The applicant, Ken Hale of Smartlink Group, is requesting an SUP
for a WCF in the Rural-43 WHSC zoning district. The proposal is for
an 80’ monopole with an antenna array diameter of 16’-2”. The
subject property is located at the southwest corner of the
alignments of Lone Mountain Road and 211th Avenue, or about 700’
west of the intersection of 211th Avenue and Grand Avenue in the
Wittmann area. The White Tank / Grand Avenue area plan assigns
the site a future land use category of “single family – rural.” The City
of Surprise General Plan assigns the site a land use category of
“Rural Residential” and places the site within its “Neighborhood”
character area. The site is also located within the Class 2 intensity
level of the Wickenburg Highway Scenic Corridor.
There are no outstanding concerns from County reviewing
agencies. The City of Surprise did not comment on the case. ADOT
has confirmed that the project would have no impact on their
highway facilities in the area, assuming that traffic control would
not be necessary on their facilities. Luke AFB has likewise
confirmed that the proposal would not negatively impact their flying
and base operations. AGFD has offered general recommendations
for the applicant to heed upon development of the site. Staff
received one letter of opposition from a property owner within 300’.
This opposition is primarily concerned with the use of the site for a
WCF and the potential negative impact it would have on the value
and marketability of the owner’s property.

On 9/12/24, the Commission voted 8-0 to adopt a motion
recommending the Board of Supervisors approve Z2024028
subject to conditions ‘a’ – ‘j’:
a.
A Plan of Development is approved subject to site plan entitled “PHO CIELO CROSSING”
consisting of seven full-size sheets, dated July 12, 2024, and stamped received July 14,
2024. The Plan of Development may be amended administratively under separate
application as long as the amendment complies with the established SUP development
standards as approved by the Board of Supervisors. Staff may determine slight
refinements to remain in substantial conformance with the approved site plan. Minor and
major amendments to the site plan will be determined in accordance with Chapter 3 of
the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “PHO CIELO_CROSSING – 17003304”, consisting of six pages, dated June 4, 2024,
and stamped received June 4, 2024, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards, and best practices at the time of
application for construction.
2.
Based on the conceptual design nature of the information submitted, changes to
the site layout may be necessitated by the final engineering design of the site’s
drainage infrastructure.
3.
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with
the application for Building Permits.
d.
The maximum height of the Wireless Communication Facility shall be limited to 80’. This
includes all attachments and concealment elements other than a lighting rod or
colocation for a qualifying eligible facility per federal rule.
e.
Future requests to co-locate carriers on the wireless communication facility shall comply
with Maricopa County and federal requirements.
f.
This special use permit is valid for a period of 30 years and shall expire on October 9, 2054,
or upon termination of the use for a period of 90 or more days, whichever occurs first. All
site improvements associated with the special use permit shall be removed within 90 days
of such expiration or termination of use.
g.
The following SUP standards shall apply:

h.
Noncompliance with any of the conditions assigned to the approval of this Special Use
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in
accordance with the requirements and procedures as set forth in the Maricopa County
Zoning Ordinance.
i.
The property owners and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
j.
The granting of this change in use of the property has been at the request of the applicant
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the Special Use Permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either
revocation due to the failure to comply with any conditions, or the expiration of the Special
Use Permit, does not reduce any rights that existed on the date of application to use,
divide, sell, or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.

Project Summary:
1.
The applicant, Ken Hale of Smartlink Group, is requesting a special use permit (SUP) to
accommodate a proposed wireless communication facility (WCF) on Parcel 503-36-011B. The
subject parcel is currently vacant and comprises approximately 5.8 acres. The property is located
at the southwest corner of the alignments for Lone Mountain Road and 211th Avenue in the
Wittmann area, or approximately 700’ west of the intersection of 211th Avenue and US 60.
2.
The legal description provided by the applicant identifies a site that is approximately 6,894 square
feet. This includes the main 2,500-square foot lease area (a 50’ x 50’ area bounded by an 8’ CMU
wall, within which the WCF will be located), as well as a proposed 20’-wide access/utility
easement that will provide construction and maintenance vehicles access to the site from the
adjacent Grand Avenue frontage road.
3.
The WCF would be a maximum height of 80’ and meet a minimum 2:1 setback from lot lines.
However, it would have an antenna array diameter of 16’-2”, which exceeds the ordinance’s
allowance of 8’, hence the requirement for an SUP. The facility would remain unmanned with an
occasional visit by one employee to oversee site maintenance as needed. One parking space
would be provided for the maintenance technician and would be located adjacent to the lease
area, within the access/utility easement.
4.
The WCF would be set back 160’ from the north and east lot lines, meeting the required 2:1
setback-to-height ratio required for WCFs per Article 1202.3 of the Maricopa County Zoning
Ordinance (MCZO). Furthermore, the WCF would be set back approximately 239’ from the west
lot line and approximately 431’ from the south lot line. Staff notes that the parcel is split-zoned,
and whereas the SUP area inclusive of the WCF would be located entirely within the Rural-43
portion of the lot, a small triangular portion of the northeast corner of the parcel is zoned C-2.
Decades ago, the Maricopa County Board of Supervisors (BOS) approved a strip of C-2 zoning
along and parallel to the right-of-way for US 60 (known as Grand Avenue or the Phoenix-
Wickenburg Highway) for most of the highway’s length between Surprise and Wickenburg. Staff
notes that, due to expansions and variations in the ROW for US 60 since circa 2000, it is best to
measure the C-2 zoning district boundary from the ROW for the BNSF Railway, which has
remained constant to date. The southwest boundary of the C-2 zoning district is 350’ from and
parallel to the southwest boundary of the railway ROW. Due to the subject parcel’s proximity to
US 60 and the railway, the C-2 zoning district extends slightly into the parcel. For the purpose of
measuring setbacks, staff notes that zoning district boundaries function as de facto property
boundaries where they cross through parcels of record. The proposed WCF would be set back
over 160’ from this boundary, thereby exceeding the required 2:1 setback.
5.
The subject property is zoned Rural-43. The applicable development standards for this district, as
well as the development standards proposed with this SUP request, are listed below:

The applicant is requesting to establish a standard for antenna array diameter that differs from
the base development standard for WCFs in the Rural-43 zoning district. Whereas MCZO Article
1202.3 allows for a maximum diameter of eight feet, Verizon Wireless is proposing to install an
antenna array with a diameter of 16’-2”. According to the narrative, the increased diameter is
necessary to allow for the required separation distance between the individual antennas. An eight-
foot diameter would not allow for the separation distance needed for the antennas to function
properly.
7.
Additionally, due to the very limited number of trips that would be generated by the WCF, the
applicant is proposing to modify the MCZO standards for access road surfacing. Specifically,
most of the access easement, including the maintenance vehicle parking space, would not be
paved, but would be surfaced with stabilized decomposed granite (DG). However, the driveway
entrance from the Grand Avenue frontage road would be paved to meet MCDOT requirements.

The following table includes the existing and proposed half-widths of the rights-of-way adjacent
to the subject site, as well as the future classifications for the adjacent roadways, based upon the
Maricopa County Department of Transportation (MCDOT) Road Information Tool. Staff notes that
the subject parcel is located at the southwest corner of the alignments for two section line roads:
Lone Mountain Road (along the north lot line) and 211th Avenue (along the east lot line). For each
alignment, the required 55’ of right-of-way along the side of the centerline adjacent to the subject
site was dedicated in 1976. However, Lone Mountain Road does not exist as a county-maintained
road, whereas 211th Avenue deviates from the section line in a northeasterly/southwesterly
direction to meet Grand Avenue at a right angle. The maintained portion of 211th Avenue has been
designated with a future classification as a minor arterial. Access to the site is provided from a
portion of the Grand Avenue frontage road within the historic 211th Avenue right-of-way along the
section line. This frontage road has been designated with a future classification as a local road.

White Tank / Grand Avenue Area Plan (adopted December 2023): This area plan assigns the
subject site a future land use category of “single family – rural,” which is characterized as allowing
for a residential density of one dwelling unit or less per gross acre. The proposed WCF is not in
conflict with this land use designation, nor with the land use strategies, goals, or policies outlined
in the area plan.
12.
Wickenburg Highway Scenic Corridor Plan (adopted January 1991): The subject parcel is located
within the Class 2 and Class 4 intensity levels of this scenic corridor overlay zoning district. It is
also located within the plan’s land use category of “rural area south,” which corresponds with the
area along Wickenburg Highway north of the CAP canal and south Morristown. Per the scenic
corridor plan, this area was to remain rural through the year 2010, although urban uses may be
suitable if sufficient public services are available. Finally, the site is located approximately 2/3
mile southeast of the Wittmann / Nadaburg townsite, which is designated as a “major activity
center” in the scenic corridor’s land use plan. A major activity center is defined as a location of
primary industrial and commercial development in the scenic corridor, whereas a minor activity
center is defined as a location of retail commercial centers for neighborhood and local area
services. The area around the intersection of 203rd Avenue and Grand Avenue, located just over
one mile southeast of the subject site, is designated as “minor activity center.”

Public Participation Summary:

The applicant complied with the requirements of the citizen review process with the required
posting of the site and notification by first class mail to interested parties and adjacent property
owners within 300’ of the subject parcel. Two signs were posted onsite in accordance with
applicable regulations. Staff received no letters in support of or opposition to the request.
14.
The Arizona Department of Transportation (ADOT) sent correspondence to County staff
confirming that the project would have no impact on their highway facilities in the area, assuming
that traffic control would not be necessary at ADOT facilities. Luke Air Force Base also provided
correspondence acknowledging that the project site is located within the “territory in the vicinity
of a military airport” as defined by A.R.S. 28-8461. The site is also located approximately three
miles outside of the High Noise and Accident Potential Zone surrounding the Luke AFB Auxiliary
Airfield #1. Per the 56th Fighter Wing’s Community Initiatives Team, the proposal was subject to
the results of an FAA Obstruction Evaluation/Airport Airspace and Spectrum Analysis (OE/AAA),
which found that the project would not negatively impact the flying and base operations of Luke
AFB. Finally, the Arizona Game & Fish Department (AGFD) submitted correspondence offering
general recommendations for the applicant to heed upon development of the site. Copies of the
correspondence from all three agencies have been attached to this staff report.
15.
The subject site is located within the City of Surprise municipal planning area. The city’s general
plan assigns the site a land use category of “rural residential” and places the site within its
“neighborhood” character area. The city did not comment on the request.

Staff Analysis:

Staff finds the requested development standards to be justified for the reasons provided in the
applicant’s narrative and discussed in the project summary of this report. Allowing a 16’-2”
antenna array diameter where an 8’ array would normally be the maximum allowed would not
significantly affect the facility’s impact (visual, aesthetic, or otherwise) on surrounding properties,
most of which are currently vacant. Staff concurs with the applicant’s explanation that a larger
antenna array would be necessary to accommodate modern antenna equipment and allow for
the WCF to perform effectively. Likewise, the request to allow stabilized DG for the surfacing of
the access easement and maintenance vehicle parking space is reasonable given the very low
number of trips that would be generated by the development. In fact, stabilized DG may be
appropriate for the site in keeping with the surrounding rural desert aesthetic, especially given
that the property is located within the Wickenburg Highway Scenic Corridor (WHSC).
18.
Regarding the scenic corridor, staff notes that the regulations WHSC overlay zoning district have
bearing on the subject site. This overlay extends two miles in either direction from the US 60 right-
of-way and is divided into four intensity levels (or “classes”). The subject parcel falls specifically
within Classes 2 and 4, which are defined as follows:
•
Class 2 – 300 feet to ¼ mile from the Wickenburg Highway right-of-way. The WCF would
be located within this class.

•
Class 4 – 0 to 300 feet from the Wickenburg Highway right-of-way; from the Rocking
Hills Drive alignment south to Bell Road.
The Class 2 intensity level imposes minimal restrictions on development beyond baseline zoning
regulations. It does establish a maximum building height of 33’. This has the potential to impact
the WCF, which would be built to a height of 80’. That said, staff also notes that the underlying
Rural-43 zoning district requires a maximum building height of 30’, three feet less than the
maximum allowed in the WHSC Class 2. In other words, the Class 2 regulations of the WHSC are
not more restrictive than those of the underlying zoning district. Furthermore, neither the WHSC
plan document nor the applicable section of the MCZO (Section 1008) mention wireless
communication facilities (by that term or any related term) in their goals, policies, or zoning
regulations. In turn, MCZO Section 1202, which governs regulations pertaining to WCFs, does not
provide any development regulations unique to the WHSC or any other scenic corridor in Maricopa
County. It may be construed, then, that as with the maximum building height regulation of the
Rural-43 zoning district established in MCZO Article 503.3, the maximum building height
regulations of the WHSC established in MCZO Article 1008.4 are not inclusive of WCFs. Rather,
the base regulations governing WCF height remain those established in MCZO Article 1202.3.
The subject parcel is bisected by the dividing line between the Class 2 and Class 4 intensity levels.
Class 4 imposes the same height restriction as Class 2, but Class 4 establishes several additional
regulations, particularly regarding screening, architecture, and landscape setbacks, for the
purpose of regulating access and maintaining a scenic aesthetic along the length of the
Wickenburg Highway. Staff notes that the dividing line between the two classes extends
approximately 200’ southwest into the parcel from the northeast property corner, which itself
brings the property approximately 100’ from the ADOT-maintained ROW for the Wickenburg
Highway. The SUP area would be located just beyond this dividing line on the Class 2 side, and as
such, the WCF would not be subject to these additional regulations.
Nonetheless, staff notes that all ground equipment supporting the monopole would be concealed
by an 8’-high CMU wall, as required for all WCFs per MCZO Article 1202.3. The sole parking space,
while not directly screened from the northeast (toward the Wickenburg Highway), would be used
as infrequently as once or twice per month for occasional maintenance visits. Existing natural
vegetation is abundant throughout the property and would not be removed or disturbed beyond
the boundaries of the SUP area. Regarding landscape setbacks, the WCF compound would far
exceed 25’ from the ADOT-maintained ROW for the Wickenburg Highway and would well exceed
25’ from any lot line, as previously noted in the project summary.
As for the architecture of the WCF, the use of natural-appearing materials, while perhaps prudent
to the design of a conventional primary or accessory structure, is not necessarily prudent to the
design or functioning of a WCF. While stealth designs may be encouraged in some
circumstances, neither a “monopalm” nor (even less so) a “monopine” would complement the
native vegetation within the scenic corridor. Furthermore, staff notes that there are transmission
lines that run parallel to the highway along its southwest side, between the pavement and the
WCF site. These transmission towers have not been subject to stealthing features nor have they
been designed to incorporate natural-appearing materials in any way. As a WCF functions
essentially as a public utility (like transmission lines), it may be construed that the architectural
requirements outlined in the WHSC are not applicable to WCFs.
It is staff’s opinion that a WCF should still be respectful of the goals and policies outlined in the
WHSC and any other scenic corridor in Maricopa County. That having been said, the regulations
established for WCFs in MCZO Section 1202.3 largely ensure that any WCF development be

cognizant of potential aesthetic concerns, whether or not it be located within a scenic corridor.
The WCF proposed would meet nearly all of the base requirements outlined in the MCZO,
including maximum height, setbacks, screening, and separation distance from existing WCFs.
Only the antenna array diameter and surfacing material for onsite access would be subject to
varied standards, and whereas the former is a practical necessity that would present minimal
additional visual impact, the latter may actually improve the site’s compatibility with the goals of
the WHSC.
For these reasons, it is staff’s opinion that the proposed WCF would be compatible with the goals
and policies of the WHSC.
19.
Staff supports the applicant’s request for a special use permit. The proposed WCF promises to
provide wireless service in a relatively rural area where such service is currently limited.
Furthermore, adding a new cell tower in the proposed location would provide a useful and
desirable service for drivers along the Wickenburg Highway, especially in the event of a roadside
emergency. It would also provide much-needed service to the planned Cielo Crossing mixed-use
development, which would be located directly across the Wickenburg Highway in the City of
Surprise, and from which the project takes its name.
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2024028 subject to the following conditions ‘a’ – ‘j’:

NOTICE TO PROCEED- NO WORK SHALL COMMENCE PRIOR TO WRITTEN NOTICE TO PROCEED (NTP) AND THE ISSUANCE
OF A PURCHASE ORDER. PRIOR TO ACCESSING/ENTERING THE SITE YOU MUST CONTACT THE TOWER OWNER AND
CONSTRUCTION MANAGER.
2.
THE INTEGRITY OF THE SAFETY CLIMB AND ALL COMPONENTS OF THE CLIMBING FACILITY SHALL BE CONSIDERED
DURING ALL STAGES OF DESIGN, INSTALLATION, AND INSPECTION. TOWER MODIFICATION, MOUNT REINFORCEMENTS,
AND/OR EQUIPMENT INSTALLATIONS SHALL NOT COMPROMISE THE INTEGRITY OR FUNCTIONAL USE OF THE SAFETY
CLIMB OR ANY COMPONENTS OF THE CLIMBING FACILITY ON THE STRUCTURE. THIS SHALL INCLUDE, BUT NOT BE
LIMITED TO: PINCHING OF THE WIRE ROPE, BENDING OF THE WIRE ROPE FROM ITS SUPPORTS, DIRECT CONTACT OR
CLOSE PROXIMITY TO THE WIRE ROPE WHICH MAY CAUSE FRICTIONAL WEAR, IMPACT TO THE ANCHORAGE POINTS IN
ANY WAY, OR TO IMPEDE/BLOCK ITS INTENDED USE. ANY COMPROMISED SAFETY CLIMB, INCLUDING EXISTING
CONDITIONS MUST BE TAGGED OUT AND REPORTED TO YOUR VERIZON AND TOWER OWNER POC OR CALL THE NOC TO
GENERATE A SAFETY CLIMB MAINTENANCE AND CONTRACTOR NOTICE TICKET.
3.
PRIOR TO THE START OF CONSTRUCTION, ALL REQUIRED JURISDICTIONAL PERMITS SHALL BE OBTAINED. THIS
INCLUDES, BUT IS NOT LIMITED TO, BUILDING, ELECTRICAL, MECHANICAL, FIRE, FLOOD ZONE, ENVIRONMENTAL, AND
ZONING. AFTER ONSITE ACTIVITIES AND CONSTRUCTION ARE COMPLETED, ALL REQUIRED PERMITS SHALL BE
SATISFIED AND CLOSED OUT ACCORDING TO LOCAL JURISDICTIONAL REQUIREMENTS.
4.
ALL CONSTRUCTION MEANS AND METHODS; INCLUDING BUT NOT LIMITED TO, ERECTION PLANS, RIGGING PLANS,
CLIMBING PLANS, AND RESCUE PLANS SHALL BE THE RESPONSIBILITY OF THE GENERAL CONTRACTOR RESPONSIBLE
FOR THE EXECUTION OF THE WORK CONTAINED HEREIN, AND SHALL MEET ANSI/ASSE A10.48 (LATEST EDITION);
FEDERAL, STATE, AND LOCAL REGULATIONS; AND ANY APPLICABLE INDUSTRY CONSENSUS STANDARDS RELATED TO
THE CONSTRUCTION ACTMTIES BEING PERFORMED. ALL RIGGING PLANS SHALL ADHERE TO ANSI/ASSE A10.48 (LATEST
EDITION) AND VERIZON AND TOWER OWNER STANDARDS, INCLUDING THE REQUIRED INVOLVEMENT OF A QUALIFIED
ENGINEER FOR CLASS R; CONSTRUCTION, TO CERTIFY THE SUPPORTING STRUCTURE(S) IN ACCORDANCE WITH
ANSI/TA-322 (LATEST EDITION).
5.
ALL SITE WORK TO COMPLY WITH VERIZON AND TOWER OWNER "INSTALLATION STANDARDS FOR CONSTRUCTION
ACTIVITIES ON VERIZON AND TOWER OWNER SITE AND LATEST VERSION OF ANSI/TIA-1019-A-2012 "STANDARD FOR
INSTALLATION, ALTERATION, AND MAINTENANCE OF ANTENNA SUPPORTING STRUCTURES AND ANTENNAS."
6.
IF THE SPECIFIED EQUIPMENT CAN NOT BE INSTALLED AS SHOWN ON THESE DRAWINGS, THE CONTRACTOR SHALL
PROPOSE AN ALTERNATIVE INSTALLATION FOR APPROVAL BY VERIZON AND TOWER OWNER PRIOR TO PROCEEDING
WITH ANY SUCH CHANGE OF INSTALLATION.
7.
ALL MATERIALS FURNISHED AND INSTALLED SHALL BE IN STRICT ACCORDANCE WITH ALL APPLICABLE CODES,
REGULATIONS AND ORDINANCES. CONTRACTOR SHALL ISSUE ALL APPROPRIATE NOTICES AND COMPLY WITH ALL
LAWS, ORDINANCES, RULES, REGULATIONS AND LAWFUL ORDERS OF ANY PUBLIC AUTHORITY REGARDING THE
PERFORMANCE OF THE WORK. ALL WORK CARRIED OUT SHALL COMPLY WITH ALL APPLICABLE MUNICIPAL AND UTILITY
COMPANY SPECIFICATIONS AND LOCAL JURISDICTIONAL CODES, ORDINANCES AND APPLICABLE REGULATIONS.
8.
THE CONTRACTOR SHALL INSTALL ALL EQUIPMENT AND MATERIALS IN ACCORDANCE WITH MANUFACTURER'S
RECOMMENDATIONS UNLESS SPECIFICALLY STATED OTHERWISE.
9.
THE CONTRACTOR SHALL CONTACT UTILITY LOCATING SERVICES PRIOR TO THE START OF CONSTRUCTION.
10.
ALL EXISTING ACTIVE SEWER, WATER, GAS, ELECTRIC AND OTHER UTILITIES WHERE ENCOUNTERED IN THE WORK,
SHALL BE PROTECTED AT ALL TIMES AND WHERE REQUIRED FOR THE PROPER EXECUTION OF THE WORK, SHALL BE
RELOCATED AS DIRECTED BY CONTRACTOR. EXTREME CAUTION SHOULD BE USED BY THE CONTRACTOR WHEN
EXCAVATING OR DRILLING PIERS AROUND OR NEAR UTILITIES. CONTRACTOR SHALL PROVIDE SAFETY TRAINING FOR
THE WORKING CREW. THIS WILL INCLUDE BUT NOT BE LIMITED TO A) FALL PROTECTION B) CONFINED SPACE C)
ELECTRICAL SAFETY D) TRENCHING AND EXCAVATION E) CONSTRUCTION SAFETY PROCEDURES.
11.
ALL SITE WORK SHALL BE AS INDICATED ON THE STAMPED CONSTRUCTION DRAWINGS AND PROJECT SPECIFICATIONS,
LATEST APPROVED REVISION.
12.
CONTRACTOR SHALL KEEP THE SITE FREE FROM ACCUMULATING WASTE MATERIAL, DEBRIS, AND TRASH AT THE
COMPLETION OF THE WORK. IF NECESSARY, RUBBISH, STUMPS, DEBRIS, STICKS, STONES AND OTHER REFUSE SHALL
BE REMOVED FROM THE SITE AND DISPOSED OF LEGALLY.
13.
ALL EXISTING INACTIVE SEWER, WATER, GAS, ELECTRIC AND OTHER UTILITIES, WHICH INTERFERE WITH THE
EXECUTION OF THE WORK, SHALL BE REMOVED AND/OR CAPPED, PLUGGED OR OTHERWISE DISCONTINUED AT POINTS
WHICH WILL NOT INTERFERE WITH THE EXECUTION OF THE WORK, SUBJECT TO THE APPROVAL OF VERIZON AND
TOWER OWNER, AND/OR LOCAL UTILITIES.
14.
THE CONTRACTOR SHALL PROVIDE SITE SIGNAGE IN ACCORDANCE WITH THE TECHNICAL SPECIFICATION FOR SITE
SIGNAGE REQUIRED BY LOCAL JURISDICTION AND SIGNAGE REQUIRED ON INDIVIDUAL PIECES OF EQUIPMENT, ROOMS,
AND SHELTERS.
15.
THE SITE SHALL BE GRADED TO CAUSE SURFACE WATER TO FLOW AWAY FROM THE CARRIER'S EQUIPMENT AND
TOWER AREAS.
16.
THE SUB GRADE SHALL BE COMPACTED AND BROUGHT TO A SMOOTH UNIFORM GRADE PRIOR TO FINISHED SURFACE
APPLICATION.
17.
THE AREAS OF THE OWNERS PROPERTY DISTURBED BY THE WORK AND NOT COVERED BY THE TOWER, EQUIPMENT OR
DRIVEWAY, SHALL BE GRADED TO A UNIFORM SLOPE, AND STABILIZED TO PREVENT EROSION AS SPECIFIED ON THE
CONSTRUCTION DRAWINGS AND/OR PROJECT SPECIFICATIONS.
18.
CONTRACTOR SHALL MINIMIZE DISTURBANCE TO EXISTING SITE DURING CONSTRUCTION. EROSION CONTROL
MEASURES, IF REQUIRED DURING CONSTRUCTION, SHALL BE IN CONFORMANCE WITH THE LOCAL GUIDELINES FOR
EROSION AND SEDIMENT CONTROL.
19.
THE CONTRACTOR SHALL PROTECT EXISTING IMPROVEMENTS, PAVEMENTS, CURBS, LANDSCAPING AND STRUCTURES.
ANY DAMAGED PART SHALL BE REPAIRED AT CONTRACTOR'S EXPENSE TO THE SATISFACTION OF OWNER.
20.
CONTRACTOR SHALL LEGALLY AND PROPERLY DISPOSE OF ALL SCRAP MATERIALS SUCH AS COAXIAL CABLES AND
OTHER ITEMS REMOVED FROM THE EXISTING FACILITY. ANTENNAS REMOVED SHALL BE RETURNED TO THE OWNER'S
DESIGNATED LOCATION.
21.
CONTRACTOR SHALL LEAVE PREMISES IN CLEAN CONDITION. TRASH AND DEBRIS SHOULD BE REMOVED FROM SITE ON
A DAILY BASIS.
22.
NO FILL OR EMBANKMENT MATERIAL SHALL BE PLACED ON FROZEN GROUND. FROZEN MATERIALS, SNOW OR ICE
SHALL NOT BE PLACED IN ANY FILL OR EMBANKMENT.
CONCRETE, FOUNDATIONS, AND REINFORCING STEEL:
1.
ALL CONCRETE WORK SHALL BE IN ACCORDANCE WITH THE ACI 301, ACI 318, ACI 336, ASTM A184, ASTM A185 AND THE DESIGN AND
CONSTRUCTION SPECIFICATION FOR CAST-IN-PLACE CONCRETE.

THE CONTRACTOR SHALL INSTALL ALL EQUIPMENT AND MATERIALS IN ACCORDANCE WITH MANUFACTURER'S RECOMMENDATIONS

IF THE SPECIFIED EQUIPMENT CAN NOT BE INSTALLED AS SHOWN ON THESE DRAWINGS, THE CONTRACTOR SHALL PROPOSE AN
ALTERNATIVE INSTALLATION FOR APPROVAL BY THE CARRIER AND TOWER OWNER PRIOR TO PROCEEDING WITH ANY SUCH
CHANGE OF INSTALLATION.
11.
CONTRACTOR IS TO PERFORM A SITE INVESTIGATION AND IS TO DETERMINE THE BEST ROUTING OF ALL CONDUITS FOR POWER,
AND TELCO AND FOR GROUNDING CABLES AS SHOWN IN THE POWER, TELCO, AND GROUNDING PLAN DRAWINGS.
12.
THE CONTRACTOR SHALL PROTECT EXISTING IMPROVEMENTS, PAVEMENTS, CURBS, LANDSCAPING AND STRUCTURES. ANY
DAMAGED PART SHALL BE REPAIRED AT CONTRACTOR'S EXPENSE TO THE SATISFACTION OF VERIZON AND TOWER OWNER
13.
CONTRACTOR SHALL LEGALLY AND PROPERLY DISPOSE OF ALL SCRAP MATERIALS SUCH AS COAXIAL CABLES AND OTHER ITEMS
REMOVED FROM THE EXISTING FACILITY. ANTENNAS REMOVED SHALL BE RETURNED TO THE OWNER'S DESIGNATED LOCATION.
14.
CONTRACTOR SHALL LEAVE PREMISES IN CLEAN CONDITION. TRASH AND DEBRIS SHOULD BE REMOVED FROM SITE ON A DAILY
BASIS.

Purpose of Request:
Anthemnet with Verizon as the anchor tenant are requesting the County of Maricopa’s zoning approval
to install a new 80’ multi carrier cell tower to provide wireless service to the surrounding area. The new
tower is meeting the height requirements of 80’ and is meeting 2:1 setback from property lines.
Description of Proposal:
Anthemnet/Verizon is proposing a new 80-foot-tall monopole tower and wireless communication facility
within an 8-foot-tall CMU wall located in Maricopa County. The current parcel is raw land and
undeveloped, so no stealthing will be required. Tower is 160 feet away from all property lines to meet
the required 2:1 setback from property lines. Verizon will be the anchor tenant and the tower will be
able to facilitate additional co-location. There are no other existing WCF’s within a 1,000 feet radius. The
tower will provide cellular service for residents and businesses currently and for the future in the
surrounding area. No mature trees or cacti will be removed during construction of the WCF.
SUP Request:
Anthemnet/Verizon is requesting a Special Use Permit to allow a new 80’ WCF, with an antenna
diameter of 16’2”” (needed for antennas to meet required separation). This SUP request will allow for a
larger antenna diameter.
SUP Request Details/Standards that need to be varied.
The WCF being proposed will require variations from the typical WCF standards outlined in MCZO 1202.
WIRELESS COMMUNICATION FACILITIES.
The applicant is requesting to vary the maximum antenna array diameter from the required 8’ up to
16’2” (MCZO Article 1202.3.1.h), due to the needed separation from all antennas being installed. The
required 8’ diameter will not allow these types of antennas to function properly as needed separation
will not be met.
The applicant is requesting to vary MCZO Article 1102.7.1 for parking to be paved. This land is
undeveloped and access road and parking will be surfaced with stabilized DG.

Relationship to Surrounding Properties:
The proposed WCF will not alter or impact the existing conditions on the subject property, or
surrounding properties, or impact traffic in the immediate area. The surrounding area is sparsely
populated with adjacent properties to the south and west being vacant. By adhering to the height,
setback and screening requirements we will limit the visual impact of the WFC on surrounding
properties.

Location and Accessibility:
A technician vehicle may access the wireless communications facility approximately once or twice a
month, or in the event of a technical breakdown. The technician will exit Grand Ave at 211th Ave and
then take a right at W Grand Ave access road until they reach the access road to the property. This
vehicle will use the existing property ingress/egress. Below are estimated distances from nearest
municipals.
Whittman – 1.5 miles Northwest
Wickenburg – 19.7 miles Northwest
Surprise – 14.7 miles Southeast
Circulation System:
The new site access easement will be a concrete driveway entrance to Maricopa County ROW. The
access path will be surfaced with a stabilized DG to allow maintenance vehicle access to the compound.
The compound will have a parking space and adequate turnaround space.
Development Schedule:
Anthemnet/Verizon would like to commence the proposed equipment improvements as soon as all
County/State/Federal permits have been obtained. Construction for this project is estimated to take 30
days to complete.
Community Facilities and Service:
The proposed equipment improvements will not alter or impact community facilities and services. The
proposed WCF is located in the Nadaburg United School District. Nadaburg Elementary and
Mountainside High School are roughly 3 miles away. Copper Park, located 1.4 miles away, is the nearest
park.
Traffic Impact:
The proposed site may be visited once or twice a month for routine maintenance, or in the event of a
breakdown, so the proposed use will not impact traffic or conditions in the area and will comply with all
local, state, and federal laws & regulations.
Public Utilities & Services:
This WCF will not require either water or wastewater services.

The Department appreciates the opportunity to provide an evaluation of impacts to wildlife or wildlife habitats associated
with this project. Based on the information provided, the Department offers the following general recommendations:
Minimize the potential introduction or spread of exotic invasive species, including aquatic and terrestrial plants,
animals, insects and pathogens. Precautions should be taken to wash and/or decontaminate all equipment
utilized in the project activities before entering and leaving the site. Please review the Arizona Department of
Agriculture’s website for a list of prohibited and restricted noxious weeds and the Arizona Native Plant
Society for recommendations on control methods. To view a list of documented invasive species or to report
invasive species in or near your project area visit iMapInvasives - a national cloud-based application for
tracking and managing invasive species.
If proposed ground disturbance (both temporary and permanent) will meet or exceed 0.25 acre in areas with native
vegetation, please ensure the project complies with Arizona Native Plant Law regulations. A Native Plant
Inventory may need to be conducted to identify, record, and coordinate plant salvage efforts for species that are
Protected under the Arizona Native Plant Law. In addition, the applicable land management agencies should be
consulted regarding guidelines for revegetation efforts.
If vegetation removal/trimming is required, the Department recommends that a qualified biologist survey for
nesting birds within the project area if work will be conducted during the breeding season. The trees and/or
vegetation within the project area may provide nesting opportunities for avian species that are regulated under
the Migratory Bird Treaty Act (MBTA) and protected under state law. Breeding season for birds in the project
vicinity is generally January through late June. If it is anticipated the project will not be in compliance with
MBTA, the Department also recommends contacting the U.S. Fish and Wildlife Service (USFWS) for technical
assistance and options to comply with the MBTA.
If trenching or digging of holes will occur, trenching/digging and backfilling crews should be close together to
minimize the amount of open trenches/holes at any given time. Avoid leaving trenches/holes open overnight.
Where trenches/holes cannot be back-filled immediately, escape ramps should be constructed, which can be
short lateral trenches or wooden planks sloping to the surface. The slope should be less than 45 degrees (1:1).
Trenches/holes that have been left open should be inspected and animals removed prior to backfilling.

Thank you for the opportunity to provide comments on the special use permit application for PHO Cielo Crossing. The
applicant is proposing to construct an 80-foot monopole cell tower with corresponding ground equipment. Additionally,
a 15’11” antenna array would bring the full height to approximately 96 feet. The 5.77-acre site is located east of 211th
Avenue and south of Grand Avenue in unincorporated Maricopa County, AZ. The parcel in the application is
approximately 3 miles outside of the Luke AFB Aux-1 2004 JLUS 65 Ldn and is inside the “territory in the vicinity of a
military airport” defined by A.R.S. § 28-8461.
Subject to the results of an FAA Obstruction Evaluation/Airport Airspace and Spectrum Analysis (OE/AAA), this request,
as described in the narrative, will not negatively impact the flying and base operations at Luke AFB.
The site will be located inside the “territory in the vicinity of a military airport,” and it will be subjected to approximately
170 over flights per day. We recommend a strong notification program on part of the applicant to inform future
tenant(s) about Luke AFB operations.
