The Maricopa County Environmental Services Department (MCESD) has reviewed 
revised documents received from the Maricopa County Planning and Development
Department for the above referenced project. This project is a CPA for Vulcan Solar 
Project at APN# State Land. Water / sewer will not be provided. MCESD has no 
concerns.
Stormwater -- The parcel is not located in the urbanized unincorporated area, and 
therefore, not regulated by the Maricopa County Stormwater Quality Program.
Based on the above, MCESD raised no objections to the Planning & Development 
Department in Accela: on December 18, 2019 and will allow the project to proceed at 
this time subject to the following stipulations

None.
It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other Maricopa 
County agencies may have additional requirements. Final review and approval will be 
made through Planning and Development Department procedures. Applicant may 
need to submit separate applications to the Maricopa County Environmental Services 
Department for approval of proposed facilities regulated by the Department.  Review 
of any such application will be based on regulations in force at the time of application.

Dear Mr. Ferrera: 
 
The Arizona State Land Department (the “Department” or “ASLD”) has received your email dated 
July 30, 2020, requesting permission to act as authorized agent for the Department to apply to 
Maricopa County (the “Jurisdiction”) for a Major Comprehensive Plan Amendment (the 
“Entitlements”) on State Trust land described above, as detailed in your application narrative and 
Citizens Participation Plan submitted to Maricopa County on December 3, 2019, to allow for 
development of a solar generating facility. 
 
Candela Renewables, LLC its employees, representatives, agents, and/or consultants 
(hereinafter “Applicant”) therefore, has the Department’s consent to file for the 
Entitlements as required by the Jurisdiction, subject to the following conditions and 
understandings. 
 
1. 
Applicant shall pay all costs associated with the Entitlements and shall not be 
reimbursed by the Department or by any subsequent purchaser at auction. 
 
2. 
Applicant, their employees, representatives, agents, and/or consultants shall be 
permitted to act as the Department’s agents to procure the Entitlements and any related 
permits or approvals which may be required (the “Entitlement Process”), subject to 
final review and approval by the Department. 
 
3. 
Applicant shall diligently pursue the satisfaction of all Entitlements.  Further, it shall 
respond to all inquiries by the Department as to the status of the Entitlement Process 
and provide regular updates without formal request.

Prior to beginning the Entitlement Process, the Applicant shall provide the Department 
with an outline of the proposal and a timeline for the process which identifies key dates 
with the Jurisdiction or other jurisdictional agency staff and project hearing dates with 
any agency or jurisdiction.  All documentation, including, but not limited to land use 
plans, engineering drawings, application materials and development agreements, shall 
be submitted to the Department for approval prior to the date the documentation is filed 
with the approving jurisdiction.  A copy of the application shall be submitted to the 
Department on the same day it is filed with the Jurisdiction or other jurisdictional 
agency. 
 
5. 
The Department staff shall be invited, but not required to attend, all meetings with the 
various agencies, elected officials, and the Jurisdiction as the Entitlements are 
processed through relevant hearings.  A minimum of five (5) business days’ notice shall 
be provided to Department staff in advance of any meeting.  
 
6. 
Applicant shall submit to the Department all staff reports and draft stipulations that will 
be considered by the Jurisdiction on the day they are received by the Applicant, and at 
least ten (10) business days before each public meeting or hearing, if possible.  
 
7. 
As additional consideration for the grant of this permission, all Entitlements and/or 
rights and permits obtained pursuant to the described applications are the property of 
the Department and will only be transferred to the successful bidder, if any, at the time 
the land is auctioned for sale or lease at some point in the future.   
 
8. 
The Jurisdiction is authorized to enter and inspect the subject property. 
 
9. 
This authorization may be revoked at any time without notice and in no way creates an 
obligation on the part of the Department of any kind.

Thank you for the opportunity to review and comment on Maricopa County Major Comprehensive 
Plan Amendments CPA2019014, CPA2020001 and CPA2020002 for a number of solar energy 
projects in the county. 
The three projects are located approx. 40-50 miles west of downtown Phoenix, AZ. The region is 
characterized by undeveloped desert areas, agriculture and sparse rural residential development. 
The region has a number of power generating stations (Palo Verde Generating Station, 
Harquahala Power Plant, Mesquite Generating Station, Redhawk Power Plant) and the proposed 
projects may be able to take advantage of existing power transmission infrastructure.
The addition of solar energy generation and storage projects should have minimal impact on 
surrounding properties and generation of renewable energy would be a benefit to the region. Pima 
County Development Services Department, Planning Division has no opposition to the proposed 
major comprehensive plan amendments.

Dear Commissioner Adkins:
We greatly appreciate the attention given by Joe Charles and Roy Moore in the 
leasing section of the Department to the concerns we’ve raised regarding the 
proposed location of this project near Arlington. In addition to seeking a lease of
this land, Candela Renewables, LLC from San Francisco has submitted a Major 
Comprehensive Plan Amendment to the Maricopa Planning & Development 
Department for reclassification from Rural- 43 and Rural Density (1 d.u./ acre) to 
“utilities”.
My clients are property owners residing directly within the boundaries of the 
proposed site and other residents in Arlington.  We’ve made clear to the 
applicant, to the County and the Department that OUR OPPOSITION IS NOT TO 
SOLAR PROJECTS in general.  
The objection is solely to the fact that THIS LOCATION IS TOTALLY 
INAPPROPRIATE for the reasons set forth hereafter.
The site is a unique geologic feature very visible in the west Buckeye valley. It’s a 
hill that makes up the entire area identified in their application and is virtually 
covered with black volcanic rocks.

Dr. Shelby Cave wrote her doctoral dissertation (ASU-2015) in which she 
identified the crater located on top of this hill as the Arlington low shield volcano
in the Sentinel-Arlington Volcanic Region. The crater is clearly visible in the 
Department’s aerial photos.
My clients and others who have worked in this area, including the utility 
companies, have long ago discovered that the hill consists of rock formations 
with underlying lava flows making construction extremely difficult, if not 
impossible.  Installation of utility poles has always proved problematic, requiring 
the heaviest equipment and multiple drill sites.  Some years ago an attempt was 
made to bury a communication cable adjacent to Old US 80 across the hill.  A D8 
cat with a single ripper initiated the dig.  They finally brought in a 2nd D8 to assist 
but still were unable to put in a simple trench. After abandoning the effort, the 
cable was attached above ground to the utility poles.
In Candela’s presentation to the neighborhood they showed row upon row of 
solar panels mounted upon frames up to 20 feet in height. They stated the “solar 
racking system is supported by driven posts”. (Refer pg 15 of the Narrative 
submitted to the County).  This design is consistent with other solar arrays 
located in the desert south and west of this site as well as similar projects 
elsewhere.  We’ve not attempted to estimate the number of “driven posts” but it’s 
obvious they will number in the thousands.
Based upon local construction experience as well as observations of other efforts 
such as utility companies, we’re certain they will discover that any sort of “driven 
posts” in the pattern needed for their project will prove impossible.  However, our 
concern, and we believe should be the concern of the Department, is that 
anything more than small core sampling will cause irreparable damage. Further, 
it’s clear that the overlay of black volcanic rocks on this site would be largely 
removed for construction.
We drew Roy Moore’s attention to a similar hillside located several miles south 
and west, which we understand you are familiar with. It’s very unaffectionately 
known in the area as “Scar Mountain”.  More than 20 years ago the overlay of 
rock was stripped leaving the underlying surface unprotected.  Absolutely no 
vegetation grows, erosion occurs and dust is driven off in the wind.  It’s 
outrageous and an insult to one’s sight. A portion of this was State Trust Land for 
which it was reported a fine was paid but no restoration ever occurred. This    
site is also clearly visible in the Department’s aerial photos.

If the Department were to make clear that upon any significant disturbance of the 
surface or abandonment of this project, which we’re confident would occur after 
testing for feasibility, or at decommissioning in the unlikely event the project is 
constructed, full RESTORATION (not remediation) would be required, including 
bonding to assure compliance, our guess is Candela would immediately be 
evaluating other locations.
Before this proposed lease is considered, we urge that you and your staff meet 
us there and personally inspect the site and Scar Mountain.
POINT #1:
This particular site is geologically, as well as aesthetically, totally unsuited for the 
proposed project and is certain to do irreparable damage to Trust Land even in 
the initial testing.  It would be a breach of the fiduciary duties of the Trustee to not 
assure protection of this land.

Additionally, Candela outlined in the neighborhood meeting that the entire site
would be surrounded by a 7’ woven wire fence topped with coiled razor wire.  
This would be on both sides of Old US 80 then down the sides of Teepee Rd. 
leading to my family’s home and to other residences within the project.
This is the equivalent of putting these residences, as well as a highway 
designated as historic, inside what looks like a prison.  It’s wrong and would not 
be tolerated in other residential areas much less well known places such as the 
Phoenix Mountain Preserve or the McDowell Mountains. For the Arlington 
Community, this hill is as important aesthetically as those Preserves are to 
Phoenix and Scottsdale.
We realize aesthetics and appearance will not usually be a significant factor in 
evaluating a lease of Trust Land; however, a basic sense of fairness to the 
community, in addition to preservation of value of the Trust Land, surely is 
deserving of serious consideration.
POINT #2:
Placing the main roadway into the Arlington community, as well as into the 
various residences, inside a prisonlike fence topped with coiled razor wire is 
wrong and bisects State Trust Land.

Viable and even preferable alternate sites exist in the immediate area for this 
project.  Several similar solar arrays were completed within a few miles south 
and west.  The terrain is far more suited and access to transmission lines and 
other infrastructure is equal, if not superior.
There will be serious archeological, historical, environmental and related issues 
but, for the reasons set forth above, it’s premature to address those.
Therefore, on behalf of my family and others who live within the boundaries of 
the site of this proposed lease, as well as residents in the Arlington community,
we urgently request the Department accept our offer for a personal visit to this 
site to evaluate the concerns we’ve outlined.  We feel confident this will result in 
a message to Candela that this site is wholly inappropriate for the proposed 
project but there are other more suitable locations nearby.
Please don’t hesitate to contact the undersigned with any questions and to 
arrange for the visit to the site.  Note:  we’ve copied Candela on this letter and 
extended an invitation to meet us there.
