Jefferson, 10th Floor, Phoenix, AZ 85003, with the following members present: Clint Hickman, Chairman, District 4 (telephonically); Jack Sellers, Vice Chairman, District 1; Steve Chucri, District 2 (telephonically); Bill Gates, District 3 (telephonically); Steve Gallardo, District 5 (telephonically). Also present: Fran McCarroll, Clerk of the Board; Kelly Gardiner, Minutes Coordinator; Joy Rich, County Manager; and Andrea Cummings, Legal Counsel (telephonically). Note: Vice Chairman Sellers was on-site for this meeting, so Chairman Hickman asked him to chair the meeting. 1. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Executive Agenda dated Wednesday, July 29, 2020, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Motion to approve by Supervisor Steve Chucri, seconded by Supervisor Steve Gallardo Ayes: Clint Hickman, Jack Sellers, Steve Chucri, Bill Gates, Steve Gallardo EXECUTIVE SESSION CONVENED Acting Chairman Sellers convened the Board in Executive Session EXECUTIVE MEETING RECESSED Acting Chairman Sellers recessed the Board of Supervisors Executive Session to convene the Board of Supervisors in Open Session. ~ Bill Gates was not in attendance when the open meeting reconvened ~ OPEN SESSION BOARD OF SUPERVISORS ACTION Special Meeting Minutes Wednesday, July 29, 2020 Page 2 of 4 2. CARES ACT IMPLEMENTATION AND COUNTY RESPONSE TO COVID-19 Take action as directed by the Board in Executive Session on Wednesday, July 29, 2020. (C-19-21-008-X-00) Motion by Supervisor Hickman to approve revisions to the County CARES Act Budget as reflected in the attached spreadsheet, and direct staff to develop an expanded Small Business Assistance program utilizing CARES Act funding, and direct staff to develop a Disposition Assistance program utilizing CARES Act funding. CARES ACT EXPENDITURE APPROVAL Approve the following uses of CARES Act funding consistent with the Board of Supervisors approved priorities. Environmental Services - IT equipment for teleworking estimated at $175,000 - Transfer station attendant booths estimated at $300,000 Enterprise Technology - Laptops and peripherals for teleworking estimated at $340,000 - NetMotion VPN and tech services estimated at $151,000 Medical Examiner - Temporary staff to address surge estimated at $318,000 (C-06-21-050-X-00) Motion to approve by Supervisor Clint Hickman, seconded by Supervisor Steve Gallardo Ayes: Clint Hickman, Jack Sellers, Steve Chucri, Steve Gallardo Absent: Bill Gates 4. DEVELOPMENT AGREEMENT WITH WHISPERING HILLS PHOENIX, LLC Approve the Development Agreement between Maricopa County and Whispering Hills- Phoenix, LLC (Whispering Hills) for facilitation of a portion of Maricopa County Special Meeting Minutes Wednesday, July 29, 2020 Page 4 of 4 Department of Transportation Project (MCDOT) TT0513: 35th Avenue – Carver Road to Elliot Road Project (Project) , and authorize the Chairman to execute the agreement. Whispering Hills is in the process of receiving final approval of its subdivision plans from the City of Phoenix (City) and anticipates development of its property will start on or about December of 2020. 35th Avenue adjacent to the Whispering Hills development is a County road and the Project construction is proposed to begin in January of 2021. The County, City, and Whispering Hills coordinated on many items in an attempt to avoid conflict between the two projects. Whispering Hills is dedicating the right of way required for the Project. In addition, the County and Whispering Hills propose to enter into the Development Agreement to set forth the terms and conditions under which the projects will proceed should Whispering Hills’ development move forward before or after the MCDOT Project begins, or not at all. The agreement specifies acceptance of storm water flows, match points for construction efforts, and a possible cash in-lieu payment by the developer in an effort to avoid unnecessary duplication of effort, conflict, and waste during construction.
