TO 
AGREEMENT 
BETWEEN 
MARICOPA COUNTY 
ADMINISTERED BY ITS 
HUMAN SERVICES DEPARTMENT 
AND 
TEMPE ELEMENTARY SCHOOL DISTRICT No. 3 
AND 
CITY OF TEMPE 
 
I. 
Maricopa County (“County”) administered by its Human Services Department Early 
Education Division (“Department”) and Tempe Elementary School District No. 3 of 
Maricopa County (hereinafter referred to as the “District”), and the City of Tempe 
(hereinafter referred to as the “City”), fully executed a financial Intergovernmental 
agreement (“Agreement”) on or about August 11, 2022. The purpose of the Agreement 
is to establish a collaboration between the Parties that will address expanding high-
quality pre-school in the City of Tempe and the District’s boundaries. The County will 
provide funding that will help to increase instructional annual hours for enrolled Head 
Start children. The term of the Agreement began on July 1, 2022, through June 30, 
2024. The County, The District, and The City are referred to here as the “Parties.” 
 
The Parties fully executed Amendment No. 1 on or about January 25, 2023. The 
purpose of the Amendment was to remove paragraph 15.0 (Safeguarding of Participant 
Information) in its entirety and replace it with revised contract language. The Amendment 
also removed Paragraph 17.0 (Non-Liability) in its entirety and replaced it with revised 
contract language. 
 
The Parties fully executed Amendment No. 2 on or about March 26, 2024. The purpose 
of the Amendment was to revise Paragraph 9.1.4 (Child Development and Education) by 
adding additional subsections. The Amendment also revised Paragraph 12.0 (Locations 
Where Service Will Be Provided), by updating School/Site locations. Amendment No. 2 
further added required contract language.  
 
The Parties fully executed Amendment No. 3 on or about June 6, 2024. The Amendment 
extended the Agreement termination date from July 1, 2024, to June 30, 2025. Revised 
Section 6.0 (Funding), to address funding amount for Fiscal Years (FY24 $146,952, 
FY25 $161,833) and revised Subsection 6.4, listing Assistance Listing Number (ALN) for 
funding source. Also, revised Section 9.0 (Responsibilities of Organization), by replacing 
subsection 9.1.1.1 with new language outlining instructional staff in each classroom. 
 
II. 
The Parties agree to address the following items: 
 
A. 
Revise Section 6.0 (Funding) 
1. 
Removing subsection 6.2 in its entirety and replacing with the following: 
The County provided a not-to-exceed amount of $146,952 for fiscal 
year 2024. The County shall provide an increase in funding for fiscal 
year 2025 in the amount of $3,803 for Cost-of-Living Allowance 
(COLA). Total funding availability will be $161,833 for based activities

and $3,803 for COLA. Total funding has been increased to $165,636 
from $161,833 for fiscal year 2025. 
 
B. 
The Agreement funding amount shall be increased from $441,905 to $445,708. 
 
III. 
Section II above contains all the changes made by this Amendment No. 4. This 
Amendment is subject to A.R.S. §38-511. All other terms and conditions of the original 
Agreement and all previously fully executed Amendments shall remain the same and in 
full force and effect as approved and amended. 
 
IV. 
The Parties have authorized the undersigned to execute this Amendment No. 4 on their 
behalf.
