Approve the abandonment of that portion of the Patent Easement Number 
1213046 as proposed by the owner of the property located at 9746 West 
Mariposa Grande, Peoria, Arizona 85383 and being identified as Assessor 
Parcel Number 201-16-039A.
Department Recommendation:
Having received no objection, MCDOT recommends the following: Abandon 
that portion of the easement described in Patent Number 1213046, lying in 
the Southwest quarter of Section 9 – T4N, R1E, of the Gila and Salt River 
Meridian, Maricopa County, Arizona being described as follows: 
COMMENCING: at the West Corner of said Section 09, from which the 
Southwest quarter corner of said Section 09, bears South 00° 03’ 49” East, 
for a distance of 2639 feet; THENCE South 00°03'49" East, for a distance of 
329.07 feet; THENCE North 89°32'40" East, for a distance of 664.77 feet to 
the Point of Beginning; THENCE North 89°32'58" East, for a distance of 
33.00 feet; THENCE South 00°03'49" East, for a distance of 305.08 feet; 
THENCE North 89°32'56" East, for a distance of 114.13 feet; THENCE South 
00°27'04" East, for a distance of 3.59 feet; THENCE South 89°04'24" West, 
for a distance of 147.02 feet; THENCE North 00°27'04" West, for a distance 
of 4.81 feet; THENCE North 00°05'07" West, for a distance of 305.07 feet to 
the Point of Beginning. The above described parcel contains 10,667 square 
feet or 0.2449 acres, more or less, and is depicted on attached Exhibit "B".

Support/Opposition: 
Request for comment has been circulated to all affected parties pursuant to 
County Ordinance P-34, Section 2d. An Initial Determination was circulated 
for review in March 2025, and results sent to the applicant in April 2025. The 
Application was circulated for review in December 2025. MCDOT has 
received no objections.
Discussion:
Laws 2013, Chapter 46 amended Arizona Revised Statutes, Section 11-
251.16 to allow a county, at the request of a property owner, to abandon a 
federal patent easement established by the Small Tract Act of 1938.  On May 
7, 2014, the Maricopa County Board of Supervisors (BOS) approved 
Ordinance No. P-34, adopting procedures for the abandonment of Federal 
Patent Easements. The Maricopa County Department of Transportation 
(MCDOT) has considered and processed this request for abandonment in 
strict accordance with A.R.S. Section 11-251.16 and Ordinance No. P-34.
