In terms of next steps, I believe you need to re-apply with Maricopa County as you did before, and in that second application process, the PUE dedication will need to be included. Maricopa County will then ask us for our determination again. At this time we then can approve the abandonment because the PUE dedication is included within the application. I believe this is how the process works, but this is Maricopa County’s jurisdiction, not Scottsdale Water. You will want to confirm the next steps with Jessica as she will know the process better. However if we were to allow 23-feet of abandonment, your water meter would then sit on the inside of your property boundary. We would then require a dedicated access easement in order to regularly access the water meter. Additionally, you would not be able to build a driveway along that location because the driveway cannot sit on top of the water meter; nor construct a boundary wall because the water meter cannot be enclosed. Our field crews must be able to easily access the meter without going onto private property. You could relocate your water meter outside of your property boundary then no access easement would be required. However, relocating the water meter would be at your own cost. Scottsdale Water can perform this work and if the relocation is less than 15-feet of movement, they will do it for a small fee. If its greater than 15- feet of movement, its considered a new service which is more expensive. I’ve attached a document which displays these costs if you decided to go that route. So I understand what you are saying. I would think we would be low priority, but you never know! Would it be possible for the City of Scottsdale to come down to just a 10' easement rather than the 13'? I just want to re iterate all the utilities, when staked were 13' west of our lot, the person who staked your water showed the service line going further west of the electric. Attached is a video I made the day the APS engineer was out, he used his survey tool to mark my property line. In the video I am walking west from the existing house, I am following the power and phone lines on the right side of the video in white you will see where we want to place our addition. As I am moving just before I get a cactus in my foot you see the black line ahead that is my property line marked. As I start moving again I will pass the property line, I get past approx 13 1/2 feet and then I turn North and you see the blue line marked, then I turn south and back north and walk up to where blue stake marked the water in blue, you will see he marked it with a blue arrow pointing further west. His point is showing it further west of the electric. We went with our plans into Maricopa County 3 times once before and twice during the design and engineering of our garage, and asked about easements and were told there was nothing. So we were so surprised when this all came up! We did have the plans drawn up originally with a 29.58' setback and then redrew once we were told again there was no easement (the one I sent you with the marking showed 22.53"). If the City of Scottsdale would agree to 10" we could go back to that plan with the 10' easement and our 20' setback. This would allow us to keep our plans for a 3 car garage addition. And which ever way the City decides to go what is the next move? Do you need to record the easement change? The existing 8-inch water main, not your service line, along 58th Street sits along the west side of the “road”. However, the determination to only allow 20-feet of abandonment is because the City of Scottsdale Water Resources Department needs to reserve the remaining 13-feet for future sewer lines. Currently, there is no sewer service within the area but we must plan that there will be infrastructure improvements in the future. Hi Julie I received you name and email address from Jessica May at the AZDOT. I have been working on an abandonment of a patent easement on the north and west side of my lot and have one by one been working with the utility companies that have service in the area. I received the above letter from AZDOT advising that the City of Scottsdale did provide an objection to the abandonment of a patent easement on the west side of our lot. APS also initially objected but ad we investigated and they sent an engineer out they have decided allow the abandonment. We really do not care about the north side we just put it in here while we were doing it! Attached is the document from AZDOT named City of Scottsdale for your reference, that states you would consider 20 feet. I have also included attachments from APS and Centurylink agreeing to abandon the west side and just setting utility easements. I have had the west side of our lot blue staked and we found that the utilities do not run on my lot, They are approximately 14 to 15 feet west of my property line west on the adjacent lot. I only have the service lines up to my connections. I have also included a picture from the plans we had submitted to Maricopa County building for the addition. I have marked it up so you could see what we are planning on doing, and where your water lines run with the new addition. What we are asking is if the City of Scottsdale would do what both APS and Centurylink have agreed to and abandon the existing easement. We do not have any plans to build west of our new garage. If it would help and you would like to send an engineer out like APS did, I could have the City of Scottsdale water lines re-blue staked. Please let me know, or contact me if you do have questions.
