A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, ARIZONA, DECLARING
A PORTION OF A ROAD ALIGNMENT INTO THE COUNTY ROAD SYSTEM TO AUTHORIZE
ABANDONMENT OF THAT PORTION OF ROAD WHICH IS NOT IN A PLATTED SUBDIVISION OR HAS
NOT BEEN DESIGNATED A ROADWAY PURSUANT TO A.R.S. § 28-7201(4) AND ABANDONING A
PORTION OF A SAID ROAD ALIGNMENT PURSUANT TO A.R.S. § 28-7214.
A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, ARIZONA, TO ALLOW
ABANDONMENT OF A PORTION OF A ROAD ALIGNMENT PURSUANT TO A.R.S. § 28-7214.
WHEREAS, A.R.S. § 28-6701(A) authorizes a county board of supervisors to establish, alter or
abandon a highway in the county and other legal subdivisions and acquire real property for those
purposes by purchase, donation, dedication, condemnation, or other lawful means; and
WHEREAS, pursuant to A.R.S. § 28-6701(B), the County Engineer has recommended that
a portion of a certain road alignment be designated a county highway and that the Board resolve to declare
it into the county road system; The legal description is described to wit:

A portion of the easement as described in recorded instrument 1972-0143824, Maricopa County
Recorder (MCR), situate in Section 06, Township 5 North, Range 3 East of the Gila and Salt River Base
and Meridian, Maricopa County, Arizona. Said portion of land being more particularly described as
follows:
The West 10 feet of the East 40 feet except the South 24 feet together with the North 6 feet of the South
30 except the East 30 of the South 257 feet of the Southeast Quarter of GLO Lot 3 of said Section 06.
General Vicinity: Restin Road and 15th Avenue. Supervisory District No. 3.
A plat or map of such road, is attached; and
WHEREAS, to facilitate abandonment of portions of right of way held by the County as easement,
which are not necessary for public purposes, the right of way must be open and declared as a public
highway; and
NOW, THEREFORE, BE IT RESOLVED by the Maricopa County Board of Supervisors that its
Chairman execute this Resolution evidencing the determination by the Board that the portion of the road
alignment that is held by easement be open and declared to be a public highway and is declared into the
county road system pursuant to A.R.S. § 28-6701 and that all of the highway identified herein is hereby
abandoned pursuant to A.R.S. § 28-7214; and
BE IT FURTHER RESOLVED that the Clerk of the Board record this Resolution in the Office of the
Maricopa County Recorder to provide public notice of the abandonment of such road pursuant to A.R.S. §
28-6701.
