INVOCATION - INVOCACIÓN Vic Petersen offered the Invocation. 2. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Vic Petersen led the assemblage in the Pledge of Allegiance to the Flag. Supervisor Gallardo stated Mr. Petersen is a veteran of the U.S. Air Force. He served for approximately 22 years. He is always the first one to volunteer and get involved within the West Valley community. He is always the first one to sign up and be present at the West Valley Leadership Coffees. He is present at all West Valley community events and is an avid runner. He participates in running events throughout the year. Mr. Petersen spent two tours in Vietnam and three deployments in the Middle East. He is active in the veteran’s community and was recently inducted into the Arizona Veterans Hall of Fame. He is a strong community advocate, friend and supporter of District 5. Supervisor Gallardo thanked Mr. Petersen for his presence and for his service. Chairman Gates thanked Mr. Petersen for his presence and service. He noted how appropriate his presence is as the County prepares for Veterans Day. 3. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL PRESENTACIÓN DE ANIMALS DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES Jose Santiago, Maricopa County Animal Care and Control Communications Officer, introduced a senior female Chihuahua. He spoke of the importance of finding homes for the senior pets at the shelters. He stated the shelters are full and are currently housing nearly 800 animals. He asked the public to consider adopting a pet. NOTE: Agenda item 47 was taken out of order and heard before agenda item PZ-1. 47. APPOINT A JUSTICE OF THE PEACE FOR THE NORTH MESA JUSTICE COURT Pursuant to ARS §11-251(16) and the vacancy created by the resignation of Cecil Ash, Justice of the Peace, North Mesa Justice Court, consider nominations and make an appointment to the fill the vacancy for a Justice of the Peace for the North Mesa Justice Precinct. Such appointment shall be effective November 4, 2019. There were eight applicants for the position. He spoke of the appointee having a good heart and being an honorable man. He has a passion to do right to others in the right moment. Kyle Jones has previously served as a Justice of the Peace Pro Tem so he is able to fill the vacancy well. Motion to appoint Kyle Jones was made by Supervisor Chucri, seconded by Supervisor Sellers Supervisor Sellers stated he knows Mr. Jones as Vice Mayor Jones and noted he is pleased to see him in the Justice of the Peace capacity. It has been a wonderful experience working in the Justice Court System. He spoke of his positive experience working in multiple courts. He looks forward to working at the North Mesa Justice Court. The Clerk administered the Oath of Office. Chairman Gates congratulated Mr. Jones and recognized the presence of Presiding Justice of the Peace Keith Russell. SALT RIVER PROJECT LAND USE LICENSE Approve and authorize the Chairman to execute License Agreement P-50340 with Salt River Project Agricultural Improvement and Power District (SRP), for use of parking space on parcel APN 112-22-930 located at 324 South 2nd Avenue, Phoenix, Arizona. This license agreement is required to provide an additional parking area near Maricopa County Elections’ MCTEC Office to meet a portion of the parking demands for staff and volunteers working the upcoming Primary and General elections from October 2019 through November 2022. The term of the license will commence upon execution by the Board of Supervisors and expire on November 23, 2022. The use will be for a total of ten (10) months during that period. The County will be responsible for ensuring the parking area is in compliance with applicable air quality rules and regulations. As consideration, the County will pay a fee of $10,000.00 plus any applicable taxes, in two payments on November 1, 2019 and November 1, 2020. DELEGATION OF AUTHORITY FY 2019 SCAAP APPLICATION PROCESS Approve retroactively delegation of authority to the Sheriff to apply for FY 2019 SCAAP (State Criminal Alien Assistance Program) reimbursement funds, per Part I: SCAAP Guidelines issued by the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice. SCAAP provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens who have at least one felony and two misdemeanor convictions for violations of state or local law and who are incarcerated for at least 4 consecutive days. The reporting period is July 1, 2017 through June 30, 2018. The application was originally submitted May 23, 2019. The authorization and filing oversight was noticed when the Grantor contacted MCSO with questions about the application. Approval of this action allows the application process to continue. MCSO has applied for this funding on behalf of Maricopa County for approximately 20 years. The actual award amount is formulaic using reporting period jail system inmate data downloads and payroll data. Award amounts have declined in recent years. MCSO will return to the Board for authorization to accept any funding awarded that is pursuant to this application. ACCEPT FUNDING FROM US DEPARTMENT OF JUSTICE, FEDERAL BUREAU OF INVESTIGATION FOR THE DESERT HAWK VIOLENT CRIME TASK FORCE Approve the Notice of Limits for FY20 State and Local Overtime Reimbursements and acceptance of up to $149,192 in reimbursement funding from the US Department of Justice, Federal Bureau of Investigation for officers assigned to FBI managed task forces. The FBI Desert Hawk Violent Crime Task Force agreement commenced October 1, 2017 and will continue for an indefinite period until terminated by one or both parties. Acceptance of this agreement was approved by the Board of Supervisors on December 13, 2017 under C-18-038-G-00. The FY20 reimbursement funding began retroactively October 1, 2019 and will terminate September 30, 2020. The Sheriff’s Office indirect cost rate for FY20 is 16.3%. Unrecoverable indirect costs have been calculated as up to $24,318.30. The unrecoverable indirect cost of up to $24,318.30 will be covered by the department General Fund. This agreement is recurring, non- competitive and does not require a match. The agreement does not require on-going cash contributions after the period end date. This is not a mandated function although it supports the MCSO public safety mandate to identify and target for prosecution criminal enterprise groups responsible for drug trafficking, money laundering, alien smuggling, crimes of violence such as murder and aggravated assault, robbery, and violent street gangs, as well as to intensely focus on the apprehension of dangerous fugitives where there is or may be a federal investigative interest. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. APPLICATION AND ACCEPTANCE OF FUNDING FROM THE OFFICE OF NATIONAL DRUG CONTROL POLICY FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA PROGRAM Approve Application and Acceptance of up to $652,796 with the Office of National Drug Control Policy (ONDCP) Award Number G20SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. The term of this funding is January 1, 2020 to December 31, 2021. This amount represents the total FY 20/21 budget and spending ceiling for this initiative. The Maricopa County Sheriff’s Office is the Fiduciary of these funds for the County and will receive up to $545,556. The Maricopa County Attorney’s Office will receive up to $107,240. The total unrecoverable indirect cost amount is $105,869.55. The Sheriff 's Office indirect rate is 16.3% and it will not recover $88,925.63. The County Attorney's Office indirect rate is 15.8% and it will not recover $16,943.92. The services provided under this Agreement support the public safety mandate through the investigation, apprehension and prosecution of illegal drug traffickers. This award does not require a cash contribution, nor an in-kind contribution, and there are no future or ongoing contributions required following the grant period. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. The HIDTA Program is sponsored/funded by the Office of National Drug Control Policy (ONDCP). These grant funds are to support and enhance activities in accordance with the approved ONDCP HIDTA Program Policy and Budget Guidance (PPBG). There has been participation in the HIDTA program since approximately 1998. AGREEMENT WITH THE DRUG ENFORCEMENT ADMINISTRATION FOR ORGANIZED CRIME DRUG ENFORCEMENT TASK FORCES - FY2020 Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Drug Enforcement Administration, Organized Crime Drug Enforcement Task Force (OCDETF) Investigative/Strategic Initiative # MN-19-0039/SWAZP0858 in the amount of $564,563 for the award period beginning October 1, 2019 and terminating on September 30, 2020. This Agreement may be terminated by any of the parties by written notice to the other parties ten (10) business days prior to termination. The funding award is recurring and has been awarded to the Sheriff’s Office the past eight years. There is no match requirement. The Sheriff’s Office indirect cost rate for FY20 is 16.3%, applicable to the award amount of $564,563 less capital expenses of $35,000 for an indirect cost base of $529,563 and indirect costs of $86,318.77 to be absorbed by the General Fund. There are no future or ongoing contributions required after the grant period ends; however, property (items) purchased with these funds must remain available to the Strike Force/Strategic Initiative for the duration of its existence. This is not a mandated function although it supports the MCSO public safety mandate and provides a benefit to the citizens by disrupting the illicit drug trafficking organizations in Maricopa County and the State of Arizona resulting in a more safe and secure community. This is a non-competitive award. The Maricopa County Sheriff’s Office is one of several local law enforcement agencies in the Phoenix metro area that participate in this effort. This is reimbursement funding that will be used to purchase capital and non-capital equipment; to lease and operate a vehicle; to secure subscription technical service; to pay monthly data charges relating to several types of equipment; and to secure contracted analyst service. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This is the third year that MCDCHS has received the grant funds for participation in the Frontlines of Communities in the United States (FOCUS) grant from Gilead for the development of Hepatitis C programs with linkages to care. The grant award is not a mandated function but provides a benefit to the citizens by providing vouchers for approved foods (milk, cheese, cereals, peanut butter, eggs, infant formula, and juice etc.) for low-income pregnant, post- partum, breast-feeding women, infants, and children up to five (5) years of age. Clients also receive nutrition and breast-feeding education and referrals to applicable social services. .The grant award is competitive. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. NEW SOURCE REVIEW (NSR)-AQ-2017-010 Pursuant to A.R.S. §49-479(b), set a public hearing for December 11, 2019 to solicit comments and consider the adoption of the Maricopa County Air Pollution Control Regulations and the associated proposed revision to the Arizona State Implementation Plan (SIP). The Maricopa County Air Quality Department (MCAQD) is proposing to revise the MCAQD’s New Source Review (NSR) rules in Maricopa County Air Pollution Control Regulation I-General Provisions and Regulation II-Permits and Fees - Rule 100 (General Provisions and Definitions), Rule 200 (Permit Requirements), Rule 210 (Title V Permit Provisions), Rule 220 (Non-Title V Permit Provisions), Rule 230 (General Permits), Rule 240 (Federal Major New Source Review (NSR)) and Rule 241 (Minor New Source Review (NSR)) - and to submit the revised rules as a revision to the Arizona SIP. Following the public hearing, the Board is requested to adopt the proposed amendments to the MCAQD’s NSR rules and to approve submission of the amended rules as a revision to the Arizona SIP. Upon Board approval, this item will become effective December 11, 2019. The MCAQD is proposing to revise the MCAQD’s NSR rules and is proposing to submit the revised rules as a revision to the Arizona SIP. NSR is a long-standing Clean Air Act permitting program that requires businesses to get an air pollution control permit before they start construction or make major modifications to their business. NSR must ensure that air quality is not significantly degraded from the addition of new or modified businesses, while also providing flexibility to businesses to improve or modernize their operations. Air quality permits must include an air quality analysis to demonstrate that new emissions emitted from the business will not cause or contribute to a violation of a National Ambient Air Quality Standard (NAAQS). The purpose of this rulemaking is to remedy the following eight deficiencies identified by the U.S. Environmental Protection Agency (EPA) in the MCAQD’s NSR rules: (1) Rule 100, Definitions of “PM2.5” and “PM10”; (2) Rule 200, Good engineering practice (GEP) stack height provisions; (3) Rule 200, Agricultural equipment exemption demonstration; (4) Rule 220, Sections 404.3(e) and (f) (Procedures for Certain Changes that do not Require a Non-Title V Permit); (5) Rule 200, Section 403.2 (Permit Renewal and Expiration); (6) Rules 100 and 200 Appendix G references; (7) Rules 100 and 200 Arizona Testing Manual references and (8) Rule 100 Definitions to be removed from the Arizona State Implementation Plan (SIP) justifications. In addition to remedying the EPA identified deficiencies, the MCAQD is proposing revisions to address Stakeholder and Staff comments and EPA’s recommended clarifications. Following the public hearing, the Board is requested to adopt the proposed amendments to Rule 204 and to approve submission of the amended rule as a revision to the Arizona SIP. Formal Meeting Minutes Wednesday, November 06, 2019 Page 33 of 47 The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 204 (Emission Reduction Credits for Use with the Arizona Emissions Bank) and is proposing to submit the revised rule as a revision to the Arizona SIP. Rule 204 implements procedures for the certification and utilization of emission reduction credits (ERCs) generated from permitted sources emitting particulate matter, sulfur dioxide, carbon monoxide, nitrogen oxides, or volatile organic compounds. Participation in the generation, certification, and utilization of ERCs is voluntary; however, when a source chooses to generate, certify, or utilize ERCs they must do so in compliance with the applicable provisions of Rule 204. In 2017, the Arizona State Legislature amended A.R.S. § 49-410 to allow for the generation, certification, and utilization of ERCs from nontraditional (non-permitted) sources. ADEQ followed with a revision to the A.A.C. on June 14, 2019 (25 A.A.R. 1433). The MCAQD is proposing to revise Rule 204 to include provisions for the generation, certification, and utilization of emission reduction credits from nontraditional sources that use truck stop electrification, electric standby equipped transport refrigeration units, or electric onsite equipment to generate emission reduction credits. The MCAQD is also proposing revisions to align the rule with the revisions made to the Arizona Emissions Bank rules by the ADEQ. Permit fees are not changing due to this action. They all noted their appreciation of County services. The Sheriff’s Department has been assisting with speeding throughout their community. He thanked the Department of Transportation for their work on highway beatification. Supervisor Sellers spoke of a recent Gilbert Chamber of Good Government Series he attended with Supervisor Chucri. He attended the Lucas Off Road National Racing Event as part of the official welcoming group. He spoke of his attendance at the River at Eastline Village Ribbon Cutting noting the public/private partnership in affordable housing. He noted at the Intel Community Advisory Committee meeting and spoke of the presentation on the impact technology has on retail. Supervisor Chucri spoke of his experience with Supervisor Sellers at the Gilbert Chamber of Good Government Series. He noted the generosity shown throughout the county through the work of each Board member within the community and he experienced seeing it at the following events: while attending a fundraiser for Officer Gene Lee; through Chairman Gates comments at the Veterans Celebration and his recent experience while volunteering at Paz de Cristo. Chairman Gates spoke of the loss of Officer Gene Lee noting the importance of Detention Officers. He thanked all who attended the Veterans Celebration and noted his appreciation to Veterans for their service. Authorize the District to award the pre-construction services contract FCD 2019C024 to the selected respondent and pending negotiation of a mutually acceptable Guaranteed Maximum Price, authorize the District to award one or more construction services contracts to the selected respondent. The estimated total cost of the construction contract(s) is $14,500,000. This is a qualification-based selection in accordance with Maricopa County Procurement Code, Article 5, Paragraph 504(F) and Article IV of the Maricopa County Procedures Manual. The Flood Control District of Maricopa County has initiated design work for the Rawhide Wash Flood Hazard Mitigation Project under a consultant contract with JE Fuller. The project partners are the cities of Scottsdale and Phoenix along with the Flood Control District of Maricopa County. The Project includes improvements to existing floodwalls and levees which must be certified to meet the Federal Emergency Management Agency’s requirements for floodwalls and levees. The project includes construction of new floodwalls and levees to contain the 100-year flood within the Rawhide Wash corridor. The Project limits are from Pinnacle Peak Road to ½ mile north of Happy Valley Road. This is a complex project and, as such, the District will select the CMAR Contractor based on qualifications in order to obtain valuable constructability input during the design effort through delivery of pre- construction services under the Construction Manager At Risk contracting method. The future construction cost is currently estimated to be 14.5 million dollars. This Agenda Item impacts Supervisorial District 2 and 3.
