MEMORANDUM OF UNDERSTANDING Between MARICOPA COUNTY ATTORNEY’S OFFICE and NEW LIFE CENTER This Memorandum of Understanding, (“MOU”) dated June 26, 2024, is between New Life Center (NLC), located at P.O. Box 5005, Goodyear, Arizona 85338, and the Maricopa County Attorney’s Office (MCAO), 225 West Madison St, Phoenix, Arizona 85003. MCAO was awarded up to $457,554.22 in Anti-Human Trafficking grant funding from the Arizona Department of Emergency and Military Affairs (DEMA), Emergency Management Division for 57 months beginning October 1, 2022, through June 30, 2027. Of this award, NLC, a trauma-informed domestic violence shelter and service provider in Maricopa County, will receive up to $274,358.38 to provide coordination for anti-human trafficking training events for law enforcement, prosecutors, and other identified professionals, participate in public awareness activities for professionals and community members to increase awareness, improve knowledge of human trafficking and its prevention, identification of victims, and improved response to victims, and provide critical advocacy services for survivors of human trafficking. Of this award, MCAO will receive up to $183,195.84 to provide advocacy services for survivors of human trafficking throughout the criminal justice process, administer grant activities, and distribute, oversee, and report on the use of Anti-Human Trafficking Grant Fund funding. All grant programming activities shall be completed no later than June 30, 2027, unless otherwise extended based on the availability of grant funding. MCAO may, at its option and with the agreement of DEMA, renew the term of this MOU for an additional year. MCAO shall notify NLC in writing of its intent to extend the term at least thirty calendar days before the original contract term expiration, or any additional term thereafter. RESPONSIBILITIES: New Life Center shall: 1. Working within established multi-disciplinary teams, identify targeted audiences for training activities and procure training faculty who are considered experts in the field of human trafficking investigation, prosecution, and/or advocacy. 2. Coordinate all training activities, including marketing plan development, identifying and scheduling training faculty, securing training facilities and A/V services, managing participant registration, communicating with training faculty and participants, compiling and printing training materials, and on-site training management. 3. Provide at least 12 trainings for law enforcement, prosecutors, and other criminal justice professionals throughout the grant period. 4. Develop training evaluation metrics and the evaluation tool within 30 days of the commencement of the contract, administer the evaluation tool to all training participants, and compile participant responses. 5. Work with training faculty as needed to update training content to provide high-quality training for participants. A negative response rate of 30% for three trainings in a row will require content updates. Training faculty will have up to 3 months to modify the training content. 6. Participate in a minimum of four public awareness/collaboration activities per year for professionals and community members to improve knowledge of human trafficking, identification of victims, and improved response to victims. 7. Working with a contracted subject matter expert, NLC will collect and analyze data obtained during the funding program annually to create a final report for the grantor. The final report is due within 15 days after the end of the period of performance. Data to be collected and analyzed will be determined upon contracting with the subject matter expert. A copy of the contract between NLC and the subject matter expert will be submitted to MCAO. 8. Provide advocacy and shelter services to human trafficking survivors in Maricopa County through established NLC programming. 9. Follow all requirements and terms of Attachment A, the Maricopa County and New Life Center, Anti-Human Trafficking Grant Fund Program agreement from DEMA. 10. Provide an itemized statement/invoice and supporting documentation for expenses incurred during the previous month by the 5th of the month following the month’s end. The invoice shall include a clear breakout of expenses in each of the following categories: Payroll supporting payroll documentation for staff paid with DEMA grant funding Fringe supporting payroll documentation for staff paid with DEMA grant funding Travel supporting documentation, including mileage (map quest showing starting and ending location), meal receipts, hotel receipts Supplies for training (handouts only (receipts for copy costs)) Supplies for survivors (hotel vouchers (receipts for hotel voucher)) Contractual Costs for training faculty and subject matter experts to include the scope of work, contractual agreements, and detailed services rendered for the invoiced amount. Training for training expense reimbursement: include detailed training agenda, which includes the training title, training date(s), location of training, and the training faculty’s name Procurement of contracted vendors shall follow all requirements set forth in Attachment B (Arizona Department of Emergency & Military Affairs, Division of Emergency Management, Anti-Human Trafficking Grant Fund). Required source documentation is outlined in Attachment B. NLC is responsible for providing required source documentation at the time of invoice/statement submission. Invoices lacking required source documentation will not be paid until all source documentation has been received. 11. Provide quarterly programmatic information by the 5th of the month after the period of performance ends. NLC shall complete Attachment C (DEMA Grant Programmatic Tracking) each quarter. (to be finalized with NLC) Qtr. 1: July 1 - Sept 30 due Oct 5 Qtr. 2: Oct. 1 - Dec 31 due Jan 5 Qtr. 3: Jan. 1 – March 31 due April 5 Qtr. 4: April 1 – June 30 due July 5 12. Provide a final report that includes a summary narrative of annual accomplishments and metrics. It is due 15 days after the completion of the project, on July 15, 2027, unless the project is otherwise extended. 13. MCAO reserves the right to cancel the contract for poor performance. The Maricopa County Attorney’s Office (MCAO) shall: 1. Aid victims and families involved in human trafficking cases proceeding through the criminal justice system. 2. Distribute, oversee, and report on the usage of Anti-Human Trafficking Grant Fund Program funding. 3. Adhere to all requirements and terms of Attachment A, the Maricopa County and New Life Center, Anti-Human Trafficking Grant Fund Program Agreement. 4. Within thirty (30) working days from the date of receipt of itemized monthly invoices and adequate supporting documentation, MCAO shall process and remit a warrant for reimbursement payment. 5. Reimbursement of all project expenses shall not exceed the budgeted amounts or extend beyond the grant cycle unless the grantor has extended the project in writing. This includes all costs associated with the project related to: a. Coordination and training of law enforcement agencies, prosecutorial agencies, and the public on human trafficking prevention and identification. b. Funding of new or existing staff positions that allow for program coordination or direct service provision for identified human trafficking survivors. c. Contracts for training faculty and technical assistance. 6. All training travel expenses will adhere to State of Arizona Accounting Manual guidelines. https://gao.az.gov/state-arizona-accounting-manual-saam 7. Reimbursement for individual course instructors shall not exceed a rate of $81.25 per hour or $650 per full day. The Agreement is hereby entered into this 26th day of June, 2024.
