AMENDMENT TO PURCHASE CONTRACT DATED SEPTEMBER 11, 2024, BETWEEN MARICOPA COUNTY AND ANTHEM COMMUNITY COUNCIL, INC. Page 1 of 2 This Amendment to a certain purchase contract dated September 11, 2024, by and between Maricopa County, a political subdivision of the State of Arizona as Grantee and Anthem Community Council, Inc., an Arizona non-profit corporation, as Grantor (herein the “Contract”), is made on November 22, 2025. Whereas, Grantee and Grantor entered into the Contract in connection with a certain project of the Maricopa County Department of Transportation, TT0551, known as Skunk Creek Crossings at Desert Hills Drive and Whereas, the Contract concerned the purchase of APN 211-86-971; and Whereas, the purchase price in the Contract was $4,931.00; and Whereas, the Maricopa County Board of Supervisors authorized its Chairman to execute the Contract at public hearing on September 11, 2024; and Whereas, the APN 211-86-971 was subject to a restrictive covenant required by the United States Army Corps of Engineer (USACE) as Natural Area Open Space (NAOS); and Whereas, it is necessary for Grantor to place a NAOS restrictive covenant on another parcel to mitigate the loss of NAOS on APN 211-86-971, the parcel being acquired in connection with TT0551; and Whereas, the parcel to be restricted by a recorded NAOS is APN 203-40-981; and Whereas, Grantee and Grantor desire to adjust the purchase price under the Contract to compensate for the requirement of the USACE. NOW THEREFORE, for the mutual promises made herein and other good and valuable consideration, the Grantee and Grantor agree as follows: 1. The recitals are incorporated herein as if fully set forth. 2. The purchase price under the Contract shall be increased from $4,931.00 to $10,512.11. 3. No money shall be paid to Grantor until the required NAOS has been duly recorded against APN 203-40-981. 4. In all other respects, all terms and conditions of the Contract are ratified and shall remain in full force and effect unless altered by the Amendment. 5.
