NOTICE OF INTENT TO TERMINATE INTERGOVERNMENTAL AGREEMENT BETWEEN THE 
DEPARTMENT OF THE ARMY AND THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY 
FOR THE TRILBY WASH, MARICOPA COUNTY FEASIBILITY STUDY 
WHEREAS, The Flood Control District of Maricopa County and the Department of the Army 
entered into an Intergovernmental Agreement for the Trilby Wash, Maricopa Count 
Feasibility Study dated  September 22, 2004 (“2004 IGA”); 
WHEREAS, the 2004 IGA was amended by Amendment FCD 2004A013A dated March 10, 
2005; 
WHEREAS, notwithstanding the efforts of the Parties, the Trilby Wash, Maricopa County 
Feasibility Study has not been completed; 
WHEREAS, the Parties to the 2004 IGA intend to enter into a new agreement which sets 
forth the understandings, rights and responsibilities of the Parties related to the Trilby Wash 
Feasibility Study: 
THEREFORE, pursuant to Article X, paragraph A of the 2004 IGA, as amended by 
Amendment FCD 2004A013A dated March 10, 2005, the Flood Control District of Maricopa 
County hereby gives notice of its intent to terminate the Intergovernmental Agreement 
Between the Department of the Army and the Flood Control District of Maricopa County for 
the Trilby Wash, Maricopa County Feasibility Study.
