The rezone will have no adverse impact on the Comprehensive Plan or the City of Buckeye’s Municipal Plan. Staff received one letter stating ADOT had no concerns. There is no known opposition. Commission Recommendation: On 11/5/20, the Commission voted 6-0 to recommend approval of Z2020027 subject to conditions ‘a’ – ‘h’: a. D of the site shall be in substantial conformance with the Site Plan entitled “Arizona Water Company”, consisting of 1 full-size sheets, dated 21 August 2020, and stamped received 28 August 2020, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “White Tanks Operation Center”, consisting of 16 pages, dated 15 June 2020, and stamped received 24 August 2020, except as modified by the following conditions. c. Detailed Grading and Drainage Plans showing the new site improvements must be submitted for the acquisition of building permits. d. The applicant/property owner shall submit a ‘will serve’ letter for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. e. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change/Plan of Development. The Zone Change/Plan of Development enhances the value of the property above its value as of the date the Zone Change/Plan of Development is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change/Plan of Development had never been granted. h. Krista Zinser of Coe & Van Loo Consultants Inc., on behalf of the Arizona water Company (AWC), requests a zone change from Rural-43 to Industrial-1 with IUPD overlay on approximately 4.1 acres. The site located on the southeast corner of 195th Ave and Monte Vista Rd in the Buckeye area. The project site is bounded by vacant land to the north and south, an existing AWC well site and water treatment facility and a single-family residence to the east, and 195th Ave then a Park ‘n’ Ride facility to the West. 2. The applicant is requesting the rezone to enable the site to be developed as an operations center for the AWC. The project proposes to construct potable water treatment, storage, pumping facilities, and Operations Center. 3. The applicant has applied for an IUPD overlay as part of this zone change to implement variations to the IND-1 base zone development standards. The following table lists the development standards to be varied under the IND-1 IUPD overlay in (bold). Staff received one letter stating ADOT had no concerns. Staff has not received any other calls or correspondence to the request. Outstanding Concerns from Reviewing Agencies: 12. The proposed use for the Arizona water Company operations Center project is consistent with the land use designation of the Maricopa County White Tank/Grand Avenue Area Plan that designates this site for Industrial use. Additionally, the City of Buckeye General Plan designates the site as Business Commercial. Staff notes the City of Buckeye has developed the adjacent area to the west as a public transportation facility and there is an existing water treatment station next to residential to the east. Staff has not received any opposition to the proposed project from residents in the area. As such, staff finds the proposed zone change in character with the land use designation of the county and municipal area plans. Recommendation: 14. For the reasons outlined in this report, staff recommends the Commission motion for Approval, subject to conditions ‘a’ – ‘h’. a. Development of the site shall be in substantial conformance with the Site Plan entitled “Arizona Water Company”, consisting of 1 full-size sheets, dated 21 August 2020, and stamped received 28 August 2020, except as modified by the following conditions. b. Exhibit C Rezoning Narrative White Tank Offi ce CVL Consultants 1 White Tanks Offi ce - in Maricopa County, AZ Rezoning Narrative 1. Purpose of Request: The purpose of this narrative is to rezone a 4.17 acre parcel from RU-43 to Ind-1 with an IUPD overlay. The purpose of the rezoning request is to allow construction of a new operations center for Arizona Water Company (AWC). The parcel has Maricopa County APN 502-67-020 and is located on the southeast corner of North Jackrabbit Trail and West Monte Vista Road (Site). The project proposes to construct potable water treatment, storage, pumping facilities, and an Operations Center for AWC (Project). The parcel is located in Section 33, Township 2 North, Range 2 West of the Gila and Salt River Base and Meridian, Maricopa County, Arizona. 2. Description of Development Proposal: Nature of the Project AWC owns and operates a water distribution system serving the needs of this area of Maricopa County. The Project expands the capabilities of this potable water system, benefiting area residents and business owners in this rapidly developing region of Maricopa County. In addition, the improvements to Site include the construction of a new AWC operations center which is intended to serve the needs of AWC customers in this area. Proposed Land Use The parcel is identified by the Maricopa County Assessor’s map as parcel 502-67-020, and consists of one lot. The parcel is currently zoned as Rural Residential - 1 unit per acre (RU-43), as well as all surrounding County Parcels. AWC is proposing to rezone the entire 4.17 acre parcel to Planned Industrial (Ind-1), based on recommendations received from Maricopa County Planning and Development at the Pre-Application phase of this project’s entitlement process. The proposed use for this site is described under the Planned Industrial (Ind-1) zoning ordinance as a permitted use within this zoning category. The site will comply with the Ind-1 site development standards detailed later in this narrative. In addition to Ind-1 zoning, AWC also proposes to include an Industrial Planned Development (IUPD) overlay district for the entirety of this project, which was also recommended by Maricopa County Planning and Development per Preapplication Meeting comments. This overlay will allow for some flexibility related to infrastructure and equipment placement within the property. Rezoning Narrative White Tank Offi ce CVL Consultants 2 Three paved driveways will provide access to the site from West Monte Vista Road and from Jackrabbit Trail. Two driveways are for customer access to the operations center and one driveway is dedicated for secure employee access to the operations center, water infrastructure and warehouse facilities proposed on the Site. All driveways are right in and right out only. There is an existing 25-foot "half-street” right-of-way to the north for Monte Vista Road, which serves as a residential collector roadway. During the pre-application meeting for this project, Maricopa County stated they will require a 25' right-of-way dedication for future road improvements. 3. Supporting Information: a. Water and Sewer Services Water services currently exist to the Site, as part of the regional water distribution system located within adjacent roadway right-of-ways. Water is provided to the site by AWC. AWC will construct a small septic system on the west side of the property. b. Parking This project provides twenty (20) customer parking spaces in total, all of which are located near the front of the AWC operations center with two of these spaces being ADA accessible. Twenty One (21) parking spaces are set behind a gate for employee use. c. Noise or Disruption This project will include an office building occupied during normal business hours, and also a screened by the 8' high CMU wall, facilities yard which will include water treatment, pumping facilities, storage facilities, and a warehouse. Arizona Water Company will use this operations center to provide a convenient location for customers to pay bills, make inquiries, and conduct general business. Those activities are anticipated to minimize excessive noise or disrupt neighbors. The site warehouse and water treatment / storage facilities are largely automated, requiring only occasional maintenence work. Rezoning Narrative White Tank Offi ce CVL Consultants 3 d. Landscaping Landscape setbacks of 10 feet in width are provided and landscaped along the projects north and western frontages to Jackrabbit Trail and Monte Vista Road. Additional planting spaces are provided in parking lot islands and adjacent to the new operations center. e. Signage An illuminated sign will be mounted on the front of the proposed operations center denoting Arizona Water Company. The freestanding sign will be oriented to the business Monte Vista street frontage. Both signs shall comply with Maricopa County Zoning Ordinance, chapter 1404. f. Existing Land Use and Zoning The Site, as well as the surrounding area land use is Urban Residential (Low 0-6 D.U./Ac.) according to Maricopa County’s Land Use Plan. The parcel is currently zoned Maricopa County RU-43 for the entirety of the project site, as well as adjacent parcels as described below. RU-43 zoning is intended for low density, large lot (1 Acre) residential development. This project will include a one story operations center, which is consistent with sites current zoning and that of the surrounding area.
