The rezone would unify the zoning to Rural-43 RUPD which is consistent and compatible with the existing Rural-190 and Rural-43 zoning districts surrounding the site. Rancho Del Oeste is adjacent to Ski Mountain Ski Ranch Phases 1 & 2 which consists of 22 residential lots with Rural-43 RUPD and Rural-190 zoning. Six property owners within Ski Mountain Ski Ranch have submitted concerns associated with incompatible land uses of the existing ski lake and the proposed equestrian amenities in close proximity. Other identified concerns related to desire for solid fencing along the perimeter, security, potential for trespass and request to re- locate the equestrian amenities to the northwest region of the site instead of the southeast corner. The applicant conducted a public outreach but did not receive any comments prior to the Commission hearing. The Commission was provided a memo with opposition received after publication of the staff report. There was one speaker in opposition and another that registered their name in opposition for the record but was unable to attend the hearing. Additional e-mails of opposition/concern were received after the hearing and are included as part of this report. Staff notes that requirement for a super-majority (four affirmative) vote for Rural-43 RUPD zoning approval has not been triggered. Commission Recommendation: On 6/13/24, the Commission voted 6-0 to adopt a motion recommending the Board of Supervisors approve Z2023023 subject to conditions ‘a’ – ‘g’: a. The site shall be in substantial conformance with the zoning exhibit entitled “Rancho Del Oeste Estates” consisting of 1 full-size sheet, stamped received March 10, 2024, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the narrative report entitled “Rancho Del Oeste Estates”, consisting of 10 pages, dated March 13, 2024, and stamped received March 10, 2024 except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Engineering review of rezone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practice at the time of application for construction. d. The following Rural-43 RUPD Zoning District standards shall apply: 1. Minimum Side Yard Setback – 30’ from right-of-way or shared lot line’ 10’ from tract. e. All outdoor lighting shall be in conformance with the provisions listed in Section 1112 of the Maricopa County Zoning Ordinance. f. Any amendments to the zone change shall be processed as a revised application in accordance with Maricopa County Zoning Ordinance requirements. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for reversion to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property, and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of this zone change. This zone change enhances the value of the property above its value as of the date the zone change is granted, and reverting to the prior zoning results in the same value of the property as if the zone change had never been granted. The applicant is requesting a zone change with overlay from Rural-43 and Rural-190 to Rural-43 RUPD (Z2023023) to accommodate their second request of a preliminary plat for the Rancho del Oeste subdivision (S2023002). The site is approximately 79.5 acres, generally located at Old US Highway 80 and 317th Drive. The subject site abuts vacant lots to the east, north, west, and south. Primary access to the site will be via a gated entry on 317th drive and the Old US Highway 80. Interior streets of the subdivision will be private. 2. The subdivision will consist of 42 lots with a minimum lot size of one acre, seven tracts dedicated for drainage and landscaping, two tracts for emergency access and private streets, one tract for an equestrian amenity, and one tract for an erosion setback easement. The applicant is proposing a three-acre tract (Tract H) on the southern end of the subdivision for equestrian recreational amenities. 3. The applicant is requesting this zone change in order to develop the site under one single zoning district and establish a consistent design and development standards for the overall community. The proposed Rural-43 RUPD zoning district will maintain the intent of the primary zoning currently established on the site and allow for the design of the community to fit seamlessly within the surrounding rural area. 4. The proposed subdivision will be placed in an appropriate location for rural development with direct access to the Old Us Highway 80. The preliminary plat is in conformance with the Maricopa County Vision 2030 land use designated of Rural Development Area (0-1 d.u./ac.) and the Rural- 43 zoning district regulations. Staff notes, the proposed subdivision is compatible with the surrounding properties. The proposed amenities and open space for equine uses are consistent with rural uses. County review staff has no objections to this development. 13. Staff recognizes that the general area surrounding the subject site has been designated to be developed with rural land uses. Staff finds the proposed Rural-43 RUPD zoning district would be appropriate for the site as it would being the subject site into one single zoning district and will facilitate the development of the proposed Rancho Del Oeste community. Staff supports the proposed zone change with overlay, with the recommended conditions, due to the general compatibility that Rural-43 would have to the surrounding land uses. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z2023023 subject to the following conditions ‘a’ – ‘g’: a. For the reasons outline in this report staff recommends the Commission motion for Approval of case S2023002, subject to conditions ‘a’ – ‘k’: a. The final plat shall be in substantial conformance with the preliminary plat entitled “Rancho Del Oeste” consisting of 5 full-size sheets, dated revised March 5, 2024, and stamped received March 20, 2024, except as modified by the following conditions. Development and use of the site shall be in substantial conformance with the narrative report entitled “Rancho Del Oeste Estates“, consisting of 10 pages, dated March 13, 2024, and stamped received March 20, 2024, except as modified by the following conditions. c. Prior to final plat and infrastructure permit submittal, the applicant is required to attend a pre-application meeting in order to coordinate the permitted process for improvements, fees, and assurances associated with the subdivision. Intake of the final plat and Infrastructure permit shall be by appointment only. d. Concurrent with submittal of final plat, improvement plans shall be submitted to the Planning and Development Department. e. After final plat recordation and prior to any zoning clearance for building permits, the applicant shall obtain a final Grading and Drainage and Infrastructure permit from Maricopa County. f. Prior to final plat approval, water and wastewater plans shall be submitted to and approved by the Maricopa County Department of Environmental Services (MCESD) subject to their procedures. g. The following Drainage Review Conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 3. Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the application for Final Plat Approval and Building Permits. 4. The subdivision infrastructure plans shall include the onsite retention basin grading for each lot. 5. Any work/disturbance with the pending Zone AE floodplain will require a floodplain use permit issued concurrent with the subdivision infrastructure permit. h. The following MCDOT Review Conditions shall apply: 1. As indicated in the study, provide WB left turn lane at primary access with a minimum storage of 160’ and 15: 1 taper. Reference RDM 6.1.10. 2. The Future classification of OLD Us 80 is principal arterial roadway. Half street improvements are required and shall be as per latest RDM. This includes two Z2023023/ S2023002 Page 8 of 8 eastbound through lanes along the entire site frontage of Old US 8-, reference Figure 5.8 3. As part of half-street improvements, provide a minimum 55’ ROW dedication, plus any additional ROW needed for improvements to MCDOT along the site frontage of OLD US 80 (Note: this requirement was reduced from the standard 65’ minimum by MCDOT planning in Dec. 2022.). i. Prior to final plat approval or issuance of a grading permit, developer(s) and/or builder(s) shall establish emergency fire protection services, covering all real property contained within the project area during course of construction and shall obtain a “will serve” letter substantiating coverage from the appropriate fire department servicing Rancho Del Oeste. This information shall be included in the narrative report for the Final Plat and the associated public report for the subdivision. The final plat shall contain a note referencing the will serve letter. j. The applicant/owner shall comply with the standard assurance provisions as set forth in the Maricopa County Subdivision Regulations. k. Preliminary plat approval shall expire two (2) years from date of Commission approval. Any request for an extension of time shall be submitted prior to expiration date and may be administratively approved in accordance with the Maricopa County Subdivision Regulations. Purpose of Request On behalf of the property owner, Brooks Ranch Partners LLC, CVL Consultants is pleased to submit this request to Maricopa County (“County”) in support of concurrent Zone Change with Overlay and Preliminary Plat applications for the community located at Old US Highway 80 and 317th Drive known hereto as Rancho Del Oeste Estates. This request represents project visioning conducted by the property owner who is pursing the objective of creating a well designed community that reflects the area’s history and rural roots, in both name and character. This vision extends to the sense of arrival experienced upon entering the community by way of landscaping and custom monumentation featured at the primary entrance, to the main amenity area that features a private equestrian amenity to be enjoyed by residents and their guests, as further described in this proposal. As stated above, two requests are being filed concurrently for Rancho Del Oeste Estates. The first request seeks a Zone Change with Overlay to revise the split zoning previously established on the site of Rural-43 (“RU-43”) and Rural-190 (“RU-190”) to overall RU-43 with Residential Unit Plan of Development (“RUPD”) overlay zoning. The second companion request is for a Preliminary Plat which will allow for the creation and subdivision of 42 residential lots with gated, private streets and common open space areas to be developed in a single phase. 2. Description of Proposal Rancho Del Oeste Estates is a gated, single family detached residential community with large lots and quality theming and amenities located southwest of Old US Highway 80 and 317th Drive in the Old US Highway 80 Planning Area of Maricopa County. The community consists of approximately 79.44 acres on an undeveloped parcel identified as APN 401-62-088 (the “Property”). Project History Originally proposed to develop as Phases 3 & 4 of the adjacent Spring Mountain Ski Ranch, split zoning of RU-190 and RU-43 was established on the Property in 2000 (Case No. Z00-169) to allow for one acre residential lots surrounding a set of ski lakes. To support this request, a Special Use Permit was established on the Property in 2001 for a recreational water ski lake (Case No. Z00-170) prior to the platting of the Property in 2007 (Case No. S2005031). The Final Plat established 28 lots of at least one acre each and 9 tracts. Zone Change with Overlay & Preliminary Plat Narrative Rancho Del Oeste Estates CVL Consultants 2 The Property was removed from Spring Mountain Ski Ranch by the property owner via separate subdivision and zoning approvals due to reduced market interest in the community at the time. A Re-Plat was recorded in 2016 (Case No. S2014012) to revert the prior subdivision to a single parcel and abandonment of the previously approved Special Use Permit was requested (Case No. Z2014046). Zoning A Zone Change with Overlay is requested to update the site from RU-190 and RU-43 to overall RU-43 RUPD zoning in order to develop under a single zoning district and establish consistent design and development standards for the overall community. The proposed overall RU-43 RUPD zoning maintains the intent of the primary zoning currently established on the Property and allows for the design of the community to fit seamlessly within the surrounding rural area. This request aligns with the County’s goals and objectives for the Old US Highway 80 Planning Area, which designates the site as Rural Residential, permitting a range of 0-1 dwelling units per acre. This Zone Change with Overlay request will set the general parameters of the overall project and its design standards to generally conform to the County’s conventional RU-43 zoning district, as modified herein by this RUPD. Zone Change with Overlay & Preliminary Plat Narrative Rancho Del Oeste Estates CVL Consultants 3 Development Standards The Rancho Del Oeste Estates community shall generally adhere to the RU-43 development standards set forth by Section 503 of the Maricopa County Zoning Ordinance and identified below for reference, as modified herein by this RUPD. Lot Coverage 25% 25% The primary purpose of the requested RUPD overlay is to modify the Minimum Side Yard to account for the drainage tracts placed between lots throughout the community. The site’s proximity to the floodplain and associated drainage challenges require drainage tracts to be added between lots, impacting the intended lot sizes, building footprints, and layout. With the understanding that these approximately 20’ wide tracts between lot lines will create additional building separation and appear as a portion of the side yard when constructed, utilizing the tracts in this manner provides an appropriate solution to the encroachment and this hardship. A modified Minimum Side Yard of 10’ is requested only when adjacent to the tracts as necessary to mitigate the significant drainage constraints on the property. The Minimum Side Yard remains 30’ from adjacent right-of-way and shared lot lines, as noted in the table above. Zone Change with Overlay & Preliminary Plat Narrative Rancho Del Oeste Estates CVL Consultants 4 Subdivision The Preliminary Plat requests the creation and subdivision of 42 residential lots and 11 tracts consisting of private streets and common open space areas, including a large open space reserved for recreation amenities and a well site on the southern end of the community. The proposed number of lots produces a density of 0.53 dwelling units per acre, in compliance with the existing Rural Residential land use designation. Rancho Del Oeste Estates could provide a projected population of approximately 88 residents when estimating for 2.1 persons per household. The community will be developed in a single phase. Refer to the accompanying Preliminary Plat for details regarding relevant site constraints and requirements such as site access, vehicular circulation, drainage and retention, utilities, open space, and other required site improvements. Proposed Easements The Preliminary Plat proposes 1’ vehicle non-access easements (V.N.A.E.), 8’ public utility easements (P.U.E.), and identifies drainage easements proposed on and/or between the proposed lots. A 30’ emergency access easement is proposed near the northeast corner of the Property to Old US Highway 80. A Well Site is located at the southern end of the Property with a 20’ well site access easement proposed from the nearest private street tract. 3. Relationship to Surrounding Properties The properties surrounding the Rancho Del Oeste Estates development are listed below. • To the north across Old US Highway 80 is vacant agricultural land zoned RU-190. • To the south and west of the property is vacant agricultural land zoned RU-190. • To the east is the Spring Mountain Ski Ranch Phase 1 and 2 AMD subdivision (MCR #: 919-45) zoned RU-43 and RU-190. 4. Location and Accessibility The site is located at Old US Highway 80 and 317th Drive in Maricopa County and contains an approximately 79.44-acre portion of land located in Section 35, Township 2 South and Range 5 West of the Gila and Salt River Baseline and Meridian, Maricopa County, Arizona. Primary access to the development is from 317th Drive and Old US Highway 80. The internal roadway network is private. Circulation System Entrance to Rancho Del Oeste Estates is from the large gated entry at 317th Drive and Old US Highway 80 which consists of two drive lanes separated by an approximately 14’ landscaped median. Secondary access is provided by a 30’ emergency access proposed from the northeast corner of the community to Old US Highway 80. The interior subdivision streets are private streets designed to 50’ in width. Consideration for future residents with horse trailers has been made in the design of the community and the site layout has been reviewed to ensure that accommodation is made for safe turning movements. Horse trailers will be able to access the site through the entry gate, traverse south to the equestrian amenity, park, and navigate back through the community as needed. Due to the low volume of traffic it is anticipated that those future residents wishing to ride their horses will be able to safely ride to the equestrian amenity. Please refer to the Preliminary Plat and Traffic Impact Statement provided for additional detail. 6. Development Schedule Rancho Del Oeste Estates will be developed in a single phase. 7. A new water company will be formed and established with the Arizona Corporation Commission (ACC) to serve this development. Water source approval will be obtained for the community. The developer will enroll in CAGRD and obtain a Certificate of Assured Water Supply (CAWS) for the site as required by Arizona Department of Water Resources. The network will consist of waterlines for the development and well sites, storage, booster pumps, and treatment facilities will be designed to serve the proposed development during the final design phase. For additional information please refer to the Water Demand Memo. Wastewater Facilities There is no existing wastewater provider or infrastructure within or adjacent to the Rancho Del Oeste Estates. Sewer will be provided by on-lot individual septic systems. For additional information please refer to the Wastewater Memo. 9. Conceptual Landscaping and Amenities Plan Rancho Del Oeste Estates features large, amenitized open space with thoughtfully designed landscape architecture and established agrarian theming. The community has been designed to provide residents with a heightened sense of place and arrival with landscaped theming at the primary entry and open space recreation areas. The entrance includes adjacent open spaces to create an open and inviting community environment with a nearby mailbox location to provide convenient access for residents. Themed fence walls are planned in key areas throughout the subdivision, along the project perimeter, and at the gated entry to enhance the streetscape and visual presence of the community. A primary community amenity and gathering area is located near the southern end of the project, featuring a private equestrian amenity to be enjoyed by residents. In accordance with County requirements, this amenity shall be used only for non- commercial public activities involving up to a maximum of 24 persons in total. No more than 5 horses and/or other equine not owned by the property owner and/or resident shall be boarded on the Property and documentation of ownership shall be maintained when more than 5 horses and/or other equine are kept on the property. Rancho Del Oeste Estates is planned to include approximately 6.21 acres of open space, which is around 7.8% of the project area. A Homeowners Association (“HOA”) will be formed and will be responsible for maintenance of all common open space, on-site amenities, private streets, and landscape tracts. No structure, landscaping, fence, wall, or terrace or other obstruction to view in excess of two feet in height as measured from the center line of the street shall be placed within the required 25-foot sight visibility triangles. 2. Landscaping in County Right-of-way shall conform the MCDOT Roadway Design Manual. 3. All transformers, back-flow prevention devices, utility boxes and all other utility related ground mounted equipment shall be painted to complement the development and shall be screened with landscape material where possible. All HVAC units shall be ground-mounted or screened with a continuous parapet for commercial projects. 4. All outdoor lighting shall conform to Section 1112 of the Maricopa County Zoning Ordinance. 5. All trees shall be double-staked. 6. Compliance with City/Town General Plan Rancho Del Oeste Estates is not identified within the planning area of a separate City or Town. The community is committed to maintaining and supporting the County’s Old US Highway 80 Area Plan. 7. Conclusion The development team believes that this request represents an appropriate and favorable planning of the site land use that is in compliance with and consistent with the County’s policies for the area. We are opposed to the RU-43 at this time. The development should have adopted stipulations for any zoning change. Will there be a separate entrance to the community? The proposed map indicated 317th as the entrance which is our property address as well. Will there be a block wall separating Spring Mountain Ski Ranch from the proposed property? Will the proposed community have a recorded HOA to govern the development? Will the residences be slab construction; no modular or trailers permitted? Will the residences have minimum square foot requirements for the residences? If the Community Equestrian Center, will it be open to the public? Will the development host public events? Will it have overhead lighting? Will there be public stabling of horses for profit? At the very least, would the Community Equestrian Center be relocated to the Northwest corner of the development providing the maximum distance from Spring Mountain Ski Ranch? As we read, RU-43 will allow for a minimum of four (4) horses per property. Further the proposed development includes an area, paddock and parking. The development could potentially have a minimum of 140 plus horses. Spring Mountain Ski Ranch is a community in which outdoor use is an integral part of our lives. No safeguard would be in place other than Maricopa guidelines for the mitigation of flies or health concerns. If the intent for each lot permits horses, the total number of horses should be reduced from four (4) at the very least. The proposed zone change is inconsistent with the existing development and zoning to our high end development. Horse property use should not be allowed. This project would negatively affect the our use and property values. There are existing, under construction and planned multi-million dollar homes in our development.
