WHEREAS, on the 20th day of December, 1965, The Board adopted Road File No. 1730, recorded
on the 23rd day of December, 1965 in Docket 5857, Page 477 (F4397), for University Drive from Val Vista
Drive to Power Road in Sections 13, 14, 15, 16, 21, 22, 23, and 24 – T1N, R6E; and
WHEREAS, University Drive from Val Vista Drive to Higley Road in Sections 15, 16, 21 and 22 has
been annexed by the City of Mesa and is no longer in County jurisdiction; and
WHEREAS, the Department of Transportation desires to make certain improvements to University
Drive from Higley Road to Power Road in Sections 13, 14, 23 and 24 and has prepared plans for
construction in project TT-0612 which requires additional right of way at various locations along University
Drive; and
WHEREAS, pursuant to A.R.S. §28-6701(A), the County is authorized to establish, alter or
abandon a highway in the County; and
WHEREAS, pursuant to A.R.S. §28-6701(B), the County Engineer has filed with the Board of
Supervisors of Maricopa County, Arizona, a petition praying the Board to alter Road File No. 1730 to
remove annexed portions and to accommodate existing right of way and new right of way as required in
Project TT-0612.
Legal description and exhibits identified as Exhibit "A", is attached; and
WHEREAS the day and hour set by the Board for a public hearing has arrived, and notice of said
hearing has been given to the public by advertising once a week for two consecutive weeks in The Arizona
Business Gazette pursuant to §28-6702(A3),; and
WHEREAS, no objections to altering, establishment, opening and declaration of said highway have
been filed; and
WHEREAS, the Board believes that the granting of the petition to alter University Drive, by the
establishment, opening and declaration of the highway as prayed for in said petition is in the best interests
of Maricopa County.
NOW, THEREFORE, BE IT RESOLVED that there is hereby established, opened and declared a
County road, known as University Drive from Higley Road to Power Road, as more fully set forth
hereinabove and further identified as Road File No. 1730-R, and that the County Engineer is hereby
directed to make a plat of the survey of said highway and cause the same to be recorded in the Office of the
County Recorder of Maricopa County as provided by law.
BE IT FURTHER RESOLVED that the Board accept any right-of-way or property donated to the
State or County for said highway. The Board hereby accepts all U. S. Patent easement reservations, right-
of-way or properties along this alignment into the Department of Transportation’s Highway system.
BE IT FURTHER RESOLVED that the County Engineer be directed and authorized, and she is
hereby so directed and authorized, to negotiate with owners of parcels of private property required for the
right-of-way of said public highway with the view of obtaining for Maricopa County said private property,
subject to the ratification and approval of this Board.
