Recommendation: 
On 9/26/24, the Commission voted 7-0 to adopt a motion 
recommending the Board of Supervisors approve Z2024059 
subject to conditions ‘a’ – ‘p’:  
 
a. 
Development of the site shall be in substantial conformance with the zoning exhibit 
entitled “Hyder Solar”, consisting of six full-size sheets, dated July 11, 2024, and stamped 
received July 17, 2024, except as modified by the following conditions. Staff may 
determine slight refinements to remain in substantial conformance with the approved site 
plan.  Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Hyder Energy Center Project”, consisting of 19 pages, dated July 2023, and 
stamped received July 19, 2023, except as modified by the following conditions. 
 
c. 
The landowner or developer shall coordinate with the Arizona Game & Fish Department in 
each phase of development to determine best management practices to minimize 
impacts on the area’s wildlife. The landowner or developer shall coordinate with the

Arizona Game & Fish Department to determine the appropriate wildlife surveys, habitat 
surveys, and/or requests that will need to be conducted during the development of the 
site.  
 
d. 
The following Planning Engineering comments shall apply:  
 
1. 
Without the submittal of a precise plan of development, no development approval 
is inferred by this review, including, but not limited to number of proposed building 
lots/units, drainage design, access, and roadway alignments. These items will be 
addressed as development plans progress and are submitted to the County for 
further review and/or entitlement. 
 
2. 
A traffic impact study must be submitted with any Plan of Development for the 
site. 
 
3. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards, and best practices at the time of 
application for construction. 
 
e. 
The following MCDOT Planning comments shall apply:  
 
1. 
A Solar License is required from MCDOT for any private utility entity that will 
occupy the County right-of-way (i.e. transmission facilities). 
 
2. 
All section lines and mid-section lines that fall on the perimeter of the project shall 
have dedicated setbacks of 55 feet for section line roadways and 40 feet for mid-
section line roadways respectively per the Maricopa County Zoning Ordinance 
Section 1105.  
 
3. 
The following future roadway reservations shall be required:  
 
 
a. Agua Caliente Rd. shall have a 55 foot reserved half-width from the section 
line.  
 
b. Hyder Rd. shall have a 30 foot reserved half-width from the street’s centerline.  
 
c. Old Agua Caliente Rd. shall have 30 foot reserved half-width from the street’s 
centerline.  
 
 
f. 
The following requested IND-2 IUPD zoning district development standards shall apply:  
 
1. 
There shall be no required yards for solar panel arrays, but no structure shall 
overhang over a property line or within any right-of-way.   
 
2. 
There shall be no landscaping requirements for this project.  
 
3. 
There shall be no parking requirements, except for any required ADA accessible 
parking requirements.

There shall be no required loading/unloading spaces. 
 
5. 
Photovoltaic solar panel arrays shall not contribute to lot coverage calculations.  
 
6. 
There shall be no sight-visibility-triangles for any site ingress/egress points, 
section lines and/or mid-section line intersecting alignments.  
 
7. 
Photovoltaic solar panel arrays and associated utility uses shall not be enclosed 
in a building.  
 
8. 
Alternative surfacing materials or other methods approved by Maricopa County Air 
Quality to minimize dust pollution shall be allowed in driveways and parking areas.  
 
9. 
A minimum of six-foot tall chain link fences and gates without screening materials 
with one foot of barbed wire attached to the top shall be allowed adjacent to any 
zoning district.  
 
10. 
Attached barbed wire or concertina wire shall be permitted under a height of eight 
feet for fences and gates.    
 
11. 
Structures that support high tension electric lines shall have a maximum height of 
196 feet.  
 
g. 
The IUPD overlay instrument is applied to restrict the use of the site, and this IND-2 IUPD 
shall limit the use of the site to a photovoltaic solar electric generation facility including 
any ancillary uses of the facility (such as battery energy storage systems, 
operation/maintenance building, and electric substation/transmission lines).  Any other 
uses on the site shall require a zone change major amendment. 
 
h. 
Prior to the submittal of any Plan of Development of this site, a copy of the completed 
Class I Cultural Resources Inventory Survey for private parcels and ASLD lands, mentioned 
in the narrative report, and a copy of the Class III Cultural Resources Inventory Survey for 
the ASLD lands, mentioned in the narrative report, shall be submitted.  
 
i. 
Prior to the submittal of any Plan of Development for this site a copy of the Military 
Aviation and Installation Siting Clearinghouse Letter, mentioned in the narrative report, 
that states if this proposal on this site meets the requirements or regulations of Luke Air 
Force Base.  
 
j. 
All outdoor lighting shall be in compliance with Section 1112 of the Maricopa County 
Zoning Ordinance.  Any outdoor lighting shall be placed so as to reflect light away from 
any adjoining rural or residential zoning district.  
 
k. 
Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to the 
issuance of a building permit, written confirmation shall be required from the emergency 
fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required.

l. 
If Hyder Energy Center, in whole or in part, is constructed and ceases operating for a period 
of five years or more, the owner shall be responsible for decommissioning the non-
operating portion of the site including the regrading and restoration of the site. 
Decommissioning of the site shall include all structures above and under the ground up 
to three feet in height that are part of the decommissioned facility. All decommissioning 
and restoration activities must adhere to the requirements of the appropriate governing 
authorities, and shall be in accordance with all applicable, federal, state, and County 
regulations. The Owner shall inform any future buyers/property owners of this 
decommissioning requirement and of their responsibility to decommission. 
 
m. 
The developer shall provide at least five-days’ notice to adjacent privately-owned parcels 
internal or external to the area of the zone change of heavy construction traffic and 
disruption to any easement providing those owners with direct access to their properties.  
An appropriate detour shall be provided to these owners. 
 
n. 
Amendment to the zone change shall be processed as a revised application in accordance 
with Maricopa County Zoning Ordinance requirements.  
 
o. 
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.  
 
p. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner. The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
shall revert to the zoning that existed on the date of application.  It is, therefore, stipulated 
and agreed that either revocation due to the failure to comply with any conditions, does 
not reduce any rights that existed on the date of application to use, divide, sell, or possess 
the property and that there would be no diminution in value of the property from the value 
it held on the date of application due to such revocation of the Zone Change. The Zone 
Change enhances the value of the property above its value as of the date the Zone Change 
is granted and reverting to the prior zoning results in the same value of the property as if 
the Zone Change had never been granted.

Project Summary: 
 
1. 
The applicant is requesting a zone change with an overlay from Rural-190 to IND-2 IUPD on a 
4,605 acre site to accommodate the development of a phased utility-scale photovoltaic solar 
panel electric generating facility with a battery energy storage component. Once complete, the 
facility will produce approximately 475 megawatts (MW) of electricity. This industrial rezone will 
allow for the electric production facility and the IUPD overlay is intended to vary certain 
development standards due to the unique design of these types of facilities. The site is located 
between Butterfield Stage Rd. to the north and the Agua Caliente Mountains to the south. 
Moreover, the site is between the Yuma County line to the west and 555th Ave. to the east in the 
Hyder area.   
 
2. 
The terrain of the site is flat with a small portion of the Agua Caliente Mountains in the south that 
will not be developed. The center of this site contains existing northeast/southwest Hassayampa 
electric transmission lines that runs parallel with Hyder Rd. Currently, the applicant is proposing 
to add an estimated 714,286 photovoltaic solar panel modules. The site will be enclosed with six-
foot tall chain link fences topped with one foot of barbed wire fencing for security. There will be 
security lighting that will be shielded and comply with County standards and international dark 
sky requirements. This development will have an area reserved for a future Battery Energy Storage 
System (BESS) that will contain several lithium battery modules inside large containers. 
Additionally, this facility will contain a future Operation/Maintenance facility that will be generally 
have approximately three staff members, and a new electric substation.  This proposal will be 
completed in phases based on current market conditions with individual Plan of Developments 
for each phase that will be approved administratively.  
 
3. 
This facility is similar to many solar energy projects with large arrays of photovoltaic collectors 
to capture natural solar rays and convert into alternating current electricity. Once power is 
generated it will be interconnected into the regional power grid by a future on-site substation via 
overhead or underground electric transmission lines. The flat terrain of the site requires little or 
no additional grading for this site maintaining the natural landscape. There are areas of this site 
within existing floodplain, floodway, and mountainous terrain that will be not developed and kept 
in its natural state, except for any necessary driveway or transmission line.  
 
4. 
On December 8, 2021, the Board of Supervisors approved a Major Comprehensive Plan 
Amendment (CPA) that changed the land use designations listed in the County’s Vision 2030 
Comprehensive Plan from Rural Density Area (RDA) (0-1 du/ac) to Utilities for 3,619 acres of the 
site (CPA2021011).  Followed by a second Major CPA for 1,997 acres of the site, which was 
approved on December 7, 2022, by the Board of Supervisors that changed County’s Vision 2030 
Comprehensive Plan from RDA (0-1 du/ac) to Utilities (CPA2022009). Finally, a General CPA was 
approved on October 18, 2023, by the Board of Supervisors that changed County’s Vision 2030 
Comprehensive Plan from RDA  (0-1 du/ac) to Utilities that affected the remaining 110 aces of 
the site (CPA2023010). On July 2, 2024, members of the Technical Advisory Committee met with 
the applicant to discuss the first review comments for this case.

Vision 2030 Comprehensive Plan (adopted January 13, 2016): The site was originally designated 
Rural Development Area (RDA) (0-1 du/ac). This land use category denotes areas where single-
family residential development or agricultural uses are desirable but urban services (sewer, water, 
law enforcement, fire protection, schools, parks, etc.) are limited.  However, the subject site had 
three CPAs that changed the land use designation of the site to Utilities, which superseded the 
RDA designation of the site and conforms with electric generation facilities (CPA2021011, 
CPA2022009, and CPA2023010). The governing land use designation is Utilities. 
 
Public Participation Summary:

The applicant has complied with the requirements stated in Maricopa County’s citizen review 
process with the required posting of the site and notification to adjacent property owners within 
300 feet of the subject parcel and interested parties via first-class mail. The applicant has 
submitted a Public Participation Results Report and according to the report the applicant received 
three inquiries about the project from the public. Additionally, the applicant held a virtual meeting 
after notifying and inviting the public on July 24, 2024; however, no one from the public responded 
to the invitations or attended the meeting.

Staff Analysis:

Staff supports this zone change on this site since the development of clean alternative energy 
production such as solar collection does not produce greenhouse gas emissions or negatively 
affect air quality. Additionally, the economic benefits of both the initial development and the long-
term would be beneficial to this portion of the County. The trading of electricity that will be 
produced from the site will also be a sustainable economic benefit for the western region of the 
United States. Hyder Energy Center will utilize photovoltaic technology panels that will follow the 
sun throughout the day constantly absorbing solar energy as a direct current and converting it to 
alternating current for electricity distribution onto the electric grid. Additionally, the use of the 
battery storage will be able to store electricity for distribution on cloudy days or in the evening will 
be an added benefit of this facility. Unlike other energy production that requires large amounts of 
water and fossil fuels, photovoltaic solar generation needs only a small amount of water to 
occasionally clean the solar panels and no need for fossil fuels during the day-to-day operation 
of the facility.  
 
14. 
Staff believes that photovoltaic solar generation facilities are compatible with rural areas, 
especially on sites that are isolated from any dense residential development. These types of 
facilities generally require flat terrain and access to electric transmission lines with adjacent 
electrical substations which makes this site a perfect location due to these attributes. Since this 
site is located adjacent to electrical substations and transmission lines staff believe this facility 
will have a minimal impact in the immediate area. Staff believe that the requested development 
standards are reasonable and are consistent with recently approved photovoltaic solar 
generation facilities in this part of the County.  
 
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors

The IUPD overlay instrument is applied to restrict the use of the site, and this IND-2 IUPD 
shall limit the use of the site to a photovoltaic solar electric generation facility including 
any ancillary uses of the facility (such as battery energy storage systems, 
operation/maintenance building, and electric substation/transmission lines).  Any other 
uses on the site shall require a zone change major amendment. 
 
h. 
Prior to the submittal of any Plan of Development of this site, a copy of the completed 
Class I Cultural Resources Inventory Survey for private parcels and ASLD lands, mentioned 
in the narrative report, and a copy of the Class III Cultural Resources Inventory Survey for 
the ASLD lands, mentioned in the narrative report, shall be submitted.  
 
i. 
Prior to the submittal of any Plan of Development for this site a copy of the Military 
Aviation and Installation Siting Clearinghouse Letter, mentioned in the narrative report, 
that states if this proposal on this site meets the requirements or regulations of Luke Air 
Force Base.  
 
j. 
All outdoor lighting shall be in compliance with Section 1112 of the Maricopa County 
Zoning Ordinance.  Any outdoor lighting shall be placed so as to reflect light away from 
any adjoining rural or residential zoning district.  
 
k. 
Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to the 
issuance of a building permit, written confirmation shall be required from the emergency 
fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
l. 
If Hyder Energy Center, in whole or in part, is constructed and ceases operating for a period 
of five years or more, the owner shall be responsible for decommissioning the non-
operating portion of the site including the regrading and restoration of the site.

Decommissioning of the site shall include all structures above and under the ground up 
to three feet in height that are part of the decommissioned facility. All decommissioning 
and restoration activities must adhere to the requirements of the appropriate governing 
authorities, and shall be in accordance with all applicable, federal, state, and County 
regulations. The Owner shall inform any future buyers/property owners of this 
decommissioning requirement and of their responsibility to decommission. 
 
m. 
The developer shall provide at least five-days’ notice to adjacent privately-owned parcels 
internal or external to the area of the zone change of heavy construction traffic and 
disruption to any easement providing those owners with direct access to their properties.  
An appropriate detour shall be provided to these owners. 
 
n. 
Amendment to the zone change shall be processed as a revised application in accordance 
with Maricopa County Zoning Ordinance requirements.  
 
o. 
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.  
 
p. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner. The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
shall revert to the zoning that existed on the date of application.  It is, therefore, stipulated 
and agreed that either revocation due to the failure to comply with any conditions, does 
not reduce any rights that existed on the date of application to use, divide, sell, or possess 
the property and that there would be no diminution in value of the property from the value 
it held on the date of application due to such revocation of the Zone Change. The Zone 
Change enhances the value of the property above its value as of the date the Zone Change 
is granted and reverting to the prior zoning results in the same value of the property as if 
the Zone Change had never been granted.

1.0 
Purpose of Request 
This report addresses the information required to apply for a Zone Change for the Hyder Energy Center 
Project (the Project). Hyder Energy Center, LLC (HEC), as the Applicant, is proposing the construction and 
operation of an electrical generation facility consisting of photovoltaic (PV) solar modules and a battery 
energy storage system (BESS), collectively referred to as the Project. The expected maximum net output 
would be up to 475 megawatts of alternating current (MWac) once converted from direct current. The 
Project would be located on up to 4,605 acres of private land in the unincorporated area of Maricopa 
County (County), Arizona; see Figure 1, Appendix A. This request is for a 4,605-acre zone change with 
overlay from RU-190 to IND-2 Industrial Unit Plan of Development (IUPD).  
Due to the large size of the project and numerous landowners involved, county land entitlement 
permitting for the Project occurred in multiple phases. In 2021, 3,619 acres were approved in the Major 
Comprehensive Plan Amendment (MCPA) process (CPA2021011). In 2022, 1,997 acres were approved in 
the Major Comprehensive Plan Amendment (MCPA) process (CPA2022083). In 2023, 118 acres were 
approved in the General Comprehensive Plan Amendment (GCPA) process (CPA2023010). Approximately 
1,129 acres from phases 1-3 of the Project have been removed from development following layout 
optimization and additional constraints analysis, and only 4,605 acres of all 3 phases will be subject to this 
current zone change request.  
In summary, the Applicant is proposing to apply for a zone change, and this zone change application 
includes parcels previously approved for two MCPA’s and one GCPA which allowed for “Utilities” as a 
future land use designation. Table 1 below describes past and current land entitlement permitting for 
both phases of the project.

1.1 
Description of Proposal 
The Project would include up to 714,286 solar modules, rated at up to 665 watts direct current (dc) per 
module, and mounted on single-axis trackers. It should be noted that watts per module may vary at the 
time of construction; however, an approximate module output of 665 watts dc is included for planning 
purposes. In addition to the installation of solar modules, the Project would include the construction of a 
Project substation, BESS, and operation and maintenance (O&M) building that would include a connection 
to an adjacent septic system. The Project would interconnect to one of the 500kV Hoodoo Wash – 
Hassayampa transmission lines owned by San Diego Gas & Electric (SDG&E) and controlled through the 
California Independent System Operator (CAISO), located 0.4 mile north of Hyder Road. The Project 
substation, BESS warehouse, and O&M building would be located on up to 45 acres within the area 
included in Phase 1, (see Appendix A). The expected maximum net output from the combined solar 
modules and BESS is up to 475 MWac. The design life of the Project is anticipated to be 40 years. 
The Project site is situated in a prime location within the regional electric grid and in a relatively remote 
area suited for renewable energy development. Anticipated benefits of the Project include:  

Compatibility with existing land uses – existing electrical transmission corridors and electrical
substations are located near the HEC site, and land uses within the HEC site include agriculture
and undeveloped lands.

Compatibility with approved land uses/zoning – existing IND-2 and IND-3 zoning to the east of
the site and existing solar to the west within adjacent Yuma County jurisdiction.

Low cost, clean renewable energy to the electrical grid.

Emission-free, solar electrical energy to the electrical grid.

Job creation (described in section 1.6).

Building Descriptions/Locations

The Project would include the construction of a Project substation, 
BESS, O&M building, and other ancillary facilities. The proposed 
location of the O&M, BESS, and HEC substation would be west of 
Agua Caliente Rd and north of Hyder Rd within the Phase 1 
boundary. Fencing adjacent to any existing residences will be 
constructed with 80% opacity screening. The Project will be 
enclosed by a 6-foot high, chain-link fence around the perimeter of 
the site. The gate to the facility will be 24-feet wide and locked, and 
a Knox box will be provided for emergency access. 
Type of Construction Material 
The Project O&M building will be a prefabricated building made 
using a combination of timber, steel, and fiberglass on a concrete 
pad. Steel shipping containers on concrete pads will house the 
batteries that make up the BESS. The PV solar panels will be 
mounted on steel racking systems attached to steel piles. 
Color palette 
The color palette of the Project O&M building and other structures 
will be neutral and intended to blend into the surrounding area. 
Site Dimensions/Boundaries 
The Project O&M building will be approximately 3,500 square feet. 
The BESS will occupy up to 40 acres, the substation will occupy 5 
acres. The Project gen-tie structures may be between 160-190 feet 
high, spaced approximately 1,000 feet apart, and the boundary 
fence will be 6 feet tall. Voltage wiring trenches will be 2-feet wide 
by 18 to 24 inches deep. 
Signs 
A Project sign will be placed at the main entrance to indicate the 
entrance to Hyder Energy Center. 
Landscape/Retention Areas 
No landscaping is proposed per IUPD table. Stormwater retention 
areas will be placed in optimal locations onsite to address County 
engineering requirements for drainage.   
Outdoor Lighting 
Permanent, outdoor, night lighting will be installed at the BESS, 
O&M building, and the Project switchyard. Lighting will be fixed to 
buildings and other structural supports, where required, or on 
ground-mounted poles approximately 25 to 35 feet high, except in 
the parking area. Some portable lighting may be required for 
maintenance activities that must be performed at night. Any 
outdoor lighting shall be in conformance with the provisions in 
Chapter 11, Section 1112. Any outdoor lighting will be placed to 
reflect light away from any adjoining rural or residential zoning 
district. The maximum height for light poles in a parking area is 18

Water Features 
There are several washes that run along the southern portion of 
HEC; the Applicant will seek to avoid building on washes wherever 
possible. 
Irregular Site Features 
Floodplains are located intermittently within the southern half of 
the site and are mapped as Zone A floodplain, 1% annual chance 
flood hazard. The Project may pursue a Floodplain Use Permit (FUP) 
from Maricopa County Flood Control District; however, the 
floodplain along the Gila River will be avoided.

The Project is in unincorporated Maricopa County, approximately 30 miles west of the Town of Gila Bend. 
HEC is situated northeast of the Agua Caliente Mountains and north of the Gila River, and the northern 
portion of the site is situated within Hyder Valley. Topographically, the site slopes slightly to the southeast 
toward the Gila River. Elevations within the Project site range between approximately 970 – 454 feet 
above mean sea level. The Project is bounded by Butterfield Stage Road (approximately 1 mile) to the 
north, 555th Avenue to the east, and the Maricopa and Yuma County boundary the west. Generally, the 
center of the Project is located at Latitude 33°1'16.52"N and Longitude 113°18'51.28"W, or the midpoint 
of T5S/R10W Section 5.  
This zone change request is for the entire Project site consisting of multiple parcels of land within the 
following township (T), range (R), and section: 

T4S/R10W: Sections 29, 30, 31, 32, 33, 34.

T5S/R10W: Sections 5, 6, 7, 8, 17, 18.
The Applicant has secured submitted applications for state leases for all parcels included within MCPA 
Phase 1. The Applicant has secured purchase options for the private parcels included within MCPA Phase 
1, MCPA Phase 2, and GCPA Phase 3 (see Figure 2). A list of all parcels within the Project boundary are 
provided as an attachment to the application form.  
The Project site is situated on primarily privately held land and state trust land, in unincorporated 
Maricopa County, Arizona. State trust land and land managed by the Bureau of Land Management (BLM) 
is located adjacent to the southern and eastern portions of the Site (see Figure 1). The Gila River passes 
within one mile of the southern extent of the site. An out of service Union Pacific Railroad (UPRR) right of 
way, the existing 500kV Hoodoo Wash – Hassayampa and the Hassayampa – Gila transmission line 
corridors, a Kinder Morgan natural gas pipeline, various Arizona Public Service (APS) distributions lines, 
and fiber optic lines all bisect the site parallel to Hyder Road. The Applicant is currently working with all 
entities along Hyder Road to obtain crossing agreements for medium voltage (34.5kV) electrical lines that 
will electrically connect the Project north and south of Hyder Road. 
The Project site and surrounding lands are within the Rural-190 Zoning District (RU-190) within Maricopa 
County which allows for both farm and non-farm residential uses as well as farms and recreational and/or

institutional uses. In addition, there are approximately 80 acres to the east of the site that is zoned as 
Heavy Industrial Zoning District (IND-3) Industrial Zoning District and approximately 29 acres to the east 
of the site that is zoned as Light Industrial Zoning District (IND-2).  
The Project would not be developed in a floodway. Further, the Project would comply with Maricopa 
County and federal regulations associated with development in a floodplain. It is anticipated that a 
floodplain use permit would be required for the Project. It is anticipated that the Project would require a 
FUP from Maricopa County Flood Control District.  
The Project will benefit the community by creating temporary construction jobs, and long-term 
maintenance and monitoring staff positions. Furthermore, HEC will be a source of tax revenue to the 
County and a quiet neighbor to landowners near the Project. 
The impact to surrounding properties and landowners (visual, noise, dust generation, etc.) will be minimal 
post-construction. During construction, impacts will be minimized by applying water to disturbed areas to 
reduce fugitive dust. Additionally, construction work will only take place during daytime hours, and the 
Project will be developed in phases so that the entire project area is not under construction at once. It is 
worth noting that the Project area is primarily agricultural land and open desert. Approximately less than 
10 residential structures are within less than 300 feet of the Project. 
1.3 
Location Accessibility 
The Project site will have multiple access points. The Project site is currently accessible along Hyder Road 
bisecting southwest to northeast in the northern end of the site, as well as by Agua Caliente Road 
bisecting north to south. Construction access would be primarily from I-8 west and the Agua Caliente 
Road interchange. 
The Project parking area will be located near the O&M building where there would be at least one 
Americans with Disabilities Act (ADA) parking space, but the IUPD request will eliminate any required 
parking amounts. 
1.4 
Circulation System 
There will be ingress and egress along Hyder Road and Agua Caliente Road. Final access points will be 
determined at time of Plan of Development (POD). Interior roads are expected to be 16-feet wide 
(conforming to International Fire Code (IFC) 2018), accessed by 24-feet wide gates. 
Several existing graded and asphalt-paved major/minor/local/farm roads are within the Project site. 
Access entry points to the Project will have paved aprons. Roads within the Project will be constructed of 
compacted aggregate base with a gravel overlay, pursuant to the MCDOT Roadway Design Manual 2023. 
Most of the ingress/egress and access points will be exclusively for construction and maintenance 
personnel to access the solar array. No new roadway construction or roadway improvements are 
anticipated outside the Project area.   
1.5 
Development Schedule and Methods 
The construction of the Project will take place in multiple stages and take up to 36 continuous months to 
complete. A first stage of construction would include on-site assembly and installation of solar panels for

up to 400 MWac of capacity, construction of the switchyard and interconnect, O&M building, and the 
BESS. Voltage wiring trenches will be constructed 2’ wide by 18-24” deep. Construction would commence 
upon acquisition of the necessary permits and approvals. Upon completion of each stage, the site would 
be stabilized (e.g., erosion control) and commissioning would ensue. It is anticipated that construction 
would begin in 2025 for the first stage with both construction stages for the 800 MWac HEC project 
completed by 2027-28.  
Construction would require the use of graders, trenchers, tractors, cranes, and miscellaneous equipment. 
The Project will use a variety of low-impact site preparation methods that meet all development, 
engineering, construction, and safety requirements. Because the Project site is primarily agricultural land, 
the presence of natural wildlife habitat within these lands is mostly absent. For portions of the Project that 
do contain marginal natural wildlife habitat, site preparation methods would include: 
 
Grading and Leveling: This method of site preparation removes vegetation and surface soils, 
resulting in flat, smooth surfaces devoid of vegetation. It is used to prepare surfaces for roads, 
inverters, and buildings. In some cases, such as inverter and substation foundations, excavation is 
also used in which surface and subsurface soils are removed to a depth of 12 inches or more. 
Stormwater retention basins would be excavated and graded. 
 
Mow-and-Go: This is the preferred site preparation method for the Project. Vegetation is mowed 
or cut low to the ground before construction while retaining the plant’s root structure. This is 
accomplished by using a bush hog or similar tractor-mounted brush cutter. This method of site 
preparation minimizes disturbance to vegetative root structures and soils, and natural drainage 
areas are left in place. 
 
Mow-and-Go with Tilling: This method is not anticipated to be required for the project due to the 
nature of vegetation on-site. If required, a tractor with a mounted tiller or disk would be used to 
remove large stumps and thick vegetation. For this method of site preparation, vegetation is 
removed, and soils are mixed but left in place. Soils are not compacted after tilling. 
 
Drive-and-Crush: This method of site preparation uses a vehicle and equipment tires or tracked 
machinery to crush the vegetation and soils.  
Prior to the start of limited grading and site leveling, the Project site will be pruned of vegetation to within 
4 to 6 inches of the ground where construction activities will occur. As stated previously, the intent of the 
Applicant is to keep plant roots intact in areas where drainage features, concrete foundations, gravel pads, 
roads/parking areas, or underground cabling are not required. All pruned vegetation will be stockpiled 
and properly disposed of off-site. Grading will consist of excavation and soil compaction to meet Project 
design requirements. Where grading is required within the solar array, the grading will match existing land 
contours as close as possible to minimize ground disturbance. 
A hydraulic driver will be used to drive metal supports into the ground that support solar panel racking. 
The Project will be enclosed by a 6-foot-high chain-link fence around the perimeter of the site. The gate 
to the facility will be 24 feet wide, locked, and a Knox box will be provided for emergency access. The 
O&M building will have an adjacent gravel parking lot with a maximum of eight parking spaces of 
approximately 10 feet by 20 feet and at least one ADA space. 
For purposes of planning, construction of the Project will be split into at least two phases of 400 MWac 
each. The Project would create up to 100 construction jobs per month for 24-36 months, with a peak of 
up to 300 jobs. An estimated 400-600 construction vehicle trips per day, with a peak of around 800

vehicle trips per day, would be required for transport of construction workers; import/construction of 
solar module materials, substation equipment, interconnect, BESS, O&M building; and construction of 
compacted roads. 
The Project will comply with County requirements for construction and earth-moving activities. A 
construction Stormwater Pollution Prevention Plan (SWPPP) would be in effect to prevent impacts on 
adjacent properties from stormwater generated on-site. Stormwater runoff would be retained on-site. 
Additionally, encroachment permits would be obtained from MCDOT, APS, and utility companies as 
required, prior to issuance of a building permit.

Community Facilities and Services 
Community facilities and services for the Project area include the Sentinel Elementary School District. 
Approximately 30 miles to the west, the town of Gila Bend has a couple parks and community amenities, 
including, but not limited to, the Gila Bend Brand Library and the Gila Bend Unified School District.

Development Standards Comparison Chart 
Table 4 lists the applicant’s proposed variations from development standards that are consistent with previously approved utility-scale solar 
projects in this area.  
The proposed IUPD Overlay is requested to modify specific development standards that are typical of solar development in Maricopa County and 
notably the surrounding area. As part of this Overlay, the only allowed uses would be strictly for solar generation with BESS and other solar related 
accessory uses. We understand that the project size and lack of urban services in the area needs to restrict the requested industrial zoning to only 
solar facility uses, which will also limit impacts of more intense industrial uses on the surrounding area.  
The proposed variations in development standards are based on other approved solar facilities within Maricopa County, which we want to be 
consistent with in our requests. The proposed setback for the solar panels is requested at 0' for all yards (front, sides, and rear) as this will allow for 
flexibility with the future site layout (POD phase) and maximum allowance for electrical output. To note, other site structures/buildings would need 
to maintain the required setbacks for the IND-2 zoning district. Maximum lot coverage is proposed to not count the solar panels as part of the 
60% coverage that is allowed, this is also consistent with other solar sites as the panels will be located on most of the site area. Parking 
requirements are to be waived given the anticipated minimal number of employees on-site after construction is completed. Paving for parking 
would be stabilized DG to limit any issues with dust for air quality purposes. SVTs would also not be required given the Project's remote location 
and anticipated limited amounts of site vehicular ingress/egress, which will mostly be for periodic maintenance once the facility is operational. 
Chain link fencing is also a standard for solar facilities with barbed wire added for security purposes, so there is no need for a solid wall to surround 
the entire site. Lastly, we are requesting a transmission line maximum height increase to 196'. However, the heights will vary from 153'-196' for the 
transmission poles.

1.9 
Compliance with City/Town General Plan & Consistency with Agency 
Management Objectives  
The Project is located 30 miles west of Gila Bend, Arizona, and not expected to be annexed by any city or 
town. No water, sewer, police, or fire services will be provided to the Project by Gila Bend or any other city 
or town.  
Since 2021, the Project has sought out public commentary and consulted with regulatory agencies. HEC 
has conducted public outreach through a vast variety of mediums to encourage public participation. HEC 
has encouraged public comments using mail notifications, information sheets, signs, questionnaires, 
public meetings, and a project website.  HEC has held three public meetings from 2021-2023, in which the 
public was informed of the Project and allowed to ask questions and make comments. The first public 
meeting was held on September 15, 2021, and 6 members of the public attended. The second meeting 
was held on September 14, 2022, and 9 members of the public attended. The third meeting was held on 
August 15, 2023, and 4 members of the public attended. Scoping reports for these meetings are available 
under separate cover.  
Additionally, HEC has conducted further enhanced outreach and sought out agency consultation with a 
variety of stakeholders considered “Areas of Interest.” The following subsections describe several of the 
agency consultations that have been initiated throughout the Project’s planning process. 
Arizona Game and Fish (AZGFD) - The Project has conducted initial surveys to describe the ecological 
conditions across the Project area several times in 2021 and 2022. In addition to a field site investigation, 
the US Fish and Wildlife Service (USFWS) Information for Planning and Consultation website and the 
AZGFD Online Environmental Review Tool have been queried for information on special status species, 
including federal threatened and endangered species, for the Project area. HEC has coordinated with 
wildlife agencies, particularly the AZGFD, since October 2021, during the 2021 CPA (CPA#2021011) 
application process and worked to develop protection measures and address concerns with species 
highlighted by the AZGFD for the 2022 CPA (CPA#2022009) in July 2022. Consultation with the AZGFD is 
still ongoing, and the Project has considered implementing protection measures, such as pre-construction 
surveys for some species, biological monitoring during construction limiting the amount of ground 
disturbance, utilizing wildlife friendly fencing, and developing wildlife movement corridors. The Applicant 
continues to work with AZGFD to develop best management practices and design features that minimize 
impact on wildlife and their associated habitat.  
Arizona State Historic Preservation Office (SHPO) – Consultation with SHPO has also been initiated to 
identify significant cultural resources. A Class I and Class III Cultural Resources Inventory and Pedestrian 
survey were completed and the SHPO has concurred that no cultural resources identified are eligible for 
listing on the National Register and no further surveys are warranted. It should be noted that the State of 
Arizona requires that the inadvertent discovery, during construction, of human remains and funerary 
objects be reported to the Director of the Arizona State Museum (ARS §41-865) upon discovery.  
Luke Air Force Base (LAFB) – HEC consulted with the Community Initiatives Team at LAFB and at their 
recommendation have applied for Informal Review to the Military Aviation and Installation Assurance 
Siting Clearinghouse (Clearinghouse), tracking number 2022-08-S-DEV-16. Christopher Toale, Director of 
the Community Initiatives Team sent a letter dated September 15, 2022, explaining that a change in land 
use designation from Rural Residential to Utilities will not affect Luke AFB flying operations. The

Clearinghouse review was completed on September 29, 2022. On June 22, 2023, Wood and the Applicant 
conducted a meeting with the Community Initiatives Team and Range Management Office at LAFB. 
Following the meeting, the Applicant submitted a tower configuration plan and KMZ that provides 
clearance heights to Luke AFB.  
Arizona Department of Transportation (ADOT) - HEC received a request from the Arizona Department 
of Transportation (ADOT) to be kept updated throughout the life of the Project, but no opposition was 
raised by ADOT. 
The Project is committed to continuing communications with stakeholders and agencies through 
consultations and solicitations of public comment to minimize potential impacts of the Project.

The Arizona Game and Fish Department (Department) appreciates the opportunity to review the
proposed Hyder Energy Center Solar and Storage Project. The Department understands that
Savion Energy proposes to construct a 475 MW photovoltaic (PV) solar facility with a battery
energy storage system (BESS) and associated infrastructure on approximately 4,605 acres of
private and Arizona State Land Department (ASLD) lands near Agua Caliente in Maricopa
County, Arizona. The facility will be located northeast of the Agua Caliente Mountains in
primarily undeveloped Sonoran desert scrub and agricultural land. The proposed project includes
the construction of a new substation that will connect to one of the existing 500kV Hoodoo Wash
- Hassayampa transmission lines that bisect the project area.
Under Title 17 of the Arizona Revised Statutes, the Department, by and through the Arizona
Game and Fish Commission, has jurisdictional authority and public trust responsibilities to
conserve and protect the state fish and wildlife resources. In addition, the Department manages
threatened and endangered species through authorities of Section 6 of the Endangered Species
Act and the Department’s Section 10(a)(1)(A) permit. It is the mission of the Department to
conserve and protect Arizona's diverse fish and wildlife resources and manage for safe,
compatible outdoor recreation opportunities for current and future generations.
The Department recognizes the importance of planning efforts to develop renewable energy
locations that contribute to regional and state economic growth needs and would like to continue
to work closely with Savion Energy, John Wood Group PLC (Wood), and Maricopa County
during the planning and development of this facility. The Department recognizes that appropriate
coordination, proper planning, and voluntary implementation of best management practices
allow projects to be developed that avoid, minimize, or offset potential impacts to wildlife and
recreational access during development and operation of the facilities. For your consideration,
the Department provides the following comments based on the agency's statutory authorities,
public trust responsibilities, and special expertise related to wildlife resources and recreation.

Arizona has recently seen an increase in the number of proposed and in-development renewable
energy generation projects and associated infrastructure. A number of solar projects have been
built or proposed within the vicinity of this project. Although each of these projects individually
may have a minimal impact on the broader landscape, these projects cumulatively could result in
loss of habitat, impact wildlife movements, and affect wildlife-related recreation. Additionally,
long-term effects to wildlife can extend several kilometers beyond the footprint of a solar project
area (Sawyer et al. 2022 ). It is important to consider all potential cumulative effects and to

evaluate this project in association with other projects in the area. Department staff are available
to assist in identifying potential cumulative impacts to wildlife and associated voluntary
conservation measures that can be implemented for the project.
The Department recommends conducting surveys in the project area to determine species
presence. These surveys should be of sufficient duration and intensity to adequately assess all
habitat types and potential wildlife species occurrence in and adjacent to the project area.
Department staff are available to assist Savion Energy in determining appropriate surveys to
conduct and design features and best management practices that can help minimize potential
impacts.
Based
on
the
information
provided,
the
Department
offers
the
following
recommendations to reduce potential impacts to wildlife and habitat; additional information can
be found in Guidelines for Solar Development in Arizona :

The endangered Sonoran pronghorn could occur in the project area and adjacent lands.
Sonoran pronghorn have specific habitat requirements based on their life history and
survival strategy. The Department would like to work with Savion Energy to minimize
any
potential impacts to this species. The Department recommends scheduling
construction activities outside the fawning season for Sonoran pronghorn (February 1 to
July 15) and requests coordination prior to construction activities in order to exchange
information on current Sonoran pronghorn use in the project area. If pronghorn are
detected during project activities, please notify the U.S. Fish and Wildlife Service3
(USFWS) and the Department’s Sonoran Pronghorn Program Lead Russell Gardner
(rgardner@azgfd.gov) as soon as possible.
●
The Sonoran desert tortoise, which is a federal and state species of special concern, has
the potential to occur in the southern portion of the project area near the Agua Caliente
mountains. While the project design avoids the mountains themselves, the rocky areas
near the base of the mountains that are not included in the exclusion area may provide
suitable habitat for this species. The Department recommends conducting surveys, in
accordance with the Desert Tortoise Survey Guidelines for Environmental Consultants ,

to determine the presence of this species or its habitat within the southern portion of the
project area. If tortoises are identified, please refer to and implement the Recommended
Standard Mitigation Measures for Projects in Sonoran Desert Tortoise Habitat and

Guidelines for Handling Sonoran Desert Tortoises Encountered on Development Projects

Suitable habitat for the western burrowing owl, a special status species that is regulated
under the Migratory Bird Treaty Act (MBTA), may be present within or adjacent to the
project area. If suitable habitat is present, the Department recommends conducting
occupancy surveys for this species in advance of the design phase to understand
distribution of burrowing owls in the project site; avoidance of a large burrowing owl
population may be advisable over removal or other conservation measures. Guidelines for
conducting this survey are found in Burrowing Owl Project Clearance Guidance for
Landowners . Please note that the survey should be conducted by a surveyor who is

certified by the Department or has similar training and qualifications. If an active
burrowing owl burrow is detected, please contact the Department and the USFWS for
direction, in accordance with the guidelines.
●
Large-scale solar PV facilities can result in bird mortality due to habitat loss, collision
with panels, attraction due to an optical illusion of water, and unknown causes (Kosciuch
et al. 2020 ). The Department recommends conducting avian surveys during the planning

stage in order to better understand species presence and to inform potential conservation
measures. Point counts are the preferred method for breeding bird surveys. These surveys
are conducted twice a year during the peak breeding season, which is mid-January
through June in this area; McLaren et al. (2019) outline protocols. Additional surveys for

Bendire’s and LeConte’s thrashers, two bird species of conservation concern, are
recommended; a draft protocol
from the Desert Thrashers Working Group is available

online.
●
The Department also recommends conducting surveys for nesting birds prior to
vegetation removal and/or construction activities that occur during the breeding season.
The vegetation within the project area may provide nesting opportunities for avian
species that are regulated under the MBTA. If it is anticipated the project will not be in
compliance with MBTA, the Department recommends contacting the USFWS for
technical assistance.
●
Burrowing mammals could occur within the project area and could be influenced by
construction activities and by loss of habitat. Surveys for these species are recommended
to determine their presence and to inform pre-construction activities. Department staff are
available to assist in identifying suitable conservation measures, such as one-way
exclosures on burrows that allow wildlife to exit the burrows and disperse to adjacent
lands in advance of construction.
Maintaining habitat connectivity is a priority for the Department, and wildlife movement
corridors are important for wildlife to respond to changing environmental conditions. The
landscape in which this project is proposed provides important movement pathways for wildlife.

The Department would like to meet with Savion Energy to discuss opportunities to incorporate
wildlife connectivity into the project design, including the following:
●
The Department recommends incorporating open unfenced corridors across the project
area into the project design to facilitate wildlife movement, including within upland
habitats as well as maintaining the ephemeral washes such as Nottbusch Wash and
Columbus Wash that occur in the project area in their natural state without fencing or
other barriers to wildlife movement. These washes serve multiple functions in the
ecosystem, including landscape-level conveyance corridors for wildlife movement.
●
The Department appreciates that grading will be minimized and the mow-and-go method
will be used when possible. Keeping the existing soil and root structures intact can
minimize erosional run-off and help reduce biodiversity loss within the site (Grodsky and
Hernandez 2020 ).

The Department’s Wildlife Compatible Fencing Guidelines
provide information on how
12
fencing impacts wildlife, ways to design fencing to prevent wildlife entanglement and
impalement, and to ensure wildlife movement is not restricted. Department personnel are
available as resources to help determine appropriate fencing design and layout that will
achieve its objective while reducing impact on wildlife, such as leaving a 6–8-inch gap
between the ground surface and bottom of the fence to allow for smaller wildlife species
to move freely through the area and make use of any habitat within the project boundary.
Finally, the Department offers the following general recommendations to reduce potential
impacts to wildlife and habitat during construction and operation of the facility:
●
A variety of other Arizona Species of Greatest Conservation Need (SGCN) have the
potential to occur within the project area. If wildlife are encountered during project
activities, the Department recommends moving them out of harm’s way, no more than
0.25 mile outside the project boundary within similar habitat. Please note that the Arizona
State Wildlife Action Plan was recently updated, and the Department has an interactive
website, Arizona Wildlife Conservation Strategy , that includes the most recent list of

SGCN to help navigate and identify conservation opportunities.
●
If trenching or digging of large holes will occur, the Department recommends that
trenching/digging and backfilling crews work together to minimize the number of open
holes/trenches at any given time. Where trenches/holes cannot be backfilled immediately,
the Department recommends escape ramps be constructed in each hole and at least every
90 meters in trenches. Escape ramps can be short lateral trenches or wooden planks
sloping to the surface, ramp slopes should be less than 45 degrees (1:1). Trenches or
holes that have been left open should be inspected for animals and animals removed prior
to backfilling.
●
The Department encourages the use of non-reflective coatings on the solar panels, which
can reduce the appearance of the array as a body of water and reduce the attraction of
birds to the site. Additionally, maximizing the spacing between solar panels can reduce
the appearance of the array as a body of water.

Birds of prey, such as raptors, owls, vultures, and eagles are vulnerable to powerline
strikes and electrocution during construction and operation of transmission lines and
substations as power poles can also serve as perches for birds of prey. The Department
recommends designing power lines and substations to be bird safe by following standards
established by the Avian Power Line Interaction Committee (APLIC) for new power
lines, which can be found in Suggested Practices for Avian Protection on Power Lines:
The State of the Art in 2006
and Reduced Avian Collisions with Power Lines: The State

of the Art in 2012 . Another possible alternative to reduce mortality is using bird flight
15
diverters to decrease avian mortalities. Tuk Jacobson, the Department’s Raptor
Coordinator, can provide further information on specific design features and best
management practices; he can be contacted at raptors@azgfd.gov or 623-236-7575.
●
Artificial lighting could impair the ability of nocturnal animals to navigate (e.g., owls,
migratory birds, bats, and other nocturnal mammals) and may affect wildlife behavior
and populations (Davies et. al. 2013 ). The Department recommends using only the

minimum amount of light needed for safety. If feasible, “warmer” narrow spectrum
lighting (amber, orange, red) is wildlife-friendly and should be used as often as possible
to minimize the number of species affected by lighting. It is also beneficial that all
lighting is shielded, canted, or cut to minimize the amount of upward shining light.
●
The information provided indicates that the project may include drainage improvements.
Department staff remain available to assist in identifying potential impacts to wildlife and
conservation measures to minimize potential impacts in development or construction of
erosion structures. As an example, rip-rap is difficult for many species to traverse. If
rip-rap is required for the construction of on-site retention basins or large-scale drainage
needs, burying and back-filling with topsoil or other substrate would allow wildlife to
move through the basins.
●
Please ensure the project complies with Arizona Native Plant Law
regulations. A Native

Plant Inventory may need to be conducted to identify, record, and coordinate plant
salvage efforts for species that are Protected under the Arizona Native Plant Law.
●
To minimize the potential introduction or spread of exotic invasive species, including
aquatic and terrestrial plants, animals, insects, and pathogens, the Department encourages
taking precautions to wash and/or decontaminate equipment before entering and leaving
the site. See the Arizona Department of Agriculture website
for a list of prohibited and

restricted noxious weeds and the Arizona Native Plant Society
for recommendations on

how to control them. To view a list of documented invasive species or to report invasive

The Department recommends revegetating disturbed areas with native drought-tolerant
species that represent the natural surrounding landscape. Landscaping with native plants

regarding guidelines for revegetation efforts.

Good afternoon Mr. Martell, 
  
Thank you for the opportunity to comment on the Zone Change application for the Hyder Energy 
Center LLC.  The proposed project spans 4,647 acres and the request is to rezone 4,605 acres from 
RU-190 to IND-2 Industrial Unit Plan of Development (IUPD).  The request to rezone is needed to 
construct 714,286 tracking solar modules along with a substation, operations & maintenance 
building, and a Battery Energy Storage System (BESS).  A map of proposed electric transmission 
lines has not been provided at this time.  However, it has been stated that the heights for the 
transmission poles would range from 153-196 feet.  The site is located outside the Luke AFB 1988 
JLUS 65 DNL, “high noise or accident potential zone,” as identified by A.R.S. § 28-8461, and is 
outside the “territory in the vicinity of a military airport,” also defined by A.R.S. § 28-8461.  However, 
the entirety of the project is located underneath multiple low-level military training routes (MTRs). 
  
Luke AFB continually appreciates the opportunity to provide comments, acknowledging that we are 
not the approval authority.  Luke AFB follows A.R.S. § 28-8481 when evaluating compatible land 
use within the “territory in the vicinity of a military airport”.  Given the location of this development 
project, we have identified actual and/or potential mission risks and hazards should the 
development encompass the following:  
  
1. Light interference – Equipment or structures that would produce light interference at night 
and or glint/glare during the day that would distract or interfere with pilot vision. 
 
2. Spectrum utilization and Electromagnetic interference – Buildings or structures that would 
cause a loss of RADAR coverage such that it interferes with spectrum utilization. 
Additionally, electrical emissions that would interfere with operating aircraft.  
 
3. Impairment of pilot’s visibility – Any production that would release substances into the air 
that would impair visibility or otherwise interfere with operating aircraft such as: steam, 
dust, or smoke. These items create a negative impact and should be eliminated.  
 
4. Bird Strike Hazard – Cooling ponds, standing water, or nesting areas on the property 
increase the potential for the congregation of fowl which are a hazard to flight safety and 
therefore the community. Mitigation measures to detract fowl from congregating on the 
property are highly encouraged.  
 
5. Potential of thermal energy events and electrochemical fire due to vibration caused by low-
level flights – developer to identify potential impacts and available emergency services. 
  
Since the overall proposed project location is located beneath multiple low-level MTRs, the 
locations and heights of transmission lines and tie-ins are imperative.  Subject to the results of an 
FAA Obstruction Evaluation/Airport Airspace Analysis and Spectrum Analysis (OE/AAA), this 
request may negatively impact the flying and base operations at Luke AFB.  We respectfully request 
the right to comment as the development matures and additional plans and mapping become 
available.  A .KMZ file is preferred for our transmission line review. 
  
Please ensure the project is submitted for an informal review through the DoD Siting Clearinghouse 
for Energy, Installations, and Environment.  The project narrative may be sent to: osd.dod-siting-
clearinghouse@mail.mil.  This response is also conditional upon their approval/input.

Additionally, it should be noted that certain investments and real estate transactions within the 
military installation footprint of Luke AFB may be subject to review by the Committee on Foreign 
Investment in the United States (CFIUS) to determine the effect of such transactions on the 
national security of the United States.  The CFIUS regulations, Foreign Investment Risk Review 
Modernization Act of 2018 (FIRRMA) provisions, and related resources can be found on the 
Department of the Treasury’s website: http://www.treasury.gov/cfius. 
  
Since the development will be located beneath MTRs, it will be subjected to a minimum of 170 over 
flights a day.  A strong notification program on the part of the applicant is essential to inform

ADOT requires a traffic statement of construction traffic and post-construction traffic traveling to and 
from the site. The statement should discuss in depth the amount of traffic using the state highway 
system, the current and needed pavement widths as well as the existing pavement conditions, and 
recommended pavement repairs/additional layers needed to accommodate stated traffic increases.
