Fern Ward, District 5, led the assemblage in the Pledge of Allegiance to the Flag.
Supervisor Gallardo thanked Ms. Ward for her presence.  He noted he has known Ms. 
Ward for years and spoke of her volunteer involvement in the Laveen community.  He 
said her son is a City of Phoenix Police Officer and spoke of her advocacy of police 
officers as well.  He thanked her for her presence and stated he looked forward to his 
continued work with her.
Chairman Hickman thanked Ms. Ward for her presence.

Monica Grey, Maricopa County Animal Care and Control Communications Officer, 
introduced Jasper, a male 14-pound dog who is people friendly and available for 
adoption.  She spoke of November as Senior Adoption Month and all fees are waived 
for the 60 available senior pets.

Approve Zanjero Trails Parcel 34D Subdivision Assurance Agreement with Maricopa County 
Municipal Water Conservation District Number One & SBH Zanjero Trails, LP; and Maricopa 
County. This agreement serves as part of the subdivision’s assurance as required by Arizona 
Revised Statutes §11-821(C) and must be approved by the Board of Supervisors prior to 
approval of the Final Plat for the Zanjero Trails Parcel 34D Subdivision (case number 
S2020006). This agreement to be recorded as required pursuant to A.R.S. §11-1101. The 
subdivision assurance agreement shall become effective on the date it is recorded with the 
Maricopa County Recorder.

A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, 
PHOENIX, ARIZONA (THE "COUNTY") AUTHORIZING EXECUTION ON BEHALF OF 
THE COUNTY, AN ASSURANCE AGREEMENT AMONG THE COUNTY; AND 
MARICOPA COUNTY MUNICIPAL WATER CONSERVATION DISTRICT NUMBER 
ONE & SBH ZANJERO TRAILS, LP (HEREAFTER, THE "OWNER") REGARDING 
IMPLEMENTATION OF THE DEVELOPMENT KNOWN AS THE ZANJERO TRAILS - 
PARCEL 34D SUBDIVISION
WHEREAS, Maricopa County is a growing county with respects to population, and 
expects population growth to continue in the foreseeable future, and
WHEREAS, a sizable portion of this population growth will occur in unincorporated 
areas as a result of large master-planned communities that will include a significant 
number of residents and various types of land uses; and
WHEREAS, the Board of Supervisors recognizes that it must exercise its authority to 
accommodate growth in an efficient manner that protects County residents and 
taxpayers from undue fiscal burdens; and
WHEREAS, pursuant to Arizona Revised Statues §11-821 (C) the posting of an 
assurance satisfactory to the County, ensuring the completion of necessary 
infrastructure, is required as a pre-condition to the granting of an approval to subdivide 
property; and
WHEREAS, Owner owns certain real property in unincorporated Maricopa County 
comprising a total of approximately 22 acres (the "Property"); and
WHEREAS, Owner represents and warrants that it is the fee title owner of the Property
and has an interest in the Property as described in Arizona Revised Statutes §11-1101 
B; and
WHEREAS, County wishes to enter into an assurance agreement in form and 
substance acceptable to the County with Owner (the "Assurance Agreement") for the 
subdivision known as Zanjero Trails-Parcel 34D in accordance with ARS §11-821 to 
help ensure timely and efficient development of infrastructure and services for future 
residents within the Property, and to help minimize fiscal impacts to County residents 
and taxpayers;

WHEREAS, ARS §11-821 provides that the Board of Supervisors may regulate the
subdivision of lands within its corporate limits by requiring the posting of performance 
bonds or other forms of assurances, including assurance agreements, necessary to 
ensure the installation of required street, sewer, electric and water utilities; and drainage 
and flood control improvements meeting minimum standards of design and 
construction; and
WHEREAS, the Board of Supervisors has agreed to accept from Owner in order to 
meet such requirements an assurance in the form of the "Assurance Agreement".
NOW, THEREFORE, BE IT RESOLVED, the Board of Supervisors of Maricopa County 
authorizes execution of the Assurance Agreement on behalf of the County.

Commission Recommendation:   On 10/8/20, the Commission voted 6-0 to recommend 
approval of Z2017085 subject to conditions ‘a’ – ‘i’: 
a.
Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Johnson Stewart Materials Plan of Development”, consisting of 3 full-size sheets, 
dated revised May 13, 2020, and stamped received August 7, 2020, except as modified by 
the following conditions. Within 30 days of Board of Supervisors approval, the applicant shall 
provide Planning and Development with an updated site plan with the IUPD standards. 
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Johnson Stewart Materials”, consisting of 12 pages, dated  revised August 20, 2020, 
and stamped received August 21, 2020, except as modified by the following conditions.

c.
The following Planning Engineering conditions shall apply: 
     1.
 The submitted plan shows extensive grading within ADOT right-of-way. A permit or 
other written approval from ADOT must be provided prior to building permit approval. 
     2. Prior to building permit approval, evidence of City of Mesa approval of the proposed fill 
over the reclaimed water line must be provided. 
     3.
 The site is located in a Special Flood Hazard Area (FEMA Floodplain Zone A). A 
floodplain use permit will be required for storage of materials in the floodplain, unless 
previously addressed as part of a Sand and Gravel Permit issued by the Flood Control 
District. 
     4.
 All development and engineering design shall be in conformance with Section 1205 
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction. 
     5.
 Engineering review of planning and/or zoning cases is for conceptual design only 
and does not represent final design approval nor shall it entitle applicants to future designs 
that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance 
and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the 
MCDOT Roadway Design Manual. 
     6.
 Detailed Grading and Drainage Plans showing the new site improvements must be 
submitted for the acquisition of building permits. 
d.
The following IND-3 IUPD zoning district standards shall apply: 
     1.
 Front Yard (along eastern property line of 001B & 014): 0’
     2.
 Side Yard (along southern zoning boundary of 003J & 001B): 0’
     3.
 Parking Spaces: Standard parking and ADA parking provided at administration 
parcels on 135-06-003M & 003L.
     4.
 Screening: Solid masonry or similar-type opaque wall not less than 6-feet in height 
shall be provided along, adjacent to, or within the Front Yard (Alma School Rd. parcel 135-
06-003J). Screening adjacent to all other property lines shall not be required.
e.
The owner shall obtain as-builts permits on all existing unpermitted canopies 
identified as Structures A, B, D, E, F and G as shown on the site plan dated revised May 13, 
2020. The owner shall obtain a final status on the as-built permits by March 31, 2021 deadline 
date as established in the associated Compliance Agreement. 
f. The zone change IUPD overlay is applied to restrict the use of the site. Until such time as 
the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa 
County Environmental Services Department (MCESD) that can be accommodated by septic 
systems. A public water system and public sewer system shall be required prior to 
establishment of any non-residential use that requires such.
g.
Noncompliance with any Maricopa County Regulation shall be grounds for initiating 
a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.

h.
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
i. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held on the date 
of application due to such revocation of the Zone Change.  The Zone Change enhances the 
value of the property above its value as of the date the Zone Change is granted and reverting 
to the prior zoning results in the same value of the property as if the Zone Change had never

Request:  Comprehensive Plan Amendment (CPA) Modification of Condition to increase 
maximum allowed units (CPA2014002) – Marbella Ranch in the R-5 RUPD Zoning District. 
CPA approval is by Resolution. 
Site Location:  Generally located approx. 407’ southwest of the southwest corner of Northern 
Ave. and El Mirage Rd. in the Glendale area
Commission Recommendation:   On 10/8/20, the Commission voted 6-0 to recommend 
approval of CPA2019006 subject to conditions ‘a’ – ‘g’: 
a. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Project Narrative CPA – Marbella Ranch”, consisting of 10 pages, dated August 10, 
2020, and stamped received August 10, 2020, except as modified by the following 
conditions.
b. If the Board takes action to amend or revert/rescind subsequent zoning, this land use plan 
shall be considered for amendment.
c. The total number of residential units shall not exceed 1,660 dwelling units.
d. Prior to initial Final Plat approval or initial precise plan of development, the applicant shall 
submit to the Maricopa County Planning and Development Department a “will serve” letter 
and verification of approval of a Maricopa Association of Governments (MAG 208) 
amendment from Liberty Utilities.

e. The following Luke Air Force Base condition shall apply:
Marbella Ranch shall notify future occupants/tenants that they are located near a military 
airport with the following language:
“You are locating in a residential dwelling inside the State Statute defined “territory in the 
vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly 
as low as 1,500 feet above the ground.  You will be subject to direct overflights and noise by 
Luke Air Force Base jet aircraft in the vicinity.
Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast.  Noise will be more noticeable during overcast sky 
conditions due to noise reflections off the clouds.
Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours and 
during most weekends.
For further information, please check the Luke Air Force Base website at 
www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and 
Development Department.”
Such notification shall be permanently posted on not less than a 3 foot by 5 foot sign in front 
of all leasing offices and be permanently posted on the front door of all leasing offices on not 
less than 8½ inch by 11 inch sign.
f. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property owner 
to enjoy uses in excess of those permitted by the land use existing on the date of the 
application, subject to conditions.  In the event of the failure to comply with any condition of 
approval, the property shall change to the land use designation that existed on the date of 
the application.  It is, therefore, stipulated and agreed that revocation due to the failure to 
comply with any conditions does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in the value 
of the property from the value it held on the date of application due to such revocation.  The 
Comprehensive Plan Amendment enhances the value of the property above its value as of 
the date the Comprehensive Plan Amendment is granted and changing to the prior land use 
designation results in the same value of the property as if the Comprehensive Plan 
Amendment had never been granted.
g. The following Planning Engineering conditions shall apply:
 
     1.
 Without the submittal of a precise plan of development, no development approval 
is inferred by this review, including, but not limited to drainage design, access and roadway 
alignments.  These items will be addressed as development plans progress and are 
submitted to the County for further review and/or entitlement.
     2.
 Condition noted on the attached memo from MCDOT Traffic Engineering dated 
8/7/20:
i. A traffic signal at the Collector Road & El Mirage Road intersection, and auxiliary turn lanes 
with appropriate storage lengths at access roads shall be provided in the infrastructure plans 
as part of Parcels 5 and 6.

Resolution Amending the Maricopa County Comprehensive Plan – 
- White Tank/Grand Avenue Area Plan

BE IT RESOLVED by the Maricopa County Board of Supervisors as follows:
WHEREAS, Maricopa County adopted its Comprehensive Plan and White Tank/Grand 
Avenue Area Plan in accordance with Arizona Revised Statutes to help bring about 
coordinated physical development consistent with the present and future needs of 
Maricopa County; and
WHEREAS, Maricopa County recognizes the importance of having a comprehensive 
plan amendment process so that this plan can be responsive and flexible to meet the 
changing conditions of Maricopa County; and
WHEREAS, Maricopa County has procedures to determine when comprehensive plan 
amendments are necessary, how comprehensive plan amendments are processed, 
and at what point comprehensive plan amendments can be presented at a public 
hearing by the Board of Supervisors, upon recommendation by the Planning and Zoning 
Commission; and
WHEREAS, 
Arizona 
Revised 
Statutes 
requires 
that 
amendments 
to 
the 
Comprehensive Plan be approved by resolution of the Board of Supervisors; and
WHEREAS, the Maricopa County Board of Supervisors has carefully considered this 
comprehensive plan amendment, has held a public hearing regarding this 
comprehensive plan amendment, and finds that this comprehensive plan amendment 
constitutes an overall improvement to the Maricopa County Comprehensive Plan the -
White Tank/Grand Avenue Area Plan, and to Maricopa County in general.
NOW, THEREFORE BE IT RESOLVED that the comprehensive plan amendment for 
case number CPA2019006, is hereby approved this 4th day of November 2020.

Ave. and El Mirage Rd. in the Glendale area
Commission Recommendation:   On 10/8/20, the Commission voted 6-0 to recommend 
approval of Z2019053 subject to conditions ‘a’ – ‘z’: 
a. Development of the site shall comply with the Zoning Exhibit entitled “Legal Description 
Marbella Ranch North Stip Mod and CPA Mod Limits”, consisting of 3 pages, dated revised 
June 2, 2020, and stamped received July 27, 2020, except as modified by the following 
conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Project Narrative Rezone Marbella Ranch North Stipulation Modification”, consisting 
of 11 pages, dated September 1, 2020, and stamped received September 1, 2020, except 
as modified by the following conditions.
c. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and 
ARS §11-814.  The term of this conditional zoning is approval of a final plat or plan of 
development, as applicable, for the initial phase of development within five years of Board of 
Supervisors approval of Z2014011, and then an additional five years to obtain final plat or 
plan of development approval as applicable for each successive phase of development.
While not a term of the conditional zoning, the applicant shall submit a written report every 
five years from the date of Board of Supervisors approval of Z2014011 which details the 
status of the project, including progress on obtaining necessary entitlements, licenses, and 
permits; compliance with the conditions of approval; compliance with the approved narrative 
report; compliance with the approved land use plan; and justification as to how the approved 
zoning still represents appropriate land use planning for the property and unincorporated 
Maricopa County in accordance with the goals and policies in its comprehensive plan and 
applicable area plan and land use plans.  The status reports to be administratively reviewed 
by Planning and Development with the ability administratively to accept or carry the status 
report to the Board of Supervisors (Board), upon recommendation by the Planning and 
Zoning Commission (Commission) for consideration of amendments or revocation of zoning 
for undeveloped parcels.  Status reports will be required until completion of all final plats 
and/or plans of development.
d. The following R-5 RUPD Zoning District standards for Single Family Traditional products 
shall apply:
     1.
 Max. Height: 30’/2 stories for detached single family residential, 40’/3 stories for 
attached single family residential townhome
     2.
 Min. Rear Yard: 5’ for detached single family residential, 5’ for attached single family 
residential townhome

g. Not less than 34 acres shall be developed as recreational open space to include 
playgrounds, tot lots, mini-parks and amenities.  At the time of each preliminary plat 
submission, the developer shall include a description of the status, cumulative acreage and 
proposed amenities as identified with this condition.  The 34 acres of required open space 
may be shared between both the north and south Marbella Ranch developments.
h. All transformers, back-flow prevention devices, utility boxes and all other utility related 
ground mounted equipment shall be painted to complement the development and shall be

i. The following Planning Engineering conditions shall apply:
 
1) Without the submittal of a precise plan of development, no development approval is 
inferred by this review, including, but not limited to drainage design, access and roadway 
alignments.  These items will be addressed as development plans progress and are 
submitted to the County for further review and/or entitlement.
2) Condition noted on the attached memo from MCDOT Traffic Engineering dated 10/6/20:
i. A traffic signal at the Collector Road & El Mirage Road intersection, and auxiliary turn lanes

k. Prior to issuance of any permits for development of the site, the applicant/property owner 
shall obtain the necessary encroachment permits from the Maricopa County Department of 
Transportation (MCDOT) for landscaping or other improvements in the right-of-way.
l. Prior to any Final Plat approval, the applicant shall submit to the Maricopa County Planning 
and Development Department a “will serve” letter and verification of approval of a Maricopa 
Association of Governments (MAG208) amendment from Liberty Utilities which 
demonstrates a willingness and capability to serve Marbella Ranch.
m. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
n. Development of the site shall be in compliance with all applicable Maricopa County Air 
Quality rules and regulations.
o. An archeological survey shall be submitted to and approved by the Arizona State Historic 
Preservation Office prior to the issuance of a grading permit.  The applicant must contact the 
State office prior to initiating disturbance of the site.  The applicant shall provide the Planning 
and Development Department with written proof of compliance with this stipulation.
p. The Final Plat shall have a note that the property is within an area of known land 
subsidence and/or earth fissuring.  No development including paved roadways or residential 
lots within 100’ of the mapped confirmed fissure, drainage and storm runoff should not be 
concreted or directed towards the fissure or offsite area.  Further, notice that the property is 
in area of known land subsidence and/or earth fissuring and a definition of both land 
subsidence and earth fissures shall be prominently displayed in the sales office, in the 
covenants, conditions and restrictions (CC&Rs), and in any disclosure statements for 
conveyance documents.  However, if said report concludes negative impact regarding land 
subsidence and/or earth fissuring the required notification can include such results.
q. Prior zoning clearance or Final Plat approval, developer(s) and/or builder(s) shall establish 
emergency fire protection services, covering all real property contained within the project 
area during course of construction and shall obtain a ‘will serve’ letter substantiating 
coverage from the appropriate Fire District, servicing the site.
r. The following Maricopa County Sherriff’s Office (MCSO) conditions shall apply:
1) Prior to any final plat, the master developer shall enter into a development agreement with 
the Maricopa County Sherriff’s Office (MCSO) to provide law enforcement services to 
Marbella Ranch and surrounding areas.
2) This development agreement shall include, but not necessarily be limited to, the master 
developer’s requirement to pay their proportionate share for start-up costs (vehicle purchase 
and patrol equipment, e.g. radios, tasers, and vehicle laptops); and interim fees for law 
enforcement services associated with the property unless it is annexed into an incorporated 
municipality or until full law enforcement service contract is otherwise implemented.  The 
development agreement may also include, but not necessarily be limited to the master 
developer’s requirement to donate to the County, for use by the MCSO, their proportionate 
share of separate office space complete with tenant improvements or land (the size to be 
determined in the development agreement), or payment of fees when a permit is issued.

3) This development agreement shall include the terms listed in this stipulation unless 
otherwise mutually agreed to by MCSO and the master developer; furthermore, the 
development agreement shall be signed by both the master developer and the MCSO and 
provided to the Maricopa County Planning and Development Department for public record.
s. The following Drainage Review conditions shall apply:
1) Drainage review of planning and/or zoning cases is for conceptual design only and does 
not represent final design approval nor shall it entitle applicants to future designs that are not 
in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the 
Maricopa County Drainage Policies and Standards.
2) All development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance and current engineering policies, standards and best 
practices at the time of application for construction.
t. Variations to the development standards as indicated in the approved Unit Plan of 
Development (UPD) table may be varied by the Board of Adjustment in accordance with 
Article 303.2.2 of the Maricopa County Zoning Ordinance (MCZO).
u. All habitable buildings constructed within this subdivision shall be constructed to attain a 
noise reduction level as per ARS § 28-8482(B).
v. Amendments to the site plan and narrative report shall be processed as a revised 
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
w. Noncompliance with the conditions of approval will be treated as a violation in accordance 
with the Maricopa County Zoning Ordinance.  Further, noncompliance of the conditions of 
approval may be grounds for the Planning and Zoning Commission to take action in 
accordance with Chapter 3 (Conditional Zoning).
x. Non-compliance with the regulations administered by the Maricopa County Environmental 
Services Department, Maricopa County Department of Transportation, Drainage Review 
Division, Planning and Development Department, or the Flood Control District of Maricopa 
County may be grounds for initiating a revocation of this Zone Change as set forth in the 
Maricopa County Zoning Ordinance.
y.
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows the 
property owner to enjoy uses in excess of those permitted by the land use existing on the 
date of the application, subject to conditions.  In the event of the failure to comply with any 
condition of approval, the property shall change to the land use designation that existed on 
the date of the application.  It is, therefore, stipulated and agreed that revocation due to the 
failure to comply with any conditions does not reduce any rights that existed on the date of 
application to use, divide, sell or possess the property and that there would be no diminution 
in the value of the property from the value it held on the date of application due to such 
revocation.  The Comprehensive Plan Amendment enhances the value of the property above 
its value as of the date the Comprehensive Plan Amendment is granted and changing to the 
prior land use designation results in the same value of the property as if the Comprehensive 
Plan Amendment had never been granted.

Marbella Ranch shall notify future occupants/tenants that they are located near a military 
airport with the following language:
“You are locating in a residential dwelling inside the State Statute defined “territory in the 
vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly 
as low as 1,500 feet above the ground.  You will be subject to direct overflights and noise by 
Luke Air Force Base jet aircraft in the vicinity.
Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast.  Noise will be more noticeable during overcast sky 
conditions due to noise reflections off the clouds.
Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours and 
during most weekends.

of $70,256 during the grant award period and has general fund resources to provide this 
match.
This grant provides critical funding for our victim advocates so they may work to ensure 
Maricopa County victims of crime receive each of the services mandated by the Arizona 
Constitution and the Crime Victim’s Bill of Rights.  The grant award is competitively bid and 
other eligible agencies may or may not bid on this grant award. If awarded, the department 
will absorb the costs of the grant award totaling $116,781.03.
Funding for this agreement is provided by a Grant from Arizona Department of Public Safety, 
Victims of Crime Act, Victim Assistance Grant Program. The overall grant budget will be 
adjusted as necessary to accommodate this grant through a future reconciliation. Grant 
revenues are not local revenues for the purpose of the constitutional expenditure limitation,

FUNDING FROM ARIZONA ATTORNEY GENERAL’S OFFICE FOR FY 2021 LAW 
ENFORCEMENT EQUIPMENT
Approve the Agreement and acceptance of $50,000 in advance grant funding from the 
Arizona Attorney General’s Office (AG), for Law Enforcement Equipment.    This one-time 
funding award was a result of a competitive process and there is no cash or in-kind matching 
requirement.  The Sheriff’s Office indirect cost rate for FY21 is 14.6%.  Unrecoverable 
indirect costs associated with this Agreement are estimated to be $7,300 and will be 
absorbed by the General Fund.  There is no match and there are no future or on-going cash 
contributions required.  This funding supports the Sheriff Office public safety mandate. 
These grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget

ADDITION OF VEHICLES TO JUDICIAL BRANCH SECURITY FLEET
Approve a permanent addition to the fleet of two (2) vehicles for Judicial Branch Security. 
These vehicles will be purchased using non-recurring funds that exist within Superior Court’s 
(D800) approved General Fund (Fund 100) non-recurring (1001) budget at an estimated cost 
of $60,000. 
Also, approve an exemption from markings, including the County seal, and issuance of non-
governmental license plates per A.R.S. §38-538.03 in keeping with other vehicles within the 
Judicial Branch Security fleet.  The vehicle information, including make, model, year, color 
and VIN number will be provided to the Clerk of the Board upon approval of this agenda and 
purchase of the vehicles.
Direct the Budget Office to adjust the Vehicle Replacement Fund as necessary in future 
years to accommodate these vehicles being added to the permanent fleet. 
FY2020-21 additional one-time preparation costs needed to place these vehicles into service 
are estimated to be approximately $10,000.  Funds for this expense exist within the Superior 
Court’s General Fund approved non-recurring budget.
FY2020-21 additional operating expenses for these vehicles are estimated to be 
approximately $1,000.   This cost will be absorbed in the Superior Court’s General Fund

Approve a Memorandum of Understanding (MOU) between the Maricopa County Air Quality 
Department (MCAQD) and White Water II, LLC for MCAQD to provide up to $60,488 in 
federal DERA sub-award funding to White Water, LLC for the replacement of two diesel 
powered delivery trucks.
This MOU will provide up to $60,488 in funds to support the State Clean Diesel Grant 
Program and benefit air quality by replacing one 1997 short haul Class 7 and one 1999 short 
haul Class 6 model year diesel delivery trucks with one 2021 Class 7 and one 2021 Class 6 
ultra-low sulfur diesel delivery trucks.  Matching funds of 75% will be provided by White 
Water, LLC.
The program is consistent with Maricopa County Air Quality Department’s (MCAQD) mission 
“to provide clean air to Maricopa County residents and visitors so they can live, work, and

Quality Department (MCAQD) and the Cartwright School District #83 for MCAQD to provide 
up to $198,630 in federal DIESEL EMISSIONS REDUCTION ACT (DERA) sub-award 
funding to Cartwright School District #83 for the replacement of one diesel powered school 
buses.
This Agreement will provide up to $198,630 in funds to support the State Clean Diesel 
Program and benefit air quality by replacing one 2007 model year diesel school buses with 
one new zero emissions fully electric school bus.  Matching funds of 55% will be provided by 
Cartwright School District #83.
The program is consistent with Maricopa County Air Quality Department’s (MCAQD) mission 
“to provide clean air to Maricopa County residents and visitors so they can live, work, and

Approve a non-financial Agreement with Child Crisis Arizona, an Arizona non-profit 
corporation (CCA), and Maricopa County administered by its Human Services Department, 
Early Education Division. The purpose of this Agreement is to integrate the County’s early 
education services into CCA’s social and community services resource network. The Parties’ 
goal is to support the transition of enrolled children from CCA’s Early Head Start (“EHS”) 
program to the County’s Head Start program and further the children’s development.
The term of this Agreement shall begin on November 1, 2020 through June 30, 2022.

Keith & Associates, Inc., an Oklahoma corporation (“School”) for a Dietetic Internship and 
Maricopa County (“Facility”) administered by the Human Services Department. Through this 
Agreement, School Interns shall be provided with supervised practice educational 
experiences with the Head Start Nutrition program.
The term of this Agreement shall be for a period of five (5) years from the effective date 
(November 4, 2020 through November 3, 2025). The County may, at its option and with the 
agreement of the School, renew the term of this Agreement for additional terms up to a 
maximum of five (5) years.

AMENDMENT WITH ARIZONA DEPARTMENT OF HOUSING FOR THE 
WEATHERIZATION ASSISTANCE PROGRAM
Approve Amendment No. 1 to the revenue Agreement between Arizona Department of 
Housing (ADOH) and Maricopa County administered by its Human Services Department. 
The purpose of Amendment No. 1 is to address the following:
A. ADOH will provide the County with Low Income Home Energy Assistance Program 
(LIHEAP) Coronavirus Aid, Relief, and Economic Security (CARES) Act funds in the amount 
of $618,009. The LIHEAP-CARES Act funding is to be expended prior to other LIHEAP 
funding. The funds will be utilized to provide Weatherization Assistance Program measures 
in dwellings occupied by low-income households in Maricopa County outside of the City of 
Phoenix and the City of Mesa. The County will be required to serve eighty-one (81) units with 
LIHEAP-CARES Act funds.
B. Revise Section 6 (Scope of Work) Attachment A and replace it in its entirety with the 
attached revised Attachment A.
C. Revise Section 7 (Reports) Attachment B and replace it in its entirety with the attached 
revised Attachment B.
D. Revise Section 9 (Budget) Attachment C and replace it in its entirety with the attached 
revised Attachment C.
E. Revise Section 13 (Compensation and Method of Payment) Attachment D and replace it 
in its entirety with the attached revised Attachment D.
The Agreement term is July 1, 2020 through June 30, 2021. All other terms and conditions 
of the Agreement shall remain unchanged and in full force and effect as executed by the 
Parties.
ADOH contracts with the County on an annual reoccurring, non-competitive basis for service 
delivery of the Weatherization Assistance Program. The funding provided by this 
Amendment is a one-time occurrence. 
The Human Services Department utilizes the provisional indirect rate of 22.2% by the U.S. 
Department of Health and Human Services for FY2021 for salaries and employee related 
expenses. The total Amendment funds are $618,009 of which $40,558 is for salaries and 
benefits. The total estimated indirect costs are $9,004, and fully recoverable. 
Receipt of the funds from ADOH does not require in-kind or match funds and no future or 
ongoing contributions by the County at the end of the Agreement term. 
The services provided under this Agreement are not a mandated function but provides a 
benefit to the citizens by providing assistance to low-income residents with weatherization 
measures to reduce their energy burden and improving health and safety concerns.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and Therefore, expenditure of the revenues is not prohibited by the budget law. 
This Amendment No. 1 does not alter the budget constraining expenditures of local revenues 
duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be 
adjusted as necessary to accommodate this grant through future budget reconciliation.

Acceptance of this Amendment No. 1 will not impact the County General Fund. Upon

Approve Amendment No. 3 to the Agreement between Native American Connections, a 
community based non-profit organization and Maricopa County administered by its Human 
Services Department. 
The purpose of the Amendment is to address the following items:

The County shall provide the Subrecipient with a not-to-exceed amount of $105,201 
in CARES Act funding for the period of October 1, 2020 through December 30, 2020. The 
monthly invoices shall not exceed $35,067. 
2.
The Subrecipient shall submit a final CARES Act invoice no later than January 10, 
2021. 
The foregoing paragraphs contain all the changes to the Agreement made by this 
Amendment No. 3. All other terms and conditions of the Agreement and Amendment No. 1 
and Amendment No. 2 shall remain unchanged and in full force and effect as executed by 
the Parties.

AMENDMENT TO USE MANAGEMENT AGREEMENT WITH SCORPION BAY 
HOLDINGS, LLC
Approve and execute Amendment Two to the Use Management Agreement (“Agreement”) 
between Maricopa County (“County”) and Scorpion Bay Holdings, LLC (“Concessionaire”) to 
allow Concessionaire to offer modified and additional recreational services to the public, 
delete first right of refusal of certain property, add certain property  for dry boat storage, 
change the payment fee schedule, and make other administrative corrections. 
Additional recreational services, among other items, includes on-shore and offshore rental 
cabins and other short-term lodging facilities, including additional support facilities and 
amenities related to the provision of lodging services.
The addition of 22 acres of land (Exhibit A-1) will allow Concessionaire to construct a dry 
boat storage complex. 
Administrative changes, among other items, include an increase in Concessionaire’s 
payment fees (Exhibit C-1) and Concessionaire’s reimbursement of certain utilities fees to 
the County. The Concessionaire shall also be responsible for  any and all upgrades, future 
expansion or upgraded services to the well water delivery system as required due to future 
improvements, at the Concessionaire’s sole expense.
All development costs will be at the expense of Concessionaire.  The activities for this 
concession will be located in Supervisory District #4. (C-30-06-012-1-05)

AMENDMENT TO USE MANAGEMENT AGREEMENT WITH EPR PARKS, LLC
Approve and execute Amendment Four to the Use Management Agreement (“Agreement”) 
between Maricopa County (“County”) and EPR Parks, LLC, as Successor in Interest to 
Harvest Family Entertainment – Arizona, LLC (“Concessionaire”) to revise development 
phases, revise the legal description of Parcel 2, and update contact information. This 
concession is known as Hurricane Harbor – Phoenix (“Complex”), located at Adobe Dam 
Regional Park and is currently managed by Six Flags Entertainment Corporation.
The Amendment sets forth the definition for each of the development phases.  Phase I and 
II have been completed to the County’s satisfaction.  The Phase III proposed development 
is within the new legal description for Parcel 2 (3.5 acres of land as illustrated in Exhibit B) 
to allow Concessionaire to construct a fenced employee parking area that will support the 
recreational waterpark and free up additional parking for customers.
All development costs will be at the expense of Concessionaire.  The activities for this 
concession will be located in Supervisory District #4. (C-30-08-034-1-08)

IMMUNIZATION SERVICES
Approve Amendment No. 3 to the Intergovernmental Agreement (IGA) Contract No. 
ADHS18-177694, Immunization Services, between Arizona Department of Health Services 
(ADHS) and Maricopa County by and through its Department of Public Health (MCDPH), 
Community Wellness and Health Promotion to provide for immunization services.  
1. Pursuant to Uniform Terms and Conditions, Provision (6) Contract Changes, (6.1) 
Amendments, Purchase Orders, and Change Orders, it is mutually agreed that the IGA 
referenced is amended as follows:  
1.1 The Price Sheet is revised and replaced by the Price Sheet of this Amendment Three 
(3); and
1.2 Scope of Work, Page Nineteen (19), Provision 4.12, added item 4.12.2 that is hereby 
revised in this         
     Amendment Three (3) to read: 
      4.12.2 Provide Supplemental Adult Flu activities as defined by the County Health 
Department and approved by 
      the Immunization Program Office, to increase the flu vaccination rates for adults, 
especially high-risk adults, 
      within the county. These efforts are intended to help keep hospitalization rates for flu 
down during the COVID-19   
      pandemic. 
All other terms of this agreement remain unchanged.
This Amendment is in the additional amount of $1,005,000 for the budget period July 1, 2020 
through June 30, 2021, bringing the total not to exceed amount from $4,514,555 to 
$5,519,555 for the cumulative period from July 1, 2018 through June 30, 2021.  The term of 
this IGA is January 1, 2018 through December 31, 2022.

The Department of Public Health’s indirect rate for FY20-21 is 18.8%. Indirect is estimated 
at $159,040, all of which is recoverable. The overall grant budget will be adjusted as 
necessary to accommodate this grant through a future reconciliation
This grant award is reoccurring and has been awarded to the department since 1993. The 
grant does not require an in-kind match; indirect cost is fully recoverable; and ongoing cash 
contributions are not required. The grant award is a mandated function and provides a benefit 
to the citizens by ensuring that immunization coverage levels in the County’s child, 
adolescent, and adult populations improve for both public and private health care recipients. 
The grant award is not competitive.  There are no costs that will need to be absorbed by the 
department’s operating budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This 
Amendment does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. §42-17105.  The overall grant budget will be 
adjusted as necessary to accommodate this grant through a future reconciliation.  Funding 
for this Agreement is provided by a Grant from ADHS and will not affect the County’s general

IGA WITH CITY OF PHOENIX FIRE DEPARTMENT FOR MASS IMMUNIZATION 
SERVICES AND ADMINISTRATION
Approve an Intergovernmental Agreement (IGA) between Maricopa County, through its 
Department of Public Health (MCDPH) and City of Phoenix Fire Department (PFD), for the 
provision and administration of seasonal flu vaccine (as well as other types of vaccines, as 
needed) to those 6 months of age and older.  Funding is in the amount of $50,000 for the 
project period beginning November 2, 2020 and ending June 30, 2021, with an option to 
extend.
This agreement will be CARES Act funded and was approved for this purpose on June 8, 
2020 as C-86-20-552-M-00. CARES Act funding is set to expire 12/30/2020. Should that 
occur, and should alternate funding not be available, Section 4.0 of the Contract, Availability 
of Funds will apply, allowing for a change or termination of the contract. (C-86-21-082-X-00)

AMERICORPS VISTA VOLUNTEER
Approve a retroactive Memorandum of Agreement (MOA) between Hands on Greater 
Phoenix and Maricopa County by and through its Department of Public Health (MCDPH), 
Office of Community Empowerment for the assignment of one AmeriCorps Volunteer in 
Service to America Member (VISTA), who will provide an in-kind volunteer service to 
MCDPH to support the implementation of a Community Health Workforce development 
training program. As a host site, the County is required to pay a $9000 service fee for a 
VISTA member assignment the service fee will be covered with grant funds totaling $8000.00 
from the Health in Arizona Policy Initiative Grant in addition to a $1,000.00 general fund 
contribution from Maricopa County Department of Public Health’s Office of Community

An easement for this project was previously granted by the Board (C-78-20-014-3-00) on 
June 24, 2020 however due to an APS design change, a new easement with a revised legal 
description is now required in order to provide electric service to the County’s new fuel station 
and carwash facility project.  This easement will grant APS the right to construct, reconstruct, 
replace, repair, operate, and maintain electrical lines for the transmission and distribution of 
electricity (and for all other purposes connected therewith).  Upon recording of this easement 
APS will release/abandon the previously granted recorded easement.
This item is located in Supervisorial District 5.

AMENDMENT TO IGA WITH THE CITY OF LITCHFIELD PARK FOR OPERATING AND 
MAINTAINING THE TRAFFIC SIGNAL AT CAMELBACK ROAD AND LITCHFIELD 
ROAD
Approve the Intergovernmental Agreement between Maricopa County and City of Litchfield 
Park for operating and maintaining the traffic signal at Litchfield Road and Camelback Road. 
Either party may terminate this Agreement at any time prior to the expiration date by 
furnishing the other party with a thirty (30) day written notice.
The County and the City previously entered into an agreement in 2013 for the maintenance 
and operations of the traffic signal. That agreement has expired and both Parties wish to 
extend the terms of the agreement. The County will continue to operate and maintain the 
traffic signal until November 20, 2023, and will invoice the City for annual services.

IGA WITH THE CITY OF LITCHFIELD PARK TO WAIVE TRAFFIC CONTROL PERMIT 
FEES
Approve the Intergovernmental Agreement between Maricopa County and City of Litchfield 
Park to waive traffic control permit fees in certain situations. Under the Intergovernmental 
Agreement, the agencies will agree to reciprocally waive traffic control permit fees for 
projects meeting specific requirements. The Agreement will remain in effect through June 
30, 2022 unless extended by appropriate actions by the County and City. Either party may 
terminate this Agreement at any time prior to the expiration date by furnishing the other party 
with a thirty (30) day written notice.
This Agreement will allow for traffic control permit fees to be waived when the City has a 
project adjacent to or near County right-of-way, the County is not a partner to the project, 
and the City needs to place traffic control in County right-of-way for appropriate notice and 
safety. The traffic control permit fees would be waived for County projects meeting the same 
conditions. Both parties are required to submit traffic control plans and follow standard 
permitting requirements. The review of the traffic control permit application plans would be

Supervisors'/County Manager's summary of current events - Resumen de temas de 
actualidad de los Supervisores/Administrador del Condado
Supervisor Gallardo recognized the reappointment of Francisca Montoya to the 
Planning and Zoning Commission.  He thanked her for her continued service.  He 
congratulated the Justices of the Peace Pro Tempore on their appointments, noting a 
few as personal acquaintances.  He spoke of the approval of the intergovernmental 
services agreement with Cartwright School District #83 for the replacement of one 
diesel powered school bus.
Supervisor Sellers spoke of his recent attendance at an East Valley Partnership 
Infrastructure Committee meeting and noted how impressed he is with the east valley 
projects such as the Salt River Project Update on the Verde River.  He noted how 
important several of the projects are to the valley.

Supervisor Chucri noted hearts, minds and prayers for Allister Adele, County Attorney.  
He spoke of the elections and how the elections staff did an outstanding job.  He 
thanked Chairman Hickman for his rigorous navigation through 2020.
Supervisor Gates concurred with the comments for Ms. Adele and her family.  He spoke 
of the recent elections and spoke of the extensive work of staff and the Board on 
elections.  He spoke of how proud he is to be part of the team to assist in execution of 
an exceptional election process.
Chairman Hickman spoke of the work of the Board and staff in making sure the election 
ran smoothly especially during a pandemic.  He thanked his colleagues, staff, elections 
team and the county workers who volunteered during the elections for their work in the 
election.

BIDS AND AWARD FOR SUN CITY DRAIN – OLIVE AVENUE – FROM 103RD AVE TO 
99TH AVE
Authorize the advertisement of the Invitation for Bids of the Sun City Drain – Olive Avenue – 
from 103rd Ave to 99th Ave (Project [#337]) and the award of the contract to the lowest 
responsible bidder, if the bid is not more than ten percent (10%) over the engineer’s estimate. 
The Project will re-construct the 1,500 ft. long channel along the north side of Olive Ave., 
from 103rd Ave. to 99th Ave. The existing trapezoidal gunite lining, built in the 1960’s, is in 
a distressed condition and will be removed and replaced with a fiber reinforced shotcrete 
lining. The project improvements also include a maintenance access ramp to the channel 
bottom and safety railing; temporary construction perimeter fencing will be required.
This channel is owned and maintained by the Flood Control District of Maricopa County 
(FCDMC), and the project is 100% funded by FCDMC.

IGA WITH THE UNITED STATES GEOLOGICAL SURVEY FOR WATER RESOURCES 
INVESTIGATIONS
Approve the annual Intergovernmental Agreement (IGA) FCD 2020A024, between the 
United States Geological Survey [Agreement #21ZFJFA1800 (USGS)] and the Flood Control 
District of Maricopa County (District), for the period through September 30, 2021, for 
collection of stream flow data on local watersheds throughout Maricopa County. The total 
cost of the IGA is $390,750. The District’s costs under this agreement will be $237,000, with 
the USGS contributing the remaining $153,750. Payments from the District are to be made 
quarterly. 
The agreement covers costs associated with the maintenance, collection, and publication of 
stream flow data and river reach characteristics at nine continuous stream flow monitoring 
stations and 22 peak flow monitoring sites throughout Maricopa County. This agreement 
further will develop and evaluate long term flood histories on watercourses in Maricopa 
County, and provide information critical to the determination of the risk of flooding in these 
watercourses. The information generated by the USGS’s ongoing work is vital to the safety 
of Maricopa County residents, and to the continuing hydrologic studies performed by the 
District. This agenda item impacts all Supervisorial Districts. (C-69-21-038-X-00)
