Approval of this item and subsequent issuance of construction permits would resolve this violation. The proposed quasi-industrial use of the site would primarily take place on the northern portion of the parcel which is split between C-3 and R-4 zoning, away from more rural uses to the south and southeast. The site is within the Town of Queen Creek’s municipal planning area and is identified for rural uses. There is no known support or opposition. There are no outstanding concerns from reviewing agencies Commission Recommendation: On 9/26/24, the Commission voted 7-0 to adopt a motion recommending the Board of Supervisors approve Z2023156 subject to conditions ‘a’ – ‘h’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Arizona Rock Depot“, consisting of 1 full-size sheet, received July 17, 2024, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. This special use permit is valid for a period of 10 years and shall expire on October 23, 2034, or upon termination of the use for a period of 90 or more days, whichever occurs first. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. MCZO, Art. 1301.1.4 permits the ‘development of earth products, clay, coal, gas, gravel, minerals, sand, stone and topsoil’ as a special use. The Department will consider ‘rock and sand storage and sales’ under the umbrella of this special use permit (SUP) category. The applicant is proposing a SUP to allow for rock storage and sales and interim industrial storage and vehicle parking at a split-zoned C-3/R-4/Rural-43 parcel in the Chandler Heights area a few hundred feet east of the intersection of San Tan Blvd and Power Rd. The site is currently under a violation, V202202003, for a business use in a residential zoning district and for remodeling the existing residence into an office without benefit of a building permit. The business is one of two locations being operated by the parcel owners with the other being in Apache Junction. Staff notes that as a quasi-industrial use, that the current/proposed use is not permitted in portion of the site including the C-3 zoning along San Tan Blvd. The R-4 portion takes up most of the southern half of the parcel. The Rural-43 portion is a thin strip at the southeastern point of the site extending north. 2. The ‘checkerboard’ zoning patterns and uses of the area speak to the strange development history of Chandler Heights. Originally consisting of orange orchards with R-4 zoning presumably intended to help develop barracks for farmhands, the area has grown to encompass not just scattered orchards, but apartments, commercial, and industrial uses alongside rural estates. In 2005 there was a grassroots effort to seek voluntary rezoning of R-4 properties in what was viewed at the time as a semi-rural community to Rural-43 RUPD (Z2005006). The subject site itself is adjacent to a vehicle collision center, marijuana dispensary, auto body shop, offices, and rural residences. As development from City of Chandler and Town of Gilbert has moved further south, and development from Town of Queen Creek has verged further north and west - Chandler Heights has found itself squeezed by the region’s rapid development and suburbanization. It is likely rapid development of the Chandler Heights area will continue. 3. As such, the SUP requests a 15-year combination of development of rock products with the site operating from 6:00 am to 5:00 pm on weekdays and 7:00 am to 2:00 pm on weekends. Staff would note the maximum allowed by Ordinance for an interim industrial use is 10-years. Trucks would enter the site from San Tan Blvd to access the office and gravel bins located at approximately the parcel’s midpoint. Upon receipt of materials, trucks would weigh in at a truck scale before exiting back onto San Tan Blvd. The rear of the parcel most near to the existing residential would be used only for the site’s drainage retention. 4. The applicant is requesting several changes to the underlying zoning district standards as shown in the table on the next page. Staff has included a separate change regarding setbacks between zoning districts internal to the site. Staff has received one letter of support as of this writing. Outstanding Concerns from Reviewing Agencies: 11. N/A Staff Analysis: 12. Staff supports this item if potential adverse impacts can be mitigated for the existing rural estates to the south/southwest. It is important to note that most of the site usage will be taking place on the northern portion of the parcel, away from these residencies and more in-line with the Z2023156 Page 6 of 8 commercial uses along San Tan Blvd. The parcels east/southeast of the subject site are owned by the owners of the collision center at the SWC of San Tan Blvd and Lime Dr and it is assumed given the similarities of the sites that the owner of this parcel has no issue with the proposed use. The parcels along San Tan Blvd are expected to remain of a commercial/quasi-industrial use. Approval of this item would additionally help resolve an existing zoning violation. Such violation cannot be resolved, however, until commercial building permits are approved and finaled. Last the applicant has indicated the site would provide a commercial service in a rapidly developing area. The inclusion of interim industrial uses limits the span of this SUP to ten years, at which point the request can be reevaluated considering new developments within Chandler Heights. Recommendation: 13. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z2023156 subject to the following conditions ‘a’ – ‘h’: a. REQUEST Rod Jarvis, of Gallagher & Kennedy, and Upfront Planning & Entitlements, LLC are pleased to submit for your consideration a Special Use Permit (SUP) on approximately 2.85 gross acres located just south of E San Tan Blvd and east of S Power Road. The property is south of E San Tan Blvd and is identified as Maricopa Assessor Parcel Numbers 304- 89-014 (the "Site"), located at 18595 E San Tan Boulevard, Queen Creek, AZ 85142, within unincorporated Maricopa County (the “County”), zoned as C-3 – General Commercial on the north 200 ft. portion of the site and Rural-43 – Rural Zoning District on the reminder. The Site Owner (the “Owner”) requests a Special Use Permit (SUP) to allow for an office with the storage and sale of a sand and rock retail business. 2. BACKGROUND The surrounding properties to the north are zoned C-3 General Commercial and R1-35 Single Family Residential District, to the east RU-43 Rural Zoning District and C-3 General Commercial, to the south exclusively RU-43 Rural Zoning District and to the west C-3 General Commercial, C-2 Intermediate Commercial, as well as RU-43 Rural Zoning District. All surrounding properties are within the County. Narrative Maricopa County 3 The Site is surrounded by a portion of CMU and chain link fence. The Site adheres to dust mitigation requirements by being covered entirely with gravel utilizing water trucks as needed. The lighting on the Site is reflected away from adjoining properties and is in conformance with MCZO Section 1112. Owner seeks to make the Site more in line with the surrounding properties and to utilize the Site for uses similar to those occurring in the area; hence, an SUP for rock and sand storage and sales and associated uses per MCZO 1301.1.4. is hereby requested. 3. PROPOSAL The Owner requests a SUP to accommodate an office building, and retail storage/sale of sand and rock materials on the Site. These proposed uses are similar to the operation immediately adjacent to the east of the Site. The Site will be accessed by a single driveway from San Tan Boulevard. Vendor trucks and retail clients will enter the Site and drive south to the parking area by the existing house, where samples of the materials for sale will be displayed. Storage of the materials is located further south within the Site, piled in bins to separate the different material types, allowing traffic to navigate the Site around the piles and maintaining the drive aisle clear of rock and materials. Interior to the Site is a truck scale for measurement of the materials. The Site has an existing chain link fence along the front (northern boundary/San Tan Boulevard frontage) and an existing CMU block wall along the sides and rear, concealing the materials storage and truck storage from adjacent properties. The driveway is gated and will be closed during non-operating hours. The Site operates Monday through Friday from 6:00 AM to 5:00 PM, Saturday from 7:00 AM to 2:00 PM. The Site will not be open on Sundays. Deviations are requested below in bold due to the nature of the business of outdoor sand and rock sales to provide the adjusted parking, screening and driveway materials appropriate and customary to sand and rock materials businesses. RELATIONSHIP TO SURROUNDING PROPERTIES The parcels surrounding the Site consist of a mix of C-3, C-2, RU-43 and R1-35. Adjacent to the north, east and west are commercial properties zoned C-3: adjacent to the north, a florist and game store, to the east, a commercial site with similar sand and rock uses, also a commercial automotive center, to the west a Cannabis retailer, all located within the County and zoned C-3. South of the Site is zoned RU-43. To the northwest, adjacent on the west side of S Power Rd, is an undeveloped 18.4-acre lot, zoned C-3, which will accommodate future commercial development surrounding the Site.
