain a ‘will serve’ letter substantiating coverage from

Crown respectfully requests an additional  25-year term for the Special Use 
Permit. 
 
DESCRIPTION OF THE PROPOSAL & PROJECT BACKGROUND 
The existing WCF was originally entitled Z005138 with subsequent Zoning cases 
for antenna modifications, Z2012113, Z2015064, Z2016011 and Status Report 
cases, Z2012112 & Z2018014. 
The existing Special Use Permit expires on August 16, 2026, 20 years from the 
date of approval by the Maricopa County Coard of Supervisors. This request is 
for an additional 25 year term for a total period of 45 years.

The proposed WCF will not provide any Community Services or Facilities; nor will 
the WCF require any Community Services or facilities during its operation.

local service providers.
