Project Summary: 
 
1. 
The request is for a Military Compatibility Permit (MCP) for the first phase of development of an 
outdoor RV, boat and mini-storage facility at the approximate south (rear) 15 acres of the 19-acre 
property. The site is within the high noise accident potential zone and the 65-69 LDN noise 
contour, requiring a Use Compatibility and Consistency Determination and an MCP. The site is 
also located within the ‘employment / industrial’ land use category of the City of Surprise General 
Plan. Both the county & city’s designation precludes new residential development. 
 
2. 
The applicant received an affirmative determination of the proposed use from Luke AFB under 
UCCD case number UC2023004 on February 15, 2023. A second UCCD was filed for the second 
phase of development for the north 4 acres for future commercial development and Luke 
responded in the affirmative on May 31, 2023 on UC2023020. Once a commercial user expresses 
interest in developing the northern 4 acres, a separate UCCD & MCP will be submitted. 
 
3. 
Site development includes a 6’ perimeter screening, covered canopy parking for RVs & boats, a 
modular office building overlooking the entrance, a wash bay and RV dump, and areas of secured 
mini storage. Eventually, the site will be operated remotely without the need for on-site staff. For 
now, an on-site modular office for one employee occupant will monitor site usage and check in 
customers. Access to the site will be provided at the northern end of the parcel at Patton Rd. with 
360’ of paved driveway crossing over the existing drainage wash to a secure entrance gate. The 
primary driveways will be paved and areas used for outdoor RV & boat storage will utilize milled 
asphalt with decomposed granite. Secondary emergency access is proposed near the southwest 
corner of the property where Blue Sky Drive, a private easement, terminates at the western 
property line. Along the west side of the property, off set to the west is a 25’ wide roadway 
easement that extends south from White Feather Ln. to the southern property line. Dedication is 
provided for an additional 50’ roadway easement for 229th Ave., finished with milled asphalt for 
the benefit of emergency vehicle access and neighborhood circulation for the adjacent 
neighborhood. Perimeter security lighting will be shielded and oriented towards the center of the 
property to prevent light trespass on adjacent properties. Further, landscape buffers along that 
west and east sides are proposed to mitigate visual impacts and any light trespass towards 
established residential communities adjacent to the west and east of this property. The RV dump 
station vault will be serviced by a vendor and is not connected to any septic system. The modular 
office will be connected to a septic system exclusively for the modular office. Future commercial 
retail at the remaining northern 5 acres will be subject to separate applications and is not for 
consideration with this subject application. A total of 284 parking spaces are proposed to 
accommodate various vehicle and watercraft sizes: 112 50’ x 12’ sized parking spaces, 88 30’ x 
12’ parking spaces, and 4 25’ x 11’ parking spaces. Five standard vehicle parking spaces are 
proposed nearest the modular office, with 1 designated ADA accessible.

The applicant proposes the following RU-43 MAAMF MCP development standards in bold on the 
next page. Building setbacks are reduced for the entire perimeter of the site from 40’ to 20’ feet 
measured from ultimate street lines. Under RU-43 zoning, greater setbacks would apply to rural 
low density development. Considering the prohibitions on any new residential development within 
the MAAMF zone and Planning policies designating the site for employment or industrial uses as 
well as the additional section line setbacks for Patton Rd further reducing developable portions 
of the site, the reduced setbacks are justified.

It is not known whether infrastructure for utilities are available. The applicant intends to use a 
private on-site well and on-site septic system to service the administrative office. The RV dump 
station vault will be serviced by a contractor. At the northern 33’ of the parcel are three existing 
power poles part of a transmission corridor of 69KvA. The site has been designed to 
accommodate emergency vehicle access at the west side of the property.

Adequate right-of-way infrastructure is available based upon the intensity of the site. Due to the 
low traffic generated by this use, regional-level infrastructure improvements are not needed to 
accommodate the site’s 1st phase development.

Maricopa County Framework 2040 (adopted May 20, 2026): The subject site is within the White 
Tank Grand Avenue Area Plan under the Military Compatible designation. Luke AFB has provided 
a determination the proposed use is consistent and compatible with their military airbase 
operation and statutory requirements per UC2023004. The proposed use is therefore in concert 
with the county’s plan.  
 
City of Surprise General Plan 2040 (adopted 12/19/2023) The subject site is within the City of 
Surprise Municipal Planning Area and is designated as Employment.  
 
The property is within the area of Municipal Influence. The existing zoning, Rural-43 MAAMF, is 
considered a rural land use designation, however, no new residential uses are allowed within the 
MAAMF area. As such, the land use designation under the County’s area plan is for urban land 
uses as part of the Urban Growth Area. The applicant has not provided assurances by the Arizona 
Department of Water Resources that the on-site well will accommodate the first phase of 
development. The City of Surprise, the closest boundary of which is approximately 2,700 feet to 
the west, did not provide comment on this case. Staff is unaware if the city will annex this 
property. Both general plan policies call for urban development; however, infrastructure remains 
sparse in this area, and more suitable for rural development.  Having said this, the proposed use 
is in concert with the county’s plan.

Public Participation Summary:

After initial notification of the case, three residents adjacent to the west expressed concerns 
about traffic, noise, lighting, the attraction of transient populations, ground water impacts to 
adjacent neighborhood wells, and the oversaturation of similar uses in the area and a lack of need 
for this type of commercial use due to the established development pattern in the area of 1 acre 
lots with space to store RVs and boats. After notifying the applicant of the opposition, a virtual 
neighborhood meeting was conducted on July 2, 2025, at 6:00 pm. At the meeting, the applicant 
explained the UCCD process for the application and emailed attendees updated site plans. The 
applicant also indicated that the proposal would mitigate visual and lighting impacts by providing 
landscaping along the western perimeter of the site. Staff notes that the 25’ emergency ingress 
easement will serve as an improvement for the benefit of neighborhood circulation with all driving 
surfaces to be dust proofed. Staff did not receive any further opposition from the public about 
this case. The applicant followed all public participation requirements.

The proposed use is a compatible use as affirmed by Luke AFB and as required by the White Tank 
Grand Avenue Area Plan and Surprise General Plan. This initial phase of development is not a land 
use that would require typical commercial water usage as only one office is being proposed. It 
can be accommodated with the onsite well and septic system. Eventually the storage yard will be 
unmanned further negating the need for infrastructure improvements specific to this use. Minimal 
opposition was received at the time of application submittal and seems to have been addressed 
by the applicant after hosting a neighborhood meeting. No additional or recent opposition has 
been received. 
 
Recommendation: 
 
12. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve MCP250004 subject to the following conditions ‘a’ – ‘l’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Stellar on Patton“, consisting of 1 full-size sheet, dated October 13, 2025, and stamped 
received May 29,2026 except as modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Stellar on Patton Military Compatibility Permit MCP250004”, consisting of 29 
pages, dated October 30, 2025, and stamped received December 9, 2025, except as 
modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply:  
1. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.

2. 
Based on the conceptual design nature of the information submitted, changes to 
the site layout and/or a reduction in the number of building lots may be 
necessitated by the final engineering design of the subdivision drainage 
infrastructure. 
3. 
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with 
the application for Building Permits. 
4. 
All disturbed or developed portions of the entire site shall be retained onsite. 
5. 
Retention basins must drain within 36 hours 
6. 
All historic flows exiting the site shall exit after development in the same location 
and manner in which they exited before, or with less flow depth, quantity, or 
velocity than before. 
7. 
Gated access(es) must provide an adequate turnaround area so that vehicles will 
not back onto public roads. 
8. 
Given the site’s proximity or access to future White Tanks Freeway, the applicant 
shall inquire of any concerns with ADOT via their red-letter process (email 
redletter@azdot.gov ) 
9. 
Driveway access to County roads (Patton Road) must be paved and will require a 
permit from MCDOT issued concurrent with building permit(s) required for site 
development. Drainage flow along the roadway must be maintained. 
10. 
All adjacent roadway improvements required by MCDOT in the Traffic Study 
approval shall be permitted with building permits and in accordance with the 
current RDM standards. 
 
d. 
The following Maricopa County Environmental Services Department (MCESD) conditions 
shall apply:  
1. 
A Notice of Intent to Discharge application for a septic system is required for any 
construction. Application must be submitted to the MCESD Onsite Wastewater 
Program. 
2. 
Wastewater is not permitted to discharge to an adjacent parcel’s septic system. 
3. 
If conducting food service in unincorporated Maricopa, a grease trap will be 
required by Onsite Wastewater program. 
4. 
Setback requirements must be maintained per Arizona Administrative Code, Title 
18, Chapter 9, Article 312, C (Features Requiring Setbacks). 
5. 
Dependent/independent recreational vehicles cannot discharge wastewater to any 
septic system(s). A dump station/holding tank will be required for any onsite 
recreational vehicle wastewater dumping under a 4.14 General Permit: Sewage 
Vault. 
6. 
Per the Safe Drinking Water Act, any water system that supplies more than 25 
people or 15 service connections per day for at least 60 days per year is classified 
as a Public Water System (PWS). If the above criteria are met, a Public Water 
System application and a New Source Approval application are required and must 
be submitted to the MCESD’s Drinking Water Program. A water quality analysis 
report will be required with submittal and is good within one-year of testing. 
7. 
An Approval to Construct application is required to be submitted to the MCESD’s 
Treatment Program for all PWS water treatment facilities. • For questions, please

wastewater system infrastructure.

A Water Service Agreement signed by the Utility is required and must be submitted 
to MCESD’s Subdivision & Infrastructure Program if the site/development will be 
provided with water and/or reclaimed water by a Utility. A Capacity Assurance 
Form issued by the Utility is required to MCESD’s Subdivision & Infrastructure 
Program if the site/development wastewater service is being provided by a Utility.

All buildings subject to noise attenuation as per ARS § 28-8482(B).  
 
f. 
The master developer shall notify future owners, tenants and lessees that they are 
located within the state-defined “territory in the vicinity of a military airport” with the 
following language: 
 
 
“You are buying or leasing property in the ‘vicinity of a military airport’ as described by 
State of Arizona statute ARS §28-8481. Your office should include sound attenuation 
measures as directed by State law. You will be subject to direct over flights and noise by 
Luke Air Force Base jet aircraft in the vicinity. 
 
 
Luke Air Force Base executes over 200,000 flight operations per year, at an average of 
approximately 170 overflights per day. Although Luke's primary flight paths are located 
within 20 miles from the base, jet noise will be apparent throughout the area as aircraft 
transient to and from the Barry M. Goldwater Gunnery Range and other flight training 
areas. 
 
 
Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast. Noise will be more noticeable during overcast 
sky conditions due to noise reflections off the clouds. 
 
 
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours 
and during most weekends. 
 
 
Such notification shall be recorded on all Grading & Drainage (Site Infrastructure) Plans 
submitted with the application for Building Permits, be permanently posted on not less 
than a 3 foot by 5 foot sign in front of all offices, be permanently posted on the front door 
of all offices on not less than an 8½ inch by 11 inch sign, and be included in all covenants, 
conditions, and restrictions (CC&Rs) as well as the Public Report and conveyance 
documents. 
 
 
Luke Air Force Base Auxiliary Field 1, located approximately 15 miles to the northwest of 
Luke Air Force Base is a site of intense instrument procedure landing approaches, with 
approximately 12,000 flight operations per year. Aircraft will descend down to 200 feet 
above the ground over the Auxiliary Airfield and will create severe noise in that area.

The following Rural-43 MAAMF MCP standards shall apply:

5. Minimum Paving: Paved & Stabilized Milled Asphalt & Decomposed Granite or dust

6. Minimum perimeter screening: A minimum 6’ solid wall is required adjacent to Rural 
or Residential zoning or any alley. Commercial outdoor uses shall be enclosed to a 
height of not less than 6’ with walls, fences of view obstructing material. Access gate 
in said solid wall shall be constructed of view-obscuring material 
 
h. 
The Rural-43 MAAMF MCP overlay is applied to restrict the use of the site. Until such time 
as the site is served by sewer, uses on the site shall only be those acceptable to the 
Maricopa County Environmental Services Department (MCESD) that can be 
accommodated by septic systems. A public water system and public sewer system shall 
be required prior to establishment of any non-residential use that requires potable water.  
 
i. 
A use consistency and compatibility determination will be required prior to any new use 
or change in land use. 
 
j. 
At the time of building permit submittal, the applicant shall submit to the Maricopa County 
Planning and Development Department confirmation of service by Arizona Department of 
Water Resources that the on-site well is adequate to serve the commercial development. 
 
k. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
l. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for revocation to the zoning that existed on the date of application.  It 
is, therefore, stipulated and agreed that either revocation due to the failure to comply with 
any conditions, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation of the 
MCP. The MCP enhances the value of the property above its value as of the date the MCP 
is granted and reverting to the prior zoning results in the same value of the property as if 
the MCP had never been granted.

Purpose of Request 
On behalf of Stellar Capital Investments LLC (property owner/developer), Gilmore 
Planning & Landscape Architecture (Applicant) respectfully submits for consideration this 
application for a Military Compatible Permit (MCP) for a Boat & RV Storage facility with 
mini-storage uses.  The property ownership includes 19.5 acres situated at the southeast 
corner of W. Patton Road and the 229th Avenue alignment in the unincorporated area of 
Maricopa County.  After the dedication of an additional 32’ of ROW for W Patton Road, the 
net developable area will be 19.0 acres.  Please refer to Exhibit 1 – Regional Vicinity Map 
and Exhibit 2 – Aerial Location Map for the location of this subject property.  The County 
Assessor identifies this single parcel as: 503-33-017E.  This property is located 
approximately 1.3 miles northwest of Luke AFB’s Auxiliary Field #1 and is within their 65-
69LDN noise contour.   
This property is also situated within the planning area of the White Tank / Grand Avenue 
Area Plan that was recently updated and adopted by the Board of Supervisors in 
December 2023.  The County’s interactive PlanNet Map – Exhibit 3, indicates that the 
subject property is within a regional area designated as ‘Military Compatibility’, which 
requires this MCP approval.  The planning area for the Surprise General Plan 2035 also 
includes this regional area and designates the subject property as ‘Employment’.  Please 
refer to an enlarged portion of the Surprise General Plan Land Use Map, Exhibit 4, that 
locates the subject property and the 65-69LDN noise contour.  Both the County and 
Surprise’s designation of the 65-69LDN noise contour precludes any consideration for a 
new residential land use.   
 
3. 
UCCD Determination 
Because this property is within the Luke AFB Aux-1 2004 JLUS 65 DNL, “high noise or 
accident potential zone” as defined by A.R.S. § 28-8461, a separate application was 
required for a Use Compatibility and Consistency Determination (UCCD).  The first UCCD 
requested Luke’s support for a “RV, Boat, and Self-Storage project on 19.5 Acres.  Luke 
AFB formally approved UCCD Case No UC2022004 on February 15, 2023 (refer to 
Exhibit 5A).  That initial request did not include the proposed commercial retail and 
service commercial uses on the north 4 acres.  A second UCCD was filed for the 
commercial use, and Luke AFB issued their support for UC2023020 on May 31, 2023 
(refer to Exhibit 5B).  When specific commercial users establish their interest to develop, 
a separate UCCD application will be processed prior to filing a POD for those proposed 
commercial uses to confirm that they will not conflict with their flight operations.  
Considering other recent UC Determinations, the following qualifications have been 
included within this MCP. 
a) Steam, dust and smoke.  These proposed uses will not generate steam, dust, or 
smoke that could impact Luke’s flight operation.  The Boat & RV Storage use will be 
developed for short and long-term rental spaces, some of which will be covered with

structural canopies.  The commercial frontage is expected to promote compatible 
commercial services for the recreational vehicles, as well as other retail uses that 
would be of interest to surrounding residential uses and the traffic along W Patton 
Road.   
b) Direct or indirect reflective light emissions:  There are no anticipated activities that 
should cause any light emissions.  These uses may elect to utilize motion activated 
security lighting, which will be downlit with shields to direct security lighting towards 
the interior of property.  
c)  Electrical emissions that would interfere with aircraft and air force communications or 
navigational aid systems or aircraft navigational equipment.  Neither the Boat & RV 
Storage or the future commercial retail will create or omit any communications or 
electrical signals that would interfere with instrument landing systems, tactical air 
navigation systems or other avionics or weapons systems on the airframe. 
d) The attraction of birds or waterfowl such as operations of sanitary landfills or 
maintenance of feeding stations. There will be no open water ponds that might 
attract water fowl.   
In coordination with Maricopa County Planning and Development, the Project Team will 
include Luke AFB in the review of POD documents to establish the appropriate mitigation 
of these listed concerns.  The Owner will also include signage and/or notifications as 
required that identifies this project location as being within an area subject to Luke AFB 
flight operations. 
4. 
Description of Proposal 
The Owner is seeking to develop the entire parcel under a phased program that will start 
with the Boat and RV Storage and mini-storage units on the southern portion of the 
property.  This initial development is situated south of the existing drainage wash that 
crosses diagonally through the site.  The southern area includes approximately 15 acres.  
Please refer to Exhibit 6 - ALTA Survey and Exhibit 7 – Preliminary Site Plan that locates 
this existing wash and the first phase of site development.  The area north of the wash to 
W Patton Road includes approximately 4 acres, which will be retained for future 
commercial retail and subject to a future UCCD and POD Application.  A main entrance 
drive off W Patton Road will be located near the center of the frontage and will extend 
south through the future commercial area providing primary access to the Boat & RV 
Storage use.   
Boat & RV Storage:  The 15 acres for the Boat & RV Storage may be further divided into 
two phases, beginning with the north half.  Depending on the market response, the south 
half will develop as capacity dictates.  In addition to the Boat & RV Storage, an area has 
been set aside for mini-storage.  This first Phase and will include a 6’ perimeter screen 
wall, covered canopy parking for the majority of the Boat & RV Storage spaces, a small 
modular office, wash bay, RV Dump, and an area for secured mini-storage units.

The expansion of urban development along the Grand Ave / US 60 Highway to 
Wickenburg as well as the proximity to the Loop 303 has created a demand for this 
commercial use.  These storage facilities typically generate a lower volume of traffic 
without AM or PM peak hour congestion events.  Access to this facility will be directed 
south from W Patton Road approximately 360’ to a piped crossing over an existing 
drainage wash to a secured entrance gate.  A modular office (10’ x 20’) will serve as the 
administrative office and check-in to monitor user/guest access.  The office is located 
where there is direct visibility to the entrance gate, the Wash Bay, and RV Dump.  The 
long-term plan is to manage the guest traffic and on-site activities by a remote system that 
monitors the access gate, along with security lighting and cameras strategically located 
around the entire Boat and RV Storage area.   
The primary drives will be paved and areas used for parking/storing boats and RVs may 
utilize milled asphalt with decomposed granite as the finish surface.  There will be 
perimeter security lighting that will be directed towards the center of the property with 
reflectors to reduce light spillage off-site.  The perimeter of the Boat and RV facility will be 
defined by a minimum 6’ screen wall.  A landscape buffer will be installed along the west 
and east sides using low water non deciduous trees and shrubs to mitigate views from the 
existing residents, and to the help contain the security lighting within the property.   
The RV Dump station will install an underground storage tank that will be serviced by a 
vendor who will remove the effluent waste for proper disposal.  This dump station will be 
separate from the septic system.  The restroom within the modular office and the wash 
bay will be serviced by a septic system.   
Future Commercial Retail:  The Owner anticipates that the development of the Boat & RV 
Storage facility will generate interest for various types of supporting commercial uses on 
the northern 4 acres.  Any proposed commercial development will be will be subject to 
future UCCD Approval, a Major MCP Amendment, and Plan of Development applications.

4.2 Requested Deviations and Justifications 
Building Setbacks – The building setbacks under the RU-43 zoning establishes greater 
front yard setbacks for rural low density residential development.  Considering the 
restriction on any new residential projects, the MAAMF overlay, Luke AFB noise contour, 
General Plan designation for employment, and the section line arterial frontage, these 
conditions all work together to support this non-residential use.  The street side setback 
for the RU-43 is 20’, which reflects the same MCP building setback for 229th Ave.  The 
installation of the 6’ screen wall and the landscape buffer can effectively screen the 
existing surrounding land uses.  
5. 
Existing & Proposed Zoning 
The existing zoning on-site is RU-43 MAAMF.  The Military Airport and Ancillary Military 
Facilities (MAAMF) Overlay Zoning District corresponds with the High Noise and Accident 
Potential Zone (HNAPZ) surrounding LUKE AFB Auxiliary Field #1.  The proposed zoning 
will be RU-43 MAAMF Military Compatibility Permit (MCP) specific for the uses approved 
under the UCCD and proposed in this narrative report.  The MAAMF overlay zoning district 
prohibits the development of new residential uses, but nonresidential uses may be 
permitted subject to review of a UCCD and determination of compatibility by Luke AFB, 
followed by the Board of Supervisors approval of an MCP application.

6. 
Relationship With Surrounding Land Uses 
The 65-69 LDN noise contour covers an extensive area surrounding the subject property.  
The existing homes around the subject property have been grandfathered as existing non-
conforming.   
North:  The north side of the subject property is defined by W. Patton Road, a major 
arterial.  North of Patton Road is the Peak View Ranch Unit 1 subdivision, an existing 
single-family neighborhood comprised of one-acre minimum lots all zoned RU-43 MAAMF 
and within the 65-69 LDN noise contour.  
East:  The east side can be divided by the adjacent north half and south half.  The north 
half has three single family lots that back onto the subject property from N. 227th Dr, all 
zone RU-43 MAAMF.  The south half is one 10-acre parcel that is vacant and also zoned 
RU-43 MAAMF.  The entire east side is within the 65-69 LDN noise contour.   
South:  Immediately south is a vacant 40-acre parcel zoned RU-43 MAAMF.  
Approximately 760’ south is the general alignment for the 70-74 DNL noise contour.  The 
entire south side and beyond is within the 65-69 LDN noise contour.  
West:  The land area immediately west is comprised of single-family homes on one acre 
plus lots all zoned RU-43 MAAMF.  There is no recorded plat.  Access to these homes is 
directed to either 230th or 231st Avenues off W Patton Road. The residential lots that have 
side yards sharing the property line with the subject property are accessible from either W. 
White Feather Ln or W. Blue Sky Dr., which terminate at the common property line.  The 
County Assessor Maps do not indicate any existing ROW for these roads.  There is an 
existing 25’ roadway easement along the west side of the west property line that extends 
from W. White Feather Ln south to the south property line.  Please refer the attached 
Exhibit 4 - ALTA Survey for the location of this easement.   
Stellar on Patton considered a number of locations prior to deciding on this site.  Some of 
the features that helped to finally select this location include:

The presence of Luke AFB’s 65LDN, would not restrict their storage uses.   
• 
The extensive area surrounding this project site that is also impacted by the same 
65LDN noise contour, which will restrict any new residential development.  
• 
The location along the W Patton Road, a section line arterial, supports higher 
volumes of traffic, and eliminates the potential conflict of allowing this commercial 
traffic from using adjacent residential streets.  W Patton Road extends directly east 
to US60/Grand Ave, which connects with the surrounding regional highway and 
arterial network.  
• 
The Surprise General Plan 2035 designates the subject property and the adjacent 
properties as Employment, promoting other similar employment-oriented uses.

Almost half of the adjoining properties are vacant, and can only develop with non- 
residential uses.  
It is the combination of these existing site conditions that facilitated the decision to select 
this location. 
7. 
Area and General Plan Conformance 
This property is within the White Tank / Grand Avenue Area Plan that was adopted in 
December 2023.  The County’s interactive PlanNet indicates that the subject property is 
within a regional area designated as ‘Military Compatibility’, which requires this MCP 
application.  The planning area for the Surprise General Plan also includes this regional 
area and designates the subject property as ‘Employment’, which restricts residential and 
supports these proposed land uses.  Both planning documents indicate the future 
alignment of the White Tanks Freeway situated south of this project site.   
In 1991, Maricopa County approved the Wickenburg Highway Scenic Corridor Plan that 
includes a 34-mile area of US60.  The planning boundary extends 2-miles outward from 
both sides of the highway.  The subject property is situated 3 miles southwest of US60 and 
outside the designated Scenic Corridor.   
8. 
Location and Accessibility 
W Patton Road is a section line arterial providing the primary access to the property.  The 
current south half ROW is 33’.  MCDOT is requiring an additional 32’ to match the north 
half ROW of 65’.  The existing W Patton Rd is a two-lane paved road with no off-sites.  
The traffic study prepared for this application does not call for any additional offsites 
except for the westbound left turning bay and a paved drive into the property.  The Owner 
intends to dedicate the additional 32’ along W Patton Road, with the understanding that 
additional off-sites may be deferred.   
At the 33’ ROW/property line are three existing power poles that are part of a major 
powerline transmission corridor that appears to be 69KVA or larger.  This powerline 
corridor extends for many miles in both directions along W Patton Road.  There are no 
conflicts along the north side of W Patton Road that should impact the location of the 
proposed entrance drive for this subject property.  The closest intersection is N. 227th Dr 
located approximately 290’ east of the subject property, and N. 230th Ave is located 
approximately 645’ to the west.  N 227th Ave is another section line road that is situated 
660 east of the subject property.  Please refer to Exhibit 6 ALTA Survey that illustrates the 
existing Patton Road improvements, power poles, and relevant site features.  Secondary 
emergency access will be included in the initial phase with an internal drive that will be 
located at the intersection of W Blue Sky Dr and 229th Ave, which is illustrated on the 
Preliminary Site Plan - Exhibit 7.

The Maricopa Association of Governments (MAG) has prepared the I-10 / Hassayampa 
Valley Transportation Framework Study that illustrates the proposed White Tank Freeway 
with an east/west alignment situated south of this subject property.  The Study indicates 
that there could be a future interchange near the intersection of 227th Ave and Patton 
Road.  This is a long-range plan and the timing is uncertain at best.   
9. 
On-Site Circulation:   
The first phase of development will be the Boat and RV Storage on the southern portion of 
the property.  There is one proposed access drive from W Patton Road near the center of 
the frontage.  This private drive will extend approximately 400’ south to an automated 
access gate with a card reader for users to enter and exit the facility.  Internal circulation 
will be paved along high traffic volume lanes.  Secondary drives and parking spaces will 
be dustproofed using both milled asphalt and decomposed granite.  A geo-tech 
specification will be included to qualify the subgrade, base course, and surface finish for 
areas that must withstand firetruck circulation.  
Secondary emergency access is proposed near the southwest corner where Sky Blue Dr 
terminates at the west property line, as illustrated on the Preliminary Site Plan.  Along the 
west side of the west property line (off-site) is a 25’ wide roadway easement that extends 
south from White Feather Ln to the south property line.  This MCP Application is proposing 
to dedicate a parallel access easement on the east side of the west property line between 
W White Feather Ln and W Blue Sky Dr to create a 50’ roadway easement for 229th Ave.  
This portion of 229th Ave will be finished with milled asphalt to stabilize the surface and 
facilitate circulation for the adjacent neighborhood as well as for police and fire access.   
The approximate four acres fronting onto W Patton Road is intended for future commercial 
retail uses.  Future development of this commercial area is expected to include one 
additional driveway at a location to be determined and supported by an updated traffic 
study along with a Plan of Development (POD).  The first phase of development will only 
include the installation of the primary access drive extending south from W Patton Road. 
This drive will be defined by a 40’ wide access easement that will extend across the 
drainage swale to the secured entrance for the Boat & RV Storage facility.  Future 
dedication of ROW for W Patton Road and the off-site improvements will be coordinated 
with MCDOT.  Except for the driveway connection to W Patton Road, the Owner requests 
that any additional off-site be delayed until there is a long-term solution for a larger 
improvement project to expand W Paton Road from US60 and further west.   
10. Grading & Drainage 
The requirement for on-site retention shall address County standards for a 100-year 2-
hour storm event.  Minimum finished floor elevations will be set in accordance with the 
criteria in Table 6.7 of the Maricopa County Drainage Policies and Standards manual. 
There is a culvert at the northwest property corner that directs historic storm flow from the

north side of W. Patton Road.  That historic flow crosses through the property within an 
existing defined wash.  The proposed site improvements will retain the existing wash to 
allow historic flows to pass through.  One covered crossing will be installed to provide 
access to the Boat and RV Storage facility.  Please refer to Exhibit 8 - Preliminary 
Grading & Drainage Plan.  A Preliminary Drainage Report has been prepared that reviews 
storm flow and this proposed crossing solution.  The Property is classified as Zone X as 
delineated the attached ALTA Survey.  Zone X places the property outside the 100-year 
floodplain, but qualifies that the certain areas are subject to 100-year storm events with 
average depths that are less than one foot.  
11. Project Landscape  
The selection of landscape material prescribed for trees, shrubs, groundcovers and 
accents will be selected from the Arizona Department of Water Resources low water use 
plant list for the Phoenix Active Management Area (Phoenix AMA).  The landscape buffers 
along the west and east sides will use low water indigenous trees spaced at 25-30’ 
intervals to establish a visual screen to mitigate the lines of sight from the adjacent 
residents.    
12. Development Plan 
Stellar on Patton intends to develop this site with the Boat & RV Storage and the Mini-
Storage Units as the first phase.  As illustrated on the site plan, the main access will be a 
driveway situated near the center of the frontage that will lead to the secured entrance on 
the south side of the existing wash.  Except for the entrance drive, the street frontage will 
remain as is.  Street trees and project ID signage will be installed near the entrance.  The 
future commercial area will be leveled and dustproofed.  The existing drainage wash will 
remain in-place with an all-weather crossing installed to access the storage area south of 
the wash.  The perimeter screen wall and buffer tree massing will be installed with first 
phase for the area south of the wash.   
13. Development Schedule  
As indicated earlier, this project will be phased beginning with the Boat & RV Storage and 
mini-storage units, which may also be phased to reflect the local absorption and demand 
for storing recreational vehicles.  The first phase will include the primary access drive, 
modular office, RV Dump, Wash Bay, the installation of the perimeter screen wall and 
buffer landscape, security lighting, and the secondary emergency access to W Blue Sky 
Dr at the 229th Ave alignment.

14. Relationship to State Statute- including how the project complies with ARS 28-8481 
and Chapter 10, Section 1010 of the Maricopa County Zoning Ordinance. 
ARS 28-8481 establishes the legal framework for political subdivisions that have territory 
in the vicinity of a military airport or ancillary military facility.  This statute also establishes 
dates for pre-existing entitlements, which are not relevant for this application.  Section 
1010 of the Maricopa County Zoning Ordinance establishes the entitlement process for 
land uses within areas in the “high noise or accident potential zones” of military facilities.  
Section 1010 first requires a Use Compatibility and Consistency Determination (UCCD) be 
filed and approved before this application for a Military Compatibility Permit (MCP) can be 
submitted.  UCCD (UC2023020) was filed for these proposed land uses, and Luke AFB 
issued a formal approval on May 31, 2023. 
15. Community Facilities and Services

The Wittman Fire & Medical Station is located 3 miles east at 20401 W. Patton Road.   
• 
The Nadaburg Unified School District #81 I is based in Wittman, AZ.  There are two 
elementary schools; Nadaburg Elementary (K-8) and Desert Oasis Elementary (K-8), 
and one high school, Mountainside High School.   
• 
There are no public community parks that are proximate to the subject property.  The 
proposed uses for the Boat and RV Storage and the service commercial uses are not 
typically influenced by the proximity to these publicly accessible facilities.

Thank you for the opportunity to comment on the Use Compatibility and Consistency 
Determination application for a RV, Boat and Self-Storage project located at 22800 W. Patton 
Rd in unincorporated Maricopa County, AZ.  The 19.5-acre site is located inside the Luke AFB 
Auxiliary Field #1 2004 JLUS 65 DNL, “high noise or accident potential zone,” as identified by 
A.R.S. § 28-8461, and is within the “territory in the vicinity of a military airport,” also defined 
by A.R.S. § 28-8461. 
 
Luke AFB considers the proposed RV, boat, and self-storage land use on                    
APN 503-33-017E to be compatible and consistent with the high noise or accident potential of 
the military airport or ancillary military facility.  Since the development will be located within 
the “territory in the vicinity of a military airport,” it will be subjected to approximately 165 over 
flights a day. A strong notification program on the part of the applicant is essential to inform 
potential occupants about Luke AFB operations.

Thank you for allowing Luke AFB to make comments on the Stellar on Patton Use Compatibility and
Consistency Determination Application.  This proposal is to rezone residential land to
commercial/retail (C2) use on approximately 19.5 acres of land.  The site is located at 22800 W.
Patton Road in unincorporated Maricopa County, AZ.  It is within the Luke AFB Aux-1 2004 JLUS 65
Ldn, “high noise or accident potential zone” as defined by A.R.S. § 28-8461 and is inside the
“territory in the vicinity of a military airport” also defined by A.R.S. § 28-8461. 
 
Luke AFB follows A.R.S. § 28-8481 when evaluating compatible land use within the “territory in the
vicinity of a military airport”. Subject to the results of an FAA Obstruction Evaluation/Airport
Airspace Analysis (OE/AAA), this request will not negatively impact the flying and base operations at
Luke AFB; however, we reserve the right to comment on any final site plans submitted. Since the site
will be located inside the “territory in the vicinity of a military airport,” it will be subjected to
approximately 170 over flights per day.  We recommend a strong notification program on the part of
the applicant to inform the tenant(s) about Luke AFB operations.

This property ownership includes 19.5 acres situated at 22831 W. Patton
Road.  The Owner intends to develop the project in phases, with the Boat &
RV Storage and mini-storage units as the first phase on approximately 15
acres.  Future Phase 2 may include General Commercial Retail subject to
applications for a UCCD, a Major MCP Amendment, and a POD. 
The presence of the 65-69 LDN noise contour in proximity to Luke AFB
Auxiliary Field #1 requires approval of a Military Compatibility Permit (MCP).
This site plan is prepared to support the MCP and must be approved by the
Maricopa County Board of Supervisors prior to obtaining any permits for
development.
Project Legal Description:
A portion of the northeast quarter of section 34, township 5 north, range 3 west of the
Gila and Salt River base and meridian, MaricopaCounty, Arizona, described as
follows:
Commencing at the northeast corner of said section 34, being a 2-3/4” Maricopa
County highway department brass cap, to which the north quarter of said section 34

DRAIN WITHIN 36-HOURS, SIGNED AND SEALED BY AN ARIZONA REGISTERED PROFESSIONAL
ENGINEER, SHALL BE SUBMITTED FOR APPROVAL WITH THE AS-BUILT PLAN DOCUMENTATION. SOIL
INFILTRATION TESTING OBTAINED DURING DESIGN PHASE ARE ACCEPTABLE.

ALL DRYWELL PERCOLATION RATES SHALL BE DE-RATED IN ACCORDANCE WITH MARICOPA COUNTY
STANDARD 6.10.13. THE DRYWELL TEST RESULTS, BORING LOGS, PROOF OF DRYWELL
REGISTRATION, AND REVISED DRAIN-DOWN CALCULATIONS SEALED BY AN ARIZONA REGISTERED

Thank you for the opportunity to comment on the Use Compatibility and Consistency 
Determination application for a RV, Boat and Self-Storage project located at 22800 W. Patton 
Rd in unincorporated Maricopa County, AZ.  The 19.5-acre site is located inside the Luke AFB 
Auxiliary Field #1 2004 JLUS 65 DNL, “high noise or accident potential zone,” as identified by 
A.R.S. § 28-8461, and is within the “territory in the vicinity of a military airport,” also defined 
by A.R.S. § 28-8461. 
 
Luke AFB considers the proposed RV, boat, and self-storage land use on                    
APN 503-33-017E to be compatible and consistent with the high noise or accident potential of 
the military airport or ancillary military facility.  Since the development will be located within 
the “territory in the vicinity of a military airport,” it will be subjected to approximately 165 over 
flights a day. A strong notification program on the part of the applicant is essential to inform 
potential occupants about Luke AFB operations.

We would like to voice our concerns about the potential of this RV and boat storage next to our home & 
neighborhood.   We are concerned about the traffic, the luring, the theft, the noise, the lights, the possible 
contamination of our water source, which we and our neighbors are on wells.  
 
Additionally, there’s no need for a RV and boat storage unit out in this area due to the fact that these 
surrounding areas  are acre plus lot properties and they can have their own RVs, boats, horse trailers, etc..   
 
Finally, it is no secret this will significantly decrease the value of our property.   
 
It’s our utmost hope there will be a better property suited elsewhere for this facility to provide a win/win 
situation for all involved. 
 
We greatly appreciate your attentiveness to our concerns.

My name is Teresa Coleman, and my husband is Glenn Coleman. We live at 28031 N 230th Ave, Wittmann Az 
8536, Parcel 503-33-015F and have lived here since 2001. We have been notified that parcel # 503-33-017E, 
22800 W Patton is wanting to build a Boat & RV, Mini storage, Stellar on Patton on 19.5 acres. We are very 
concerned about the traffic, noise, and the lights at night, which will hinder the natural darkness of the night 
sky. This type of business brings unwanted attention to this area including loitering, graffiti, vandalism and 
theft. We are also very concerned about our water; we live on a well and this type of business so close to our 
property has a high chance of contaminating our water source. 
We would like to point out that this type of business in this area is not warranted, as all surrounding 
properties are on at least one acre lots with the ability to house their own Boat, RV and recreational vehicles, 
along with storage containers. 
We ask you please consider our concerns and don’t approve of this business to move forward with their build.
