Project Summary: 
 
1. 
The applicant is requesting a Special Use Permit (SUP) for a 6-bay storage structure to be used 
as an interim industrial use for indoor personal and industrial storage. The parcel is approximately 
1.1 acres in size, zoned Rural-43 and has been developed and utilized as a single-family 
residential home since approximately 1997. The proposal is to allow for the existing building to 
be utilized for storage uses only. The building is 50’ X 125’, approximately 6,250 square feet in 
size with four 931 sq. ft. and two 1,088 sq. ft. bays, approximately 18% lot coverage. Chain-link 
fencing is proposed to secure the site. There will be a keyed gate allowing customer access daily 
from 6am to 8pm. The site is proposed to be surfaced with granite for dust control. There is no 
planned office or on-site staff.

The current owner acquired the property on December 24, 2024. Residential building permit 
application BLDR2500662 was submitted for the six-bay garage on January 24, 2025. Violation 
V2501231 for the commercial storage operation without proper zoning entitlement was issued 
on August 25, 2025 as a social media post indicated that available rental spaces in the subject 
building was identified to the County code compliance staff. The residential accessory building 
permit was finalized on September 2, 2025 and the violation was subsequently closed on 
September 17, 2025 wit the removal of the commercial storage offering.

Public Participation Summary:

The applicant has met and complied with all required public participation requirements as 
required by Maricopa County. The site was posted in two locations on February 2, 2026 with 
hearing dates updated on May 13, 2026. Notice of application letters were sent to all parcel 
owners within 300’ and to all registered area of interest members.  Staff has received two inquiries 
into the SUP application who expressed concern and were against the proposal. Neither inquiry 
has provided public comment on the matter.

Staff Analysis:

Staff supports the proposed use of an existing six-bay garage to be used for personal and 
industrial storage on an interim basis. Staff notes the owner will need to apply for a commercial 
construction permit for occupancy of the residentially permitted building for commercial use.  
 
11. 
The proposed use is complicated to entitle.  The property owner does not reside on site and thus 
the facility cannot be entitled as a cottage industry SUP for a home-based business.  A 
commercial storage operation is not an SUP category and would require Commercial zoning. 
Staff considers the site, mid-block on a local street surrounded by large-lot residential, to be 
inappropriate for Commercial zoning.  An interim industrial use SUP may be permitted in Rural 
zoning for a limited period.  Industrial storage is an interim industrial use. Staff recognizes the 
actual storage may also include bays leased for personal storage in addition to or rather than 
industrial storage.

The  six-bay storage operation should have minimal impact on the surrounding residences and 
generate very minor traffic. All storage will occur indoors. Staff does wish to ensure the proposed 
use won’t harm the neighborhood’s rural residential character. Staff recommends a five-year SUP 
timeframe so that the applicant can prove the indoor storage use to be  a good neighbor.  After 
the five years the SUP may be re-evaluated to decide if the use should be extended or terminated.  
 
Recommendation: 
 
13. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve SU260005 subject to the following conditions ‘a’ – ‘h’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Public Storage Building“, consisting of 2 full-size sheets, dated April 8, 2026, except as 
modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Project Narrative Special Use Permit, Public Storage Building”, consisting of 2 
pages, dated April 8 2026, except as modified by the following conditions. 
 
c. 
This special use permit is valid for a period of five Years and shall expire on July 15, 2031, 
or upon termination of the use for a period of 90 or more days, whichever occurs first. All

site improvements associated with the special use permit shall be removed within 90 days 
of such expiration or termination of use.   
 
d. 
The facility shall be open only from 6am to 8pm daily. The Special Use Permit approval is 
limited to indoor storage uses only. The indoor spaces are not to be utilized for repair, 
manufacturing, habitability or any public occupancy uses. Outdoor storage is not 
permitted on the parcel outside of uses associated with the single-family residence use.  
 
e. 
The owner shall apply and obtain issuance of a building permit for the storage building 
due to the change to a commercial use prior to operation of the business.  
 
f. 
The following engineering conditions shall apply:  
1. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 905 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction.  
2. If new development is proposed, detailed Grading and Drainage (Site 
Infrastructure) Plans must be submitted with the application for Building 
Permits. 
 
g. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
h. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation  
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted.

Purpose of Request + Description of Proposal 
This submittal is for a special use permit with no time limit for the full property that includes several buildings.  
The primary need for the special use permit is for recently constructed residential accessory storage building 
that needs to be considered for use as a commercial public storage building.  The owner has been thru the 
process of a pre application review meeting under the reference of PA250167.   
 
The owner of the property is Daniel Shreeve of Green Island Investments, LLC.  The storage building was 
previously permitted, constructed and received inspection approval.  The owner then decided to convert the 
structure to six individual storage units.  Enclosed documents show a vicinity map, aerial site view and site 
plan.  Additional upgrades to the building will include demising partitions between the storage units for security 
and a two-hour rated fire wall at the south exterior wall where the building is withing five feet of the property 
line.  A fire sprinkler system will be provided to the structure due to the commercial status.  The system will 
be a deferred submittal to the county and will also be submitted to the local fire department for approval. 
 
The facility is expected to be available to the public daily 6am to 8pm.  There is no official office for the storage 
building, renters will have key access to the individual storage units.  The building has been constructed with 
white exterior metal panels and black trim.  No signage is provided at this time.   
 
Relationship to Surrounding Properties 
The adjacent properties are all of similar zoning RU-43 on large lots.  Several locations have small businesses 
active on their properties.  Photos of this project site and adjacent properties are provided in the enclosed 
documents.   
 
Location and Accessibility + Circulation System 
The existing property is zoned RU-43, rural residential with a minimum of 43,560 sf.  The property is 47,916 
sf in coverage and is located north of East Mews Road accessed via South 197th Street to the north.  South 
197th Street is a compacted dirt road providing access to the project site, to the property south of the project 
site and then continues north via an access easement to the land locked residential property to the north.  
The fenced in property contains a rental residence building of 1,074 sf, attached porch 512 sf and a detached 
garage of approximately 1,200 sf.  The newly constructed storage building of approximately 6,250 sf is placed 
to the far west end of the property and separated from the east side residential area by a fence and access 
gate.  The owner does not reside on the property and uses the residence as a rental property.      
 
Development Schedule 
Since the building has already been constructed, the intent is to get the commercial permit in place so the 
owner may begin to provide storage for the surrounding community in a timely manner.  
 
Public Utilities and Services 
The site is served by public water service, septic is an on-site septic system.  The property is served by the 
Maricopa County Sherrif and fire support services are provided by the Town of Queen Creek,  
Queen Creek County Island Fire District.  Commercial will serve letter to be provided.
