The application is intended to unify a mixed zoned parcel of C-2 and Rural-43 entirely to C-2 for a 
future commercial shopping center. The zone change is similar and is planned to be utilized in 
conjunction with Z250044 which received Board of Supervisors’ approval May 6, 2026. 
 
• 
There is no Plan of Development (POD) associated with the development at this time. Utility 
services such as water and sewer service will be identified during the administrative POD process.  
 
• 
Direct access to the site is from Wintersburg Rd. roadway dedication and ultimate improvements 
will be determined during the administrative POD process.  
 
• 
The parcel is within the Tonopah Arlington Area Plan and is designated as a Community Retail 
Center. Proposed C-2 zoning is consistent with the plan.  
 
• 
There are no outstanding concerns from reviewing agencies. There is no known opposition. There 
is one letter of support from a regional interest group who welcomes future commercial uses in 
the area.

Z260003 subject to conditions ‘a’-‘f’: 
 
a. Development of the site shall be in substantial conformance with the zoning exhibit entitled 
“Zoning Exhibit“, consisting of 1 page stamped received February 11, 2026, except as modified 
by the following conditions. Staff may determine slight refinements to remain in substantial 
conformance with the approved site plan.   
 
b. Development of the site shall be in substantial conformance with the narrative report entitled 
“Salome Village Shops“, consisting of 12 pages stamped received March 12, 2026, except as 
modified by the following conditions. Staff may determine slight refinements to remain in 
substantial conformance with the approved site plan. 
 
c. Administrative approval of a Plan of Development will be required prior to approval and issuance of 
construction permits to develop and establish use of the site. Prior to issuance of a building permit, 
written confirmation will be required from the emergency fire protection jurisdiction having authority 
that the facility has been designed in accordance with their regulations and requirements, and that 
emergency fire protection service will be provided to the facility. Prior to issuance of the certificate 
of occupancy, local fire protection jurisdiction review and approval will be required. 
 
d. The following Engineering conditions shall apply: 
1. The site is located within a special flood hazard area and any development must comply with the 
Maricopa County floodplain regulations.  
 
2. A 24-foot paved driveway access off of Wintersburg Road is required to be shown at the Plan of 
development phase.  
 
3. A traffic impact study is required with the Plan of Development.  
 
4. Engineering and drainage review was based on a zone change without a plan of development. 
Therefore, without the submittal of a precise plan of development, no development approval is 
inferred by this review, including, but not limited to number of proposed building lots/units, 
drainage design, access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review and/or 
entitlement.  
 
5. Engineering review of re-zone cases is conceptual in nature. All development and engineering 
design shall be in conformance with Section 905 of the Maricopa County Zoning Ordinance; 
Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices at the time of 
application for construction. 
 
6. The County does not provide fire service, therefore, it is incumbent that the applicant seek service 
and approval of plans from the jurisdictional fire service provider. 
 
e. The property owner/s and their successors waive claim for diminution in value if the County takes 
action to rescind approval due to noncompliance with conditions.  
 
f. The granting of this change in use of the property has been at the request of the applicant, with the 
consent of the landowner.  The granting of this approval allows the property to enjoy uses in excess 
of those permitted by the zoning existing on the date of application, subject to conditions.  In the 
event of the failure to comply with any condition, the property may be considered for revocation to

the zoning that existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, does not reduce any rights that existed 
on the date of application to use, divide, sell or possess the property and that there would be no 
diminution in value of the property from the value it held on the date of application due to such 
revocation of the Zone Change. The Zone Change enhances the value of the property above its value 
as of the date the Zone Change is granted and reverting to the prior zoning results in the same value 
of the property as if the Zone Change had never been granted.

Project Summary: 
 
1. 
The applicant is seeking to rezone an approximately 3.4-acre property from Rural-43 and C-2 to 
C-2 for future commercial uses without a precise plan of development. Currently the parcel is split 
zoned with C-2 fronting Wintersburg Rd. to the east. The C-2 portion was approved  for a now 
defunct travel trailer park which was approved under Z 77-45 on June 20, 1977. The C-2 area runs 
approximately 300’ deep into the parcel from Wintersburg Rd. The parcel is located in a 
designated community retail center land use within the Tonopah Arlington Area Plan.  
 
2. 
The parcel is currently undeveloped with a small wash running east/west though the parcel. 
Arizona State Land Department (ASLD) is located adjacent to the parcel directly to the north with 
single family residential to the west. The parcel is 0.2 miles (1,100’) north of the Wintersburg Rd. 
and Salome Hwy. crossroads.  Both are minor arterials with future expansions respectively 
planned to principal arterial and parkway routes.

There is no Plan of Development (POD) associated with the project at this time. The ownership is 
seeking to work with owners of adjacent commercial parcels for future commercial development. 
Presently there are commercial uses along Wintersburg Rd. Parcels to the south are currently in 
the rezoning process to C-2 under Z250044. A future POD will indicate site access, use and parcel 
design specifics.

Community Retail Center. The 3.4 acres for the subject site would fall within the 100,000 sq. ft. –

permit the subject site’s land use designation.

the public. They were able to meet 4 of the 5 residents to the west of the subject site where only

one resident expressed concerns with the potential impact to drainage and flooding to the area. 
It was explained that future development would be subject to an engineering review and approval 
during the Plan of Development phase.

Staff received one letter of support from a local nonprofit organization in the Tonopah area 
interested in community development. They support the development and welcome additional 
commercial uses in the area and specifically at the location.

Staff is supportive of the rezoning of this parcel to C-2. The current split zoning indicates previous 
intentions of commercial uses on the parcel. The proximity to the major intersection of  
Wintersburg Rd. and Salome Hwy. allows for appropriate commercial development. This is how 
it’s designated under the Tonopah Arlington Area Plan.  There is existing retail use at the 
immediate arterial corner. The area around the arterial intersection is expected to continue 
developing as a community retail node. There is local community support for the commercial 
zoning.    
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z260003 subject to the following conditions ‘a’ – ‘f’:

• Wintersburg Road is classified as an urban principal arterial requiring fee dedication of 
a 65-foot half street from the section line per the Maricopa County Zoning Ordinance 
Section 804.  
o It is the developer's responsibility to determine if the existing right of way is fee 
simple, if it is not then the developer will need to provide the right of way in said 
form.  
o Applicant is required to provide, at applicant’s expense, an American Land Title 
Association (“ALTA”) Owner’s Policy of Title Insurance showing title vested in 
Maricopa County, a political subdivision of the State of Arizona.   
o Dedication shall be completed by time of permit approval or case closeout if no 
MCDOT permit is required.  
• The above comments do not include identification of utilities or underground facilities 
within or adjacent to the required right-of-way that may have prior rights and/or require 
relocation.  
• Any additional dedication and offsite improvement requirements will be determined by 
MCDOT Traffic based on a submitted TIA/TIS and the above roadway classifications.

Onsite Wastewater (Septic) –  
A Notice of Intent to Discharge application for a septic system is required for any 
construction. Application must be submitted to the MCESD Onsite Wastewater Program.

Wastewater is not permitted to discharge to an adjacent parcel’s septic system. 
• 
If conducting food service in unincorporated Maricopa, a grease trap will be 
required by Onsite Wastewater program. 
• 
Setback requirements must be maintained per Arizona Administrative Code, Title 
18, Chapter 9, Article 312, C (Features Requiring Setbacks).

Community Water System (NTNCWS) is defined as a Public Water System that serves the

Support Tonopah Opportunities, Progress, & Preservation (STOPP), Inc. is a non-profit 
organization “committed to protecting the communal and social well being for the Community of 
Tonopah…”  We have reviewed the Notification Letter for the zone change from Rural-43 to C-2 
Commercial to create Martinez Village Shop at the following location:  about 500-feet north of 
Salome Highway and Wintersburg Road. 
 
We support the proposed change and welcome shops and commerce that will provide goods and 
services to the Tonopah community.
