Site Size: Approximately 5.1 acres (218,260 sq ft) County Island Status: Yes – Avondale Additional Comments: The proposed IND-2 IUPD zoning is to accommodate an indoor facility for salt distribution with future rail spur. the site is a former agricultural / industrial site with railroad siding. The facility will package and transfer salt from delivery trucks to railway cars. All activity will take place within the existing warehouse on site. The IUPD overlay zone will liberalize development standards for height and screening as well as limit the entitled uses. There are no outstanding concerns from County review agencies. The City of Avondale objects to the proposal stating it does not meet the City’s General Plan designation. However, the Commission’s recommendation for approval is based on the parcels historical use and recent similar zoning approval for the neighboring parcel. Since the Commission hearing, staff has received 25 letters of opposition chiefly from the residential neighborhood to the north across the railroad noting a potential for increased noise, dust and traffic congestion. The level of opposition has not triggered requirement for a super-majority (four affirmative) vote of the Board as all opposition is greater than 300’ distant from the site. The case was originally heard on September 11, 2024 by the Board of Supervisors. The case was continued to a later date by Supervisor action. October 23, 2024 Z2023048 Page 2 of 4 Commission Recommendation: On 8/8/24, the Commission voted 6-0 to adopt a motion recommending the Board of Supervisors approve Z2023048 subject to conditions ‘a’ – ‘j’: a. Development of the site shall be in substantial conformance with the site plan entitled “Preliminary Site Plan“, consisting of 2 full-size sheets, dated 5/29/2024 except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the narrative report entitled “Salt Works USA”, consisting of 18 pages, dated August 2023, except as modified by the following conditions. c. The following zoning district IUPD standards shall apply: 1. Max height: 50-feet (new construction) & 100-feet (existing buildings) 2. For sites located within the County’s Urbanized Area, a Storm Water Pollution Prevention Permit (SWPPP) from the County will be required prior to issuance of any construction permits. This does NOT preclude the requirement to obtain a Notice of Intent to Discharge (NOID) from the State (ADEQ), as may be required. 2. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 3. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of building lots may be necessitated by the final engineering design of the subdivision drainage infrastructure. 4. The site is not located in a Special Flood Hazard Areas (SFHAs). The Flood Control District has no comments on this application. g. Site access via adjacent private easements will be improved per Maricopa County paving standards. Applicant is responsible for coordinating with MCDOT to improve adjacent 107th Ave ROW access. MCDOT TIS approval is required prior to any construction permit. h. The applicant/property owner shall submit a ‘will serve’ letter for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. i. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall be considered for reversion to the zoning that existed on the date of application pursuant to Maricopa County Zoning Ordinance requirements. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The applicant is requesting to amend the zoning on an approximately 5-acre parcel from C-3 & Rural-43 to IND-2 IPUD for indoor salt distribution uses with a future rail spur. The parcel is generally located along Buckeye Rd. between Avondale Blvd. & 107th Ave in the Avondale area. The Union Pacific railroad runs between the parcel and Buckeye Rd. The parcels main access is via an easement on a neighboring vacant Union Pacific owned parcel directly to the east leading to 107th Ave. 2. The parcel is currently vacant with a 992 sq. ft. former industrial warehouse with three detached silos. The applicant intends to utilize the location for salt distribution through packaging and rail car distribution via a planned rail spur from the adjacent railway. The salt is locally mined and will be transported to the warehouse facility via truck deliveries. All activities on the site are proposed to take place within the warehouse with no outside salt storage. The request includes a height deviation to 50’ for the existing non-conforming structure and 100’ for the existing silos. No additional buildings are planned at this point and any future construction will conform to the 50’ proposed height standard. 3. The surrounding uses include vacant railroad property to the east which the parcel gains access from and an IND-2 zoned trucking facility to the direct west. A newly built residential housing community abuts the parcel to the north. There is an approximately 170-foot landscaped buffer between the subject parcel and the closest residential parcel to the north. The applicant has indicated a plan to construct a CMU wall on the north, east and west parcel boundaries for additional screening and noise attenuation on the parcel. The applicant has completed all of the required neighbor notification required by Maricopa County including written neighbor notification to all parcel owners within 300’ of the site and site notifications. The City of Avondale has requested the applicant hold a neighborhood meeting to their city standards of notification. The applicant held a neighborhood meeting on June 20, 2023 at the Avondale Civic Library meeting with one concerned neighbor. Outstanding Concerns from Reviewing Agencies: 11. The City of Avondale has provided written objection to the rezoning proposal. The City states that the use does not conform to their general plan and it would interfere with the surrounding communities. The City sees the parcels along Buckeye Rd as key parcel for future adaptive reuse commercial projects. Staff Analysis: 12. The adjacent railway was the first developed use in the Avondale area and has existed long prior to the City’s incorporation in 1946. The adjacent truck depot and the warehouse with silos on the subject parcel are viewable in historical images dating back to February 1956. All of the current surrounding development has grown with the railway and commercial / industrial type of land uses occurring on the surrounding parcels. The subject parcel had been a frequent violator between 2014 and 2022, accumulating eight violations for improper uses and junk trash and debris. Staff recognizes the efforts of the current ownership to clean up the blighted site and propose a development use that continues to utilize the existing structure. 13. Due to the historic uses, immediate railway access and neighboring industrial uses, staff sees the proposed use as compatible to the surrounding area. The proposed CMU wall screening and indoor operations will add buffering from the newly developed residences to the north who purchased residents knowing there was an active railroad operating in the area. Purpose and Intent 1. PROJECT OVERVIEW Upfront Planning & Entitlements, LLC is pleased to submit for your consideration the Property located adjacent to the Union Pacific Railroad Company, just north of Buckeye Road, and just east of Avondale Blvd. within unincorporated Maricopa County. The site is identified as Parcel Number 101‐01‐972E (the “Property”). The project is intended to be used as a light industrial site for an indoor salt distribution facility with the addition of railroad spur. The facility will utilize the existing building on site. Operations are proposed to include trucks and trailers driving in and out of the site as well as parking to distribute salt for loading and unloading into the building. The building will also be used for storage of product. The request for the project is a rezone to IND‐2 Light Industrial on approximately 5.01 gross acres with an IUPD Industrial Plan of Development overlay and an addition of a railroad spur. The lot has an existing building previously used as a warehouse. This site is located within unincorporated Maricopa County and to the north, east and west is the City of Avondale. The Site is currently surrounded by other industrial uses and residential density. Salt Works USA intend to develop the Site to meet with the surrounding industrial uses and be able to utilize the railroad spur since being in close proximity to the Union Pacific Railroad Company. A Vicinity Map and Regional and local Aerials of the Site are provided. For over 20 years, Salt Works USA has been meeting the needs of the Phoenix Valley and the State of Arizona with their product and service. Salt Works USA prides itself on being the leading provider of salt and water treatment needs with exceptional quality of their products and service. This proposed location will better advance the services that Salt Works USA provides and create new connections with the access of the Union Pacific Railroad Company. The property is in an area designated in the City of Avondale 2030 General Plan as Mixed‐ Use. The Property is located within the existing zoning of two districts, General Commercial (C‐3) and Rural 43 (RU‐43) zoning districts. The site is located on the broader of the City of Avondale north of Buckeye Road. OVERALL DESIGN CONCEPT The proposed project of Salt Works USA will take advantage of the already existing industrial warehouse that is sized 992 sq. ft. floor area located on the site. The project will implement a 20’ wide driveway entering east of the lot through an existing entry gate. This driveway will be used as industrial access for the company as well as for the associates working on the site. The property will place 44 parking spaces just east of the existing warehouse. Plans to replace the existing 7‐foot chain link fence with a solid masonry wall around the property. The proposed railroad spur will be located south of the property along the Union Pacific Railroad and Buckeye Road. 3. PROJECT COMPATIBILITY The proposed parcel has a mixture of exiting residential and commercial zoning districts. The parcels to the north adjacent and south of the Property are within the City of Avondale and are zoned Planned Area Development (PAD) and R1‐6 with 125’ to 165’ wide open space tracts. SITE LAYOUT The objective of the site design for the project is to create a workable functioning design for the staff as well as integrate the site seamlessly into the surrounding environment. This is done through orientation, and placement. Site layout consideration included: a. New 20’ Wide Access Driveway with a 45’R b. ARCHITECTURAL DESIGN The design of the facility will integrate into the area with little to no disturbance to the surrounding community. With the rezone to IND‐2 Light Industrial IUPD Industrial Plan of Development with a railroad spur, it shall comply with the development standards in the Maricopa County Zoning Ordinance Section 903. I raised my hand to discuss the above case and was not acknowledged until after the case was heard. I am disappointed that the commission did not give much credence to the city of Avondale’s objection to this case. I noted several commissioners mentioned growing up in the area; however, they do not live here now and will not be subject to the increased noise, dust and traffic. I live on Hill Dr and while I do not live within 300 ft of the lot; the access road which will be used by trucks delivering salt is directly behind my home. The increased noise from multiple deliveries of salt via trucks as well as the additional train cars using the new rail spur will impact our quality of life. The increased truck traffic on 107th Ave will also be an impact to our development. What will be the operating hours for the facility? Will it be Monday – Friday during normal business hours or will it be 24/7? I understand a public hearing was held in 2003; however, the homes within 300 ft (which received notices) were not built or sold at the time of the meeting.
