INVOCATION - INVOCACIÓN
Vic Petersen offered the Invocation.
2.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Vic Petersen led the assemblage in the Pledge of Allegiance to the Flag.
Supervisor Gallardo stated Mr. Petersen is a veteran of the U.S. Air Force.  He served 
for approximately 22 years.  He is always the first one to volunteer and get involved 
within the West Valley community.  He is always the first one to sign up and be present 
at the West Valley Leadership Coffees.  He is present at all West Valley community 
events and is an avid runner.  He participates in running events throughout the year.  
Mr. Petersen spent two tours in Vietnam and three deployments in the Middle East.  He 
is active in the veteran’s community and was recently inducted into the Arizona 
Veterans Hall of Fame.  He is a strong community advocate, friend and supporter of 
District 5.  Supervisor Gallardo thanked Mr. Petersen for his presence and for his 
service.
Chairman Gates thanked Mr. Petersen for his presence and service.  He noted how 
appropriate his presence is as the County prepares for Veterans Day.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL

Jose Santiago, Maricopa County Animal Care and Control Communications Officer, 
introduced a senior female Chihuahua. He spoke of the importance of finding homes for 
the senior pets at the shelters.  He stated the shelters are full and are currently housing 
nearly 800 animals.  He asked the public to consider adopting a pet.
NOTE: Agenda item 47 was taken out of order and heard before agenda item PZ-1.

APPOINT A JUSTICE OF THE PEACE FOR THE NORTH MESA JUSTICE COURT
Pursuant to ARS §11-251(16) and the vacancy created by the resignation of Cecil Ash, 
Justice of the Peace, North Mesa Justice Court, consider nominations and make an 
appointment to the fill the vacancy for a Justice of the Peace for the North Mesa Justice 
Precinct. Such appointment shall be effective November 4, 2019. (C-06-20-217-M-00)

Supervisor Chucri stated there has been a vacancy in the Mesa Justice Court due to the 
resignation of Cecil Ash who retired.  There were eight applicants for the position.  He 
spoke of the appointee having a good heart and being an honorable man.  He has a 
passion to do right to others in the right moment.  Kyle Jones has previously served as a 
Justice of the Peace Pro Tem so he is able to fill the vacancy well.
Motion to appoint Kyle Jones was made by Supervisor Chucri, seconded by Supervisor 
Sellers
Supervisor Sellers stated he knows Mr. Jones as Vice Mayor Jones and noted he is 
pleased to see him in the Justice of the Peace capacity.

Kyle Jones thanked the Board for the opportunity to serve in the North Mesa Justice 
Court.  It has been a wonderful experience working in the Justice Court System.  He 
spoke of his positive experience working in multiple courts.  He looks forward to working 
at the North Mesa Justice Court.
The Clerk administered the Oath of Office.
Chairman Gates congratulated Mr. Jones and recognized the presence of Presiding 
Justice of the Peace Keith Russell.
Chairman Gates asked if there were any changes or corrections to the agenda.  The 
Clerk noted the applicant has requested to continue item 5.d. until November 20, 2019.  
The department has requested that item 33 be withdrawn.

SALT RIVER PROJECT LAND USE LICENSE
Approve and authorize the Chairman to execute License Agreement P-50340 with Salt 
River Project Agricultural Improvement and Power District (SRP), for use of parking space 
on parcel APN 112-22-930 located at 324 South 2nd Avenue, Phoenix, Arizona.
This license agreement is required to provide an additional parking area near Maricopa 
County Elections’ MCTEC Office to meet a portion of the parking demands for staff and 
volunteers working the upcoming Primary and General elections from October 2019 
through November 2022. The term of the license will commence upon execution by the 
Board of Supervisors and expire on November 23, 2022. The use will be for a total of ten 
(10) months during that period. The County will be responsible for ensuring the parking 
area is in compliance with applicable air quality rules and regulations. As consideration, the 
County will pay a fee of $10,000.00 plus any applicable taxes, in two payments on 
November 1, 2019 and November 1, 2020. (C-21-20-001-L-00)

DELEGATION OF AUTHORITY FY 2019 SCAAP APPLICATION PROCESS
Approve retroactively delegation of authority to the Sheriff to apply for FY 2019 SCAAP 
(State Criminal Alien Assistance Program) reimbursement funds, per Part I: SCAAP 
Guidelines issued by the Bureau of Justice Assistance, Office of Justice Programs, U.S. 
Department of Justice.
SCAAP provides federal payments to states and localities that incurred correctional officer 
salary costs for incarcerating undocumented criminal aliens who have at least one felony 
and two misdemeanor convictions for violations of state or local law and who are 
incarcerated for at least 4 consecutive days. The reporting period is July 1, 2017 through 
June 30, 2018.
The application was originally submitted May 23, 2019. The authorization and filing 
oversight was noticed when the Grantor contacted MCSO with questions about the 
application. Approval of this action allows the application process to continue. 
MCSO has applied for this funding on behalf of Maricopa County for approximately 20 
years. The actual award amount is formulaic using reporting period jail system inmate data 
downloads and payroll data. Award amounts have declined in recent years.
MCSO will return to the Board for authorization to accept any funding awarded that is 
pursuant to this application. (C-50-20-026-G-00)

ACCEPT FUNDING FROM US DEPARTMENT OF JUSTICE, FEDERAL BUREAU OF 
INVESTIGATION FOR THE DESERT HAWK VIOLENT CRIME TASK FORCE
Approve the Notice of Limits for FY20 State and Local Overtime Reimbursements and 
acceptance of up to $149,192 in reimbursement funding from the US Department of 
Justice, Federal Bureau of Investigation for officers assigned to FBI managed task forces. 
The FBI Desert Hawk Violent Crime Task Force agreement commenced October 1, 2017 
and will continue for an indefinite period until terminated by one or both parties. 
Acceptance of this agreement was approved by the Board of Supervisors on December 13, 
2017 under C-18-038-G-00. The FY20 reimbursement funding began retroactively October 
1, 2019 and will terminate September 30, 2020. 
The Sheriff’s Office indirect cost rate for FY20 is 16.3%. Unrecoverable indirect costs have 
been calculated as up to $24,318.30. The unrecoverable indirect cost of up to $24,318.30 
will be covered by the department General Fund. This agreement is recurring, non-
competitive and does not require a match. The agreement does not require on-going cash 
contributions after the period end date. 
This is not a mandated function although it supports the MCSO public safety mandate to 
identify and target for prosecution criminal enterprise groups responsible for drug 
trafficking, money laundering, alien smuggling, crimes of violence such as murder and 
aggravated assault, robbery, and violent street gangs, as well as to intensely focus on the 
apprehension of dangerous fugitives where there is or may be a federal investigative 
interest. 
These revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget

APPLICATION AND ACCEPTANCE OF FUNDING FROM THE OFFICE OF NATIONAL 
DRUG CONTROL POLICY FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA 
PROGRAM
Approve Application and Acceptance of up to $652,796 with the Office of National Drug 
Control Policy (ONDCP) Award Number G20SA0005A, for the High Intensity Drug 
Trafficking Area (HIDTA) Program. The term of this funding is January 1, 2020 to 
December 31, 2021. This amount represents the total FY 20/21 budget and spending 
ceiling for this initiative. 
The Maricopa County Sheriff’s Office is the Fiduciary of these funds for the County and will 
receive up to $545,556. The Maricopa County Attorney’s Office will receive up to $107,240. 
The total unrecoverable indirect cost amount is $105,869.55. The Sheriff 's Office indirect 
rate is 16.3% and it will not recover $88,925.63. The County Attorney's Office indirect rate 
is 15.8% and it will not recover $16,943.92. 
The services provided under this Agreement support the public safety mandate through the 
investigation, apprehension and prosecution of illegal drug traffickers.

This funding is recurring and competitive. This award does not require a cash contribution, 
nor an in-kind contribution, and there are no future or ongoing contributions required 
following the grant period. Grant revenues are not local revenues for the purpose of the 
constitutional expenditure limitation, and therefore, expenditures of these revenues are not 
prohibited by the budget law.
The HIDTA Program is sponsored/funded by the Office of National Drug Control Policy 
(ONDCP). These grant funds are to support and enhance activities in accordance with the 
approved ONDCP HIDTA Program Policy and Budget Guidance (PPBG). There has been 
participation in the HIDTA program since approximately 1998. (C-50-20-027-G-00)

AGREEMENT WITH THE DRUG ENFORCEMENT ADMINISTRATION FOR ORGANIZED 
CRIME DRUG ENFORCEMENT TASK FORCES - FY2020
Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Drug 
Enforcement Administration, Organized Crime Drug Enforcement Task Force (OCDETF) 
Investigative/Strategic Initiative # MN-19-0039/SWAZP0858 in the amount of $564,563 for 
the award period beginning October 1, 2019 and terminating on September 30, 2020. This 
Agreement may be terminated by any of the parties by written notice to the other parties 
ten (10) business days prior to termination.
The funding award is recurring and has been awarded to the Sheriff’s Office the past eight 
years. There is no match requirement. The Sheriff’s Office indirect cost rate for FY20 is 
16.3%, applicable to the award amount of $564,563 less capital expenses of $35,000 for 
an indirect cost base of $529,563 and indirect costs of $86,318.77 to be absorbed by the 
General Fund. There are no future or ongoing contributions required after the grant period 
ends; however, property (items) purchased with these funds must remain available to the 
Strike Force/Strategic Initiative for the duration of its existence.
This is not a mandated function although it supports the MCSO public safety mandate and 
provides a benefit to the citizens by disrupting the illicit drug trafficking organizations in 
Maricopa County and the State of Arizona resulting in a more safe and secure community. 
This is a non-competitive award. The Maricopa County Sheriff’s Office is one of several 
local law enforcement agencies in the Phoenix metro area that participate in this effort. 
This is reimbursement funding that will be used to purchase capital and non-capital 
equipment; to lease and operate a vehicle; to secure subscription technical service; to pay 
monthly data charges relating to several types of equipment; and to secure contracted 
analyst service. 
These revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget

In accordance with the provisions of A.R.S. 12-102.02, subsection (C), authorize the 
Chairman of the Board of Supervisors to endorse and sign the FILL THE GAP plan 
submitted by the Presiding Judge of the Superior Court. In accordance with the instructions 
from the Administrative Office of the Courts, the plan has already been endorsed by the 
Presiding Judge of Superior Court, the Clerk of Superior Court, and the Presiding Justice of 
the Peace in Maricopa County.

APPOINT SUPERIOR COURT COMMISSIONERS AS SUPERIOR COURT JUDGE PRO 
TEMPORE
Approve the appointment of Court Commissioners Steven Warren McCarthy and Rodney 
Irvin Mitchell as a Superior Court Judge Pro Tempore in accordance with Arizona Revised 
Statutes § 12-141. The appointment will be for the period commencing November 4, 2019 
through June 30, 2020.
In order to obtain greater flexibility in the use of Court Commissioners, the Superior Court 
customarily has all Court Commissioners appointed as Superior Court Judges Pro 
Tempore so they may, on occasion, hear contested matters. This serves the interest of 
judicial economy and promotes sound caseflow management. Court Commissioners 
Steven Warren McCarthy and Rodney Irvin Mitchell would serve as a Superior Court Judge 
Pro Tempore without any additional compensation other than that to which she is entitled

through Animal Care & Control, and the Maricopa County Community College District on 
behalf of Mesa Community College, in which Mesa Community College of Veterinary 
Medicine students house select animals provided by MCACC for the purpose of providing 
medically necessary veterinary services as part of the students' educational modules. 
The initial term of the Agreement was effective from January 1, 2017 through December

In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and 
expenditure authority in Animal Care and Control (D790) Animal Care and Control Grant 
Fund (573) Non-Recurring Non-Project (NRNP) appropriation group by $7,500.
The Animal Care and Control indirect rate for FY2020 is 19.18%. Total grant indirect costs 
are estimated to be $1,438.50 and are not recoverable. Costs will be absorbed in the 
Department operating budget.
The grant award is a one-time, non-recurring. The grant award does not require a cash 
contribution, nor an in-kind contribution, and there are no future or ongoing contributions 
required following the grant period. The grant award does provide funding for a mandated 
service, which is to provide adequate care of animals that are sheltered with the Animal 
Care and Control Department. This grant was competitively bid.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The 
approval of this action does not alter the budget constraining the expenditures of local

AMENDMENT TO IGA WITH ARIZONA HEALTH CARE COST CONTAINMENT 
SYSTEM FOR PAYMENT SERVICES
Approve Amendment No. 11 to an Intergovernmental Agreement between Arizona Health 
Care Cost Containment System (AHCCCS) and Maricopa County through the Department 
of Correctional Health Services in the not-to-exceed amount of $230,000. The purpose of 
this amendment is to extend the IGA for one year. This amendment is effective from 
07/01/19 to 06/30/20. All other terms and conditions of the Intergovernmental Agreement 
remain in full force and effect.
This agreement is for third party claims payment services provided by AHCCCS to CHS. 
AHCCCS processes all outside provider claims incurred due to the incarcerated patient 
population needing medical services from a health care provider outside of the jail system. 
These patients are currently booked into the jail and under the care of CHS. Although, CHS 
provides many services on site, it does not provide inpatient acute hospitalization, certain 
specialty care services, or emergency and urgent care services. (C-26-08-011-0-11)

BUDGET ADJUSTMENT FOR DONATION OF LONG ACTING INJECTABLES
Pursuant to A.R.S § 42-17106 (B) approve the following appropriation adjustment:
Increase revenue and expenditure in the Correctional Health (D260) Correctional Health 
Grant Fund (292) Graves (GRV0) appropriation by $3,600,000.
This is a recurring donation, non-competitive award, effective from June 27, 2018 until 
June 27, 2023. There is no in-kind matching requirement or indirect costs associated with 
these donations. There will be future ongoing contributions required after the donation 
period ends to comply with the mandated Graves judgment of $3,600,000.
Donations are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. 
These budget adjustments do not alter the budget containing the expenditure of local 
revenues duly adopted by the Board pursuant to A.R.S. § 42-17105.
Also, approve a waiver for the annual request for monthly donation reporting per the 
Donation Policy (A2508, V.E.2) that requires a department that accepts cash and non-cash 
donations to provide an itemized listing to the Office of the Clerk of the Board, by the 5th

GRANT FUNDS FROM GILEAD SCIENCES, INC. FOR HEPATITIS C SCREENING 
PROGRAM
Approve the receipt of renewal grant funds from Gilead Sciences, Inc. (Gilead) in the 
amount of $308,177. Also request authorization for the Chairman to sign Renewal Focus 
Award Letter and all documents related to these grant funds, as applicable. The purpose of 
the grant funds is to support hepatitis C testing (“Project”). The grant award availability 
begins on 7/1/19 and ends on 06/30/20.
This grant award is a non-competitive award, but Maricopa County by and through the 
Department of Correctional Health Services (MCDCHS) submitted a continuation funding 
application in June 2019. This is the third year that MCDCHS has received the grant funds 
for participation in the Frontlines of Communities in the United States (FOCUS) grant from 
Gilead for the development of Hepatitis C programs with linkages to care.
There are no future or ongoing contributions after the grant period ends. Hepatitis C 
screening is not a mandated service. MCDCHS began testing for Hepatitis C at the initial 
award of this grant. 
The grant allows up to a 10.0% rate for indirect costs. The Maricopa County Department of 
Finance has calculated the MCDCHS’ composite indirect cost rate at 8.78%, which is fully 
recoverable and retroactive back to July 1, 2019. The indirect costs are estimated at 
$28,016.00, which are fully recoverable. There is no in-kind matching requirement.

ACCEPT GRANT FUNDS FROM ARIZONA DEPARTMENT OF EMERGENCY AND 
MILITARY AFFAIRS
Approve and accept grant funds from Arizona Department of Emergency and Military 
Affairs, Grant No. EMF-2019-EP-00010, CFDA #97.042 in the amount of $900,236. These 
grants are for emergency Planning within Maricopa County. The grant award begins on 
July 1, 2019 and ends June 30, 2020. Authorize the Chairman to sign all documents 
related to these grant funds, as applicable. The Department will be recovering the 
allowable 10% de minimus rate based on the total direct charges, which totals $81,840.
The grant award is reoccurring and has been awarded to the department for the past thirty 
(30) plus years. The department has a match requirement of $900,236 during the grant 
award period, the match for this grant comes from the General Fund (100-D150-1510), 
Palo Verde (100-D150-1510) and the Intergovernmental Agreements (100-D150-1510-
CTIGA). Maricopa County does not have to fund any additional costs for the program. The 
grant award is a mandated function for emergency preparedness through the Robert T. 
Safford Act. This grant provides funds for recipients to build and maintain emergency 
management programs at the state and local level. This grant award is non-competitive 
and all counties in the state are eligible to apply for funds to support their Emergency 
Management Programs.
In accordance with A.R.S. 42-17106 (B), authorize the following budget adjustment for the 
FY 2020 Emergency Management (D150) Budget: 
a) Decrease the revenue and expenditure authority in the Emergency Management’s Fund 
(215), Operating (OPER) by $25,896 from $1,103,871 to $1,077,975. 
b) Increase the revenue and expenditure authority in Non Departmental (D470) Non 
Departmental Grants Fund (249) Operating (OPER) Contingency (4711) in the line 
“Unreserved Contingency” by $25,896.
The Decrease is needed because during Fiscal Year 2020 Budget adoption, we originally 
budgeted the EMPG grant at $926,132 which included $25,896 for EMAP Certification and

The purpose of the Amendment is for the County to provide the Contractor with $100,000 
for the period of July 1, 2019 to June 30, 2020 for the provision of weather relief 
accommodations for individuals experiencing homelessness. 
The County shall reimburse the Human Services Campus, Inc. at a cost not to exceed 
$1,000 per night. 
The County shall reimburse the Contractor on a Net 0 payment basis.

the only low-barrier shelter services providers in downtown Phoenix that provide temporary

(County) and the Town of Cave Creek (Town) (Agreement) to clarify responsibilities for 
preparing and filing the documents necessary for transferring title and establishing the 
beneficial use of the water rights in the Spur Cross Ranch Conservation Area (Spur Cross), 
and authorize the County’s Parks and Recreation Director, or his designee, to take 
administrative action related to preparing such documents.
County and Town acquired Spur Cross in 2001, however, the associated water rights have 
not yet been recorded at Arizona Department of Water Resources (ADWR). This 
Amendment Two sets forth the responsibilities and procedures for both the Town and 
County to prepare the necessary filings related to Spur Cross water rights to be filed with

(MCDPH) to provide continued funding for the WIC and BFPC Services program. The Price 
Sheet is in the amount of $9,602,495.52, of which $112,246.52 is additional funds for 
indirect costs and the addition of a staff person who will be focused on achieving the goals 
and objectives for outreach and coordination. The budget period October 1, 2019 through 
September 30, 2020. The IGA term is October 1, 2018 through September 30, 2023.
Maricopa County Department of Public Health’s Indirect Rate for FY 2019-20 is 19.2% The 
indirect costs are estimated at $18,080 all of which are recoverable.
The WIC Services award is reoccurring and has been awarded to the department for many 
years. This grant does not require match, indirect cost is fully recoverable and ongoing 
cash contributions are not required. The grant award is not a mandated function but 
provides a benefit to the citizens by providing vouchers for approved foods (milk, cheese, 
cereals, peanut butter, eggs, infant formula, and juice etc.) for low-income pregnant, post-
partum, breast-feeding women, infants, and children up to five (5) years of age. Clients 
also receive nutrition and breast-feeding education and referrals to applicable social 
services. .The grant award is competitive. There are no costs that will need to be absorbed 
by the department’s operating budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. 
This Agreement does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be 
adjusted as necessary to accommodate this grant through a future reconciliation. Funding 
for this Agreement is provided by a Grant from ADHS and will not affect the County’s

anticipated amount of $499,231 to sub-recipient Southwest Human Development is not 
subject to indirect. Full indirect costs are estimated at $191,025 all of which is recoverable. 
Program costs not covered by the grant will be subsidized by the MCDPH indirect cost 
pool. Departmental indirect rates are re-established at the beginning of each fiscal year 
and the future indirect rates will be collected at the corresponding rates.

Pollution Control Regulations Rule 510 (Air Quality Standards) and the associated 
proposed revision to the Arizona State Implementation Plan (SIP). Following the public 
hearing, the Board is requested to adopt the proposed amendments to Rule 510 and to 
approve submission of the amended rule as a revision to the Arizona SIP. Upon Board 
approval, this item will become effective December 11, 2019.
The MCAQD is proposing to revise Rule 510 (Air Quality Standards) and to submit the 
revised rule as a revision to the Arizona SIP. Rule 510 lists primary and secondary ambient 
air quality standards that are applicable within Maricopa County. This updated list of 
primary and secondary ambient air quality standards aligns Rule 510 with the portions of

Pursuant to A.R.S. §49-479(b), set a public hearing for December 11, 2019 to solicit 
comments and consider the adoption of the Maricopa County Air Pollution Control 
Regulations and the associated proposed revision to the Arizona State Implementation 
Plan (SIP). The Maricopa County Air Quality Department (MCAQD) is proposing to revise 
the MCAQD’s New Source Review (NSR) rules in Maricopa County Air Pollution Control 
Regulation I-General Provisions and Regulation II-Permits and Fees - Rule 100 (General 
Provisions and Definitions), Rule 200 (Permit Requirements), Rule 210 (Title V Permit 
Provisions), Rule 220 (Non-Title V Permit Provisions), Rule 230 (General Permits), Rule 
240 (Federal Major New Source Review (NSR)) and Rule 241 (Minor New Source Review 
(NSR)) - and to submit the revised rules as a revision to the Arizona SIP. Following the 
public hearing, the Board is requested to adopt the proposed amendments to the 
MCAQD’s NSR rules and to approve submission of the amended rules as a revision to the 
Arizona SIP. Upon Board approval, this item will become effective December 11, 2019.
The MCAQD is proposing to revise the MCAQD’s NSR rules and is proposing to submit the 
revised rules as a revision to the Arizona SIP. NSR is a long-standing Clean Air Act 
permitting program that requires businesses to get an air pollution control permit before 
they start construction or make major modifications to their business. NSR must ensure 
that air quality is not significantly degraded from the addition of new or modified 
businesses, while also providing flexibility to businesses to improve or modernize their 
operations. Air quality permits must include an air quality analysis to demonstrate that new 
emissions emitted from the business will not cause or contribute to a violation of a National 
Ambient Air Quality Standard (NAAQS). The purpose of this rulemaking is to remedy the 
following eight deficiencies identified by the U.S. Environmental Protection Agency (EPA) 
in the MCAQD’s NSR rules: (1) Rule 100, Definitions of “PM2.5” and “PM10”; (2) Rule 200, 
Good engineering practice (GEP) stack height provisions; (3) Rule 200, Agricultural 
equipment exemption demonstration; (4) Rule 220, Sections 404.3(e) and (f) (Procedures 
for Certain Changes that do not Require a Non-Title V Permit); (5) Rule 200, Section 403.2 
(Permit Renewal and Expiration); (6) Rules 100 and 200 Appendix G references; (7) Rules 
100 and 200 Arizona Testing Manual references and (8) Rule 100 Definitions to be 
removed from the Arizona State Implementation Plan (SIP) justifications. In addition to 
remedying the EPA identified deficiencies, the MCAQD is proposing revisions to address 
Stakeholder and Staff comments and EPA’s recommended clarifications. Permit fees are

The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 204 
(Emission Reduction Credits for Use with the Arizona Emissions Bank) and is proposing to 
submit the revised rule as a revision to the Arizona SIP. Rule 204 implements procedures 
for the certification and utilization of emission reduction credits (ERCs) generated from 
permitted sources emitting particulate matter, sulfur dioxide, carbon monoxide, nitrogen 
oxides, or volatile organic compounds. Participation in the generation, certification, and 
utilization of ERCs is voluntary; however, when a source chooses to generate, certify, or 
utilize ERCs they must do so in compliance with the applicable provisions of Rule 204. In 
2017, the Arizona State Legislature amended A.R.S. § 49-410 to allow for the generation, 
certification, and utilization of ERCs from nontraditional (non-permitted) sources. ADEQ 
followed with a revision to the A.A.C. on June 14, 2019 (25 A.A.R. 1433). The MCAQD is 
proposing to revise Rule 204 to include provisions for the generation, certification, and 
utilization of emission reduction credits from nontraditional sources that use truck stop 
electrification, electric standby equipped transport refrigeration units, or electric onsite 
equipment to generate emission reduction credits. The MCAQD is also proposing revisions 
to align the rule with the revisions made to the Arizona Emissions Bank rules by the ADEQ.

management, design and construction of the new MASH facility.
2. Increase the expenditure authority for the Sheriff’s Office (D500) Sheriff’s Donations

3. Increase the revenue and expenditure authority for the Sheriff’s Office (D500) Sheriff

Approval of this item allows the MCSO to proceed with work associated with the project 
management of the new MASH Facility, initially funded through PetSmart Charities. 
The MASH building is expected to cost $8,000,000 - $10,000,000 over the next two years. 
A 501 C3 organization was established to raise funds for this project. MCSO will return to 
the Board to request revenue and expenditure appropriation adjustments as funds are 
raised by that organization and transferred to County Fund 430 so that design and

SUPERVISORS'/COUNTY MANAGER'S SUMMARY OF CURRENT EVENTS
Resumen de temas de actualidad de los Supervisores/Administrador del Condado
Joy Rich, County Manager, spoke about the Wellness 5K Walk/Run at Durango.
Supervisor Gallardo thanked the Veterans of Maricopa County for their service.  He 
commented that constituents can visit District 5 offices in the following locations: 
Avondale, Gila Bend and Buckeye.  He noted the recent coffee event was well attended.  
The topics discussed were Census, County Justice Courts and an Election Update.
Supervisor Hickman noted he spoke with the group leaders of the Sun City 
Homeowners Association, Sun City Prides, Sun City West Posse and the Sun City 
Recreation Department.  They all noted their appreciation of County services.  The 
Sheriff’s Department has been assisting with speeding throughout their community.  He 
thanked the Department of Transportation for their work on highway beatification.
Supervisor Sellers spoke of a recent Gilbert Chamber of Good Government Series he 
attended with Supervisor Chucri.  He attended the Lucas Off Road National Racing 
Event as part of the official welcoming group.  He spoke of his attendance at the River 
at Eastline Village Ribbon Cutting noting the public/private partnership in affordable 
housing.  He noted at the Intel Community Advisory Committee meeting and spoke of 
the presentation on the impact technology has on retail.
Supervisor Chucri spoke of his experience with Supervisor Sellers at the Gilbert 
Chamber of Good Government Series.  He noted the generosity shown throughout the 
county through the work of each Board member within the community and he 
experienced seeing it at the following events: while attending a fundraiser for Officer 
Gene Lee; through Chairman Gates comments at the Veterans Celebration and his 
recent experience while volunteering at Paz de Cristo.
Chairman Gates spoke of the loss of Officer Gene Lee noting the importance of 
Detention Officers.  He thanked all who attended the Veterans Celebration and noted 
his appreciation to Veterans for their service.  He said the next County Coffee would be 
held at 8:00 a.m. on Thursday, November 7, 2019 with Allister Adel as the guest 
speaker at the Deer Valley Airport.  He announced that Zach Schira, District 3 Deputy 
Chief of Staff, was leaving to work within the County Attorney’s Office and thanked him 
for his service to District 3.

MITIGATION PROJECT – PRE-CONSTRUCTION
Authorize the Flood Control District of Maricopa County (District) to issue a Request for 
Qualifications for a qualified construction manager/general contractor to provide 
Construction Manager at Risk (CMAR) services under Contract (2019C024) for the Rawhide 
Wash Flood Hazard Mitigation Pre-Construction (Project) and award a Pre-Construction 
services contract to the successful respondent not to exceed $500,000. Authorize the 
District to award the pre-construction services contract FCD 2019C024 to the selected 
respondent and pending negotiation of a mutually acceptable Guaranteed Maximum Price, 
authorize the District to award one or more construction services contracts to the selected 
respondent. The estimated total cost of the construction contract(s) is $14,500,000.
This is a qualification-based selection in accordance with Maricopa County Procurement 
Code, Article 5, Paragraph 504(F) and Article IV of the Maricopa County Procedures 
Manual.
The Flood Control District of Maricopa County has initiated design work for the Rawhide 
Wash Flood Hazard Mitigation Project under a consultant contract with JE Fuller. The 
project partners are the cities of Scottsdale and Phoenix along with the Flood Control District 
of Maricopa County. The Project includes improvements to existing floodwalls and levees 
which must be certified to meet the Federal Emergency Management Agency’s 
requirements for floodwalls and levees. The project includes construction of new floodwalls 
and levees to contain the 100-year flood within the Rawhide Wash corridor. The Project 
limits are from Pinnacle Peak Road to ½ mile north of Happy Valley Road. This is a complex 
project and, as such, the District will select the CMAR Contractor based on qualifications in 
order to obtain valuable constructability input during the design effort through delivery of pre-
construction services under the Construction Manager At Risk contracting method.
The future construction cost is currently estimated to be 14.5 million dollars.
